washington and this is america's late news, "fox news @ night". breaking tonight, an irony so thick you could cut it with a knife. new york d.a. alvin bragg refusing to drop the case against president trump today, instead suggesting that his state delay trump's sentencing for, wait for it, four years, until after his term. in 2029. meantime just yesterday that very same justice system in new york allowed a mentally ill homeless man with eight prior arrests to roam free and allegedly stabbed to death three innocent people. it seems clear where new york's priorities are. more on this in just a moment. meantime in los angeles, that city preparing for a trump immigration standoff. city council voted unanimously to adopt a sanctuary ordinance barring any city resources from assisting federal immigration enforcement. in fact the la public school district there declaring it's schools are immigration sanctuaries. that story is coming up.

egos, but i think there's an undeniable friendship. what say you about this budding relationship and/or possible rift going forward? >> no, there's no rift between elon musk and donald trump. donald trump is glad to have his support. one of the most brilliant and consequential entrepreneurs of our time. we know that he spent over $200 million for donald trump's campaign and he has a packed that will continue to do work outside of this presidential election for 2024. they are looking at the midterms. not only that, he's going to offer services for free for the federal government and bring in brilliant people from across the country. this is a good thing in the left is trying to divide, as they normally do. >> kevin: as they usually do, siaka. that i like best about it, when you talk about trying to make it more efficient, more effective, this is right up elon musk sally.

i can't imagine that this could go south and yet there are those who are trying to suggest or throw that out there. what say you? >> trump being there today to be with elon musk is just an example of a forward-looking leader that we needed. if you look at most of his pi picks, from j.d. vance as vice president to matt gaetz as doj to, you know, peter hegseth, we are seeing the fact that he's bringing in a new generation of leadership and this is what the left lied to us and tried to say they were doing, he's actually doing it, he's uplifting and upholding our geniuses to remind the american people, look, in two years we will be celebrating 250 years of this country's greatness. while one side wants to see our hurdles and our missteps as to finding us, i think trump and administration he's putting together is showing that no, we are greater because of those, because we've gotten through, and this american experiment is far from over. >> kevin: this will be a great

specifics. >> kevin: appreciate you spending time tonight, we will see you a bit later, mark meredith in washington. let's take a deeper dive into the biggest legal question of the day with judicial watch president tom fitton. listen, i'm frustrated prefer the people there. it's an outrage that people would be skipped just because they had a sign supporting one candidate or another. i can't believe that is actually happening. they have to answer questions for this. this is an outrage. let me share this from "the washington times", an op op-ed. it says this, families that should have received critical resources are still waiting for help. for those affected, this is not about politics but survival. the idea that aid was withheld because a political affiliation is a slap in the face to every american who believes in fairness and equality under the law. what say you?

>> for years the biden administration and even before then have equated trump support with terrorism. the media has been pushing it and you see it with the fbi, you see it with military training, and so it's no surprise that a major government agency like fema would incorporate that into it's decisions on who to give aid to. they had this narrative, oh, it's dangerous for trump supporters to question fema so therefore it let's not have fema provide any aid and comfort to alleged trump supporters in their time of dire need. these are emergency life or death situations. it's clear based on the woman who was initially fired, the new whistle-blower coming forward, and of course it makes sense that there was this agencywide directive or understanding that trump supporters are violent so therefore it let's not even offer them aid. >> kevin: i'm still stunned

because at the end of the day you have a responsibility to all americans. they are taxpayers too whether you like who they voted for or not. i don't think this is the end of the story. alvin bragg wants to make -- he wants to make president trump wait for years before he decides whether or not to go through with the end of this particular case or sentencing. let me share one of your great colleagues thoughts and your reaction on the other side. >> you cannot have a local district attorney treat a sitting president like a freak on a leash where he just is able to say that i will finish this work once you are out of office. it elevates the district attorney to a grotesque level. >> kevin: a grotesque level, and my concern is and has been for quite some time, and we've talked about this off-camera, turnabout becomes fair play. i don't want to see some d.a. in texas for example saying about the border well i think we will

run in another former president. i think this is a bridge too far and yet this is where we are. you think this goes forward? >> i hope not. i hope at least the federal courts intervene here. bragg is ignoring the immunity issue. the big issue is whether this case should exist at all given the supreme court immunity ruling. the idea that bragg and the judge would hold over a sitting president's head the possibility of going to jail would obviously impair the presidency. it's designed to intimidate and harass him while he's president. so the fact that alvin bragg is still playing this game shows, and he's a politically connected guy, shows the democrats are still committed to law fair to harass president trump. right now for instant jack smith is visibly typing away, misusing taxpayer resources, to put out a smear report on trump. everything should stop, everything in terms of the law
