scavino is back. he has been picked to be trump's deputy chief of staff. good choice. according to reports. vice president elect vance has also confirmed that trump is interviewing candidates to replace chris wray at the fbi. now, wray had an opportunity after comey. i spoke about it often to restore the reputation the former greatness, the integrity to the fbi, which continued to operate in a very hyper partizan manner under his watch. so chris wray's time as fbi director is now running short. in fact, far left, politically motivated bureaucrats from all across the federal government. they should know that their reign of oppression on the american people is about to end. the witch hunts will end, the leaking will end, the abuse of power. the corruption will end the so-called resistance within our government against we, the people will be over. donald trump has nominated a team of disruptors like he said he would. they are hell bent on

and willing to use another tool at his disposal. it is not the ideal way to do it, but if he has to, he will, like other presidents, have. it's called recess appointments and like everything else that donald trump does, this will send the left the state run legacy media mob into a fit of hysteria. here's some facts. let's look at reuters as the source, shall we? the u.s. constitution says that a president can make recess appointments to fill vacant positions when the senate is not in session. the supreme court ruled that a president can make those appointments once the senate has been adjourned for at least ten days. the first ever recess appointment. well, that was made by the first president himself, george washington, during the very first congressional recess in 1790. more recently, ronald reagan made 240 recess appointments. president george h.w. bush made 77 recess appointments, including his secretary of state, bill clinton. clinton

made 139 recess appointments. george w bush 171. barack obama 32. so this thanksgiving, if you're sitting with your liberal relatives and they're not throwing turkey legs or mashed potatoes at you, and they are freaking out, you can present them with these simple, basic, fundamental facts and truth. presidents from both parties have made hundreds of recess appointments. it will not be unusual. it will not be unlawful for donald trump to do the same. so tonight, we can all feel very good about donald trump's incoming cabinet. they are about to clean house in the washington swamp. there is little that anyone on the radical extreme left can do about it. and of course, that won't stop them from screaming, yelling and crying and trying. but their manufactured hysteria didn't work during the election. it's not going to work now. it's sort of like it all comes together. it's just one big nine year period of, you know, breathless trump.

ratings bonanza every time he did it. that's how americans are consuming their news these days. so we will certainly look at options on how to respect the tradition of the white house, while also ensuring that press briefing room reflects the media habits of the american people today. and just like we did on the campaign trail, president trump is serving the american people, and we want to make sure we are getting his message out as effectively as possible to the american people. he is serving the. under trump's first term, the role of press secretary. i think, changed somewhat dramatically inasmuch as nobody speaks to the press about donald trump better than donald trump. so it's a tough position that you're being put in. have you given thought as to whether or not there will be daily white house briefings or occasional white house briefings, or on an as needed basis? have you thought about that at all? that's certainly something i'll discuss with president trump. ultimately, he is the decision maker. as you know, that was the way in his

first white house. it was the way on our campaign. and i will defer to him. but like i said as well, in his first term, he was the most transparent president in history. he often brought the press into the oval office when he was signing bills. he did rose garden press conferences. in fact, during the covid pandemic, president trump briefed the press in the james s brady briefing room 72 days in a row. i know a lot of the fake news reporters will tell you behind the scenes, sean, they missed that transparency and that access to the leader of the free world. and i know president trump will provide that to them again. okay. so are there going to be rules in your press when you deal with the press? in other words, you're dealing with somebody that's rude. that's interruptive that wants to ask five questions, not one question. are you going to set up rules? well, we hope there will be decorum, certainly. and we will try to instill that. but we're not we're not shy of the hostile media. we've dealt with that now in the campaign for the last year. nobody does it better than president trump.

friend. after nine years, we are here on the heels of a landslide. like the world has never seen before. prepared under president trump's leadership to implement historical, transformative, long awaited change to make this government accountable to the people of this country. once again, it will be, as donald trump said, a new golden age for america. i want to go through how dramatic this is going to be because what what i hear the president is proposing and look at elon musk and vivek ramaswamy, and they're setting up this new department and they're going to get rid of waste, fraud and abuse. and they're going to cut they pledged to cut by by july 4th, 2026, $2 trillion in federal spending. that is a monumental task and there are ways to do it. i think one way to do it would be to increase revenues. that would be through energy dominance. that's a separate topic, but this is transformative. what the president is talking about. he

for the first time, we've heard conservatives for years talk about limited government cutting waste, fraud and abuse. and now somebody for the first time in my adult life, if you will, to catch a phrase i'm believing it's going to happen. how real is that? that they're going to cut to that extent? well, the president has put together the dream team and you just mentioned two members of the dream team. so you have the department of government efficiency that from the outside is going to direct and organize this extraordinary effort to remove all of the waste and the corruption from the federal government. so they will do that in concert and in league with the white house, president trump, the office of management and budget. here's the shocking truth, sean. the departments do not have any clue where the dollars are going. how many audits has the pentagon failed? who has any idea how much waste and abuse there is in the trillions of dollars spent by this federal

government? who has any idea how many hundreds of billions of dollars every year are stolen? stolen from taxpayers by fraud rings, scammers, foreign operatives. this government is not watching how your dollars are being spent. and president trump has commissioned ellen and vivek and many others across the government to get to the bottom of this. so the money that you earn as an american citizen will be jealously treasured and guarded and not waste any longer. and we are going to go into these agencies and find everybody who is not performing on behalf of the american public. and we're going to say, if you're not providing that service, if you're not serving the public, then you can go. the border has been a big issue. how quickly, in your estimation, can that border get secure? number one, and we have known terrorists in the country. we have people that have murdered americans. we have the lake and riley trial, trial going on right now. dozens of dead americans murdered by harris, biden,

unvetted illegals. we have dozens of americans raped, hundreds and hundreds of victims of violent crime. we have gang members. we have cartel members in this country. how quickly do we secure the border? how quickly do we deport those that are criminal aliens in the country? it's going to be at light speed, sean, the moment that president trump puts his hand on that bible and takes the oath of office, as he has said, the occupation ends. liberation day begins. he will immediately sign executive orders, sealing the border shut, beginning the largest deportation operation in american history, finding the criminal gangs, rapists, drug dealers and monsters that have murdered our citizens and sending them home. no one will be allowed to enter the country illegally and ice will be empowered in partnership with fbi, dea, atf, the national guard to fully seal and secure the border with cbp and to find and identify the criminal threats that are inside this country and send them back

home. we saw that heartbreaking testimony. sean laken riley, that precious, beautiful young woman, fought for her life against an illegal alien imported by biden-harris for 18 harrowing minutes. she fought for her life, and we are going to honor that extraordinary woman, and we're going to honor every victim who has suffered under president trump's leadership. we are going to honor that suffering by unleashing a righteous wave of justice and sending these criminal migrants back home. how do we ensure that the weaponization of the department of justice never happens in this country again? and that means it shouldn't happen to republicans. it shouldn't happen to democrats. how do we get rid of political operatives that have deviated from their original mission, that are inside important groups like the fbi or our intelligence community? how do we find those actors that are loyal to clapper and brennan and comey?

the deep state operatives, as we call them? well, dismantling the deep state and restoring democracy is going to be another urgent day one mission. look, the department of justice and the intelligence community has undermined and sabotaged our democracy. they've tried to stop donald trump through third state despotic means. president trump winning this election is also one a mandate to fundamentally reform the department of justice. the fbi and the entire intelligence community. tulsi gabbard at the directorate of national intelligence will lead the effort to find those bad actors and to ensure that the intelligence collection process across all 18 intelligence agencies is done only to protect americans, not to persecute them. at the same time, matt gates at the department of justice will reform doj to turn it again into the world's premier crime fighting organization, not an

arm of the democrat party. and we will find an fbi director who is going to likewise lead an effort to get the fbi back to basics, find criminals, find cartels, find gangs, find terrorists, and put them in jail or send them home. but do not use the awesome powers of the fbi to try to rig our democracy. as has happened in recent years. this is why president trump is indeed the greatest champion of democracy in modern american history, because he weathered the attacks, he withstood the assaults, and now he stands here on the verge of taking the oath of office, prepared to make these agencies make these departments once more answerable and loyal to the citizens of this country and to no other interest but them. if there are some cabinet appointments that become troublesome, will the president use the recess appointment process? yes. the president has

york city, a homeless man reportedly went on a rampage all across manhattan. now the fatal. he was fatally stabbing three innocent people that he reportedly targeted because they were alone and distracted. the suspected killer walked some three miles during this killing spree and evaded capture for a couple of hours, and the only reason he was on the street in the first place. no shock. new york's no bail, no jail laws. he had been charged with petty larceny just a month prior to the killings, but was set free right away. amazing. and even with killers on the loose like this and the streets of new york, well, guess what? new yorkers they are helpless. now, consider the case of marine veteran daniel penny, currently standing trial on manslaughter charges. facing 19 years in jail because he was subduing another crazed homeless man who was threatening to murder people in

a subway car and saying he has no problem killing them or himself. now, the manhattan da's office announced today that they do not want the jury to hear a thing about the homeless man's drug use or mental health issues. and that's not all. the da's office also told judge juan merchan, remember him today that it doesn't want the falsifying business records charges against donald trump dropped, although they'll consider it for a december 9th filing. instead, the da said he'd be perfectly fine delaying sentencing as long as necessary, even if that means january 2029, when donald trump leaves office. it is insane. here with reaction, fox news legal analyst gregg jarrett, former harvard law professor alan dershowitz. let's go to the trump issue first. professor, we know the supreme court has ruled on the issue of presidential immunity. we know in this case that evidence was

presented to that jury. hope hicks, for example, testimony given in that case directly tying donald trump to the time he was in office, that case, on every measure should be thrown out. a novel legal case, statute of limitations long gone for legal nda that was labeled an nda and put together by a lawyer for the president. well, this is a slam dunk for appeal, which is exactly why brag doesn't want it to go to appeal. he wants to campaign for office next year with the scalp of donald trump saying, i have him. i have him convicted by a jury. he wants to make sure when he serves as president, he's always referred to by cnn as a president who is convicted by a jury. this is an attempt to circumvent the appellate process. it's illegal, it's unethical. it's unconstitutional, it's immoral. and my advice to the trump lawyers is if marchand says he's going to put this

sentencing off for four years, immediately file a writ of mandamus to the appellate courts. it's a very, very appropriate writ, because the writ of mandamus is designed to get review when you can't get an appeal and here, by denying him the right to be sentenced right now, they're denying him the right to appeal. because under new york law, you can't appeal until you have a final judgment. and a final judgment means a sentence. so this is an attempt to circumvent the law. it's an attempt to put bragg above the law. and i think the courts will hold him responsible and will do the right thing and reverse this conviction on appeal. do you agree with that? gregg jarrett? or maybe just let the judge sentence donald trump, then go through the appeals process while he is president? sure. well, we just don't know what he's going to do. but i do agree that delaying the trump case for four years is ludicrous. it's an insult to justice, and it violates state

law by the way, that requires sentencing within 12 months from conviction. the dilemma for trump's lawyers is that they cannot appeal all of marshawn's chronic, reversible errors at trial until there is, as the professor points out, an adjudication. well, that happens at sentencing. they can, however, immediately appeal if merchan denies the motion to dismiss on the immunity claim. if the judge refuses to rule and that's what he's doing right now, they should seek a writ of mandamus from a higher court, force him to do his job for goodness sakes. but also, the defense still has pending a petition to remove the case to federal court where it belongs. because this was always an incoherent prosecution, it should never have been brought. bragg manipulated the law, transforming misdemeanors into phantom felonies. he claimed it influenced the election. well, guess what? the transactions happened after the election. and it's not a crime to conceal a perfectly legal nondisclosure

agreement. people do it every day. so in the end, the conviction will never stand up. mershone and bragg know it. that's why they want to delay the inevitable. all right. i'll stay with you. greg. on the issue of daniel penny, all these people on a subway train, they all have. many have testified that they felt their life was in jeopardy. he was a good samaritan. he put his life on the line. everybody was calling for police. other people felt their life was in danger. why did the d.a. put this guy? the law is very clear that if you feel your life is in jeopardy, you have the right to defend yourself. he was defending not only his life, but the life of everybody in that subway car. why is this trial even taking place right? it should never have occurred. and the court right now is considering whether to allow a forensic psychiatrist to explain to the jury how neely's menacing death threats towards subway riders, likely drove his extreme drug abuse and severe

psychiatric issues. they fed on each other. and while passengers, including penny, didn't know it at the time, that doesn't matter. it would offer proper context of the extreme danger that neely posed at the very moment the defendant intervened to save people's lives. they feared they were going to die. neely's drugged up propensity for violence, that is highly relevant in a case of self-defense and defense of others. but of course, bragg and his prosecutors want to hide the truth and conceal the evidence from the jury. what's your take, professor? yeah, well, there are two trials going on here. the prosecution wants the trial to be what penny did the defense wants the trial to be. what neely did. and the jury will have to consider both. and the jury will have to ask themselves. the question is, what neely did threatening and posing this kind of great danger, which we now saw manifested in new york, by the way, around the corner
