mark: hello america i am mark levin this is "life, liberty & levin" send up a thank you for joining us. two great test joe concha and tom homan. before we get to them i'm sick and tired of already on the attacks on donald trump like he is sometime a anti- liberty are somehow doing things that you are not supposed to do. whether it's appointments to his cabin and so forth and so on. i want to nip this in the bud. as you know we try to do things differently here we do not have a line of 48 guests. we have two guests with longform interviews. for my opening statements i do my own research, my own thinking. and i want to give you a little bit of history about presidential misconduct. presidential misconduct we put things in some historical context because a lot of the people writing and speaking do not have the foggiest idea what

that's not what it says not only is that not what it says, that's not why it was passed. it was passed to prevent the u.s. marshals for being able to call up the military without the authority of the president of the united states. so congress passed this law and said essentially he's underlings the department of justice, these other people do not have the power to call in the military for law enforcement police actions. and in fact the att attorney gel to dwight eisenhower had set up the act is applied this way it's probably unconstitutional because it ties the president's hands. you and i are not saying we ought to bring in the military to be chasing people all over the place. this is a national security of federal action you are talking about if you are rounding up illegal immigrants by the hundreds of thousands because you've had illegal immigrants imported into the country by the hundreds of thousands. what is your general thinking
