judicial picks confirmed by the senate. the republicans in the senate are going to do their best to slow down the process. while they still have the ball, the democrats are going to try to get as many joe biden judges on the bench. the republicans are saying the next guys donald trump and he's going to have other people, so let's take our time. >> ainsley: how do they slow it? filibuster? >> steve: there's a whole bunch of procedural stuff you can do to make washington grind to a halt. >> ainsley: can they slowly down through the end january? >> brian: it shows how ineffective the senator is. they work three days a week for you to have this backlog. what tom homan has to do, the public sentiment is on his side. people say, you are the mayor over in boston, in chicago, stopping x, y, and z from us deporting them. they've murdered, they've killed, they have robbed, they are members of gangs, but you are mayor and your governor is

allowing them to stay. is that okay with you? and the answer is a resounding no. make sure they know the criminals these people are protecting. >> ainsley: great idea. if tom homan is listening, great idea. go to each of the states and find out those districts, those areas. give us examples of what's happening and how you can't change the law or get these criminals out because of their policies. >> brian: you are talking to seth moulton, the democrat, speaking more common sense and finding himself on the other end of protests. >> lawrence: he doesn't want to resist, he says the party needs to moderate and he gave us for an interview earlier today. let's watch. >> we need to be able to debate contentious issues without just being shut down. this is a problem we have in politics today. we can't as democrats feel like we can debate some of these contentious issues at the risk of offending people. we can't represent the vast majority of americans and the concerns that they face if we are not willing to actually

engage in debate. that is my core point here. there are definitely some people who say you have to oppose every single thing that trump does, and i disagree with that. i think we need to work with would republicans where he can and set up and fiercely oppose trump when we disagree with him. i am trying to moderate the party, but this is not about me. it's about how we get the party back to a winning position. we are going we are not going to restorebalae myself. we are going to do it if we get more people elected to places like the house. >> lawrence: this is the one thing the democratic party cannot do right now, state the policy position without mentioning donald trump. every time i ask a democratic question, tell me what you are for, tell me what you are against, all they say is donald trump. they don't know how to formulate their thought process without mixing him and it. >> ainsley: we saw that at the convention. remember how we talked about the

>> ainsley: this is a fox news alert. right now laken riley's murder suspect is back in court after a day of stunning testimony create madison scarpino joins us live from outside the courthouse in athens, georgia. madison? >> good morning, ainsley. prosecutors have called nearly 20 witnesses so far, but we expect the defense to start laying out their case very soon. some of the most striking testimony from yesterday included a jail phone call between ibarra and his wife. she lives in new york and was begging her to tell the truth over the phone. that call is translated from spanish to english. listen. >> she said that she think it's crazy that they don't have anyone else's dna, they only have his. she says she doesn't understand how someone can see someone dying and not.

>> we also talked with the woman who lived with ibarra and his brothers in athens. she's also venezuelan and now in federal custody. she did not to be filmed and also needed a translator, but she said she met ibarra when they were all living in new york after entering the u.s. through the texas border. fox has been covering new york city's hotel roosevelt a lot, which is now of course turned into a migrant shelter. the roommate testified her and ibarra moved to athens after requesting humanitarian slight from hotel roosevelt. we also heard from the officers who showed up at ibarra's apartment the day after riley was murdered and also fbi agents he went over a lot of ibarra and riley cell phone data. the prosecution says they plan to rest their case today and the defense is their testimony will only last about half a day. we will likely hear closing arguments and then it is up to the judge to decide ibarra state. back to you. >> ainsley: thank you so much, madison. let's bring in paul mauro, covering the case. good morning to you, paul.

what stood out to you yesterday and what can we expect today? >> the phone call that madison references was a dramatic moment when she says to him, i can't understand how somebody would see a body dying and not common 11. he really seems to indicate they were previous phone calls where he indicated to her that he was at the scene. this industry their party who wasn't even there. we saw that as a striking moment. today we are likely going to see the prosecution beginning to wrap up. this has been a narrative chronological way for the most part. they've built the narrative very meticulously. we will probably see it because that was maybe an interview with him. the initial arrest, to see if he made any statements. they would have to be translated. and then maybe something from a corner or medical examiner

closing out specifically how laken died to close the loop on the entire case, and then a defense case that's going to involve his brothers. >> ainsley: that's what i'm hearing, they could be called to the stand this week. and they only have about half a day of testimony for their case. what does that tell you? >> apparently according to the opening statements, some of the objections and the things that have been raised, it looks like where the defense is going to go is to try to raise some doubt about the dna. there were three rounds of dna. after the second one, it pointed to a member of the ibarra family but not specifically to jose. also diego ibarra, jose's older brother, was wearing a hat very similar to the one that was captured in the video by the dumpster of the perpetrator apparently dumping a key piece of evidence. it looks like they're going to
