everyone. i'm judge jeanine pirro along with jessica tarlov, jesse watters, sandra smith, and greg gutfeld. it's 5:00 in new york city, and this is "the five." ♪ ♪ sanctuary city leaders are gearing up to resist trump's mass deportation force as justice finally comes for the illegal immigrant monster who brutally murdered nursing student laken riley. a judge in georgia taking less than 20 minutes to find jose ibarra guilty of murder, sentencing the venezuelan national, who should have never been in this country in the first place, to the maximum of life in prison without parole. ibarra sat emotionless in court as he listened to the heartbreaking victim impact statements from laken's friends and family. >> if you have the ability to bring her back out of all of this, i would give up every earthly position i have to see

deported. >> jesse: first of all, i want to say i am so sorry to the family. it is just such a tragedy, and it never should have happened. and that is what bill clinton said. bibill clinton said if kamala hd done her job vetting these people, laken would still be alive -- and it is pronounced laken, joe biden. if you say you are going to oppose federal action, this is what's going to happen, whether the atf, dea, fbi, any federal law enforcement agency, when they go in with a fugitive task force to go grab people, there is nothing the locals can do. let's just say they decide to call the local chief because the chief is not cooperating to deconflict, all right, fine, you don't want to tip them off, they are coming in, and they are coming and heavy, and they are going to do a really good job, and because they have to go in so heavy because they are not getting cooperation, they are going to probably interview more people than they were targeting, and if you don't want to give us a call from the jail to let us know who you have so we can pick them up, they'll post up right

outside of the local jail and interview anybody that comes out of there. that's what's going to do. they are actually inviting more federal presence by not cooperating. that means more migrants, not just criminals, anybody here illegally, is going to be removed. now if i was a migrant judge and i saw that trump won, i packed my bags and get on the first flight to nicaragua because here's the other option: 6:00 a.m., i.c.e. knocks on your door, puts you in a van. you haven't brushed your teeth. you haven't packed. may be your wife had already left for work. where is she now? so they are going to put you in a van to, take you to a military base where there will be hundreds of other migrants who are going to be very happy and they are probably going to have you there for 3-4 weeks until they put you on a flight and send you back to nicaragua, and then you have to do the walk of shame. if you go back on your own terms and you arrived at the village, you can say, you know what, boston wasn't for me, didn't like the food, let me regale you

this is articulate the distinction between people like jose ibarra and other people who have committed crimes here, who must go, and the mandate from the election -- i mean, massachusetts move 6-7 points to the right. i mean, people were voting for elizabeth warren were voting for donald trump, and part of that definitely was the overcrowding of our big cities because of the migrant crisis, and everyone does know -- everyone who is here is not someone who is guilty of a crime or would even commit a crime, majority of good people, that there are some who slip through the cracks. so i would just say we are a sanctuary city. it is important to us that those who live here and contribute feel safe in their homes, but we want to do everything possible to make sure that the bad people who do not belong here and who abuse our system go, and i look forward to working with the federal government in doing that in an orderly fashion. >> judge jeanine: so you think this resistance is a bad idea, especially when it comes to the 1.4 million, to the 13,000 convicted murderers and the

sexual assault, those who are guilty? >> jessica: i don't think anyone things that isn't a good idea -- >> judge jeanine: yeah, they do. >> jessica: no, they don't -- >> judge jeanine: excuses causing fear, who gives a damn about fear if americans are in danger? >> jessica: like a lead with, i think she should have been clear in what she was articulating which is i don't want to create fear amongst people who are here, they may be undocumented but leading good and just lives, not committing crimes and criminals, i don't know any democrat that says these criminals should remain here. >> judge jeanine: sandra, then why wouldn't they come out and say, as opposed to saying, i will not let my police department of information to i.c.e., why wouldn't these alleged good democrats, who care about americans, say we will cooperate if and give information if it involves a convicted felon, a sex offender, or someone who has already had a final order of deportation? they could say that easily. >> sandra: i just heard you say slip through the cracks,

jessica. assuming there is a wall -- there is no slipping through cracks. there are many of these people who are here. paul mauro joined me directly following his sentencing today, and he said, after walking that same jogging trail where she was brutally murdered by this monster and in this heinous, heinous act, he said, paul maur, there are more of them. and they target women. and you look at him sitting in that courtroom today, as we did for a solid hour during our show this afternoon, he showed zero emotion, and it tells you a lot about this man, and the reason why they are able to carry out these horrific murders. because they don't value human life. he doesn't value his own, as he is sentenced to life in prison without parole, and he certainly did not respect life in the form of laken riley. that mother in that courtroom today was burying her head in her hands. she was inconsolable, as our producer in that courtroom was detailing. this could have been settled

down in georgia, right? but he presumed his innocence all the way through, took this through trial. the victims that spoke out in that courtroom, it was chilling. her sorority sisters. her roommates. her friends. her sister, who is now an only child. it was heart-wrenching to watch this. and so, jessica, what we saw in this election, people saw cases like this rise to the forefront and they said this cannot happen where we live. this girl, this nursing student went out for a run one day, and wound up dead, and that story ended up in living rooms all over this country, and people said that's enough. >> judge jeanine: you know, greg, two things. there is an intel memo in the intelligence memo that says that as more venezuelans continue to populate the united states, there is an even greater chance that tda becomes increasingly -- increases its number. why are we not vetting these

people? >> greg: i don't think we have to. we have the solution. we know. we send them to mayor michelle wu's house. if she is vowing not to cooperate with deporting illegal aliens, well, now we know where to send them. we send them not to their cities, but to their homes. and every time that criminal leaves the city block, you put them back on. i will pay for the bus tickets. i'm happy to do that. if we wants to be a hero under her fake virtue signaling, then she should absorb both the risk and the responsibility for the public stance that she is taking. this is a moment in time where you wish there was a death penalty, but perhaps there will be an inmate in that facility who will step in to fill that hole and take care of business. you know. wu and others should consider themselves lucky that ibarra wasn't sent to boston, where she could have been nearly. >> greg: sixed and murdered. it's amazing a woman can take that kind of stance in a

situation where another woman is murdered. it could have been michelle wu, does she have a daughter, i don't know, i didn't do that research, i don't care. but if you want totalitarianism, talk about putting ideology this for the needs of citizens. it's not like these politicians didn't know that the migrant crisis was causing a depletion of resources from the citizens putting their lives at risk. they know that. they also realized these are the eggs they are willing to break to preserve and allegiance to their ideology. this is not unauthentic virtue signaling, oh, we feel this compassion. they are basically doing this, for some reason, maybe it's because they think they cannot be aligned with the other side, but the dems need to define what mass deportation is. what's your number? what number are you comfortable with? because if you can't give a number, we are going to do it. we are going to shut off the border, we are going to remove the criminals, followed by the illegals who just got in, and

♪ ♪ >> sandra: a victory for nancy mace after she introduced a bill to keep transgender women out of the ladies bathroom on capitol hill. >> mike johnson announcing that facilities in the capitol and house office buildings are reserved for individuals of their biological sex. it's in response to the controversy over sarah mcbride, the incoming first transgender woman member of congress. take pride promises to follow johnson's rules and use the men's bathroom. now mace is going a step further, introducing another bill to expand the bathroom man to all federal properties and here is her reason why. >> i'm not going to stand for a man, you know, someone with a penis in the women's locker room is not okay and i'm a victim of

abuse myself, i am a rape survivor, i have ptsd from the abuse i suffered at the hands of a man, and i know how vulnerable women and girls are in private spaces, so i'm absolutely 100% going to stand in the way of any man who wants to be in a woman's restroom, in our locker rooms, in our changing rooms. >> sandra: and while that battle takes place, the democratic party is still fighting over how to talk about transgender athletes in women's sports, and issue many in the party believe cost them the election. but some don't see what the big deal really is. >> there are vanishingly few trans girls competing in high schools anywhere, even if there were more, trans kids like all kids vary in applicability and there's no evidence they pose any threat to safety or fairness. it is very weird for you to be so focused on the subject. >> there are just incredibly few examples of transgender girls playing in these sports. and when we see those examples, there isn't evidence that these kids are a threat to safety or fairness. >> sandra: okay, greg, you

seem hot on this. >> jessica: is interesting watching oliver and jen psaki because you get a clean of how e media works. they have all followed the same torture justifications. it's not really happening. but it is, and why should you care if it is? okay, it's happening, it is good thing, but you are worse because you care about it. it's a perfect illustration of the echo system. oliver got his points from an activist blog, and then psaki, just listen, she almost did it literally what oliver did, came out two days later, didn't do any research, didn't do any thinking about it. no steel manning, no consideration, or real empathy. it is about the members of the member, that's what i say. oliver has a british accent. which fools the mid wits at hbo into thinking he is thoughtful but he misses the clearest, obvious to points that americans get: and there is a system based on self reporting, it is

impossible to prevent the corruption of the system, hence the infiltration of men in women's safe spaces. unhealthy, somehow mentally unstable men, and they claim it only affects a small percentage of trans. than why are we forced to change entire systems if it's a small percentage, including title ix, buildings and bathrooms, it's about actually compelling society to adhere to a tiny percentage, and within that tiny percentage are a lot of men who are basically cosplaying as women as a form of perversion, perversion. the media has full compassion while denying real compassion to the families who are losing relationships to their children and losing children entirely to an activist-driven cult. we are going to look back at this era and go this is embarrassing, if anyone remembers oliver or psaki, they will be seen as those who cheered brutality and insanity. >> sandra: jessica, why is it that these democrats on capitol hill are so enraged that

women lawmakers don't want men in their bathrooms? what is this? >> jessica: there enraged by nancy mace's attention to her, which is going really well, and she's been doing this for years, remember she showed up at a prayer breakfast and said sorry i was late, i was doing it, which is definitely the kind of crowd you should be talking about -- >> greg: are you shaming? >> jessica: you ask me that all the time, and this time, yes, i am. sarah mcbride is a new member of congress and has been nothing but magnanimous about this situation because this bill was created just to shame her. and to float wild conspiracies. shown no evidence anyone has felt uncomfortable in a bathroom at capitol hill because there was a trans woman in the bathroom. if anybody has been attacked. she wants to bully, she wants to demean, and she wants to raise false flags about an issue. think back to the north carolina bathroom bill which completely exploded in republican spaces. this is not what they are

talking about. they don't think that your kid is going to go to school and come home with different. they do think a women's sports issue is a real problem, and what john oliver says we have different abilities, at the competitive level, that's the point. lia thomas was winning as a woman and was losing as a man. and when you're competing this isn't about 5-year-olds, this is about people who are in college, professional athletes. but this bill, it's so nasty, and it's for no reason, and good on sarah mcbride and good on the democratic caucus for standing up for her because it's so lame -- >> greg: false compassion -- >> jessica: no, it's really -- would you ever notice, if sarah mcbride walked into the room, would you -- >> greg: that's not the point. what you are doing, you've got to step back. you are talking about a system that changes for a tiny percentage of people. you are asking a lot of people they have every right to say -- >> jessica: why didn't you

in some instances, they are great. but it's pretty hard if you are out there in the middle of the country, and you are working hard, and you've got to her three kids, and you have to watch every penny you make. there's a lot of identity conflicts, racing through our society now, through our world, and these culture wars topics still have enormous salience, and we democrats have to learn to talk to people. >> jesse: and bill clinton, ever the expert on women, claims america is ready for a female president, but there's a catch. >> i think it would probably be easier for a conservative republican woman to win. >> then a democrat woman? >> because, i mean, that's what maggie thatcher did. but i still think we'll have a woman, female president, pretty soon. >> jesse: he didn't really explain why. he just said margaret thatcher. why do you think bill clinton doesn't think we're going to have a female democrat

president? >> judge jeanine: i think because he realizes where the country is right now, because he saw what happened in this election. he knows that the country is more right than it was when he was president. and maggie thatcher was a tough, straight talking, conservative woman, friend, obviously, if you remember, of ronald reagan. i just think that conservative women don't focus on nonsense. i think they are just smarter. in your face, mark cuban, okay? but even more than that, i think when he was stumping for kamala, clinton, he said things now, you can say he slipped because he's older, but what he said was basically, you know, they weren't venting people, which is why laken riley was killed. he basically said the economy was better under trump, recognizing that it wasn't that good under biden-harris. and he was, i think he was very

straightforward. he knew when he was president he had to change things. that he listened. that the democrats today are not listening. i have to give him credit. i think he's right. i think the first woman president will be a conservative. >> jesse: what do you think, greg? >> greg: i think what he was saying, kind of like what the judge said, the gender thing is not important, it's about the other part that describes a conservative. if anybody liberal right now is in trouble, because they went too far left. but i like what he said when he said we need to talk to people. because i think he realizes, it's probably from being among democrats and younger ones, really young ones, that they talk at people, or they are talking at each other. they lack the persuasive skills, and they alienate people. they drive them away. perhaps because maybe their ideas aren't good. we know that. but they are also -- they are not being taught how to win friends and influence people. instead they are finding value in alienating and losing

friends. there is a reason why identity politics fail. it wasn't about -- it wasn't about other people. it was about you and the secret to success in life, anyone who has read "win back friends and influence people," you win by ag about other people. what is interesting in their lives. people love it when you ask them about their lives. they are not interested in your pronouns. they are not interested in your identity. and that cuts people off. the other thing, dems love to say we need to have a conversation, but that is usually to get out of the current one. the kryptonite has always been a follow-up question. once they learn how to deal with a follow-up question, they will do a lot better but the issues don't allow that. >> jesse: i've noticed, after reading that book, women especially like it when you ask them about themselves. it gives you a great opportunity to just kind of sit back and just think about other things. once in a while, there is a moment, then ask another question. >> greg: ask her if she agrees

whatever. what's 20% -- >> jesse: you are on -- i don't know. >> sandra: $20. >> jesse: all of this wisdom from slick willie, where was this wisdom a year ago, two years ago, when everyone was dealing with these high prices? >> jessica: well, the problem is that bill clinton, because he is a bit of a walking #metoo violation gets ignored by a lot of people, and frankly had the best advice in 2016 for hillary's team and they didn't take it, and he had the best advice for kamala's team, and they didn't take it. so in 26 teen he was like hillary hasn't been to wisconsin, guys. we need to win wisconsin. we lose. this time around, he went to the team, so says the autopsy reporting after the election, he said the charlemagne add is resonating with people. we have to say something. and i also pointed out that it wasn't just an ad about trans people, it was an economic add because the argument was we'll spend money on this special interest group, but we will not spend money on you, the

general american taxpayer. and they didn't want to say anything about it. and if we live in an endless cycle of recycling people that have run past campaigns, and listen, what the obama team was able to pull off his incredible. i think david plus and stephanie cutter are amazing. but why wouldn't you listen to a guy who won to elections, who is beloved by people, have you watched him walk a rope line? i mean, people are beside themselves that they are so excited to meet him and to get to spend time with him, and he has decent advice. >> jesse: you said the reason why is because he was #metooed. >> jessica: he wasn't -- >> jesse: you just said people don't listen to him because he was #metooed. even people that are #metoo deserve to be listened to pe peered. >> jessica: i'm glad we had that talk. ahead, trump is building his celebrity cabinet, tapping linda mcmahon and doctor's. ♪ ♪

medicare. >> greg: we haven't brought her up. >> judge jeanine: i love linda mcmahon. let me tell you something. don't look at me, jessica. i have that eye on the side of my head. let me tell you something. this woman knows a lot about education. she has been on the board of trustees for colleges, she's on the connecticut board of education, she's got all the requirements. she knows right now there are huge problems with our students in our education system as a result of progressive democrats. the unions that are running these schools, our kids being so far behind kids in other countries, student loans, kids are starting to rely on, they can't get a student loan. there is nothing merit-based anymore. i don't want to hear about drag queen story hour, gender identity, or a book that is being show to kids of two guys having oral sex with each other. linda is a fierce advocate of parental rights. i'm telling this story, i don't care. we don't need schools on the progressive agenda, and linda is going to put an end to it.
