provisional ballots. senator casey is asking for more than 1200 ballots to count across nine lawsuits. mccormick wants thousands of votes removed from the count but that hasn't been ruled on by pennsylvania courts. >> sandra: that's a lot. nate foye, thank you. >> gillian: quite a story. joining us now is bucks county committee chair. let's play a little more of what commissioner said in that apology. i want to get your reaction. >> last thursday, when i spoke at the meeting that you are all here about, the passion in my heart got the best of me and i apologize again for that. >> gillian: do you think it was passion in her heart that led her to say that court orders in america are meaningless? >> i can't really speak for her intent. i only know what she said was so offensive to so many of us. absolutely you have to follow the law in this country. even if you don't like it.

and that ultimately a winner is determined based on the will of the people. >> gillian: what is your reaction specifically to his comment that dave mccormick's team last time around made the same exact decision that senator casey's team is making now. >> that's not my understanding. i was told they did not. i don't know where he is getting that. i don't recall a recount. the state mandates it. the candidate may say no. i heard people saying including dave he did not do that. i would have to check further. that's the first i'm hearing the governor say anything about it. he waited until the supreme cou ruling to say yes, you have to follow the law. >> gillian: what would you like to see the governor do or say now to try and -- i don't know if it's possible to sort of smooth over the situation now. a lot of damage has already been done. presumably we get the results of the recount soon and this will be put to bed.

we're also reporting right now the senate -- fox digital exclusive -- the senate majority leader chuck schumer reached an agreement with republicans allowing president trump to fill four higher tier circuit court nominations if republicans allow four district court nominations to go forward. you look at the judiciary committee meeting this morning. president-elect trump is not happy that biden nominated judges continue to make it acrows the finish line. for lifetime appointments. the biden administration still and democrats have the senate majority technically. trump says confirmation needs to stop and counting on republicans to make it sfop. -- two judges were appointed yesterday. they say the judges are qualified. republicans say they are too liberal on a wide range of subjects. republicans are doing whatever possible to try to slow down the
