know, there would be a lot of talk that something was going to the happen and the former president four years ago would call an audible change. we have heard overnight from sources familiar that it was likely to be rubio. so at this point, if he were to pull back on that, if the campaign were to say no, we are not going to do that. that would be a major story. at this point i think it's pretty safe to say it's going to be rubio. i guess we will have to wait for the former president, soon-to-be president to make it official. >> steve: it ain't over until it's over. >> lawrence: pretty much a done deal. he was second in the running when it came down to the vice presidential choice. also just reported that tom cotton will ascend to the gang of 8 as the chairperson of the intelligence committee for the senate. so i think it's pretty much that marco rubio is going to be the secretary. >> steve: tom cotton is going to -- he has been on our program a number of times over the last year. i have got small kids. i don't want to president and stuff like that. apparently the number three guy in the senate leadership.

on television and talked about donald trump in glowing terms where you back in the day when marco rubio was running for president they were rivals. now they are all on the same page, so, to your point, lawrence and brian, when they go out -- whether he is the new antony blinken where he goes into another country and talks to different foreign leaders, is he going to be on exactly the same page as donald trump whereas antony blinken would probably go back to foggy bottom in washington and call the president and say okay. this is what you need to know because i just decided this. >> brian: as opposed to the who quhows. >> ainsley: after tom homan announced as border czar all these soundbites on every channel the last few days it. reminds us what we used to hear about the border and all the wives of the border agents when they were panicking about their husbands and their safety. you always mention, lawrence, about them being accused of whings the migrants. >> lawrence: whipping gate. >> ainsley: turned out to be

day. it's inexcusable and it's a complete disregard of the responsibilities for this president. >> brian: tom homan said he had to shut off his phone because so many people want to come back to the job. some people want a job. want to come back to ice. what about the men and women working pat control. these are some of the texts that bill melugin got. he said morale is super high. especially with the homan news, too. this from another agent ecstatic to go to work. morale even higher than the first time he won. people who were going to retire are not. everyone is happy. so that is just unbelievable. the thing you point out when you go there is that it's the middle of nowhere. and then i asked people where they live because to get a hotel in that area. usually run down hotel not the nicest. i'm looking in the area, not the greatest area. you have a choice. brings your family to an area which is not a lot of population, small towns. not a lot to do. or you leave your family met tropic tis. stay there during the week and come back on the weekends. if you go to work, you are not being supported.

and then you worry about your life. and then you spend all day changing diapers and telling people they got a cold and getting them row buy tuesday sin. that's the problem. >> lawrence: that's the real point you have made. they have been changing diners and doing processing. this is law enforcement. they want to go after bad guys. they want to go be able to chase after people. lock people up that are a threat to our country and they haven't been able to do it. and so the text messages that i have been receiving from guys that i know there are excited that they get to actually work again. >> steve: because the handcuffs are being taken off. and, information, fox news digital spoke to paul perez who is the national border patrol council president. and he said that the agents are so excited that they are going to be able to do the job they signed up for, that they have not be able to do over the last four years. a number of people who put in their retirement papers asked for the papers back. they want to stick around. and of course the department of homeland security has got a lot of openings. so they're going to take them

back. the other thing is he also said that given the fact going forward that donald trump has made it very clear that he has got the back of the men and women of the border patrol, this is going to help with recruiting. so it's going to be so much easier to get quality people to work our southern border because they are now allowed to do their job. >> ainsley: that's what -- and he told fox digital suspects to exciting. think about how positive that is for our law enforcement individuals. they don't make a lot of money. they put their lives on the line. now they are getting support from the president. >> brian: they need rapid processing. i hope they call henry cuellar. is he dying to work for somebody. all these people that ran ads i'm going to be tough on the border laura gillilan swayze. go work with them. don't be a block. don't be a block. go ahead and make -- full fill the ads that got you the position. because most of you kept your positions because you ran like republicans. >> ainsley: i thought the liberals who voted for trump down in texas were misogynists.

don't be confused. >> lawrence: i'll cope. >> steve: these are things you need to deal with dating phase. >> lawrence: i think they want us to move on. >> ainsley: today is judge merchan's deadline to decide on the 34 felony charges or whether sentencing will go on at the end of the month. >> juan merchan will decide whether to dismiss or uphold president-elect's conviction in the new york vs. trump case. if the judge upmodel the verdict the case would be on track for sentencing later this month. the juror convicted him in may falsifying business records related to $130,000 payment to stormy daniels in 2016. the option to dismiss follows the supreme court's ruling that presidents have broad immunity from criminal prosecution. legal experts though say a sentencing is unlikely. listen. >> supreme court's immunity decision really lays out this case as a textbook example of a case where have you inadmissible

first things he said was we are going to close the borders. we're going to bring justice for rachel. and for the other families. and i think that the laws that are going to be passed should be nonpartisan because it effects every american. but i do believe that our families have lost the ultimate loss, life, that we should have bipartisan support and i was really amazed when i went and spoke at a judiciary committee and to see the divide on the left. they were ridiculing and down playing our grief. and accusing us of being bribed, to come and speak before the committee. that just opened up my eyes at how divided our country is.

see, what people don't understand is that sanctuary cities are actually a middle eastern religious cultural thing. there are only four countries in the world that have sanctuary cities, united states, canada, the united kingdom and italy. and can you think of middle eastern country that would want to destabilize and weaken these countries? and if you look, sanctuary cities, america has 190 sanctuary cities in 11 states. and in those states, because of this invasion of illegal immigrants, crime has not even doubled, it's like 800 percent increased. and it overflows to over states and other cities. so, it's not just their people and their state, it is affecting every state. and i think something has to be done about it. >> lawrence: let's talk about the background of this suspect.
