it is because i want a court to pay attention to it. and there is nothing more important than counting votes. >> choose which laws you want to violate. mccormick says it's business as usual going forward with orientation and making new hires and excited for his time in washington, d.c. i think they want this to wrap up. they say they have the votes. >> dana: i was reading a woman who covers our program. this is a terrible way for people to remember you, bob casey, by going forward this way. keep us informed. thank you, alexis. a growing team heading for the white house getting ready to reset national priorities including pull the plug on a woke agenda. i'm dana perino and bill is off today and john, we have one more hour to go. >> john: looking forward to it. i love being with you.

the trump transition team moving forward to fill out the new administration and democrats are digging in dead set on resistance. mike johnson leaving the door open to recess appointments to speed things up if democrats stand in the way. trump adviseor with a reminder for the opposition party. >> democrats refuse to admit that donald trump is coming back to washington, d.c. with a mandate from the american people and is entitled to have his cabinet around him. that he chooses. donald trump's mandate allowed him to make the u.s. senate a republican majority. as these u.s. senators consider the president's nominees they should remember why they are in the majority. >> dana: chad pergram on capital hill. >> some nominees indicated they will try to reverse the

officers to the top brass. >> lady jill biden's secretary said slamming the characterization saying this on x. opposing dei initiatives doesn't make you a white supremacist. voices like this on the left are calling the democrats a joke. if you oppose them good reason to oppose them represents everything the democratic party should be running away from. fighting back with strategy and tactics instead of defamatory and juvenile language. >> dana: i joined the club. there is landscaping equipment that starts up. >> john: you used to work there and know what it is like. you have to trim things every day. chad pergram live on capitol hill with more on president-elect trump's quest to quickly confirm his cabinet

picks. chad. >> good morning. we're expecting an intense period in early january. senators will prep as many trump administration nominees as possible for confirmation right after the inauguration. the gop cannot move until it controls the senate. >> to a session we can get start evidence right away with the hearings themselves because we can't do anything to actually approve them in the senate until the new administration takes place until the new president is sworn in. we can get all that out of the way in that two-week period of time. >> there will be some paperwork and then votes shortly after the inauguration on a host of nominees. republicans want the new president to hit the ground running. that said, bipartisan senators insist on full vetting for nominees, that includes background checks. >> it would be a mistake in most cases to curtail the
7:05 am
investigative process and the public hearing because that is the senate's constitutional responsibility. >> there is still a lot of chatter about using recess appointments to advance nominations if they get bogged down. both the house and senate must be out for ten days to execute that maneuver. recess appointments bypass the usual confirmation process. democrats and many republicans are wary of recess appointments. >> i certainly hope that's the case. and that we won't see nominees jammed through in recess appointments where there is no confirmation hearing, no confirmation vote, and they take over incredibly powerful positions for up to two years. >> democratic california senator says democrats will do whatever it takes to block some picks of the new president.
7:06 am
mr. trump is watching to see which republicans balk at his nominees. john. >> john: chad pergram with the latest from capitol hill. thank you. >> dana: for more arkansas senator tom cotton the incoming republican conference chairman. congratulations to you on that. there are three topics and no one better to do all three in the time we have. speaker johnson on "fox news sunday" about recess appoint also. watch. >> i wish the senate would simply do its job of advice and consent and allow the president to put the persons in his cabinet of his choosing. but if this bogs down a great detriment to the country. i'm very hopeful the senate will do its job and that is provide its advice and consent and move these nominees along. they have an obligation to do a vetting of every nominee and they will. >> dana: i've been wondering the numbers that the republicans have in the senate why does everyone have to talk about
7:07 am
recess appointments when it should be easy to get everybody confirmed? >> that's exactly right, dana. once again, the left doesn't seem to have learned anything from the campaign or the last eight years hyperventilating about an anti-constitutional practice that's in the constitution itself. recess appointments go back to the beginning of our republic. i don't see a need for that. i expect to senate to work promptly and efficiently to process all the nominations and put donald trump's cabinet in place. the new senate sworn in january 3rd. we can have many of the confirmation hearings in that 17 day period and then on january 20th shortly after the president gives his inaugural address and sign the formal papers to nominate all the people to cabinet positions and senate should start working promptly to process the nominees. i can tell you you don't want to see my dance moves in a ball and
7:08 am
other senators' dance moves. we should work the get the nominees confirmed that day. that's what we should keep doing in the days ahead after the president is inaugurated. >> dana: it is always freezing on inauguration today anyway. you support senator john thune the new majority leader for the republicans and his push to deal with the international criminal court who wants to go after israeli. if the iss and prosecutor don't reverse their unlawful actions the senate should immediately pass sanctions legislation has the house has done on a bipartisan basis. let me get your take on this. why is it important and should it be done right away? >> dana, absolutely. it is not just senator thune and i but i think probably all republicans and a lot of democrats as you said. the house passed this bill months ago with more than 40 democratic votes because the international criminal court is targeting israeli official eaves
7:09 am
to include prime minister netanyahu for supposed war crimes when israel is the victim of war crimes. this bill that i helped draft is based on executive order that president trump issued in his term and again it passed in large bipartisan vote. chuck schumer could bring it up this week, much better use of time than confirming the head of the office of government ethics that we spent hours on last week. because this court, which is acting in a rogue fashion, could issue arrest warrants at any time. we shouldn't allow that to go forward without severe consequences against this kangaroo court and its rogue leader. >> dana: there is also this. we did a story with alexis mcadams at the end of the last hour about dave mccormick, the republican senate candidate in pennsylvania. the race has been called for him. bob casey continues to push forward and there seems to be some sort of craziness and possible illegal activity. this is the pennsylvania county official after democrats
7:10 am
rejected a gop led challenge. it said i think we know that precedent by a court doesn't matter anymore in this country. if i violate this law it is because i want a court to pay attention. there is nothing more important than counting votes. what is happening in pennsylvania and what can the republicans do to bring it to a successful close to the party? >> well, dana, it is crazy. once again democrats doing exactly what they always accuse donald trump of doing, defying a court order. he never did that in his first term. now you have the pennsylvania supreme court ordering county officials not to count certain improper or incomplete ballots and democratic officials are simply saying we'll disregard the supreme court order and count these ballots. the department of justice should investigate these democrats immediately. if joe biden's department of justice won't do it because they focus more on things like getting illegals to vote in virginia, i bet the trump department of justice will investigate it. you can't allow partisan
7:11 am
election official eaves to defy a court order. the time has come to bring the case to a close and allow senator elect dave mccormick to represent the people of pennsylvania. >> dana: tom cotton. keep us posted on that. appreciate you coming on today. >> thank you, dana. >> dana: let's go to athens, georgia. prosecution is calling new witnesses in the laken riley murder trial and what they are revealing on the stand. >> john: chicago city council meeting getting heated. >> i'm a black man and i don't see at you i see through you and i see the lies that you have been saying since you become office. >> get rid of the illegals! ♪ limu emu & doug ♪ woah, limu! we're in a parade.

on trying to protect uzbekistan nationals coming from our southern border. get your act together. >> dana: the 21 migrants were handed over to customs and border protection. see where it goes from there. not a good situation. well keep an eye on it. >> brandon johnson has ignored every plea, call, cry. you are going to protect the undocumented while allow for the citizens in the chicago to suffer. >> you ain't going to abide by the what the president of the united states said. >> loser, get rid of the illening purple. we are going to turn red. >> john: chicago residents tearing into mayor brandon johnson at a heated city council meeting accusing him of prioritizing illegal immigrants over citizens in chicago. the executive director of violence interrupters joins us
7:19 am
now. not a popular guy. who exactly does he represent these days? >> right now mayor brandon johnson represents himself and his party because a lot of the people in in chicago are frustrated with his performance as a mayor when it comes down to the migrant issue here in chicago. >> john: what exactly is it that constituents are upset about? >> african-american people have been deprived of resources for decades in chicago. if you travel to the south and west side of chicago you know you can count thousands of abandon buildings, a lot of people living in poverty and people are upset because there appears to be a priority for the migrants compared to pry or tidesing some of the issues of single african-american women living in homeless situations. we had over 60,000 homeless people living in chicago before the migrants came to chicago and the homeless people were never a priority until migrants came to chicago and still not a priority to this date and the reason why a lot of african-american people are upset.
7:20 am
hispanic people voted for donald trump as well in chicago. some hispanic people are upset. people need to understand this. what donald trump is doing here and saying if you come over here legally it's okay. do not come to our country illegally. i don't know why people have a problem with that to be honest with you. >> john: all along the counties along the border in the southern part of texas blue for so long went red in this election. so the president-elect ran on and was elected on a platform to start deporting a lot of illegal immigrants beginning with obvious criminals and the tren de aragua gang. the leadership there in chicago and state of illinois is saying we'll fight him every step of the way. listen here. >> to anyone who intends to come take away the freedom and dignity of illinoisians, a happy warrior is still a warrior. you come for my people, you come through me. >> this is a city that will

remain a welcoming city. we'll protect undocumented individuals. >> john: a lot of people are saying that kamala harris lost because the democratic party is out of touch with what its constituents really want. what do you think of what the officials are saying? >> people in america should understand over 76 million people voted for donald trump and trump painted a very clear narrative that the democrats have failed in the area of the economy, the conflict in the middle east, the migrant issue and so many other issues out there. perception of democrats have truly failed. i wish the leaders in illinois and chicago would fight the same way for this high unemployment rate for african-american young men between the ages of 16 and 25 which is staggering. around 85%. you can check those numbers out. why won't we fight to make sure these young guys are employed in chicago? we have issues with gun violence running rampant in chicago. let's step up to the flat and be just as diligent in our efforts
7:22 am
to reverse this tide of gun violence with this illegal gun trade in chicago as well. >> john: the dell imma with the illegal migrants. the biden administration let 9 million across the border and taken up residence in the united states awaiting asylum hearings or other legal proceedings. you can't just leave them to their own devices or they will starve in the streets. something to take care of them. estimate you have to look after the community that pays taxes to you and people who have been there for generations. but the real trick here is how do you achieve the balance between those two things? >> it's hard to achieve a balance. it is inhumane for some of them to be in chicago. you had babies sitting on the streets and parents begging for money on street corners and babies had to sit on the streets like 18 hours a day. i'm not making this up. ride around and see what i'm talking about. the conditions, cramming people up in these places they call
7:23 am
them migrant shelters or whatever the case may be. totally inhumane. hard to balance. right now chicago is facing a budget deficit and the mayor talks about not raising property taxes and yet backs it up a little bit recently because the city council decided not to allow him to raise property taxes. during his campaign he said he would never raise property taxes. the migrant crisis has caused a lot of ripple effects in chicago and across our state. it's hard to balance because we have to get our act together in our city first before -- how could you have a sanctuary city and you aren't prepared to provide adequate sanctuary in the first place? the reason a lot of people voted for trump as well because millions of americans are tired of these perfect candidates. trump is the not so perfect candidate and able to identify with people from all walks of life and the reason why trump became the president in the united states of america. he had a lot of issues in his background as well people are tired of people telling them anything.

people were upset he said something they considered to be outrageous. he said he had two daughters and didn't want them getting run over by boys on the field of play. that is something that 80, maybe 90% of sports fans, almost all dads and moms in america agree with and they protested outside of his office because they considered it unacceptable what he said and they say they are going to run somebody against him in that district. democrats are taking wrong lessons for why they got whipped two weeks ago, 13 days ago now. it is because culturally they are out of touch. you are not a hard core sports fan but all over the nfl and usc over the weekend athletes were doing the donald trump y merck ca dance everywhere. there is a cultural awaken. the woke ridiculousness of the democrat party is being rejected by mainstream americans and

democrats seem content to double and triple down on what got them whipped in the election 13 days ago. >> dana: meghan, you are somebody who has a lot of common sense and i'm sure you talk to a lot of friends. are you talking them off the ledge, are people coming around to realizing that maybe they actually had something wrong or do you think it will be rerunning the same playbook? >> i think people are starting to come off a ledge a little bit and evaluate where they want to go to move forward. we'll see that when people start running for dnc chair and other state races. i think that the democrats do need to move to the middle and understand what's going on in the rest of the country and some of the issues that may be really important to people on the far left aren't impacting the rest of the country. if democrats want to continue to -- want to win again they will have to move more moderate and care about working class people and the price of groceries and those types of things that really went down this cycle. >> dana: we only have a minute
7:39 am
left. let you add one more thing. i actually feel, clay, that we're just hearing the same things we heard after 2016 when president trump won the first time. >> look, i will say msnbc which nobody is watching. you saw already mika and joe bent the knee to donald trump at mar-a-lago. on meghan's point here, i think really what this trans men pretending to be women issue in sports represents is just a baseline test. if you will lie to me and say a man pretending to be a woman is a woman, why can i trust you on anything? once you admit to me something that i know to be untrue, i should trust you less and i think that's where a lot of mainstream middle of the road voters are as we sit here after trump's big win. >> i think it's more than that. more why do you care more about

those issues that impact such a small group of people and care about grocery and gas prices for the entire country? we as democrats don't need to abandon the left of our party bust show people we care about the economy and issues impacting the majority of the party. >> dana: clay and meghan, thank you. great to have you both. have a great week. john. >> john: the laken riley murder trial continuing this morning in athens, georgia. more from the courtroom on the illegal immigrant accused of killing a nursing student coming up. >> what the prosecution is doing is getting out ahead of the defense's plan which is to try to muddy up the waters and muddy up the dna by saying it could come back to one of the brothers and not jose.

>> dana: back to athens, georgia. watching day two of the laken riley murder trial. madison scarpino is live from the courthouse. what more do we know, madison? >> good morning, dana. a woman who lived with ibarra is on the stand and have to be translated from spanish to english for the court. before that we heard from the two officers who went to ibarra's apartment the day after riley was killed.
7:46 am
they went there after police obtained a video of a man who prosecutors say is ibarra throwing a jacket into a dumpster. it had blood and hair on it. offices said when they first araved they talked to his brother diego. the officer said he noticed dirt on the hat. >> i was on scene when we located laken on the day pryor. she had a lot of dirt and mullch on her body. if an individual was wearing that hat and touching laken in that manner, dirt could have been transferred to the hat. >> jose ibarra was sleeping at first but officers eventually made him come outside and noticed several injuries on his body. >> noticed on his right arm, bicep was a scratch.
7:47 am
defensive wound. on helps lift arm he had a forearm scratch similar in my mind looked like fingernail scratches to me and speaking to us i noticed on his left writ below the palm he had a puncture maybe a half inch wide. >> laken rile''s mother was very emotional while the court showed photos of the scratches. the defense questions how old those scratches were. defense alluded that diego was wearing that hat in the video but they also alluded that he was wearing the same clothes in that video. we'll continue monitoring this trial and keep you guys updated with the latest developments. another day, dana, of laken riley's family filling that small courtroom. back to you. >> dana: madison, thank you. >> john: let's bring in kerry urbahn. the defense tries to muddy the

waters, question the dna and say the evidence is circumstantial. the case appears to be very strong. >> very strong. what else would they do. thumbprint on the phone and dna. it is pretty open and shut sui why the defendant waived his right to a jury trial knowing there is no way he could get a sympathetic jury and the judge hasn't been, either. ruled against him at every opportunity. look, i think one of the interesting aspects of this, the horrible story that should never have happened. i do believe the country failed this young woman especially as a woman it has been hard to listen to all of this. an interesting aspect, though, is this defendant's brother whom he lives with with ties to this venezuelan gang tren de aragua. just last week the state version of the f.b.i. in tennessee put out an alert saying this gang is currently in every major city in tennessee and the reason that struck me is wow, that's terrifying but two, when i was at the department of justice only four or five years ago, this gang wasn't even on our

7:50 am
>> the charges were front and center in the campaign despite the prosecution's more than 75 million -- 76 now. majority of the popular voted decided to send trump back to the white house. what do you think merchan will do? >> first thing we'll hear tomorrow is perspective of alvin bragg's office. curious to see what they'll say. are they going to follow the lead of jack smith here in washington, d.c. and basically say look, this person has been elected president, we will follow d.o.j. 's policy to not indict or prosecute. in the spirit of that policy we'll do the same thing based on how the people have decided and just im practicality of a president fulfilling the sentence. so i'm wondering if they are going to make that argument and
7:51 am
then judge merchan, what to do. if he doesn't drop these cases he will be an outlier. he will be the only judge holding on for dear life to these cases. my question the judge merchan politically speaking is one, you have off ramps now to get out of this case. you have the security ruling on immunity and now you have the fact that donald trump won the presidency. you have a way to get out of this and save face. two, another question he needs to consider. do you want to be responsible for the republicans winning in 2028 by holding onto this for dear life? as we all know the lawfare strategy majorly backfired. does he want to be responsible for that again? that's a decision he has to make. >> john: this afternoon we'll mull over what is happening in pennsylvania. >> one of my favorite topics right now. >> john: what in the frack is going on there? see you later on. >> dana: a winter storm system
