and that's problematic and it's an unfortunate sign perhaps of what is to come. >> bill: trump made a handful of other nominations yesterday. some include doug collins who trump is tapping to lead the department of veterans affairs e is also announcing he wanted to blanch as his deputy attorney general. blanch, of course, defended donald trump during hush money trial. meanwhile incoming senate majority leader john thune says they are going to look at every option to get these picks through as fast as possible for president trump. take a listen. i think we have to have all the options on the table. these nominees deserve their day in court. we are not going to allow the democrats to thwart the will of the american people and giving president trump the people that he wants in those positions to implement his agenda. >> bill: during his interview with our colleague bret baier, senator thune confirmed that one of the options on the table that they could potentially look at

trial for the illegal immigrant accused of killing nursing student laken riley begins in georgia. >> lawrence: his fate is set to be decided by a judge. >> ainsley: chanley painter joins with us a preview. >> good morning. the fate of 26-year-old undocumented venezuelan man jose ibarra now solely in the hands of a judge after waiving his right to a jury trial earlier this week. today the family of 22-year-old laken riley is expected to fill the gallery of the courtroom as prosecutors again presenting evidence of how the nursing student was viciously attacked while out on a run the morning of february 22nd, 2023. the deci defendant, jose ibarra pleaded not guilty to 10 counts, malice murder, aggravated murder, kidnapping with intent to rape among other charges in an indictment that accuses him of hindering riley's attempts to call 911 and concealing a jacket and gloves smeared with blood nearby the apartment where he lived with brothers and a

roommate, all of whom were in the country illegally at the time. and, get this: the judge has ruled those men be present at this trial as possible witnesses. also, the judge has denied the defendant's motion to change venue and suppress evidence, including d.n.a. and cell phone data. the judge has also denied the defendant's motion to sever the peeping tom charge against ibarra that prosecutors say occurred on the same day with another woman. ibarra illegally crossed into our country in 2022 released into the u.s. via parole. since then cited for shoplifting in georgia and charged with child endangerment in new york if the judge finds him guilty. and this trial ibarra faces life without parole. guys? >> brian: if there is anybody that deserves -- thank you so much, chanley. if anybody deserves the death penalty, it's him. unfortunately he will maximum just life in prison. he came here to commit crimes. his brothers also seemly a

china. >> absolutely. they have a lot of experience here. they are going to be a major assistance to the president in dealing with this issue what is on the table as china comes back china outpacing military in terms ever capability. >> they have been investing for 20 years. and they are the pacing challenge of this current administration but the challenge is they are outpacing us. fix the military erosion taken place. the last four budgets in terms of defense have been flat. that makes no sense given the threats that we're facing. so we have got to rebuild the military. economically i nanny china now has a $1 trillion surplus dealing with the united states. that means exports over imports. that's considerably larger than what it was during the trump administration.
