all the republicans that will take over as the chairman of the committees in the united states senate. the leadership team met earlier today focused on things that president trump can do immediately, in terms of restoring control at the borderline get back to enforcing the law and bringing back things like remain in mexico. those things worked. what he can do immediately to take the handcuffs off of american energy so we can produce emergency energy in place here. and getting his time confirmed quickly. no surprise he's making bold decisions and bold appointments and doing it more rapidly and thoughtfully than what happened in 2016 because he's been thinking about this all along. >> and he has the first term to learn from his experiences, something that he's spoken about. he wishes that he had made some different key decisions. were you surprised -- i don't know if i'd say i'm surprised, but i noted this week when he's

laying out the top tier cabinet posts, he's going with the national security bench looking at his national security adviser, secretary of state, secretary of defense nominations as opposed to more of an economic focus, treasury and commerce. it was interesting to see that's what he prioritized. >> we'll hate to lose marco rubio in the united states senate but he's the right person for secretary of state. he will project the same strength that president trump has been projecting and it's such opposite of what we've seen under the biden administration, which was a position of weakness, which invited those to come in and be aggressive toward us. so that was a great choice. we'll make sure as we were talking today at our leadership meeting, we take over january 3. the president doesn't come in until january 20th. we want to hold hearings on the nominees early so by january 20th, we can get ready that day

to vote and get as many cabinet positions filed day one. so the president has his team around him as quickly as possible. the president really does feel the clock ticking already. he says i only have four years. we have a lot to get done if we want to get america back on track. that's what the american people demanded with this electionout come? a big part of the conversation has been the nomination of matt gaetz to be attorney general. will he get confirmed? >> he will have a fair hearing and people will have a chance to vote. what i want to do and specifically with this and you'd expect the president to make bold decisions and appointments. look what happened to the president over the last four years. we have seen the justice department in this administration weaponized, politicized. they have dragged president trump through the court repeatedly. nobody should be above the law. nobody should be the target of the law. president trump has been the target of the law. when he talks about draining the swamp, it's'just all of washington but specifically the department of justice.

nonprofits vow a new resistance. will donors pay? charles payne joins us. it's early yet. see how the resistance will shape up when the new administration comes in. the early signs are that the democratic party's donors, whether they're big or small, have some weariness and sort of exhaustion after the billion dollars that they poured in to kamala harris's losing race. >> there's no doubt. this is a time of intraspection if you're on the losing side. if you think about almost all the great warriors out there, the great generals, great strategists in military, the first thing they tell you is retreating is a good option. this may be the time to look in the mirror and see what you want to believe in.

yesterday real clear politics have a poll on economic sentiment, it erupted up 13% the first time its been positive since 2021. think about that. there's so much enthusiasm out there, so much animal spirits. you want to throw more money trying to dissuade that at this moment? >> john: here's what dave and ken wrote in "the new york times." nonprofits are finding that some supporters are not energized by another round of resistance. instead, they have been left exhausted wondering whether their donations made any difference. some are afraid they could be targeted by retaliation by trump and his allies by donating to groups that oppose his administration. clearly the trump administration is not going to take the resistance lightly when it comes to some sort of push back. let's put it that way. also, do you think democrats just realize, this didn't work in the 2024 election. so why should we try it again?

>> well, definitely have to -- they have to go back to the drawing board before you throw more money at it. this is the new york knicks strategy. let's throw money at it and lose every year. if you believe in what you believe in, fine. you have to find out why the american people rejected it and overcome their own echo chamber. when you start to say like worried about retaliation, those are the same sort of comments that turned people off in the first place. president trump is hitting the ground running, pulling together a cabinet and ideas. they're not looking backwards to fight people. any time those suggestions are bright up, you automatically turn folks off. if you want them to listen to your message, you made it that much harder. >> gillian: how much donor weariness would you a tribute to the reality that just in the last week or so millions of small dollar democratic donors found out that their money was

partly because they accent cryptocurrency for wagers and stirred up some concerns about conflating opinion polls with betting markets. but they say it's a great barometer for the election because the odds are based on people's hard-earneded dollars and after all it correctly predicted the outcome of last week's presidential election. back to you. >> gillian: thanks, lydia. john? >> john: all right. court breaking for lunn inch the daniel penny man slaughter trials. jurors heard new testimony on choke holds by the marine sergeant that trained penny. it comes on the heels of chocking testimony from a key witness that took the stand and admitted that he lied. let's bring in judge jeanine pirro, co host of "the five." so the witness today is the one that trained daniel penny in choke holds. what did his testimony bring? >> well, it was very interesting because you had this marine veteran who had taught danny

penny all of the choke holds. what was interesting is that everyone on the jury and in the courtroom learned there's a myriad of different chokes. you've got the air choke, you have the blood choke, the front, the rear, the side and the figure four variation. the more they talked about it, the more you started to say, gee this is what is normally done when you have an aggressor situation. so danny penny's own instructors said we taught him all of these chokes, and it looks like he was doing the figure four variation. i'm not going to get too specific here. you may recall in some of the videos that we've seen, you got danny penny with his left arm on his right bicep. that's a signal that he used on the platform and at the police department telling law enforcement that i was using the figure four variation. they come in, the prosecution

assistant ada. i told them that as things were transpiring, i was there on site when everything went down. i told the ada that neeley had struck me first and then everything went down. why did he lie, judge? >> well, because he felt that he might be charged with some level of homicide. so he had to change his testimony. basically say look, you know, neeley hit me, so i had to help penny hold him down. then we find out he didn't walk out to the train until a few minutes after it stopped or a few seconds. i think the most important part, gonzalez doesn't matter anymore. other than they chose to indict danny penny and not this guy gonzalez who lead and reached an agreement with the prosecution. the most significant thing today was a choke holds are a normal part of restraining an aggressor and you do it until they're unconscious. we know that jordan neely was

material support to a terrorist organization, specifically isis. we're getting information fast here right now specifically from douglas williams, the fbi special agent. he called this a great day because a terror suspect has been taken off the streets of houston. this is a 28-year-old who had been on the fbi's radar since 2017. they interviewed him multiple times. williams said after october 7, he was inspired by that attack and his behavior trended towards violence. he jumped to what williams said was the top of the list of security threats. the decision was made last friday to go ahead and arrest him. here's handani. >> the agents directed mr. sayed several times to put his hand up. he ignored their commands. he threw an object from his hand to the ground. continuing to ignore commands, the defendant once again reached

federal agents despite the law, despite the incoming agenda of the trump administration. what do you say about that? >> well, what we're seeing is here in the state of illinois, you're seeing mayor johnson and governor priska that they're going to dig their heels in. both of them are having trouble looking at the voter turnout, looking at the numbers of people that voted republican. not all of those people voted republican because they were supporters of president trump. a lot of them voted republican simply because they did not like these policies that the democratic party is pushing. i think instead of digging their heels in especially in the midst of the budget crisis that we're in here in both the city of chicago and in the state of illinois, i think the mayor and governor prisker have to look.

we cannot afford to look and not be in president trump's good graces with the financial situation that we're in in this city. so to dig his heels in, if anybody is hurting black families and residents of the city of chicago, it's mayor brandon johnson. >> gillian: i want to check in with you. i know you have a lawsuit that you brought against the city accusing them of mishandling the migrant crisis to the detriment of the people that list there. what is the status of that today and what you hope to achieve? >> what basically happened, we got a stay from the court. what the judge told the city of chicago as well as the residents in the community is that as long as the mayor and his administration did not bring the migrants in to our park, then they would not move to make a judgment. so with him finding somewhere else to send the migrants, we were able to avert having to go

in to a long court battle. >> gillian: so now president-elect trump says that illegal immigration in american cities across the nation is something that he's going to be focuses on from day one in the oval office. what would you like to see as a first move coming out of the trump administration? >> one of the things i want to see as a first move is for him to send mr. holman to the city of chicago, to the state of illinois and remember that, you know, we like to call them migrants but at the end of the day, they're illegal immigrants. they are here illegally. if you want to be in this country, if you want to be in this city, you have to go through the proper channels to be here the way you're supposed to be here. if you're not here the way that you're supposed to be here legally, then i think that mr. holman has every right to come in to chicago, the state of illinois and these sanctuary cities where these people are

being housed. let me tell you something else that people fail to understand. when you are a sanctuary city, all it means is that there's some protection from ice. it does not mean that we have to financially support and house these people when they come here and put our city in the budget deficit we're in. the citizens of chicago are not happy about that, especially when you're asking taxpayers to pay more money for less services when our communities are still blighted and disininvested in. you have a mayor that says hey, listen, i'm here and i'm fighting for the people. right now everything that we have seems to be going to the migrants. you have our mayor who pushed for the chicago teachers union to wrap funding for migrant students. they want to give migrant students 2,000 per month stipend. not all students that may be suffering or standing in need, but just migrant students.
