welcome back to "america reports." i'm john roberts in washington. sandra, maybe he just sits back and lets them go about their business. >> sandra: we will see. tom homan, incoming border czar, speaks to fox news earlier. slamming blue leaders who oppose them removal of migrants. >> these mayors and governors saying they will put roadblocks and what i'm trying to do when i come in as border czar. go talk to laken riley's parents. sit in this trial. tell me you want to put a roadblock up from president trump tried to remove these criminal threats from the country being. it's. >> sandra: homan was speaking about the murder of laken riley, georgia nursing student allegedly killed by an illegal venezuelan migrant whose trial started earlier today. many critics placing the blame for riley's death on a border crisis courtesy of the biden-harris and administration. >> john: former president bill clinton acknowledge things might have

been different for the riley family had the people coming across the border been properly vetted. we are covering this from all the angles. criminal defense attorney heather hansen will join us in moments to breakdown jose ibarra's murder trial. texas sheriff thaddeus cleveland has an update from the border and terrell county as trump plans take shape. >> sandra: brooke taylor live from eagle pass, texas, growing concerns about a potential border rush before trump takes office. broke? >> sandra, troopers out here are preparing for the possibility of exactly that. they are ramping up efforts here not only in eagle pass but all across the counties here because they are preparing for migrants to cross the border. they want to send a message loud and clear not to come here because of the heavy presence, hundred to these migrants heading north hoping to cross into the u.s. before their chance slips away. texas officials bracing for that potential surge before president trump takes office in

january. stricter immigration laws expected to follow. part of his major campaign promises on mass deportation. last week in eagle pass, troopers encountered a group of more than 100 illegal immigrants, including 13 unaccompanied kids. now to prevent this possible massive surge, dps in the national guard conducting what they call these migration response exercises. we got to see it ourselves. it is happening in areas that are known for these heavy border crossings. the former el paso border patrol chief tells us he believes that this change in administration has boosted morale among agents. >> the current administration come in there, it wasn't the same type of rhetoric. there was no consequences, and we see record numbers. we've seen it numbers that i never imagined in my worst nightmares as chief patrol agent ever seen. >> now remember a lot of what we are talking about our families and large groups. they want to get caught and they

want to seek asylum, but there is also those who don't want to get caught, the got-aways. the mexican cartels sent families across the border to take attention and resources off of criminals, just a few miles away, getting past the border. this is a tactic that we've been reporting on for a while, but it really highlights a lot of the staffing challenges out here. sandra. >> sandra: broke taylor out of eagle pass, texas. thank you. john? >> john: thaddeus cleveland. some of the changes trump plans to implement after he takes office, one to overhaul asylum laws, reinstate to remain in mexico policy, allow longer detention of migrant families and enable faster processing of unaccompanied minors. that's just the beginning. how would all of that help you? >> hi, john. it's good to be back with you. have a smile on my face, first and foremost, because we know reinforcements are on the

way. it's going to be great down here along the border. we are seeing an increase in our specific area here in terrell county, and like it was mentioned earlier, with those asylum-seekers crossing in eagle pass and el paso, we don't experience that here, we experience the people who want to get away, and due to our resources we have, we catch about half of what crosses here and our numbers back that up. but i'll tell you, those policies that will be put in place will make the border safer, more secure, and it will protect more americans, as well. >> john: he has also pledging, president trump, to take i.c.e. agents off their desk duty and put them back out in the field. here is what "the new york post" wrote about that. thousands of i.c.e. officers reassigned from desk jobs as trump vows to flood sanctuary cities with agents. the move would mean thousands of desk-bound i.c.e. officers would be out making arrests of millions of illegal immigrants who snuck across the besieged southern border and are now

roaming american streets. one source says they "can't wait" to get back on the streets while another said he hasn't had any experience yet making arrests for i.c.e., his years of previous experience with the border patrol will make it an easy task. i mean, there's going to be some resistance from mayors and some of these sanctuary cities, governors and some of these century states. what would you say to them? >> hearing mayor adams speak on "the view," couldn't be further from the truth. saying i.c.e. won't work with them or they are not allowed to work with i.c.e., i.c.e. is there and willing. the administration has definitely handcuffed them, but as soon as president trump takes office, they are going to be available to work with those century cities, law-enforcement officers who want to turn over those criminal aliens to them. i can tell you also that is what is going to be great, i foresee tom homan coming in and building task forces comprised of state and local law enforcement, sheriff deputies, as well as

u.s. marshals and other federal components to investigate border crimes. i think it is going to be significant, and i think we are going to see a lot more help coming from some of those century cities. i don't know if it is help, i think they're going to be cooperating because trump is going to lay it on the line and he is either going to get them to assist us or he is going to make them pay. >> john: one thing we don't have a lot of information about is exactly how this deportation process will work from this standpoint, sheriff. a lot of the people that came across your border are not from mexico or northern tier countries, they are from places like venezuela that won't take them back, china that won't take them back, india and other places in southeast asia where it is very difficult to send them back to, so how do you foresee this process working? >> you know, john, that's a great point because currently venezuela, as you mentioned china, aren't taking their citizens back and we saw the speck in the early '80s in the muriel boat list and dealing with humans that

crossed -- came across 30-40 years ago, so we will be dealing with some of these people for quite some time, but i do see having a strong president in the white house with president trump negotiating with some of those other countries, and i can foresee him talking them to taking people back. i think he will have success negotiating, bargaining, getting this country cleaned up. >> john: he does tend to be a very convincing fellow making arguments. always good to catch up with you, take you, sir. good luck on the front lines. appreciate it. now this. >> our roommate went out for a run at 9:00, usually runs, and we haven't heard from her. >> and he went hunting for females on the university of georgia's campus. and in his hunt, he encountered 22-year-old laken riley.

>> the as the dense that jose ibarra killed anyone is circumstantial. >> her encounter with him was long. her fight with him was fierce. >> sandra: court back in session for an undocumented venezuelan migrant accused of murdering 22-year-old nursing student laken riley. the testimony points directly to jose ibarra as the killer. heather hansen, criminal defense attorney. good to have you here. for somebody who should have never been here in the first place, it was here illegally to hear the agony from that family and that courtroom has been absolutely brutal today. your thoughts on the evidence presented so far. >> i have never seen such a sad and straightforward case. the evidence, it's an open and shut case. i think it would be almost impossible for the judge to find any other way than guilty on all of the count, and i never say that, sandra, but you've got dna under her fingernails. you have the defendant's

thumbprint on cell phone. you have all of this video evidence. you have the garment, the watch that she was wearing, showing the fight she put up, it is such a sad case, and as you pointed out, really could have been prevented. >> sandra: it really became a focal point for so many debates in this election, this past election cycle, to the point that the defense attorney actually brought that up. this is dustin kirby earlier today making the case, listen. >> people have used this case for their own personal gain, financial gain, political gain. the evidence in this case is very good. that laken riley was murdered. the evidence that jose ibarra killed laken riley is circumstantial. >> sandra: heather, i see you

shaking your head aggressively. >> it is just not circum circumstantial. circumstantial is when you can infer guilt, a thumbprint on the phone is not circumstantial evidence. listen, this defense attorney does not have a lot to argue. he was speaking to the judge directly because they have decided to do this by bench trial, so the judge will decide this case and not a jury which is very unusual. >> sandra: this was the testimony of laken riley's roommate, lily steiner. in that courtroom, explaining the moment she realized laken was not home yet and the search for her. listen. >> we were using the find my friends app to kind of go directly to where her location was until we were standing kind of right around it. sophia noticed and alone air pot that was sitting on the trail kind of right around where her location was. it wasn't shortly after that we got home that i called 911 -- not 911, excuse me, the ug a

police department. >> sandra: a horrifying realization as she came about this. >> every young woman should have friends like those, they immediately use the technology, went to where she was, called the right people. unfortunately it just wasn't soon enough but that family and those friends in the courtroom, there are scores of people to support the family and it is a terrible thing for them to have to go through listening to this testimony. >> sandra: heather, good to have you here. thank you very much. john, obviously this was brought up during the election cycle, something so many voters felt extremely passionate about, immigration, illegal immigration, and clearly this was somebody who was here illegally and able to carry out allegedly this heinous murder. >> john: i really think the harris campaign ms. red america when it came to this topic. the secretary of homeland security was doing or wasn't doing for the last on most four years in terms of saying the border was secure, as we are seeing tens of thousands of people come across it every week, so i think those chickens are really coming home to roost,

>> sandra: the prosecution is expected to rest in the daniel penny case today. rossa hitters a former marine, t daniel penny choked a homeless man jordan neely to death on a new york subway last year. the new york's supreme court in new york city. where things stand right now? >> hey sandra. the cross-examination of the prosecution's final witness is about to begin. lunch is ending as we speak. and the final witness for the prosecution is the medical

examiner who performed the autopsy on jordan neely last year. she ruled that he died as a result of a choke hold, but she also said he had an unknown amount of synthetic drugs in his system. the marine veteran daniel penny is charged with manslaughter. penny interviewed last year with an nypd detective who took the stand and penny told the detective he puts between two and eight choke hold because he was dangerous and seemed high on drugs. >> he threw himself at those people and he's like, i'm going to kill everyone, i'm prepared to go to jail for life. >> he seemed like he was a hostile -- >> he was -- >> high -- >> something like that. these people are going crazy. >> so penny's martial arts instructor in the marines took the stand, as well. he said it looked like penny attended a choke hold technique he taught him but he didn't do

medical contributor. good to see you again, doc. >> hey john. things for having me on. >> john: here's what meghan mccain said about rfk being nominated for hhs, she said "rfk is good to be hhs as a direct result of democrats and found she blatantly lying to mothers in this country, putting our children second behind adults and radicalizing them during covid." what do you think of that? >> john, megan is absolutely right. the distrust in the public health system is a man-made problem and covid, risk versus benefits when it came to treatments as well as vaccines. we have a major problem here in the united states with medical distrust, and i know there are critics right now who are questioning the appointment of rfk jr. to the hhs secretary but the reality is historically speaking, they don't actually have medical professionals in this role. in the last several decades, only one physician held the

spot, tom price, it was the shortest run ever, seven months only. there have been career politicians, lawyers, even pharma executives, so rfk jr. being an environmental lawyer who for the last several decades has been speaking about some of the chronic illness problems in our country, he has probably spoken more about health and human services of our country in the last couple of years then all of the proceeding hhs secretary's combined before they got the nomination. >> john: you know, you talked about confidence in scientists having the best interest of the american public, pugh has been measuring this every year for the last few years. take a look at this. it is not an absolute low, that was last year, but still almost a quarter of americans say that they do not have any confidence in science to look after the best interests of the american people. that's way down from the pandemic, so it would seem that what happened during covid really did have an impact on american people's perception. >> it certainly did, and i see

it every single day when i talk to patience. it's going to be a long time and a lot of hard work for us to gain public trust back, but the reality is president-elect trump has promised that he is going to be a disruptor, that he is going to change things, and the truth of the matter is, under the status quo, we have the opioid crisis, the obesity epidemic, and the chronic illness pandemic. we have been talking about this for years and years and years, john. you and i have had these conversations and if we do not have support on the federal level, the state level, so people can have access to healthier foods, remove a lot of these chemicals from our diet, it is only going to get worse. so are there other people i would have nominated for this position? there's a lot of people i think could do a great job. i would have loved to see rfk jr. in more of an advisory role, but i am certainly willing to give him the opportunity. he has promised he is not going to be taking away vaccines or other things. i think he wants to make sure the science is real, that we are open and honest with the public about it, and that we are removing some things that are harmful to our population. >> john: in terms of bias in

the scientific community, the editor of scientific america had an online meltdown on election night in an expletive-filled rants, said solidarity to everyone who is dumbest, most bigoted high school classmates are celebrating early results, because f them to the moon and back. i apologize that gen x is full of effing fascists. she resigned after backlash. another example of why people do not trust the scientific community. >> first of all, john, we saw bias exists especially during the covid pandemic but the reality is there's all sorts of bias when it comes to -- we actually have to disclose a lot of bias in all of our research because there is implicit bias. it is always there. in terms of what this woman wrote, i'm so glad to hear she resigned but this just shows the

whoopi goldberg is stirring it up, claiming a popular family owned staten island bakery, refused to serve her because of her political views. goldberg and her cohost celebrated her 69th birthday with desserts onset. the bakery's is denying these allegations. staten island borough president explained what happened during a news conference in the noon hour today. listen. >> 60 or 70 years old, and the first week in november, guess what, it went on the fritz, it had to be replaced, and the reputation is impeccable, so rather than commit to something they couldn't guarantee, they say we can't do it, and the person who besmirched and defamed them took that as an insult to her. well, get over it. frankly, the people houthi feigned them should apologize for making stuff up to suit their needs.

>> sandra: i don't know if anyone is holding their breath. you are here on this. where to begin? you and i have covered business for so many years, this is a family owned business, i heard the word defamed, we all reacted to that, perhaps some legal repercussions here, but why would she take, to her audience, to say such things, she doesn't have any evidence that they didn't serve her because of her political views. they did not say that, not that we know of, so why did they do this? >> it's kind of, number one, i don't think there is defamation here because she didn't name the bakery. the only reason we know the name of the bakery is because the owner, the woman, whose last name is holtermann, came out in the press and said she's talking about us. i told her that the ovens weren't working because we are having boiler problems -- >> sandra: she also showed the desert that is unique to that bakery.
