meaning the majority could grow not with standing matt gaetz's resignation yesterday. speaker johnson, also winning unanimous support for another term as the top house republican. now, the trifecta was clinched after the race was called in arizona for republican juan ciscomani, defeating democrat kirsten ingle, it came on the heels of kim call better defeating will rollings in california's 41st district. meanwhile in the senate, mitch mcconnell's long time deputy, john thune will be the next majority leader, ready to help deliver on president-elect trump's vision. >> we are excited to reclaim the majority and get to work with the colleagues in the house to enact president trump's agenda. we have a mandate from the american people. a mandate not only to clean up the mess left by the hind, biden harris agenda but also to deliver on president trump's

period to fill that seat. he has already talked to ron desantis. ron desantis is in italy. they will talk this morning. he said the clock has started but they might be able to fill that seat by january 3rd. >> brian: yeah. it's pretty amazing what has taken place. the senate is going to be up to 53 as soon as mccormick gets done with casey. and then you have on the house side after all the chaos almost a year ago with the flipping where matt gaetz led an insurgency to flip kevin mccarthy. they couldn't pick anyone. chaos caucus. they flipped more seats than the democrats. still going to be a slight advantage but what an epic fail by democrats. hakeem jeffries says hey, this is on me. i was unable to do it. they had more money. they had more time. and they had this young leader that they said was going to be their future unable to flip it. so, i'm very curious to see how quick elise stefanik gets filled how quick they fill up for congressman -- for matt gaetz as well as -- swells congressman --

florida congressman now going to be a national security adviser mike waltz. to mike waltz. he called right away and told the speaker look i'm probably going to be tapped for something and get them lined up. interesting time for governor desantis to go to italy. because there is a lot for him to do. >> lawrence: actually released a statement maybe about an hour ago on x. and he said that he has already notified the secretary of state to start the process. so, he may be out of the country but the effective leader that he is. >> ainsley: enjoy your vacation. >> lawrence: is he already on it. take a moment to pause to see what the country has done right now. they are telling the republicans, we are going to give you a shot for 20 years. if the american people wanted divided government they would have given divided government. this is a mandate for the president's agenda. apparently it was more relatable to the people in their pain and republicans have to get to work now. >> steve: you are absolutely right, lawrence. for the longest time, while publicly the people in the house said, you know, republicans are going to win, the democrats were

outraising them, fund raising them. they had a lot more dough. so it was right up until the very end that we knew what was going on. ultimately, there are still nine seats to be determined. but i read a couple of things about the analysis of this trifecta. and that is there are so few competitive seats, keep in mind there are 435 seats in the house of representatives. only about 45 are truly competitive but only about a dozen are true battleground districts on both sides. and so those days when you would see a 30-seat majority for one of the parties for right now, that is nowhere to be found. that is why it is so important for mike johnson to be able to manage that very little sliver of a majority. >> brian: no longer a single seat motion to vacate now nine seats. so no longer can some -- some selfish person going to stand up

and go i don't like the speaker anymore. >> ainsley: also, speaker johnson he unanimously was approved and trump backed him as well. the last time we had this trifecta was right after trump won in 2016. it was 2017, '18, and '19. that's when the tax cuts happened. the jobs act was signed. the criminal justice reform bill was signed. first step acted and justices gorsuch and kavanaugh were confirmed. >> brian: of course. and then we will keep you up to date on how this goes in one of those other races are decided. now, as we mentioned, matt gaetz is the third house member to be nominated for a role in donald trump's upcoming administration. along with elise stefanik and michael waltz house speaker mike johnson jokingly telling donald trump to knock it off. >> i have begged and pleaded with the new president enough, already. because our numbers are small. we are going to have the majority, we are celebrating that. >> brian: and also the president said leave speaker johnson in place. >> ainsley: right. mark meredith is in west palm beach with the latest.

hey, mark. >> mark: ainsley and friends, good morning to you guys. president-elect trump has shocked both washington and the world once again by announcing he wants matt gaetz, the florida congressman to resign from the house just yesterday to be his next attorney general. gaetz rose to power back in 2016 representing florida's western panhandle. he has been a staunch supporter of trump but he has had some controversy of his own. the house -- excuse me, the house ethics committee was investigating allegations gaetz was part of a scheme tied to a sex trafficking of a minor. now, gaetz has long denied these allegations. and last year the justice department ended its probably of the matter. trump says he wants gaetz because matt will end weaponized government, protect our borders, dismantle criminal organizations, and restore america's badly shattered faith and confidence in the justice department. gaetz as you guys talked about resigned from congress and the decision will end the ethics investigation. and now, as far as we know, no report is going to be issued. but lawmakers are likely to dig deeper during any upcoming

confirmation hearing. >> just kind of like a god tear kind of trolling. just a trigger of meltdown. >> i think what we can tell you right now is that we always allow the president to have the benefit of the doubt but we still have to do our role in terms of due diligence. >> somewhat interesting pick. we will have to see how that all unfolds. >> there is another nominee also from florida likely to have a much easier time getting confirmed and that's florida senator marco rubio who trump wants to be secretary of state. trump writing: he will be a strong advocate for our nation a true friend to our allies and fearless warrior never back counsel to our adversaries. tulsi gabbard the democratic hawaii congressman turned republican trump supporter will be the nominee for director of national intelligence. trump says tulsi will bring the fearless spirit that has defined her illustrious career championing constitutional rights and securing peace through strength. >> talk a little bit about the work that needs to be done.

he didn't believe gaetz would get confirmed. you just mentioned, steve, well, gaetz may not have a lot of friends in the house. he has a friend who is going to be here in mar-a-lago and soon-to-be in the white house. that may be what matters the most. and, do you know what? power can change a lot of things. so perhaps gaetz all of a sudden has a lot of new friends within the coming days. he says he is very excited with this opportunity. >> steve: indeed. thank you, sir. >> brian: thanks, mark. a lot of people in the "wall street journal" bad named choice. never going to get confirmed. got to get through the judiciary committee. can't lose any republican votes. lisa murkowski is somebody who says is he not a serious candidate. joni ernst says he has his work cut out for him. way of saying you got to sell me on your background. >> lawrence: i had a lot of, i would say, spirited conversations last night. talking about this pick. the view from the trump camp is that they want a disruption in the department. >> brian: they got it. >> steve: check. >> lawrence: they wanted someone that was also targeted, they

say, by the department of justice. now, we all talk about what this house ethics committee was going to present. but, also, there was a department of justice investigation that was dropped against him. and so, they are saying that the president wants to go all in and that he deserves a shot to go through the process. the problem is that there are some people in the senate that have already made it very clear that they are not going to vote for him. lindsey graham is of the opinion let him go through the process. flush through his resume and make a decision then. >> ainsley: yeah, that's fair. >> steve: what we have heard though over the last couple of weeks, the president, the new incoming president, donald trump, the former president, has said he would like to see a lot of his picks go through the recess nomination or the recess process. essentially where you could bypass the nomination by essentially appointing somebody when the house and the senate are in recess. john thune said yesterday to outlet from south dakota, his home state, that he would prefer

to go through the old fashioned way with the confirmation hearing. but, he is open to recess appointments. the question is, with the recess appointment, you need the assistance of the democrats. and the democrats are going to be squarely against mr. gaetz. >> brian: is he not going to get paid. >> ainsley: ethics investigation was highly damaging but maybe we won't know unless there is leaking. >> steve: yeah. >> ainsley: what is matt gaetz's resume he? served on the house judiciary committee. he led the charge, remember, was it last year, to oust kevin mccarthy. >> steve: last year. >> ainsley: last year as house speaker. served as adviser to donald trump during the latest campaign and helped him prep for the kamala harris debate. he was under the house ethics committee investigation that we have been talking about. as a.g., obviously you have to be an attorney. he went to law school at william and mary. >> steve: one other thing, ainsley, matt gaetz flew to washington yesterday with donald trump on trump force 1 and also very close to susie wiles. she had him help donald trump do

the debate prep, which was on your list. >> brian: the "wall street journal" writes yeah he got a degree from william and mary. performer and provocateur. the view more explosions can he cause and more attention he can get, it's impossible to get canceled if you are on every channel. if you aren't making news, you aren't governing. that's his philosophy. and that's what, you know, he has got to be quick on his feet and have an answer to a lot of the probing, because if he can't get out of committee, he can't get to -- >> lawrence: i will say this. there is two things here. if you are going to say that he is not the person, right? , if you are going to attack him, then it has to be on his credentials. because if we attack the fire brand, that is what the trump base -- that's what the former president wants. the second thing is to steve's point. if they leak the documents of what was happening, in that investigation especially after the department of justice dismissed the charges against

him that's not going to be very good as it relates to the case if you don't want minimum. because it only is going to make people that are within his camp say, see, the system is attacking him yet again even though the department of justice said there is not a case here. >> brian: beginning of the murkowski, collins. murkowski, collins are going to be moderate on everything, and they are very comfortable pushing back on trump. >> ainsley: it's official, marco rubio secretary of state, tulsi gabbard director of national intelligence. this is interesting: the rise of the millennials, this was from courtney holland, she put this out on x okay. did you want to. >> steve: i was just going to say there is tulsi's resume which is impressive. >> ainsley: vivek 39 years old. elise stefanik 40 years old. j.d. vance 40. remember when donald trump took office in 2016, '17, everyone was older. everyone was much older. so, this is interesting.

>> steve: a new generation. >> lawrence: i will say we have to appreciate the balance of the administration right now. you got fire brands and you have more traditional republicans that are still america first, so, for example, you got michael waltz who is going to be national security adviser. you got marco rubio who is the secretary of state. and then you have pete hegseth as the defense. one is going to be a fire brand that is going to interrupt the military in a way that some people are not prepared for yet. but, again, this is something that the former president campaigned on. is he going to get rid of the wokeness there. and so there is a balance approach. >> ainsley: do you think he learned his lesson from the first administration like i need people that i know are staunch conservatives? >> lawrence: there is a time for a compromise and then there is. >> ainsley: rewarding loyalty. >> lawrence: time to shake things up. >> brian: if you are a conservative, people that are thinkers, but are not going to stab him in the back. the other thing is do you notice

first cuban, first woman, first hawaiian, all we have is person. that's what i want to get back. to say just like, you know, i guess susie wiles broke the mold. i guess a cuban american whose dad born in communism escaped to freedom. that's a story. do you know what is more important who marco rubio is like and philosophy is. i love the fact we are seeing the best people and we don't have to look at their heritage and d.n.a. and find out if they used to be a woman or if they are, you know what their sexuality is that's what joe biden -- i will never forget joe biden told joe manchin. what are you doing, joe, hiring all these left wingers? is the most diverse cabinet ever. the answer to joe manchin is, so? are they going to do anything? >> steve: going in joe biden wanted it to be the most diverse cabinet ever. he got that. that's why donald trump wants to shake everything up in washington and he is going to get it. because he has got people who are like-minded and who are going to be able to hit the

trump told the "new york post" this about the meeting. i asked for his views and he gave them to me. also, we talked very much about the middle east. likewise, i wanted to know his views on where we are and what he thinks. and he gave them to me. he was very gracious. and i think joe biden said the questions -- he asked a lot of good questions and he wanted answers. i think that's good. it could be a fresh start of cooperation and hopefully no more personal attacks. i think the country could use it. i will add one more thing. i'm very interested to see if he gave any talk about harry, i'm hey, i'mabout to meet with pres. what do you want me to say? >> arguably the most important relationship. and i'm sure joe biden didn't make it a secret. keep funding ukraine got as much money out the door as possible. >> lawrence: looking at the president, you know, even though he wasn't on the ballot, it was his candidate that was on the ballot. he looked happy. >> steve: he smiled a lot.

prediction betting platform allegedly accepting trade for u.s. based users which would be a violation of an agreement with the commodity futures trading commission reached in 2022 the fbi's apparent raid comes just a week after polymarket correctly predicted donald trump's presidential victory. the platform showed trump holding a 58% chance of winning over vice president kamala harris who was at 42%. that prediction happening at 7:00 p.m. eastern on election day cope plan suggested the raid was politically motivated saying it's current administration last i ditch effort to go after companies they deem to be associated with political opponents. the incumbents should do self-reflecting and recognize that taking a more pro-business pro-start up approach may be what may have changed their fate this election. >> the fbi declined to comment when reached by fox. brian, over to you. >> brian: i will try them again

in the break. thank you very much, todd, a fox news alert. this morning the g.o.p. officially keeping control of the house after the race is called for arizona republican john could you say man any. this coming as president-elect trump shaped things up in a big way. nominating matt gaetz for attorney general. the third house pick for a role in his administration what is that going to do for that slim majority. guy benson joins us now. donald trump comes off the map to pull off a win and brings the house and senate with him. that's a story. >> it's a huge story, of course. for the next two years republicans are going to have this golden opportunity govern with the trifecta. that always sounds great this another we going to do x, y and j. the governing party gets one or two big bites at the apple that's it. all back to campaign mode for midterms. >> i hated to talk about the next election.

that's passionate of the ticking clock that starts in january you will see a lot of ducks lined up ahead of that moment. we will see what the republicans prioritize right out of the gate. those opening days, that first foray is usually a really, really important one. >> brian: guy, can you look already with some early differences with the republican president. and a powerful one. donald trump says hey, stop -- don't even try to take a run at speaker johnson. i like the guy. nobody takes a run at him. also, the motion to vacate. it goes from 1 1 to #. semblance of majority. >> when the republicans are were in opposition. certain people felt they had outsized influence because they did. and they felt like okay, well, we can stop certain things so we can kind of play around with this a little bit. with donald trump now running the executive branch, he doesn't have time or energy for those types of side dramas to play

out. he want to get some things done. so he wants the troops in order and these, you know, leadership fights that do nothing except divide the party, i think will be highly discouraged by president trump. let's put it that way. >> brian: so, believe it or not, dave mccormick is still in a fight and recount now with bob casey. people point out that marc elias, a very intelligent, but diabolical attorney in my view is working for casey to, i don't know, drum up some votes. and ari fleischer says this. republicans everywhere should pay attention to what casey is trying to pull off. while he has no chance, this is a warning about the d plan, democratic gain plan for thousand count votes in close races. they want people who aren't registered, don't have ids or live out of state to be counted. are you keeping your eye on this? >> yes, very carefully. now, marc elias has a mixed record. sometimes diabolical is definitely the word to apply to him and he has had some success

♪ >> steve: well, in just a couple hours, a marine veteran daniel penny's manslaughter trial is expected to resume right here in new york city. the jury last heard from a subway rider who helped penny hold down jordan neely on the floor. he recalled his frustration with another passenger saying, quote at one point he was telling daniel penny not to hold too tight to dismiss and and to shut him up. i told him he was not holding on tight enough. >> this is one of the star witnesses. and he is saying i told him hang on tighter. >> look, in the typical criminal case, all of the witnesses that are called by the prosecution

tell the same story, that are on the same page and their story is completely consistent with the narrative that the prosecution wants to present to the jury. that has not happened here. numerous witnesses called by the prosecution have given testimony that will only help the defense. you got to remember, okay, this at its core, it's a self-defense, a justification case, right? but, the defense does not have to prove mr. penny's actions were justified. the burden remains at all times on the prosecution. they have to prove beyond a reasonable doubt that his actions were not justified. this kind of testimony makes that extremely difficult. steve the prosecution has had witnesses who stories, shall we say, have evolved over time. they told the cops one thing in front of the court they are saying something else. the other thing is some of the prosecution witnesses are actually helping daniel penny because they say, yeah, when this guy came on the car, i was scared. he was threatening. he was freaking me out. >> right. the big test were mr. penny's actions reasonable? did they seem reasonable?

when you have other witnesses, other people who are present, who have no connection to mr. penny or mr. neeley, so they don't have inherent bias, when they say that they, too felt threatened, they too felt he posed a danger. they too felted need to intervene. all of that lends itself to the idea that mr. penny's actions were, in fact, reasonable, other people came to the same conclusion he did. >> steve: since we have got a lawyer in the hot seat right now. got another question four. yesterday jack smith, the special lawyer looking into those trump cases, sent a note to an appeals court to say hey, you know what? given what the supreme court has said, and given the fact that he is going to be president, we have got to pull the plug. >> beginning of the end for jack smith. it's interesting. jack smith comes manhattan d.a.'s office texasing yesterday with another former colleague we used to work very closely with him. he said jack smith is an incredibly competitive guy, and this has got to hurt. >> steve: had donald trump not won, jack smith would be going
