i think the jury especially in the case like this where emotions are high and that could benefit daniel penny with in terms of people riding the subway. it is important to see that this is a regular human being and yes he was a marine and served his country but he has friends, family members that care about him and this was not somebody looking to destroy somebody's life that day but looking to help people on the train. >> todd: in the meantime for defense moving for a mistrial and the star witness brought up the word homicide on the stand "dr. graham radius all homicide reports." as for that shrinking comment a motion for mistrial, had with that decision along with the other decision to deny mistrial hold up on appeal ultimately if daniel penny is convicted? >> it remains to be seen but if convicted, you are correct they were appealable issues and appealable issues in the most tried cases. this is another one and a

72% of jewish college students feel unwelcome on campus and over 50% have personally been victim of anti-semitism at their school. sam castle filed that lawsuit against sequoia union high school district and he joins us now. what led to you file this lawsuit? >> yeah, good morning. and thanks for shedding some light on this topic. you know, and this is just one story of a number of stories that are happening in our area. as you pointed out anti-semitism is on the right and becoming culturally acceptable. shortly after the october 7th terrorist attack my daughter came home very upset. her world history tenth grade teacher teach nag very biased way and basically teaching propaganda wearing free palestine class and posters on the wall. when i looked at the material

she was being taught specifically one example vocabulary matching test in order to get a good grade she had to match the term palestine with the definition a country formerly recognized by the u.n. in 1947. another example is the term is hamas. and definition was a political party continuing the fight against israel. she had to go against her beliefs and what she knows to be correct in order to get a good grade. when she brought this up to the teacher, repeat you hadedly in class and was brave enough to stand up, he belittled her, made an example of her, and ended up, you know, in this lawsuit, as we pushed for the material. the source material was never provided. the administration basically circled the wagons over the past year. and regardless of their formal processes really didn't, you know, even lift a finger.

and their number one responsibility is not to protect themselves and the teacher but to protect the children. >> carley: you are absolutely right. we reached out to the sequoia union high school for a statement and haven't heard back. when you filed the lawsuit, what was the reaction from the school to you? >> exactly what it has been for the past 11 or 12 months. just absolute silence. you know, some emails and so many requests for partnering and trying to come to a proper resolution have just simply been turned down. it seems like they are going to do everything to try, you know, make this go away and not deal with the topic directly. >> carley: so we -- you know, we have seen a lot of examples of this when it comes to anti-semitism on college campuses. but, high schools, you're still living with your parents. you feel like a level of protection there. also dealing with a lot younger students. were you surprised by this? >> i mean, honestly, what

surprised me is the level of anti-semitism, you know, in the bay area. i grew up in the south. i grew up in florida and of course we had anti-semitism in the 1980s. the anti-semitism that my children have experienced not just in high school and middle school and elementary school is just a normalization of the hatred and we have seen very clear, you know, examples of the anti-semitism on college campus over the past year. but, even in the bay area, just to let you know it goes down into the very, very lowest grades. in the oakland side they were teaching p is for palestine to little children. and that completely unacceptable. completely unacceptable. >> carley: you say there has been a cultural shift in accepting anti-semitism. how did we get here? >> i think a lot of uneducated people. if you are growing up and getting your facts and your world view through social media and tiktok.

i think it's a serious problem. you haven't been taught the critical skills to figure out what is, you know, what is true and what is not. and when you have high school teachers, teaching that palestine was a formerly recognized state by the u.n. in 1947, and an administration that doesn't really lift a finger to try to stop and reeducate those students, it's, you know, no doubt you end up with anti-semitism. >> carley: you say this all happened as a reaction to october 7th, which was a horrific attack on jewish people in israel. we did like we said we reached out to the school district. we have not yet heard back. we will bring it to our views if we do. sam, we do have to leave there, thank you so much for joining us. we're sorry this is happening to you and your family. we appreciate you speaking out. >> thanks for the time and have great morning. >> carley: all right.
