i talked to little girls as young as nine years old raped multiple times when members of cartel. everything innocent and pure has been ripped from her soul and life will never be the same. i'm tired of it. >> gillian: ice announcing the arrests of three illegal migrants in massachusetts two charged with raping children, one convicted of the same crime in brazil. mike tobin is following the story. what can you tell us? >> all three of the individuals we're talking about today came into contact with u.s. authorities were but released. with the cases in massachusetts they were a threat to innocent people. first case is a guatemalan charged with the rape of a child by force. indecent assault and battery against a minor. he was arrested in november in massachusetts. he entered the u.s. illegally and released with a notice to appear for a judge. arrested in february of 2024.

the ice detainer was ignored. when he made bail he walked free. now brazilian man was picked up in massachusetts november 18th. he was convicted of raping a child in brazil and sentenced to 14 years. he fled to the u.s. entering illegally in new mexico in 2022. he was released with a notice to appear. he was a fugitive until last monday. a third case is a 42-year-old columbian man charged with raping a child in massachusetts been in the u.s. since 2016 but didn't leave when his visa left out. he is now in custody. supervisor says these are the kind of guys targeted for deportation with the new administration. >> that is what these mass deportations are going to be. after criminals. now detainers are one of ice's biggest things that we can use and when you have these states that will be bucking trump they won't honor detainers. we need them to keep people who

can be removed in custody. >> massachusetts is a safe state where the governor just promised not to cooperate with the income administration's federal efforts to enforce immigration laws. >> gillian: mike tobin in chicago for us thank you. bring in oklahoma republican senator tom langford. thank you for taking time with us this morning. let's kick it off and talk about the problem of migrant crime and border crisis along the southern border. what are you making of the president's nominees so far and his proposed border policy? >> the border policy from the biden administration is reaping the fruit we all said it would reap and why i continue to ring the bell over and over again on the border and be able to say not just folks coming in to work. we don't know if they are fleeing justice or if they are fleeing poverty. no idea. right now the biden administration is not filtering those but alloying everyone in.

a great frustration for the american people as they spoke out loudly during the election. they want this to stop and should stop immediately. we'll continue to be able to find every way we can to target first criminal aliens, there are thousands and thousands of them that are now in the country, folks that have final order of removal from a court and over a million of those folks that we know of that are in the country right now. and other folks national security risks need to be reported immediately. >> john: a question about that. information from dhs that 1.4 million people in this country illegally have deportation orders against them. 13,000 of them are in ice custody. a question a lot of people might have is why are they still in the country? why haven't they been removed? >> i've asked that question over and over of this administration. they say they are scent priorities for criminal aliens.

avoiding a court order that says you have to leave is a criminal act as well. they are picking and choosing who they want to be able to deport and who they don't. best thing to be able to do if a court ordered them removed, they need to be removed and need to be removed immediately. if they commit any other criminal act other than immigration violations they have to be able to be removed immediately and start identifying the highest risk and removing them. >> gillian: i want to make sure we take time to ask you about foreign policy. the international criminal court issued an arrest warrant for benjamin netanyahue, what is your take on that? >> frustrating again. this is another reason why the united states is not a party to the international criminal court and neither is israel. this random court tries to step in and take over sovereignty. they are saying as a court the nation and leader of a nation that was attacked by terrorism that still is trying to get the

hostages back for their nation, that that person is the criminal. this is how backwards the world has become on that and one of the many reasons we continue to stand with israel even though yesterday bernie sanders actually brought a resolution to try to strip away american weapons systems to israel and 19 folks voted with him. we had 19 other folks that said we want to strip away weapons from israel. we won't do that. we will stand with israel. we want to see an end to this war and return of those hostages and we don't want a lawless international criminal court to be able to step in and try to convict benjamin netanyahue. >> john: finish on the border. the situation we have. we talked to tom homan about this all the time. you've got people in this country from countries that we do not have reciprocal agreements with. all these members of tren de aragua that are operating in 16 states across the nation. met as at the sizing like a

criminal cancer. people who came into the country by the tens of thousands from china and from india, bangladesh, uzbekistan, places like that. when it comes to deportations, how do you remove people to countries with which we don't have reciprocal agreements? >> that is a challenge that you have to have the full weight of government that engages with. under the trump administration they were using the state department to put pressure on countries we'll apply additional pressures to you and call you out or due tariffs on your nation if you don't take these criminal aliens back. biden administration has been unwilling to do that. today we were supposed to have a public hearing with christopher wray and alejandro mayorkas coming before the committee. they both have dropped out within the past hour and said they aren't coming. it's one of the questions that already told them i would ask them about is special interest aliens. the folks from all these

different countries we know nothing about coming into our country. they have now both dropped out and said they won't come at all. it is one of a million reasons we're ready for a transition of the administration on january 20th. >> gillian: i understand this is the second day in a row that this hearing has been postponed. have they given a reason for the no show? >> they have not given a reason other than they did not want to testify in an open setting on these issues. the american people need to know. we have multiple threats out there and need to know about special interest aliens. chinese have done a significant hack into telecom systems in the united states. they are refusing to bring things like this to light. >> john: alison showed 75% of people who voted think what is happening on the voter is an important issue. you don't have these people showing up to a senate hearing. senator langford, thank you for joining us this morning. appreciate it. >> gillian: thank you, sir.

president-elect trump's administration starting to take shape quickly. certainly faster than back in 2016 for his first term. he has named two new ambassador in the last 24 hours and assembling his cabinet behind closed doors at mar-a-lago. another difference this time around from 2016. alexis mcadams is covering all the details as they unfold. what can you tell us? >> whether it's happening behind closed doors or not at mar-a-lago people are finding out about the clips quickly. the former president said for months he would go back to washington, d.c. and shake things up. that's exactly what he has done with these cabinet picks. a lot of controversy surrounding a few of them. might be an uphill battle on capitol hill to get them confirmed. trump says this is what the radical left does. they try to dirty people up, chew you up and spit you out before they destroy you. he isn't worried about it. you can see what's going on at

>> gillian: f.b.i. have arrested a south florida man for allegedly planning the bomb the new york stock exchanges. they began investigating the suspect in february after receiving a tip that he was storing bomb-making scheme attics and met an undercover agent and asked for photos of the exchange as well as explosive materials. according to the affidavit he told agents the explosion would be like quote a small nuke went off. anything outside the building will be wiped out and anything inside would be killed. >> john: another flip for republicans in the house. projects republican has won

alaska's only congressional district unseating the democrat. the position was held by his grandfather in 1972. goes to show how young these members are these days. republicans have secured the house with 219 seats so far. still a narrow majority. meanwhile california still tallying votes almost half a million ballots have not yet been counted and officials say they might not be done processing them until after we all eat turkey and are laying on the couch. william la jeunesse has the latest from los angeles. what are they doing there? >> it sounds like crazy town. 16 days after the election, right? the parties are still going door-to-door hunting for votes. don't believe it? here is nancy pelosi's daughter this week doing just that. >> my life, my love is curing ballots with my friends.

i'm following it goes that folks are leaving target for staples, essentials, especially ahead of the holiday and moving to cheaper big box stores most especially wal-mart. talk to us about charles's assessment there if you agree. >> i think you are hearing from all the retailers that these are very price-sensitive, bargain hunting shoppers looking for necessities. we saw it in exit polling two weeks ago. 75% of voters saying that inflation had caused financial hardship in their household over the last year. this is a year when a lot of officials in washington have been telling us that inflation is essentially beaten. the federal reserve already in the rate cutting cycle. so there is certainly a lot of pain. we've seen a lot of workers during the biden-harris era

after inflation seeing their wages falling. so that is a big part of it. i think there is also a story here on management. i don't think investors want to give target completely let them off the hook and say it's all inflation. because you see in the wal-mart case, they seem to be thriving both with customers who are on food stamps and customers with over $1 hundred thousand of household income. wal-mart does have an advantage here over target because they sell more groceries than target does and that's one of those necessity purchases. you have to get credit to wal-mart. this is a company that seems to be clicking on all cylinders. ceo is inspiring for kids in the audience. started unloading trail earls at the warehouse. he knows this business inside and out and it's part of the story here, too, along with

shoppers who really have been ravaged by the inflation of this era. >> gillian: another big factor contributing to prices and the overall health of the economy is energy. president-elect trump has said he wants to restart, reignite the keystone xl pipeline, which companies are not currently working on. do you think he has a shot at doing that or is this more of sort of a play for the incoming president he tries to boost america's natural energy and gas sources? >> the question, it may be a signal because the company that was attempting to build that is no longer trying to do so and they've largely dismantled the work that has been done and market changes where it is easier to get canadian crude oil to the pacific coast. but i wouldn't discount entirely

the value of the signal. what you are likely to see is this statement from the president early in his administration along with a lot of other executive orders deregulating energy and other markets. i think it may be a signal at this point, but i think it is a meaningful one because this is really i think going to be a stark contrast with those opening days of the biden-harris administration in terms of saying enabling people to drill, baby drill and produce all kinds of things with less government interference. >> gillian: have to leave it there. thank you for taking time with us this morning. >> john: outrage growing over district attorney alvin bragg spending time and money prosecuting daniel penny while crime runs rampant through the rest of the city and he is not the only progressive prosecutor facing pushback. >> daniel penny could have ignored it but he was someone

one of those rainy days in new york city that ended up in, well, disaster, john, thank you for jumping in. >> john: happy to do it. >> sandra: it is day 18 in the daniel penny subway death trial. daniel penny holds the victim neely in a choke hold on the floor of that subway car last may. another passenger attempted to help penny subdue neely who witnesses say was threatening to kill people and actinger act it. penny tells two detectives he never intended to do neely serious harm. >> the guy came in and whipped off his jacket and like i'm going to kill everybody. i'm going to -- i can go to prison forever, i don't care. he was acting like a crazy person. he was rolling around the floor.

witnesses to the stand. so far this week jurors have herd a defense expert testify based on eyewitness accounts it is likely jordan neely was experiencing a schizophrenic episode on the train last year. that psychiatrist also testified that thousands of neely's medical records showed he was hospitalized more than a dozen times. mostly for schizophrenia and k-two abuse. that's a drug 40 to 100 times stronger than marijuana. he also said neely's medical history is one of the most severe schizophrenia cases he worked on. defense using this testimony to advance their case that penny acted to protect others. defense has also called several character witnesses to include a marine corps platoon leader who testified penny had a reputation for being calm and peaceful. if penny does not testify his video will be the only time jurors have heard directly from the marine veteran who did not

know neely had died when he waived his miranda rights to speak to police right after the ordeal. >> i'm not -- i wasn't trying to like injure him. i'm just trying to keep him from hurting anybody else. he is threatening people. >> so prosecutors rested their case after testimony from the medical examiner and penny's former martial arts instructor and marine corp. prosecutors furthered their argument that penny should have known when to let go and that he was reckless. a lot more to watch. >> sandra: thank you. let's bring in olivia ryan gold and paul mauro. day 18 of the daniel penny subway death trial. paul, you have been on this since go. your thoughts as you watched on at that video of that

interrogation and where it went. >> the cops did a good job. they did what they have to do. you have a dead body and have to bring everybody in for interviews. they gave daniel penny open-ended questions and allowed him to tell his story. his story is so well told. articulates the position how much danger they felt in that car. women and children there. the fact he wasn't seeking confrontation and stepped up in a justified way. i actually think that video is so good there is a good chance he won't even testify. that's a big question right now. realistically he just did and i think that it is very effective video for him. >> sandra: you think what we are seeing play out with this man on the subway and the trial continuing and criminals are running free in new york city. olivia you have been covering this. these are the headlines in recent days as they continues to play out. a man suspected of slashing a tourist in the face and neck during a random attack. homeless man wielding an ice

pick accused of pushing an elderly guy to a crowd. a shoot out with an officer and a homeless man kills four people. how about these criminals? >> what the prosecution doesn't understand. this is a piece of evidence introduced by the prosecution, not the defense. what they don't understand is that a lot of people look at that video and they see a hero. they see someone who has intervened despite what they say about the crime being record lows. that's not how people feel when things like this are happening. a lot of people look at how daniel penny performed in that video and they see a hero. >> sandra: you and i were talking yesterday covering the laken riley sentencing and we know that immigration and illegal immigrants committing crime in this country, what a huge part of this election this was. but a huge part crime in general in this country has become. the "new york post" writing this

morning bragg pros coots daniel penny but allows walking time bombs with long rap sheets go free causing us to -- time to seize a chance to oust him. the city journal writes about the anti-crime election. voters have learned a key lesson from recent history when it came to progressive policies. they went along to get along until the results hit them hard and fast. >> manhattan is the the last -- the message is clear. manhattan is the the last hold-out. bragg's bailiwick. don't buy this idea that crime in down in manhattan. violent crime is up double digits under bragg. one of his own d.a.'s got robbed in hell kitchen the other day. let's see if they drop those

charges. the m.o. is everything gets dropped to a misdemeanor and it's not bail eligible and everybody is out the door. these charges miraculously won't be dropped. to put a nuance on the penny case, let's remember something else. penny was not arrested by the police that day. he wasn't arrested for ten days. the cops assessed this as a good samaritan case and kicked it to the district attorneys office. the protests happen. political calculus and they buckled and the order was made arrest him before a grand jury. manhattan is the last place in this city. you have to hope at some point common sense prevails. >> sandra: the ousted liberal d.a.s this election cycle. do you think this is a sign that people have had it? >> i think based on how people are reacting to this case absolutely. but i would say perhaps maybe

for only half of america. the remarkable thing about this case is almost everyone i speak to has made up their mind. there are so few undecided people. it is so binary and for half the people they look at this and say we have had enough. i have been in this situation where a subway car feels unruly. a lot of people relate to that. but at the same time there are half of americans who think that daniel penny is a racist white vigilante. >> sandra: it played out in my decision whether or not to bail in upper manhattan and get on a subway this morning. people trying to make it to work every day their costs are up because there are so many young women in the city fearful of jumping on the subway. thank you very much to both of you. good to see you. now this. >> policies are outrageous and gotten people killed not only in georgia but around the country. that's why people elected donald
