judge mostly signals he probably wanted to avoid the emotions of a jury. there are technical legal issues that come up in trial and sometimes a jury is asked to disregard certain evidence, a judge is able to do that presumably more than a jury. in many ways choosing to not plead guilty even with such overwhelming evidence is a decision, in my opinion, to preserve a lot of appellate rights. if you plead guilty you wave a lot of issues on appeal. ironically enough even though he came here illegally, broke so many laws, he is entitled to full constitutional rights in america. joey: they didn't ask for the death penalty. is that because all the evidence is circumstantial? is there a reason? is the severity of the punishment indicative of the amount of evidence you have? explained that. >> the da did not seek the death penalty even though it was available. there's not from what i can

issue because the question about the reasonableness of his actions is at play and the idea that somebody was under the influence of substances even if they were being re-strange could have played into whether his actions were more or less reasonable in terms of whether the chokehold would have expedited the death of somebody on drugs versus somebody that was not. will: it is reasonable to have re-strange jordan nearly but was there a point in the restraint when a reasonable person would have said enough or the risk has gotten too high of killing a man? is that the debate? >> essentially he might have been within his right to restrain mister neely but once it reached a certain point that his actions became unreasonable the prosecution has a very uphill battle with that because based on all the witness testimony and even his own words jury heard in his

interrogation video he seemed very subjectively under the belief that this was a necessary thing to protect other people, not to injure mister neely which did occur but not as an intentional act of mr. penny. joey: we need men or women to step up in those situations and he did and i hope the jury sees that. rachel: the point is women can't do it was very unlikely. 18 minutes fighting for her life and she lost that battle. we need men to step up and protect women and when we punish younger men like this who do the right thing and everyone around him said he did the right thing but the prosecutor goes on and they have discretion to not do this. i don't understand can we talk about this earlier, this is not a popular position of this da, is it? >> decisions by prosecutors are political. i don't know what the political win is even in new york. >> it was the wrong call.
