the georgia case isn't going anywhere. we're left with manhattan. he doesn't move to toward a resolution any time soon. so you have to look at this and wonder when we'll call it a day. >> dana: you have to also wonder if there would be a bold decision. andy, your point is well taken that this is complex, there are nuances, it is complicated and they are working through it. we appreciate you three being with us today as we waited for the news. we don't have anymore yet. we could in the next hour. >> bill: good to be with you. >> dana: harris faulkner will take you through the next hour. a lot of news on the hill and elsewhere today. >> harris: this is a critically important day. the nation just decided in a

landslide for the man on the left of your screen to take the nation forward in a new way. they wanted change. they wanted him to be able to unify the people around him. nominate the people that he thinks need to go forward. get those nominees confirmed and bring about change on many issues, the least of which an inflation-driven economy. we saw the number tick back up just on friday. and the border crisis created under the biden-harris administration. so he needs to be able to do that. a judge's decision today will reflect on how much latitude he could really have or would not have. we begin with this fox news alert. the judge juan merchan could soon rule on the fate of president-elect donald trump's new york criminal conviction. prosecutors had pushed to delay the ruling until today so they could evaluate the next steps. now that trump has been elected

to a second term. judge merchan could uphold the conviction, dismiss it or kick the can down the road. we'll get into the details because again this moment is critical. i'm harris faulkner and you are in "the faulkner focus." the decision on whether trump's guilty verdict should be tossed or kept comes after the u.s. supreme court decided to give presidents broad immunity from criminal prosecution. that wasn't that long ago. it was right before the election. trey gowdy lays out what he thinks should happen next. >> i don't think you can hold it in abeyance. you can't sentence him because then he is a convicted felon. i can't possess a firearm because i'm a convicted felon but i have the nuclear codes. that's absurd. he hasn't had an evidentiary hearing on presidential immunity. look, the prosecution said there are competing interests. not anymore. the competition is over. they lost.

so he needs to end the case. >> harris: so a jury convicted trump in may of this year on 34 felony counts of falsifying business records relating to payments to an adult film worker stormy daniels. kerri urbahn and leo terrell are with me for this moment in history. leo, i will go to you first. i'm putting it into context for people so that they understand what could possibly happen. tell us the two scenarios. >> yeah. and it's sad that he cannot make a decision today because i think he is motivated by politics. he could dismiss the case right now. he could do it right now if he wanted to. he can also say the evidence that inadd missible evidence the security ruled was inadmissible is grounds for dismissal.

that evidence was heard by the jury. no one on this planet could determine whether or not that inadmissible evidence had an impact on the jury's decision. that warrants a new trial or dismissal. why won't he make a decision? because it's politics. he has had this case for a very long time but he is holding it and he is holding it over the head of president trump. if he rules against trump okay, let the trump team pursue an appeal. they feel they'll be victorious. he is holding it and that is wrong. that is absolutely wrong and i submit to you my experience as a lawyer, he is playing politics with a case that he should not have in his custody, control or possession. >> harris: so far arguments' sake let's say the political game would be the benefit to democrats and the loss to republicans should this judge make the decision against trump. i think that's fair.

they just lost, the democrats. so the voice that matters most in the room is the people's voice. >> it is. we do know that judge merchan is a political animal and we know this because he donated to joe biden in 2020. people will say it was only $15 or $20. irrelevant. he donated at all while trump cases were percolating before him. as someone who clerked on a state appellate court it was shocking to me at the time. judges do typically do everything in their power to avoid the appearance of unfairness. this judge has not cared about that. so we know that he considers politics. now, to your point, harris, if he were to not toss this case out, he will be an outlier politically speaking. it is clear what will happen in washington, d.c. jack smith's is wounding down the dayss. in georgia the court of appeals pulled off the hearing with fani willis whether or not she can remain presiding over the case.

that indicates that case is going away. so if judge merchan doesn't take one of the off ramps that he has to get out of this case he will be out there by himself and the question that i think he needs to consider if he hasn't been is does he want to be responsible for republicans winning again in 2028? because lawfare didn't work. he told us everything we need to know about this person that he does not care even about the appearance of fairness, which is quite concerning especially when you have the former president of the united states, possible future president, you want to do everything in your power to at least maintain that appearance. typically very important to a judge having clerked for a judge for two years, it is something they think about all the time. and that was one -- one of a number of things he did that struck me as political and i don't care. which means that he is thinking

about all of these things and that's why today is a very interesting day to see what he will do. >> harris: last one on this, leo and we'll move forward to the situation in pennsylvania that has blown up. why wouldn't the judge have just come out strong and made his decision? we've been sitting in wait for some time. >> harris, i will tell you simply this. let me add one other factor. his daughter is involved in democrats politics. it is politics, you can't justify his holding this case. i will tell i right now this case will be reviewed on a federal level by the department of justice, i appellate court. trump is not going to have 34 felony counts against him and get vindicated either in the state appellate level or federal level. it will happen. it is politics, nothing else and nothing more. >> harris: makes me wonder what the judge gets out of it. democrats lost. if you play politics don't you need a win? i don't know what that would be.

let's move on. pennsylvania's supreme court. state supreme court struck down a bid by democrats to count undated or misdated mail-in votes. let me make it simple. they aren't qualified. they're disqualified votes in the senate race count. there is a recount now. will that recount prompt democratic bob casey to finally concede the race? senator casey wrote an opinion piece yesterday. he has time. he endorsed counting those ballots again just before the court's decision and republican dave mccormick edged out a win over casey by some 17,000 votes. they would have to recount and find in his favor a lot. that triggered an automatic recount, which is right now underway. they are doing it right now. republicans have expressed some of their leadership they feel confident that 17,000 cushion will be just enough. pennsylvania officials, meanwhile, admitted to allowing those disqualified ballots to be

counted. one commissioner said this exact thing last week. watch. >> mostly because i think we all know precedent by a court doesn't matter anymore in this country and people violate laws any time they want. so for me if i violate this law it is because i want a court to pay attention to it. and there is nothing more important than counting votes. >> harris: so apparently she can break the law any time she wants. if you are a cop, write that down. the "new york post" editorial board writes pennsylvania democrats show their true disdain for democracy and bob casey dave mccormick race. you saw it, disdain. pennsylvania's governor josh shapiro spoke out. any insinuation our laws could be ignored or do not matter is irresponsible and does damage to faith in our electoral process. some critics say that's nothing. those are words.

what is he going to do? >> imagine if a republican said that about never to count illegal votes? disgraceful. josh shapiro, if he really wants to be a leader, he should say -- he should make pennsylvania the blue state answer to florida. after the hanging chads in 2000. >> harris: all right. leo, what is your response to all of this? and really what does this say to the voters? >> harris, it is not in the dna of the democrats to follow the rule of law. i would love to know the lawyer who told this commissioner it's okay for you to break the law. it's okay for you to break the law. i want to know the lawyer who told her to say those words. it doesn't make any sense. i will sit here and tell you this, harris, this is another example of the democrats using the legal system. ignoring the legal system for

political gain. all about power and control and josh shapiro too little too late. again, it's all about power and control and they ignore the law when it is not to their advantage. >> harris: i wanted to have this name in front of me. diane ellis marcalia is the the commissioner. note the name. she is not famous for admitting to breaking the law to get her way in politics. when you look it up her picture should be next to it in the dictionary should anybody decide to add breaking the law to that point. but it doesn't even seem like it is problematic. >> you know who was trying to influence elections, marquee lie yeas is casey's lawyer and hillary clinton's general council in the 2016 campaign. what did they do? they fed the f.b.i., our government, false information

about a false connection between donald trump and russia. why? to generate an investigation they could tell the press donald trump was being investigated. they did that in the hopes of swinging the election in hillary clinton's favor. mark elias was at the center of that and it's the same lawyer here. >> harris: the voters know this. chirping up, fetterman. the democratic whisperer. the senator -- people get it. they get what's going on in their state. donald trump won that state and now there is a fight with 17,000 votes between two senate candidates. leo, i go back to you. >> i will tell you, harris, they don't care. you have a situation in pennsylvania where they are fighting a battle. the democrats are fighting a battle without following any rules. the voters have spoken over and

over again. trump has electoral college victory and popular vote victory. that does not deter the democrats in pennsylvania or throughout this country. they will put up a fight because his name is donald trump. >> harris: you know, thank the good lord that it wasn't close. because can you imagine what would be happening as this is a microcosm at how far at least people in pennsylvania who think they have power like this commissioner and like that lawyer for bob casey in 2016 that you gave the example of, carey, can you imagine what people might do to get their way? it was decisive. the voters of america decided. great to have you both. with this happening this hour, it's potential judge merchan could decide what happens in this case. we'll bring you both back. for now we move on. democratic national committee laid off hundreds of people in the wake of harris's loss in the 2024 election cycle. staffers gone. it's raising questions about the

>> somehow find new ways to make the recovery process more difficult for impacted communities. agencies is accountable directly to the president and so the buck stops with the president. each of these reports alone are unacceptable. combined they show a pattern of incompetence twin agency. >> it seems this particular worker believes she is being treated like the scapegoat. if that's the case more people at fema must be held accountable. >> harris: lawmakers are demanding answers from fema administrator deanne criswell on capitol hill right now. she has quite a day ahead. this is the first of two separate hearings she has to sit for in the next few hours. after accusations of political

favortism within her agency following hurricanes helene and milton. allegations surfaced that the agency directed current and former employees to, quote, ignore homes that displayed trump signs for flags or flags when providing aid. so if you saw something that was supporting the current president-elect, you skip that house no matter how much you thought they were going through. house destroyed, whatever, you would crawl right over that. it all came to light after a fired agency supervisor began speaking out. now she is not the only one criticizing her former bosses. >> how can fema tell its number one strategic plan objective is equity for everybody and then it's not applied? equity for everybody is everybody. >> it was created in 1939 to protect citizens from being

alienated based on their political stance. >> harris: somehow republicans are calling for an overhaul of funding for fema. they were slow, too. they had a lot of problems just responding in general to helene. the sites were difficult to get to but people in some areas are still suffering. they got problems in fema. the florida attorney general filed a lawsuit against fema. white house has requested $98 billion in supplemental disaster relief from congress and this would be used to help communities affected by recent disasters as well as to replenish fema's disaster relief fund which we know they did not put out equally or fairly politically. in "focus" now kellyanne conway fox news contributor. former senior counselor to president trump. kellyanne, great to see you. first of all, i have heard you say on separate occasions that this is not all that surprising

wait in line or be totally ignored based on any signage in your yard let alone your political -- first amendment right is completely outrageous. this woman said she is a scapegoat for a simple reason. she is telling us all folks, this was a policy. it wasn't my idea. i'm just following the rules, following the orders. byron donalds, congressman from you naples, florida says we need an investigation. he needs democrats helping him in this regard. i want democrats to stand up and say no more. >> harris: i had two thoughts. one, should she be given whistleblower status at this point and protected? because she is blowing the whistle and she has receipts in some cases. so to protect this woman speaking out i think is really important. the other thought i had, kellyanne, was sending lawyers on the ground inside some of these hardest-hit areas.

take everything you can for present sources with you, don't just show up with your pad and phone. and go help some folk out to navigate this. there have to be some lawsuits with validity against fema based on what we know about how they acted. >> both of those have legitimacy and validity. i would support both of those. i want to take it a step further. this was a fairness election. fairness over wokeness and inequity. the left talks about equity. that's equality of outcomes. fairness is a quality of opportunity. and so whether you don't want plumbers and pipe fitters to pay for student loans or you say when a crisis hits the dollars need to go those in need. no questions asked. trump signs in the yard or whatever. and now we've come to find out from this woman that we should be looking, i think, at all the agencies. so those lawyers who might be on

the ground i think they should ask questions about of all these departments and agencies. all the ridiculous offices created under the biden-harris administration. climate justice this, dei that and departments and agencies that have no jurisdiction over that whatsoever. the trump administration will get in there and examine them and rip them out root and branch. this stuff gets encouraged because of that. >> harris: hard to kill a government agency. we know that. that's why the government is such a beast. >> with the new offices. >> harris: elon musk may be in there with doge, government accountability. we'll see how that does. outrage after the democrat national committee laid off hundreds of people. employees raising questions about the organization's spending on the failed kamala harris campaign. according to reports, the harris campaign spent a whopping $1.5 billion in 15 weeks. oh my goodness.

$7five and consider voting for you. take report also said people should know that they created rally apparatus at a park in pittsburgh only to be told by secret service you have to tear that sucker down. it is not secure. they scrambled to do that and erect a different one all the while not connecting with the voters. you know who should have been paid? whatever staffer and consultant could have gotten kamala harris to tell us what she would do differently than biden, or would she do the same as biden. anybody able. the teleprompter operator got the biggest payoff. this is a great lesson for everyone. no way to connect with the american people. we a smart and savvy and in charge of who the presidents are, not the consultants, anchor or pollsters or donors. we the people. >> harris: american voters don't have a lot of time trying to make ends meet -- their pay got

>> harris: house committee hearing is set to focus on missing my -- migrant children today. the biden-harris admitted to losing 300,000 children released inside the united states. most of them came across our southern border, all of them illegal. they're children. they don't file for asylum. many of them don't speak the language and can't even read yet, the little ones. we know they are being trafficked and exploited inside this country as they come across the border and we're looking for them as biden leaves office. incoming trump border czar tom homan and i spoke about this in

depth. >> president trump is committed to this. he has three rails. number one we'll secure that border. at the same time we'll do a mass deportation operation. third rail is president trump is committed to finding these over 300,000 children and saving them. based on my decades of work many of the children are sex trafficked today and forced labor. we found many in forced labor and living with predators. president trump is committed to trying to locate these 300,000 children and get the them back to their families and save lives. it's difficult. children don't have a digital footprint or credit cards or drivers license. we have to find the so-called sponsors and find what the hell they did with these children. president trump is committed to finding every one of these children and save them. >> harris: jeff paul is inside the sanctuary state of california. jeff. >> we're about 2 1/2 hours away from the house subcommittee hearing on migrant children who went missing under the

biden-harris administration and expecting to hear from witnesses including a retired border patrol agent and former health and human services employee. after they entered the country migrants are processed by border agents. then turned over to child welfare workers at hhs. an agency whistleblower reportedly will testify about the deeply flawed inadequate process by which hhs ultimately places kids with sponsors throughout the country. this all stems from a report that was released earlier in the year by homeland security inspector general that confirmed the current administration had lost track of tens of thousands of unaccompanied migrant children. report detailed that out of 365,000 who were released to sponsors, tens of thousands of them haven't shown up for their hearings and many more weren't given orders to appear. former immigration judge art arthur put it into context like this. >> we're talking about a population of unaccompanied alien children that if they all

were in the same school district it would be the fifth largest school district in the united states. >> the report indicates what ends up happening to many of the kids they are exploited without a way to monitor their location or status, immigration and customs enforcement has no assurance kids are safe from trafficking and exploitation and forced labor. the new report regarding the biden administration's failures to protect kids. the takeaways include the administration weakened the sponsor vetting process and oaf en reportedly obstructed congressional and state investigations into exploitation and trafficking. it accused the office of refugee resettlement of relying too heavily on third party contractors. >> harris: on the second point. why would you stop the law that's trying to help these children be found, unearth them? it is so confounding. jeff paul, great reporting. thank you. >> an day one i will launch the

some democrat governors and mayors are pushing back. boston's mayor is the latest. >> elections have consequences and the federal government is responsible for a certain set of actions and no individual city can reverse or override some parts of that. but what we can do is make sure that we are doing our part to protect our residents in every possible way that we are not cooperating with those efforts that actually threaten the safety of everyone by causing widespread fear and having large scale economic impact. >> harris: the mayor of newport beach, california criticizing newsom with his sanctuary policies after dealing with a boat load of immigrants off the coast of his town. the third boat load so far this year. mayor will o'neill of newport beach, california. thank you for being in focus. first of all, describe the

problem that the illegals have caused in newport beach. >> well, we just last week had the u.s. coast guard intercept a boat that had 21 folks coming in from the southern border, 18 there mexico, two from use and one from russia. they brought them in and handed them off to customs and border patrol. our local law enforcement the ones to catch them they wouldn't be allowed to do anything because they are handcuffed by california policy sb54 creates a sanctuary state policy. >> harris: so how complicating is this for you? you've taken a different stance. why? >> because one of the problems we have here in california is when they use the word sanctuary state it is a cute phrase they are trying toy voc piece. illegal immigration means we don't know who is coming in and what they're doing. it is not just illegal it's

dangerous. it is destructive. voters in california have shown their disgust with feeling unsafe. one of the worst thing newsom plays in california is redefining phrases. when he uses the sanctuary state phrase he also loves to use the word victim and perhaps his worst trick is redefining the word victim to mean the people committing the crime not the people who are affected by it. >> harris: and when you bring those -- the number i'm sure people say 21 people. the problem is it only takes one or two and we know that among t thousands who are here illegally 13,000 are convicted murderers. it is important. there may be 21 to 50 or whatever it in on a boat but you have no way to vet these people. >> no way to vet them and people have forgotten even nancy pelosi's husband paul pelosi was attacked by someone in the country illegally. the district attorney up in san francisco came out and said we'll protect that person from

talking to the federal government on immigration. this policy is insane. when you have uzbekistan national coming in on a boat and we're not vetting them on purpose. that's crazy. you ran the quote from mayor wu in boston. we've seen her on the news plenty of times. her knee jerk -- she has forgotten what it means to be a mayors. the mayors of san francisco and oakland were just recently booted out of office because they forgot what it means to be mayor. one of my favorite things about being mayor is talking to my neighbors to make sure we put policies in place that improve their lives and making their lives safer. in california they're doing the exact opposite. in sacramento, in fact in newsom's most rent purchase for his home no county they're getting altitude sickness from the ivory tower they are sitting in. we have to bring this back down

and have grounded, good sense public policy in our cities. california sanctuary state policy is the exact opposite of that. >> harris: we have to be quick. do you think democrats are listening to you in the party? >> i think they need to listen to the voters. they just got overwhelmingly defeated here in california on public policy issues with gascon going down and prop 36. they have got to listen to voters if they won't listen to their mayors. >> harris: mayor o'neill. you had a lot of rich detail. i really appreciate it. president biden's term is nearly over but that is not stopping him from making major foreign policy moves. really? trump's nominee for ambassador to israel mike huckabee is calling biden out. >> it's a little unusual that a president in his lame duck days of ending his reign as president would make major policy shifts.
