used to have another border wall built on that land by the state of texas. but using this land for deportation purposes is just part of a multitude of strategies we're involved in. one is as we speak right now more orange buoys put into the river to deny illegal entry. second thing we're working to make sure we go after the criminals that they were talking about. i declared tren de aragua as a foreign terrorist organization so that we would be able to muster every single law enforcement tool in the state of texas to go after them and arrest them. we made hundreds of arrests of tren de aragua which is working to expand across the country. we're making it clear tren de aragua made a mistake when they tried to put a foothold in texas. >> martha: katie hobs, these states are pushing back. the biden administration is already trying to stop what you are doing with the buoys.

angry about this. these office holders will have to be responding to that anger. >> martha: i want to ask about the bills with regard to china and more clarity on these deportation centers that they will be built on this property? is that the understanding? >> all of that will be up to the trump administration and where they want to use or what strategy. the reality is a lot of the people being deported will be deported from new york, from california. flown out on planes going elsewhere. so we just want to make sure that the trump administration understands we are here to help whether it be to deny illegal entry, whether it be to arrest those here illegally, whether it be to assist in the deportation process. >> martha: let's talk about what you are doing aimed at the chinese communist party in texas to make sure they don't have a foothold. in a lot of places they already do. >> right.

many americans are unaware that china specifically targets states in the united states to undermine what's going on in the united states of america. they have been in texas going after chinese dissidents who left china and they are legally in the state of texas now and they have these local police stations set up run by chinese going after the chinese in the state of texas. >> martha: there are chinese police stations set up in texas. >> in houston. >> martha: how do they get away with it? we don't allow other law enforcements from other countries in our texas. >> they think they have a law enforcement effort for the chinese who are in houston, texas. that's being shut down. so once we learned about it, working with the federal government, f.b.i., people like that we were able to identify it and work to shut it down. we have the chinese going after people. the chinese going after

cities. >> they are violent toward law enforcement. they will fight and they will attack police. they have no respect for law enforcement and that's an understanding as well. we want to make sure our partners throughout the state and policing know that. they are prepared for those encounters. >> this gang got its start about ten years ago in venezuela. they began by extorting businesses and then they began to prey on migrants trafficking women and young girls as well. they are notorious for having no boundaries when it comes to violence. burying people alive and seen the effects of this violence in neighboring countries like columbia and peru. 5,000 members. not clear how many are in the u.s. the group did start to get a lot of attention after some security video went viral at the end of the summer showing members of the gang inside an apartment complex in aurora, colorado. the trump administration is

pushed a delay of sentencing until trump leaves office. judge merchan hasn't indicated when he will issue a final decision on the case. ashley is the lawyer for trump's co-defendant in the georgia case and joins us now. ashley, great to see you. it has been a minute. what do you thick judge merchan. will he hold everything in abeyance until 2029? >> i think he is hoping and praying that the prosecution does the right thing and i think he has given them extra time to hope they do the right thing. you have to understand that prosecutorial discretion is the basis of our entire criminal legal system. without a prosecutor willing to exercise that discretion for the greater good the whole system fails. i think the judge is hoping to do the right thing. a president on bond for four

years? will it be pending for five years? is that really what the public wants and for the greater good? this case needs to go away. >> john: i don't know about that. andy mccarthy was talking about this yesterday. clearly in bragg's interest to keep this thing going because he is up for re-election next year in a city that voted 80% for kamala harris? does he want to dismiss the whole thing or is a no, we'll fight this tooth and nail and i don't care if it takes five years, we're going to bring him to justice? new york politics it may not be in the interest of the nation but it is in the interest of alvin bragg. that seems to be his top priority. >> that's the problem. whose interest is it in? really in the interest of the new york people? it is interesting there is no victim here. that's really important because

prosecutors normally have to answer to a victim. there is no one that actually called and reported a crime. there is no mother that lost their child or no person that their money was stolen. nothing like that happened. so he could save face. he could do this politically and still save his office and do the right thing. still facing re-election but it is unfortunate to see him and making a decision based on his own political well-being, not the greater good of the people that he represents. what we need is a strong leader, someone who is actually willing to dismiss this. >> john: even though there are a few legal lemons. trump transition is making lemonade out of this. this is a total definitive victory for president trump and the american people who elected him in a landslide. manhattan d.c. conceded the witch hunt cannot continue. lawless case is stayed and president trump's legal team is moving to get it dismissed once and for all. obviously they are hoping that judge merchan will see the light

here. when you consider how partisan merchan has been when it comes to trump, the fact that his daughter was a heavy democratic fundraiser, raised tens of millions of dollars according to people i talked to for democratic candidates even though he is an appointed judge and not elected like bragg it would be in his personal interest to keep this thing going as well. >> right. i think that's the problem. we see two people who both can put a stop to this but their own personal political interest to keep it going. judge merchan has the ability to do the right thing and can stop it and sit as the 13th juror and say for whatever reason he wants this needs to end. i am dismissing this. i have the power to do this. let's move forward. hopefully for unity for our country, hopefully that's the decision he makes. i hope the politics and partisanship doesn't play into that decision. when you are talking about criminal legal system it shouldn't.

john we're keeping an eye on vice president elect jd vance campaigns for trump's cabinet picks. they're meeting with republican senators critical to securing the nominations. chad pergram is live at the capitol. >> jd vance arrived today with secretary of state nominee mark row rubio and matt gaetz. he will shepherd them to meetings with senators as the house ethics committee meets about its probe of gaetz. >> if there is an ethics report out there or that has been completed, then i think the senate will want to see it. it may very well speed up the vetting process. on the other hand, if it is not available and we have to recreate it ourselves it would delay our ability to make a decision on a very critical nominee. >> the ethics committee

happen here and if the ethics committee does release that report, what the impact might be? >> so that's what the hearings are for and what the preliminary meetings are for. democrats are welcome to meet with the nominees as well. i totally encourage that. sounds like our senator from new jersey has other ideas. good to see him again. it has been a while. this is what the meetings, the private meetings and hearings are for. remember, the nominees will be under oath. people asking the questions never are, martha. we'll have to have a truthful, transparent hearing process for each of the nominees and then the folks will decide. i think that presidents right, left and center are giving a great deal of grace and latitude in forming their government especially after the country has spoken to decisively. the shared demographic breadth of victory means trump has a mandate and wants to find people who will fulfill that mandate.

the other thing i just want to say is that i look at some of the cabinet secretaries we have now. they are still on the job and still paying them in their positions. we have a department of homeland security secretary who has lied to us for four years. he said in 2021 the border secure and it is closed. since then 10 million people have come here. that's a number larger than the population of 39 states. we have a guy at health and human services who has no real health background. we have a guy bernstein not an economist. a music or sociology degree. that's fine. are we concerned that these people aren't up for the jobs they currently have and yet they got confirmed? some overwhelmingly. the last one i want to talk about is blinken. our secretary of state. i turned up the volume when he had his confirmation hearing four years ago, martha and talked about his stepfather being a holocaust survivor.

i have since met with some australians who helped his stepfather's family at that time and guess what? he is the first one to call for a cease-fire after october 7th. i think president trump will stick with these nominees. we'll see what happens. and i'm not surprised that the democrats who can't get over the election results will try to resist every single nominee. i can't think of a -- >> martha: they won't resist every single nominee. matt gaetz is the most controversial what we're hearing on the hill and may be senators prepared to perhaps vote against him and we haven't seen this house ethics committee. i think it is important to point out the d.o.j. did not press charges in the issues that were brought before them. i want to get a quick thought on recess appointments. an interesting piece in the national review today by john yu

saying president trump could throw congress into adjournment and push through a recess appointment of his picks. then the senate would be likely to do the same thing and gavel it back in. do you think that all of that, if it goes to that level, is a good move for the incoming president to go through? >> let's be clear, martha. that presidents for many years have used recess appointments. i remember first becoming mostly familiar with it during president george w. bush. >> martha: for not the attorney general or top cabinet spot. >> appointments. these judges are lifetime appointments. they don't leave when the president does. >> martha: i looked into this. it is true obama did 171 recess appoint also, bush did 70 some. not any that were at the cabinet level. so it's a question of whether or
