ballots coming to a head in pennsylvania. that state supreme court striking down a bid by democrats to count undated mail-in votes. you who do you do that? apparently you don't now. will that prompt the incumbent senator democrat bob casey to finally concede? maybe get an answer soon. live in new york i'm bill hemmer. big program starting now. how are you? >> dana: i'm dana perino and this is "america's newsroom." and you would imagine that this could probably end today but the democrats have been dragging this out. we're two weeks from election day and still going on. dave mccormick beat senator casey by 17,000 votes. that's within the margin of error -- to trigger an automatic recount. >> bill: officials wanted counties to include ballots who failed to write in the date. heavily democratic counties. >> dana: the ruling is a victory for republicans.

conservatives say it should have been a non-starter. >> imagine if republicans. if josh shapiro wants to be a leader he should make pennsylvania the blue state answer to florida. after the hanging chads in 2000. >> bill: the governor, democrat stepping in. nate foye has that from the new york city newsroom. where are we now, nate? good morning. >> good morning. senator-elect dave mccormick's campaign calls it a massive setback to casey's attempt to count illegal ballots. casey says he just wants to count every vote. pennsylvania supreme court ordered counties not to count mail-in ballots with incorrect dates. this reaffirms an earlier ruling that some democratic county officials promised to ignore. mccormick's campaign says buck county and others blatantly

violated the law to help senator casey. senator-elect mccormick is pleased with this ruling and looks forward to taking the oath of office in a few short weeks. pennsylvania governor josh shapiro is reminding election officials to follow state law saying quote, any insinuation that our laws can be ignored or do not matter is irresponsible and does damage to faith in our electoral process. after a bucks county election official promised on camera to count illegal ballots. >> i think we all know that precedent by a court doesn't matter anymore in this country and people violate laws any time they want. so for me if i violate this law it is because i want a court to pay attention to it. and there is nothing more important than counting votes. >> bucks county now says it will follow this order while philadelphia county says it will continue to fight through every legal avenue. the court ruling has some wondering why casey hasn't

conceded. he told fundraisers in a note last night quote, the answer is simple, pennsylvania deserves to have their voices heard and the worth of someone's vote is not determined by how long it takes to be counted. the replay will take place over the next week. >> bill: we're watching it. nate foye in new york. >> dana: we are awaiting a major decision out of new york. judge merchan is set to rule on trump's criminal conviction. trump's re-election upended a new york court's plans for falsifying business records. the question is really if you are following the bouncing ball, one of your favorite sayings, all these trump cases i will give you an update. this is the new york criminal case. we're waiting because his team said well he just won the election. can we see what we should do next? prosecution agreed to that.

election day. charges were front and center in the campaign despite the prosecution's more than 75 million people the majority of the popular vote decided to send him back to the white house. so now you have a judge in lower manhattan, judge merchan who has barely cut a trump team a break throughout the entire case. what does he do next hour? >> oh, he didn't cut any breaks. i was there for part of it. i have never seen a more pro-prosecution judge. how do you hold something in abeyance for four years or hold the sword over the leader of the free world's head for four years? i don't think you can hold it in abeyance. you can't sentence him. he is then a convicted felon. i can't possess a firearm but i have the nuclear codes. that is absurd. he hasn't had an evidentiary hearing on presidential immunity. look, the prosecution said they there are competing interests. not anymore.

the competition is over. they lost. he needs to end the case. i never agree with "the new york times." i had to restart my heart when you were reading that but they're right. they need to end. he won, the competition is over. >> dana: the other one is the georgia court canceled oral arguments in the trump appeal and the georgia court filing says the oral arguments scheduled to take place december 5th at 10:30 a.m. is canceled until further order of this court. what do you think that means? >> i think fani willis and nathan wade will be in court sooner than donald trump will be in court. if i had to lay money on who will go to trial quicker it would be fani willis and nathan wade versus donald trump. that thing isn't going anywhere. it was already a lifetime channel movie. it was a joke before he won the presidency. so if i'm fani willis i have a better chance of going to prison than donald trump does. >> bill: what do you think

during this campaign trump kept talking about lawfare. a lot of his allies did as well. you've watched this various court cases. i don't know how you felt about the documents case in florida or the jack smith thing in washington, d.c. coming after january 6th but when you look at all of them and think that there is a possibility they could all be now dissolved, 0 for four. you are a man of the law. that is your profession. what do you think of how this went? >> do not use the justice system as a weapon. and the message for republicans is don't do it on the other side, either, with this absurd a.g. pick that you just made. justice is different. it is a combination of policy, law and also morality. you do not use our justice system as a political weapon. voters rejected it in november and they will reject it if

inadequate process by which hhs places kids with sponsors. a report was released earlier in the year by the inspector general confirmed they lost track of tens of thousands of unaccompanied migrant children. the report detailed that out of 365,000 who were released to sponsors, tens of thousands of them haven't showed up for their hearings and many more weren't given orders to appear. so not only do we not know where they are but we don't know even if they are safe. at the moment it doesn't appear the hhs office task with refugee resettlement is taking any responsibility. >> does not monitor or track the whereabouts of children after they are released from our care. >> the report indicates what ends up happening with these kids is that they are often exploited without a way to monitor their location or status, immigration and customs

anti-ev. he has always been anti-ev mandate. let the free market dictate how quickly we adopt evs overall. this specific rule relates to autonomous driving. self-driving vehicles. one of tesla's biggest growth drivers has been the robo tax he initiative. that will be hugely profitable for them over the next few years. what trump is looking to do potentially is increase the amounts of self-driving cars each manufacturer can release in a given year. i want to say it was capped at 2500 per manufacturer per year. very low. in the past he was trying to get that number up to 100,000. i think he will push to do that. tesla without a doubt when it comes to autonomous vehicles they have the best technology and first mover advantage and you will like this, bill, nvidia makes the best chips for

unprovoked. vicious attacks. it has new york authorities searching for answers happening in broad daylight in the space of less than 2 1/2 hours. the first stabbing 8:30 monday morning. a 36-year-old construction worker standing by his work site on manhattan's west side without warning he was stabbed in the abdomen. two hours later across the island a 68-year-old man was stabbed while fishing in the east river. both men died shortly after the stabbings. a third attack just before 11:00 a.m. 36-year-old woman was stabbed multiple times near the united nations complex and pronounced dead at the hospital. 51-year-old homeless man with mental health issues was nabbed after a passing cab driver who saw the third attack alerted police. >> i saw the guy in suit and earphones trying to look for a suspect. he pointed toward that homeless guy because apparently he was

the authority of the u.s. president were given the authority to fire what's called an attack missile into russia. an attack is an army tactical missile system with a distance of 190 miles. up to this point in the war u.s. policy has been to refrain the ukrainians and zelenskyy from using this type of weapon. now based on the early read-out on this they fired six overnight. the ukrainians said they were targeting an army depot that had a lot of weapons. there were secondary and third explosions there. the russians are claiming they shot five of the six missiles out of the air. when the dust settled the russians now are talking about their own nuclear charter and when and how they use it. so that's what is happening in the ukraine war. we'll keep a close eye on the story and bring in dan hoffman next hour to bring us up to speed what we need to pay

attention to. it appears that conflict may be going to a new level. we'll see. >> dana: the pennsylvania supreme court striking down the push to count mail-in ballots non-dated. it is a victory for dave mccormick heading toward a recount against bob casey. karl rove joins us now. the pennsylvania governor did side with -- basically against illegal ballot counting. let me read it to you. any insinuation our laws can go ignored or don't matter is irresponsible and does damage to faith in the electoral process. the rule of law matters in pennsylvania. it is critical for counties in both parties to respect it. do you imagine it might get resolved soon, karl? >> absolutely it will get resolved. this was a last-ditch effort by five jurisdictions, democratic jurisdictions to count ballots

in violation of state law that says you have to have a date on the ballot and so forth. specific requirements. this is one of the more extraordinary comments, the board chairman in bucks county, a democrat said in announcing a 2-one vote to count the illegal ballots said people violate laws any time they want. so for me if i violate this law it is because i want a court to pay attention. november 1st the pennsylvania supreme court said you can't count these ballots that don't have a date and don't meet the other statutory requirements of the laws of the commonwealth of pennsylvania. she had already been told by the supreme court not to count these ballots. this was a desperate last-minute attempt to say let me count the illegal ballots and, of course, the court said no and good for the governor, the democratic governor to stay the democrative board chairman in bucks and four

new regulations and new requirements. and so this is not -- it's not simply eat healthy. eat your vegetables. have the broccoli. this may have deeper consequences than that. >> dana: also there is the usda is the other place where this would matter. school lunches. michelle obama wanted to do something about this but i think this goes a little deeper when you talk about the chemicals as well. is that the domestic policy council at the white house that would handle that? >> yes, but both the department of agriculture with regard to the diet that we have and school lunch programs and the department of health and human services with its regulatory powers could have a great deal to do with setting standards for what kind of food we're allowed to eat. this should not be taken lightly. i thought it was interesting you have governor polis, a democrat from colorado, who is a very
