asking linda mcmahon to return to his administration. this time as education secretary. now, remember, she had previously served as administrator of the u.s. small business administration in the first term and is the co-founder and former ceo of wwe. and he is also bringing someone else back. former acting attorney general matt whitaker has been tapped to be the u.s. ambassador to nato. wow. what are we going to do for ingraham angle guests. they are all be taken by the trump administration. we will bring you more news on that as it comes. in now for years we have watched as venal forces, i want to put venal in bold face and italics because truly venal. venal forces lined up against donald trump. they punished him with impeachments, sham civil suits, baseless indictments. all politically motivated and it was all because he wouldn't play nice with the swamp. all he wanted to do was make

america great again. but that in and of itself, that was a threat to the gang that likes to run washington without accountability. but trump is not the only one being pummeled for daring to stand up for the voiceless. because the similar dynamic is at play in new york city as the trial of daniel penny. an american who refused to sit back and do nothing when others were threatened. remember last may we covered it at the time penny saw jordan neely on the subway and witnesses say neely was screaming like a maniac at other passengers. actually threatening to kill the other passengers. now, penny didn't wait for someone to get hurt. he sprung into action. tackling neely and restraining him until police got there neely went unconscious and later died. the nypd hauled penny in for questioning. >> guy came in and is he like whipped his jacket off and is like i'm going to kill everybody.

i'm going to -- i can go to prison forever. i don't care. i can do that at that point i looked at the person next to me i said hang on to me. headphones took off and kind of grabbed him from behind because he came in -- because he was acting like a lunatic. like a crazy person. so and he was throwing around the floor and at that point the train stopped, i'm like someone call the cops. still rolling around and going crazy. i had two other guys just kind of help me keep him from going nuts. >> laura: you notice who wasn't sitting next to penny in that room, i don't believe, unless i'm missing something, a lawyer. why did he think he needed a lawyer, right? but now we see the line of questioning shows that they were after something else. proof that this good samaritan was guilty of a crime. >> i'm not a confrontational guy. i'm not. i'm not out here trying to attack people, you know. >> but he was making enough of auto scene you probably would have noticed if you put his

hands on him? >> but i didn't. >> laura: he waived his right to counsel because he just only protected people on the subway. but, of course democrats will almost always side with thugs against patriots. as some did in this case. >> no one should really be strangled to death for acting up on a subway or performing on a subway. >> we see a black homeless person who is scary because that person is hungry and thirsty and it's okay to dehumanize the person who is in need of help or who is simply trying to protect themselves. >> i also find it very strange that people will come to the aid of an accused rather than come to the support of the judicial system. >> i don't even know what that means but what if their son or

daughter or wife had been on that subway car? do they not care about how regular people feel threatened every day of the week in these cities? i know congressman, most at least, have security. most regular people they don't have security. >> egg, everyday people need to be safe. harassing ordinary people and nobody gets involved it could create a dangerous situation for a lot of people. >> mta should be concerned about the issues that are happening once they are on board their train and their service. so, possibly looking to having some sort of added security. >> what are we doing? why are we not prosecuting some of these guys that are getting them off the streets or going if they need mental help? get some help for them. >> no, because we are prosecuting the people who stood up to fight the people who are threatening other americans. of course alvin bragg. d.a. alvin bragg, as he did with trump, ignore the evidence and he goes forward and charges

daniel penny with second degree manslaughter and criminally negligent homicide. as this trial plays out. it becomes more apparent how ludicrous these charges are almost all of the other passengers when they were interviewed recalled how neely had approached yelling about being hungry ant and wanting to go back to jail. one witness testified she was filled with a sense of relief when daniel penny took neely to the ground saying this is the first time in my life where i like took a moment because i thought i was going to die. and all the evidence suggests that neely was mentally unstable. dr. alexander bradley a forensic psychiatrist for the defense testified that neely had mental health breakdowns. including delusions that the rapper tupac shakur using him to change the world and he heard the devil's voice. the toxicology found synthetic marijuana in his system. this is where alvin bragg's

focus is. prosecuting a brave man who risked his own life for others. and frankly, when you think about it, how bad things are in the new york subway right now. like a shining light. in this crumbling crime-ridden subway system. and when he is not targeting city's heroes for prosecution, al village bragg is trying to, of course, imprison president trump. >> in regards to the president-elect trump's sentencing do you want a sentence to be rendered before inauguration or would you rather it come after his term? >> we have significant competing constitutional issues. the office of the presidency and all the obligations that come with that on the one hand, and the other hand the sanctity of a jury voice. a jury ha that has spoken and rendered a guilty verdict. >> laura: fully of you out there think law school and passing the bar is difficult remember alvin bragg did both.

so, when he continues to funnel the city's resources into these baseless prosecutions, the real violent criminals are still roaming about the streets, terrorizing people. just this week three were killed during a random stabbing spree. the suspect, 51-year-old ramon rivera has an extensive rap sheet spanning three states and gary worthy, a convicted felon with 17 priors, get, this only including murder, is accused of holding up two local businesses before reportedly shooting nypd officer rich wong and an innocent bystander. officer wong fired back killing worthy. these stories, stories like this part of the reason why trump made gains in certain parts of these blue cities. manhattan seems, you know, to be lost. still lost. the bronx, queens, staten island, obviously, already knew about that. made huge gains. and people are just have had

enough. this is just -- warped version of justice. and where the heroes are prosecuted, and the villains set free. joining me now paul mauro, fox news contributor, former nypd inspector general and mike eiglarsh criminal defense attorney. paul, start with you. watching penny's interrogation, you feel bad, right? and it's why everyone watching, if you are ever asked to go into a room with police, and you have been involved in anything approaching a violent situation, you just can't speak until you are represented by counsel. but he said i didn't do anything wrong. i just tried to save people. >> yeah. so the cops here did their jobs. you know, look, you have a dead person. you are going to have to look into this. i mean, just to play devil's advocate what if daniel penny had said something crazy incriminating i felt like killing somebody that day. you have to do the interviews. that said, they asked open-ended

questions. they gave daniel penny every opportunity to tell his story. he does such a good job in that interview, describing why he did what he did, that i almost wonder if, you know, the question whether he will take the stand is now moot because he really lays out he felt threatened, women and children were on that train. he felt he had to act. and he mentions that neely was still struggling and so that goes to this negligent and reckless mindset that's required for the charges that he is hit with. so, i think he did a very good job. remember something else, the cops didn't arrest him that day. they gave it to the d.a. he doesn't get arrested for 10 days later, until the protests start and then, of course, city hall buckled. >> yeah, mark, considering that he gave a -- you know, willingly, voluntarily gave his statement, it's a little odd that it took that long to charge him if they believed they had a good case.

the police have to cross their t's and dot their i's there as paul said. what's your take given what you have seen thus far in this case? normally i don't always share your outrage, laura. tonight i do. i think this is disgraceful. if you watch this video as i did several times, he lays out a perfect case of defending others. he reasonably feared eminent harm to passengers. other passengers felt the same thing. this guy with a history of mental illness made it very clear that violence is going to take place at any given moment. he did what a hero does. he jumped in to save others. now, in doing so, a tragic accident occurred. he is responsible, apparently, for the death of this man, but never intended on doing it, wasn't criminally negligent, wasn't reckless in any way, they should never have charged him.

>> laura: well, i don't always share your point of view either, mark, but i adore you. >> i love your analysis. it's awesome. paul, let's get to this story, i think, of individuals in new york. with this as a back drop and we will see how this plays out. people as they go into the underground, and they can't afford car service or ubers all the time, they have to go -- working people have to used subway. and you are in a situation like this, it's very tricky, because now people feel like if you step in and something goes awry, it's kind of like what they did with the police. if you move too fast something goes awry you could be in jail the rest of your life. what does that do to that dynamic at human level. >> daniel penny realistically here was forced to step up against a very flawed system that nobody seems to be interested in fixing that alvin bragg is very much a part of. the results of that are exactly what you are talking about. people on the subway when a crazy gets on, threatening and

it happens all day every day, stare at their phone, look at their feet and say please pass me by. and nobody wants to get involved. the repercussions are everywhere. nobody wants to take the subway who can avoid it kathy hochul put in will taxes. no one wants to take the subway at night go back to the boroughs where they live where it's cheaper. >> the bars, restaurants all closing. no longer the 24 hour city that it was and these are the reasons. >> mark, what's your gut here on how this is going to come out in the end? you can't really predict these things but what's your gut seeing so many cases in your career? >> not guilty. the worst part having been in the criminal arena so many years, i'm seeing a trend now. this case would have never been brought 20, 30 years ago. now there is a trend in prosecution for people who, you

g.o.p. incumbents have either been eliminated or drastically reduced long after election day. never goes the other way. california's election system is a disgrace and the state should follow arizona's lead, recognize the need for an overhaul and enact transparent reform. don't hold your breath about california doing that. they like it the way it is. it is clear they do want to whittle away the popular vote margin of donald trump so then democrats can cling to their no mandate point. and it's just a blatant effort to stop a duly elected president from enacting the agenda that he campaigned on. look, the people want change. they rejected the biden-harris status quo as we saw drove up inflation, sent hundreds of billions of dollars to ukraine and as millions of illegal also poured across the border. really returning power to the people, it's gonna require a lot more than executive orders. trump knows that he knows the transformational change will require revolutionary thinkers. and nominees willing to use

because we all as americans need to watch this. your reaction to what you just heard? >> you know, laura, a lot of people ask me why i get so emotional when i do fox news. why i scream at members of congress. because i have seen so much tragedy. i have talked to hundreds of angel moms and dads who bury their children because they are killed by illegal aliens. this is the latest. i have talked to little girls as young as 9 years old that were raped multiple times by members of the cartel. when you look in her eyes and everything innocent and pure has been wind from her soul. her life will never be the same. i'm tired of it. and this -- and the government failed the laken riley family. not only trump was president, he would be sitting in mexico in the remain in mexico program. and if he did get to new york, he was arrested for injuring a child in new york ice would be able to arrest him under the priors under trump if you are in the country illegally you are a

target. because mayorkas put the priorities so low even endangering a child didn't meet the standards ice couldn't place a detainer. this could have been prevented. this young lady is dead. every mayor, every governor of a sanctuary jurisdiction to listen to that tape, listen to this young girl fight for her life, fight for her breath. trying to survive terrified. i. you to understand what she went through. like the 9-year-old boy that -- 45-year-old boy in the back of the tractor-trailer that i held i found him dead baked to death. i thought about what the last hour of his life was like. youneed to listen to this tape. governors and mayors who say they are going to stop tom homan and president trump. shame on you. your responsibility is to protect your community. that's what we want to do is protect your community. >> laura: well, tom, we have the boston mayor saying she is not going to help. we have other sanctuary city mayors and other leaders, governors, saying they are not going to take part in this mass

deportation. but we know american citizens overwhelmingly supports deporting people from this country. take us through how it will work, what list you will cross-reference to try to find the people that are here and how will this play out? >> first of all, for those people who say they are going to stop us from doing what we're doing, they will not. i'm going to do this job. men and women of ice are going to do this job you are not going to stop us. let me give you a reasonable doubt would of advice. if you impede us there will be consequences. you cannot help us also read title 8 united states code 24 triple iii it's a felony to knowingly harbor and conceal illegal alien. read the statute and don't cross that line. but, look, president trump has made it clear, coming out of the gate public safety threats and national security threats. we have plenty of them to find. under the biden administration removal of criminal aliens has decreased 74%. so we have target-rich

environment. so going to prioritize public safety threats. for any governor or mayor who doesn't want public safety threats taken out of their communities, you should resign your office because you're number one responsibility is to protect those communities. we have ways of finding people. i'm not going to explain it here on national tv because they are law enforcement sensitive but we will find many of these folks. they will be arrested. they will be detained and they will be removed because what these facilities do and get back on sanctuary cities they don't want us in the jails. which means we have to go into the community to find them. sanctuary cities are putting officers at risk rather than the safety and security of the jail, where we can take them into custody easily. now we have to send a team to the street to wrestle on his turf. we have to access who knows what weapon. it pus the officer at great risk. puts the alien at great risk. puts the community at great risk and force our hand on this. so i want to pray every night that men and women of ice go home to their families every night after taking the bad guys off the street. >> laura: i don't think joe and

kamala gave a rip what was going to happen to the poor members of ice who have to carry out their duties. they don't care. they don't act like they care. they don't call the victims of horrible illegal alien monsters brutalize children and young girls. don't care about calling them anything. i want to get back how you move these people out of the country and how you detain them before they are removed, tom, because i know texas has offered 1500 acres for a basically a super detention facility to house people as they are processed out. do you imagine you will utilize that area for this type of operation? >> we absolutely will. when we find somebody that's a target enforcement operation where they get arrested they will be detained. they have to be detained for a short while while we get travel documents from host country. host country has to agree international. we get travel documents and flight arrangements and agreements. detain them for a little while. sanctuary states not allow any detention facilities in their

state, fine. we will arrest them. fly them out of the state and detain them outside the state. again, away from their families and attorneys. is that what you wants? that's what you get. you are not going to stop us doing what we're going to do. move them to a state where we can detain them. there is plenty of sheriffs across this country who want to give us empty beds. they want the funding and put them in a jail all across the country. we will have no problem finding a place to detain these people. it's going to cost money. we have to have the money to do it. president trump do everything he can to make sure we have the funds to do it. they will be arrested, detained, put on an airplane and go home. >> laura: tom, there are a lot more people than that, right? there are millions and millions of people who are here under fraudulent circumstances. really qualify for asylum but they are here. and they are going to be emotional videos you know what it's going to be. tom homan is mean. here is a mother and child and you are shipping them back or separating. i just know that's coming. they are going to rely on that to try to shut this down. think they can pressure to you shut this down.

it's rushing to the border. trying to get there obviously before inauguration day. your message to them tonight and to the biden administration that i imagine will, you know, perhaps wave a lot of these people in? >> i think president trump needs to make a phone call down there to tell them they are going to stop that caravan or they will have consequences like they did before. if you want to spend every bit of your money. if you want to sell your house and savings and give it to the criminal cartels that come to america, understand. this you are not going to be staying. you will be leaving. make sure of that i talked about prioritization of public safety threats and national security threats. if you are in the country illegally. you are not off the table. we are going to prioritize smart way. the worst person pose the most danger if you are in this country illegally, you have a problem. enter the country illegally, which is a crime you will be held accountable. >> laura: go back on your own recognizance. maybe you will have a chance some day of coming back into the country. tom, this is going to be a huge

regulations, administrative reductions, and cost savings and they are going to rely heavily on trump's executive actions. joining me now ned ryun, american majority founder and ceo. ned, this is a first real explanation, a bit of a summary on what they expect to be able to do. this is published in the "wall street journal." your thoughts thus far? >> i love the idea. you love that donald trump is going to be serious about this and brought vivek and elon on to do this. there are a couple things on to add to that article, laura. one, there is a fundamental question that has to be answered by the supreme court. and i think trump can trigger this on day one by firing 200,000 of the gs 12 and gs 13 federal employees. the federal employee union also fight back. this will probably be 18-month process supreme court. the supreme court has to answer this question. does the head of the executive branch, the duly elected

president of the united states, have the right to hire and fire whoever he wants to inside of the executive branch where most of the administrative state resides or will federal employees protected by the extra constitutional acts and statutes and regulations? i think this court would rule in favor of donald trump absolute demolition man fire whoever he wants. to say shut down any department that he wants to. implode buildings and completely destroy the administrative state. so i would like to see them do that on day one and have donald trump fire hundreds of thousands of them and start this proceeding all the way up to the supreme court. >> laura: well, we know that will be tough for the economy. there is no doubt about it. people have to get my father would have said real work. real jobs. people have to get jobs and they will be scrambling. one would think that the economy will start churning out new jobs. that's going to take a while for our manufacturing base to get, you know, up and running again. he reindustrialization of the

country. but that's what you are beginning to hear. but what about the economy? but what about the employment? unemployment is going to rise? for that you say? >> i would say this is going to be -- this is not going to happen overnight, laura, as much as i would like to think that we will be able to reduce federal government employees, i think it's going to be 18 months to two years to get this question answered. and, in the meantime, obviously begin cutting the regulations, making government more efficient, the last thing i will add is, this laura, we know that the gs-15s and ses types are the ones inside the departments and agencies that will be fighting reform items of elon and vivek. they need to be sent to an empty government building 30 minutes off the hill, called the department of elimination. put an empty desk and said you will sit there for 8 hours a day outside of the department and agency so you cannot resist these reforms as we decide how we are going to get rid of you and fire you and reduce and destroy the administrative
