right now you are staying the tap for humanity shelter and we were looking at pictures of what your home look like and it is completely collapsed. in this period of two months, what has your interaction been with fema and do you feel like you are getting the help you need? >> well, i know they are overwhelmed with applications and stuff. i can't really speak for them. i do know i was on hold for a very long time. and at that time, there were 3 million people. i don't know about now or what is going on periods fee when you are fema money is hinting and are you talking about the $750? >> no, we got back and we are waiting to see if we will get anything else. the application shows pending for other things. so we don't know what is going on other than that.

>> carley: that is the scary part, you just don't know. because you had this house and hoping to live in it the rest of your life. you have $4,000 to pay off on your mortgage until it was completely yours. the house, we are looking at what it looks like. so when you think about the future, donna, what does it look like to you? >> scary. i don't know what is going to happen. from homeowners insurance, they refused to cover it. and we don't know. now, there is the grandkids school and transylvania habitat humanity put together a fund-raising pain. they helped tried to, you know, cover some of that cost of the building or buying of a home. but it's not today's process

laken riley to fill the gallery of the courtroom as prosecutors presenting evidence how the nursing student was viciously attacked while out on the run the morning february 22nd, 2023. the defendant jose ibarra pleaded not guilty to felony murder, kidnapping, aggravated assault with attempt to rape among other charges in hindering riley's attempt to call 911 and concealing jacket and blood smeared with blood at the apartment where he lived with his brothers and former roommate all of whom were in the country illegally at the time. the judge has ruled those men must be present at the trail as possible witnesses. also, the judge denied to change and suppress evidence like dna and cell phone data. that judge has denied motion to sever the peeping tom charge against jose ibarra that occurred on the same day with another woman.

if the judge finds him guilty, jose ibarra face is life without parole. >> carley: team i thank you so much. former dhs secretary for and prosecutor jonathan fahey. jonathan, good morning to you, as we go into this trail as chanley painter pointed out that there will not be a jury because the defendant has opted for a trial by judge who will decide his fate. is there a strategy behind that? why would he want that to ha happen? >> that is somewhat unusual strategy, particularly criminal cases, most defendants won a jury because a jury at least a chance have may be a jury being uninformed or when you're not going along with the others and causing a mistrial. i think the strategy here is this has got so much publicity, the defense think the judge can take a sober look at the evidence and not inflamed by publicity or all the things surrounding it. i think it is quite a curious

decision because the evidence is so overwhelming or at least my understanding, his dna and are her his fingernails and almost impossible to overcome. but the strategy, i think that is the strategy but a curious one and you don't see it often. >> t >> carley: a horrifying process for laken riley's parents to sit there and listen to the evidence prosecutors will present they believe this man killed their daughter. and part of the indictment he had a jacket and gloves with blood in his apartment. how long do you think the trial will take questioning. >> you know of who i don't know how long typically things taking georgia but i think this trial in terms of things i have tried, may be a few days to a week at the most. that is the other thing bench trial versus jury trial it streamlines things quite a bit in terms of arguments in the way things are presented.

i think this will be done and over quickly. he will be convicted and sentenced to life imprisonment the maximum with the charges he is facing. speech we wanted to ask you, jonathan, the piece out a "wall street journal" likens to rush to the u.s. before trump takes power appear until "the wall street journal" goes on to say all no evidence migration search is materializing right now, smugglers using whatsapp and social media groups to tell migrants it is now or never. so what do you take from that? what do you think the next two months will look like before donald trump takes office? >> yeah, i take from that the smugglers know that illegal immigrants know that the fight and administration had open border they want to get here before basically shut down. it flies in the face of everything that the biden-harris administration tougher on the border. but the important point here, the reason we have had and one
