both brothers have been serving life sentences without the possibility for parole for killing both their parents in 1989. outgoing l.a. district attorney george gascon recommended the case be resentenced which is a decision the next d.a. wants to review here to discuss is l.a. county deputy district attorney john lewin. good morning to you. >> good morning, steve, i just have to tell you in advance that obviously i'm appearing. i'm not a representative of george gascon or the d.a.'s office piece opinions are my own. i need to make sure i clarify that. >> steve: start at the beginning. today for attorneys for both these men now are going to ask the judge to reconsider the sentencing given the fact there was that you will evidence they abused the boys back in the 1980 they weren't able to present. that's what is he going to say to the judge, then what happens?
3:44 am
>> today, the judge has already said the hearing will take place on december 11th. what have you is you have got an expublic defender who spent almost 30 years in the public defender's office came over schroder while ago took over re-sentencing. in essence defense attorneys on both sides. you have geragos and his people representing the menendez brothers. and you have what district attorneys also representing the menendez brothers. what you are going to see today is the cooperation what is in essence a joint d.a. kind of that can a raiding. defense attorney masquerading as d.a. see them try push a judge to make a decision today. i don't think it's going to happen. it would not surprise me if the
3:45 am
judge decides that he needs more time so that he can properly assess new d.a. nathan hochman more time than december 11th to figure out what his position is going to be? so i understand the brothers are going to be appearing virtually because they are incarcerated, i think, in san diego. they are going to be beamed in to the court where the judge will talk about things today. you mentioned mark geragos. he would like to see them resentenced on voluntary manslaughter, given all this new stuff that he intends to present to the judge. but ultimately -- if the judge decides okay, doesn't it still have to behave to be decided bye board whether or not these guys are sprung? >> so, even if they are a couple different ways that this can go. if they ended up -- let's say the judge resentences to voluntary manslaughter, that would mean that they already served all of their time.
3:46 am
it wouldn't be a matter of parole. because, by operation of law. they would have completed their sentences if on the other hand. prosecution in original motion resentenced to basically life sentences. life with parole. what would happen is that they would immediately be eligible for parole. that would then -- they would have to schedule a parole hearing parole board would have to roll and then up to governor newsom whether or not he wants to honor if parole is given or to reverse it if that is his decision. >> steve: all right. let's see what happens in court today. john, thank you very much for getting up so early out there in california today. >> no problem, steve. happy to do it. >> steve: thank you very much, sir. all right. of course, we will have coverage throughout the day right here on fox. meanwhile, the latest episode of the saints on fox nation tells a story of john the baptist. the actor who plays john coming up next.

3:53 am
essence and importance of john the baptist is in his quest for truth conscious and desirous paving the way as he says in the series namely jesus repentance, during back to god. i thought about it as to what repentance actually means. and to some extent it's just believing in mercy. attempt to incarnate the role bearing in mind i'm not a saint and i wouldn't even purport to

be able to qualify myself as anyone even remotely close to the saintlessness of john the baptist huge responsibility and i tried my best. >> ainsley: did you a beautiful job. yes, i have read about his life, my entire life. and just someone that we all admire. he was so brave. was willing to be elm prisoned because he loved his cousin jesus so badly and knew that was his calling on his life. angel appeared to his parents and said you will have a son and name him john. actually baptized jesus and the heavens opened. this is what martin scorsese says about john the baptist. watch this. >> with john the baptist, of course, we are yawrsed to seeing him strong and muscular and unshakeable. when you stop and think about him that i think we realize he must have been going through some real agony trying to find a spiritual path, his spiritual

path, which ultimately, i think he understood, ultimately is going to lead to his martyrdom. >> ainsley: what is your reaction to that i can't ha? >> finding one spiritual path is agonizing. can i only speak to moo spiritual endeavor. at least saints they had it very difficult because they chose a specific way notwithstanding the risks associated with it. i just hope that it inspires some people to just, you know, be inspired by the messages of truth, of compassion, of mercy, and, above all, of humility. actually, if i may say so, one of the best -- because humility is a term and various subjective desks of what humility is, but
3:56 am
there is one french philosopher whom i really admire, her name is see more. weil. and she wrote a book waiting for god. and there is -- i think it's another one of her writings where she defines humility as an intelligent form of just the capacity of attention and there is a lot of nuances under that definition, but the fact that you know, we are all in this together and there is something incredibly miraculous about being here and it's a journey for each one of us which may be agonizing sometimes but also uplifting in others. >> ainsley: absolutely. i can relate to that. you might be persecuted and in john the baptist case it caused him to die eventually for being a christian or to standing up for what he believed in and talking about jesus. thank you so much, you did a beautiful job. i encourage everyone to go and watch it. it's on fox nation. >> thank you so much. >> ainsley: thank you. got bless you.
