results in three more races, one in iowa, close there, the republican incumbent is currently leading there, that's merion, as well as a pair of tight races being tallied in california. just to be clear the election was november 5th. caribou in alaska as you said. a man in florida arrested and charged for plotting to bomb the new york stock exchange. the fbi said he planned on detonating the bomb using a remote control device and recorded a statement saying, quote, he feels like bin laden which he planned to release the day of or after the attack. according to court documents the suspect told agents he wanted to hit the exchange to, quote, wake people up. the fbi has been investigating since february after they received a tip about him storing bomb-making items in a storage unit. that suspect is going to remain behind bars while awaiting trial. >> carley: the justice department urging a federal judge to make google sell its chrome browser after a judge ruled in august the company has

they allowed for attacks directly -- long-range attacks, 130, 190 miles up to 190 miles into the territory of russia that's never been authorized before. these are us weapons that are now authorized to go directly against russia and then also what lloyd austin was just slaying about the anti personnel mines those have never been given over there and are very, very dangerous once again a major escalation. if true this icbm launched for the first time against ukraine, this would mean a major escalation, really a response to the provocation that the biden administration is doing in the last throes. we've got two months going in this administration, president trump has said that he's going to ramp this war down, and suddenly why are we provoking the russians and having a tit for tat. meantime more going on on iran we can talk about about you we are-the verge of world war three on two locations on the biden

harris and two months before president trump takes office. >> carley: vladimir putin just lowered the threshold for them to be allowed to use nuclear weapons, the current stance is they can use nuclear weapons if they're attacked at any time. so where do you think all of this is going? >> once again we're on the verge of world war three right now because putin has said that there was a red line. he said that if we allow ukraine to attack directly long-range missiles into russian territory, then that was a red line and that he threatened nuclear action as a result of that. and, look, we also have the iranians one month away from building several nuclear weapons right there. this is once again the instability that's brought about through the biden harris weakness, we saw it in afghanistan. there was a green light for putin to go to years ago into russia, two and a half years ago now. and so this is something where russia is right on the edge right now and this is something that we need president trump in

office right away so that he can ramp down these conflicts and just bring peace to that region. >> carley: john, there are also those in the republican party who think that president biden should have already done this given ukraine the ability to strike deep inside russia from day one, give them everything they want. you could make the argument that that would be the peace through strength position. what about that? >> well, it's not the case because, once again, this is something where president putin is ready to negotiate because he knows for a long time that this is a position that president trump has had and that he will, as a deal maker, he's the art of the deal and he'll be able to push both sides together. but what this risks right now is something that can spiral out of control very quickly. we saw the use, if this is truth the report of the icbm being used, that's the first time ever and that shows all you need to do is put a nuclear war head on that and we have world war three. this is something that is very dangerous and if we're looking to strengthen the hand of zelenskyy, the ukrainians against russia, this is a very dangerous game to play and we

need to be very careful and get president trump in office so that he can push both sides together and get a deal here. >> carley: tense times john elliott thank you so much for joining us we appreciate it. >> reporter: thank you carley. >> carley: you're welcome. to a fox weather alert at least two people dead and hundreds of thousands without power after once in a decade bomb cyclone slammed the west coast and conditions are expected to worsen today as an atmospheric river bluffs the coast with heavy rain and dangerous winds. >> in the northeast dangerous weather in northeast and new england as they brace for a powerful winter storm and rain. senior meteorologist janice dean here with the forecast. >> let's talk about the northwest the bomb cyclone an area of low pressure very strong, you can see almost looks like a hurricane on the satellite imagery, it's not. but we did feel hurricane force winds along the northwest coast and more heavy rain in the forecast over the next 24-48

hours. we have over 300,000 people without power. and the dangerous conditions continue today and friday. so life-threatening flooding along the coast and then we could see feet of snow in the mountains. so it's a good story because we need the rain, but bad because a lot of it is coming in a very short period of time and a very powerful storm. now here across the great lakes, the ohio valley, the northeast we are talking our first significant winter storm for some of these areas including chicago, upstate new york and we are watching the radar because we potentially could see a mixing of rain and snow along the coast, along the i95 corridor and watching this carefully for friday for our big tree lighting here in the city. there might be a window of opportunity where we are outside. so i'm crossing my fingers, i'm keeping everyone up to date. we actually could see some snowflakes as well here in the new york city area, but, again, a wait and see. it's going to be a game-time

♪ >> carley: a judge ruling brian coal better berger the man accused of killing four university of idaho students in 2022 can face the death penalty. >> chanley painter joins us with the details. >> reporter: good morning todd and carley the death penalty remains on the table despite the defense throwing nearly every legal argument at the judge in hopes of sparing their client of

the possibility if he is convicted of being the monster prosecutors said murdered four university of idaho students with a knife two years ago. in filings the defense claimed among many other things that the death penalty goes against contemporary standards of sdunt situate but the judge pointed to the fact the idaho and the u.s. supreme courts say the death penalty is constitutional. the family of kaylee cog salve as reacted with we finally have a judge who appears prepared well versed in the process. a new found level of seriousness that has been absent for far too long. justice is moving forward and we pray that one day in the not so distant future it will be served. this decision comes as the defense also filed a 160-page motion to -- this week to suppress much of the evidences in this case including the defendant's own dna allegedly found at the scene. >> todd: a lot paying attention as well as daniel penny case

what's the latest. >> reporter: today the case continued with defense witnesses, they call a forensic pathologist to challenge the state's conclusion that jordan neily ace death was solely a result of daniel penny's choke hold this testimony coming on the heels of defense forensic psychiatrist who told the jury tuesday that neily had been hospitalized more than a dozen times for psychotic episodes and abusing synthetic drugs including delusions the rapper tupac sha correspond was using him to change the world and he heard the quote devil's voice t psychiatrist said neily's behavior as described by witnesses were the result of a psychotic schizophrenic episode compounded by drugs. >> he approaches a woman who's got a young child, a baby, in a stroller and then he says, i don't care if i go to jail for the rest of my life, somebody's going to die. daniel penny has the right,

under new york law, of justification, to use whatever force is necessary to confront the deadly force that was about to be used against the mother with the child in the stroller. daniel penny could have ignored it but he was someone who made a decision, as a marine, to take him down and keep him from those individuals. >> reporter: and now the question remains whether penny will actually take the stand in his own defense. guys. >> carley: that's the big question. chanley painter live thank you so much. illegal immigrant josé ibarra has been found guilty in the murder of laken riley and has received life in prison without the possibility of parole your honor i'm asking you to give josé ibarra the same thing he gave us when he made the choice to take laken's like and destroy ours. he showed no mercy when she was begging her life. >> i plead with the court to the world of this evil person.

>> i am disgusted to look and be in the same room as him. >> the district attorney trying the case is facing outrage for no, sir asking for the death penalty because they take into account collateral consequence toss undocumented. patty morin the mother of someone allegedly killed by an illegal last year. what a day for laken riley's family and friends who received a partial level of closure yesterday but clearly the anger and sadness is overwhelming given those victim impact statements that they gave to the judge yesterday. what was learning this verdict and hearing it come down like for you knowing that you are in the exact same position that laken riley's family is? >> well, first i have to say that i didn't watch the whole trial because there were some similarities to things that happened with my daughter. and so it made it very emotional for me. and my heart just went out to the mom and the family, because,

in a small part, we all grieve differently, but i understand their pain. in maryland, we don't have the death penalty, it's just life without the possibility of parole and i think the question is more where does the line between justice and mercy come, and are we being merciful by allowing this person to live because they have descendants, possibly children? or are we protecting other families by doing the death penalty. so, to be honest, i don't really have an answer for that. i have mixed emotions about the possibility of this person in my daughter's case, if he's found guilty, having life without the possibility of parole because we don't know if laws are going to

change down the road that could somehow reverse that. so that scares me. it really does. >> carley: that's so well said and clearly you've thought so much about this. >> thank you. >> carley: this question has come up a lot, especially because the da of athens clark county who by the way was voted out of office overwhelmingly in large part because of her progressive policies, the da that was in charge of the laken riley case initially and in 2021, her name is debra gonzalez, her office said that they would no longer seek the death penalty when considering charging defendants, and she would, quote, take into account collateral consequences to undocumented defendants. so i think the question does become, what collateral consequences should you really be focusing on for undocumented immigrants or for the victims? and it's something that i think a lot of people are grappling with, including yourself.

>> yes. i do think there is a place for the death penalty. like truly, i do. i think that if somebody knows that if i'm going to kill another person, that i have the potential of dying myself, that it would prevent crime. i really do believe that. but at the same time, i think it more becomes the circumstances of the crime. was it intentional, unintentional, you know, those kinds of things. but something that's just done out of the moment out of rage or passion or just animalistic desire where you prey on another person, i think possibly, i think possibly they should get the death penalty. but, again, it's a hard line. >> carley: it really is. patty, we haven't spoken since president trump won the

election. i think that in large part one of the reasons he won is because americans, people across the country, saw what happened to your daughter and said, we cannot stand for this. a beautiful life extinguished. do you view his election victory like that? >> i am so grateful that he won. 87% of americans voted for donald trump. so i am so happy that he won. and i think the reason why is, yes, because of stories like my daughter's that have hit the media, but also there are thousands of countless other stories across america that media is not picking up or that local law enforcement is keeping on the down low because they don't want people to realize how -- i can't think of what the word is but how extreme this violence really is and how prevalent it really is.

i think that the key here is that every tool in the toolbox has got to be used to protect our citizens, to protect our residents and protect our states and certainly to hold the line on democracy and the rule of law. >> todd: trump says he will launch the largest domestic deportation operation in america history but not just mass chutes many blue state leaders are trying to push back on trump's deportation plan including in los angeles. the city council there actually doubling down on its sanctuary city policies. but citizens say they're fed up. one of those business owner paul, great to see you as always. let's be clear, ice is going to remove illegals in la whether the city participates or not. tom homan has been explicit to that. all this does and what other sanctuary cities are doing is create a dangerous environment not only for the agents but for the public at large. does anybody in los angeles actually want that, paul? >> absolutely not.

look, everyone i talk to -- good morning, todd. everyone i talk to is so excited that trump was elected, that did he is choosing a cabinet that is bold and aggressive. not a lot of them are lawyers or politicians, they're regular people who have been affected by all this crime caused by immigration. people in los angeles now, we told the world, we told country the story. if you saw all the counties, all the counties in los angeles improved republican over democrat. so los angeles -- california and los angeles is fed up with this whole thing. the city council, i don't know what they're thinking. it's a draft ordinance, it does nothing. it has no teeth. it is simply a declaration, symbolic like everything else they do. it has no teeth. there is no mandate on any city department to obey the ordinance.

there's no mandate. it's all recommended that these city departments obey these mandates and lapd is excluded from the ordinance. so although the new chief mcdonald says he is not going to cooperate with ice, i think he better listen to tom homan. i think mayor bass better listen to tom hoeman and the city council better listen to him because the way i heard tom homan says he will make recommendations to our majority congress on how to alter the federal felony harboring laws so he can come in la with handcuffs, i will invite him over for lunch first and he can go to city hall and cuff everybody if they're not going to cooperate and get rid of the crime problem. >> todd: when you read the resistance it does beg the question why, why are all these groups and politicians so committed to potentially creating an environment where the next laken riley tragedy can occur, the next rachel morin

this is -- that they're being woke, trying to go woke but we know that woke is broke and companies are pulling away with it. what i see is a different thing here. jaguar's had a lot of problems for a long time and they want to go all electric by the way by next year. this is a british company and a fair point to put out here, are they trying to go all austin powers on us? the marketing team, look, they actually are not producing a lot of their main cars anymore they want to go all electric so customers have kind of been moving away and jaguar is now responding to the couldn't verse saying, the re-imagined jaguar begins its unveiling today with an all new brand identity that establishes its unique character through a dramatic new visual language. again we don't know the cars though because they don't have them folks. okay. on the other side is the business of jaguar which has been failing and here's what in the detroit free press wrote before this ad came out.

i'm honored that the president has asked me to take this role, and i hope that i'll get through the senate process. until then, i'm certainly not speaking for the administration. the future one or the current one. but i want to be very clear, this is outrageous that these 19 senators don't understand what an ally means and why we need israel. as a strong ally and why they are important to us. this should be one of the most bipartisan and overwhelming understandings and we are not asking to give things to israel, but to sell them the things that they need to protect themselves against the annihilation that is intended toward them from iran and from their proxies, hamas, hezbollah, and the houthis. this should be an easy call. and i don't know why these 19 senators are more in favor of terror than they are in peace. >> carley: how do you think our relationship with israel would change when president trump enters office? >> president trump was the most effective president in history

when it comes to israel. in bringing about a level of peace and security for the jewish state. he moved the embassy. he recognized the go alan heights. he recognized jerusalem as the eternal capital of the jewish state. there were so many ways entrepreneurship brought forward. the historic abraham accords should have earned him the no bell peace prize. only way it didn't is because there were people prejudiced against him. that was a breakthrough. a sizeable breakthrough that hopefully he will be able to build upon and i have every confidence that he will. >> todd: it seems whenever we refer to israel, the word head scratcher comes in to play. this decision you were talking about a vote against sending arms to israel head scratcher and resolution on the gaza cease-fire during the u.n. security council vote because we wanted to make sure that a cease-fire included the hos

hostages. governor huckabee, how would it not include the hostages? they have done nothing wrong. they were in captivity for over a year. why not include them? >> yeah, for over 400 days, todd, the hostages had been held and it's really pathetic that at least seven of those hostages are u.s. citizens. we don't hear anything about that. and i really do appreciate the fact that the biden administration in the u.n. did stop that from happening, this ridiculous resolution. it was absurd and insulting. but to say that we're going to have some type of cease-fire without getting those hostages back, is an insult to anyone's intelligence. and i'm glad the u.s. decided to spike that run right in the ground. >> carley: i want to get your reaction to this "new york times" columnist was a biden backer he recently said donald trump has a chance to be an historic president with a major middle east deal he writes,
