exhibited at the time of the incident. however it is obvious, quite clear, that alvin bragg's office does not want a jury seeing that type of evidence. the prosecutor arguing and filing today, the psychiatrist testimony and the unredacted psychiatric records are inadmissible and they are suggested -- there instruct -- an attempt to smear the victim's character so that the jury will devalue his life. defense attorneys say mr. neely had used synthetic marijuana around the time of the incident and had a history of mental health outbursts, drug abuse and criminal behavior. as for mr. penny,'s attorney wrote in a court filing the defense has the right to elicit information contained in mr. neely's psychiatric records that demonstrate the pervasiveness of his k2 use along with physiological

>> trace: it's interesting because some on the other side are accusing you of weaponize inc. civil rights to justify discrimination. what would you say to the people who think that way? >> ironically the back of the girls shirts say it's common sense. really this is all we are dealing with, it's just common sense. we are trying to advocate and protect for the safety of our girls in our sports, that's common sense. we aren't just ruminating against anyone. these girls have worked hard for the positions they are in and female athletes across the country deserve a chance in the sport that they've trained, they've worked long hours, years of their life to be in the positions they are in. >> trace: and you are right, the common sense department would agree with exactly what she said here. but, you know, when you look at this whole thing, i wonder what your family and what your friends are saying, are they saying you should stand strong and continue this fight or are they giving you alternate

believe that women should be held to the same standards as everyone else. everyone should have the same standards. >> trace: a lot of students in california over the past few years, robust debate has been shut down. one of those things were some states foster debate, california does not appear to be one of them. it's an issue. >> it absolutely is. unfortunately where our schools are supposed to be this place where ideas are exchanged, even unpopular ideas can be exchanged and discussed and when you have an athletic director and the principal saying this message is hostile, that's an attempt by the school district to completely sensor a message, completely sensor discussion and we want to encourage our young people to engage in these conversations. we don't need to have hatred and this vitriol associated with these conversations. >> trace: best of luck to you

that, hundreds of thousands of kids in la have dropped out of the educational system altogether. they have disappeared, they are not going to school. this is a crisis and for the school district, which has many, many problems, academics being one of them, food on campus being another, violent crime et cetera, to be dealing with these issues which have absolutely nothing to do with them is really a travesty. i think for them it maybe a matter of money. if they have students of theirs who are deported, they get even less money from the state and they need to survive. >> trace: sheriff, 20 seconds for you to wrap us up but in the schools, come on. >> you know, we have to look out for the safety of our children. the message that is being sent in california is absolutely the wrong message. law-enforcement needs to hold the most egregious and full only as people accountable. we must protect our children, we must protect our families and that means that we have to remove people that have been here and come here illegally, committing horrible crimes against american citizens. >> trace: sheriff, doctor, thank you both.
