8:01 am
top of the new hour here, president-elect donald trump's incoming border czar tom homan will join greg abbott today. they will be touring part of the hern border. show how the trump administration will work with texas helping to secure the border after years fighting the biden administration. >> we're not waiting until january 20th. we're already planning what we'll do to lock down the state of texas. i guarantee the trump administration isn't going to constantly sue him for securing the border. we'll partner and help him do 100% security on the border and across the southwest border. >> sandra: democrat led cities are working to help immigrants. los angeles city council voted to become a sanctuary city despite a surge in illegal migrant crime. police arrested more than 1200
8:02 am
illegal immigrants in the metro area so far this year. more than 700 of them had prior criminal convictions. democrat-led detroit an ill lemme immigrant is accused of hitting and killing a beloved pastor while driving without a license. and in sanctuary new york city officials refuse to hand over and illegal immigrant to ice. he is accused of robbing a woman and committing allude act in front of her. the suspect linked to the violent tren de aragua gang smirked and yawned during his bail hearing. one new york city democrat with a warning about his party's policies. >> we have to remember in new york city 9/11. what happened? we didn't communicate, nypd didn't communicate with obviously federal agents. so that's how the terrorists got in. so we need some communications. what we're doing here is we are shielding them. the governors, democratic
8:03 am
governors and mayors of these sanctuary cities are shielding criminals and terrorists. >> sandra: bill melugin is live in eagle pass, texas today where tom homan are governor abbott. >> we're standing by for their arrival at the texas military base. they'll get here within two hours or so. we had significant activity out here in eagle pass this morning. show you this video. our cameras on scene in the pre-dawn hours this morning as a large group of more than 200 illegal immigrants were quietly pushed across the border by cartel smugglers and human traffickers. mixed in with the group were more than 50 unaccompanied children and minors traveling completely alone. we caught up with a 16-year-old boy from honduras. we ran into two little girls
8:04 am
ages seven and ten from guatemala. they were completely alone. take a listen. >> as we wait for homan and abbott to arrive we want to take a look back at how tense relations got between texas and the biden administration. this video last year border patrol was cutting the razor wire that texas was putting at the edge of the rio grande river. texas was upset saying it was a violation of state sovereignty. it didn't end there. this video last year in eagle pass, the biden administration border patrol brought out an industrial forklift to start
8:05 am
raising the razor wire. border patrol said they had to do this because they had to process migrants once on u.s. soil according to federal law. it infuriated texas and sued dhs over it. look at this video. the biden administration also sued texas to stop the state from butting water buoys in the rio grande. an appeals court sided with the state and expected to end up in the supreme court. last night homan and abbott were on hannity together and not wait until trump's inauguration to start working together. take a listen. >> we're not waiting for january 20th. the planning starts now. january 20th game on. so if they want to push back, push back. don't cross that line. >> right now you are taking a live look at starr county in the rio grande valley.
8:06 am
we expect a press conference to begin from texas land commissioner don buckingham and announce more texas border wall construction and she is the one who is signing off on texas giving 1400 acres of land to the incoming trump administration to help carry out mass deportations. texas congressman chip roy tells me he will be at this press conference as well and he will be joined by the mother of jocelyn nungaray. again, the 12-year-old houston girl who was sexually assaulted and murdered earlier this year allegedly at the hands of two venezuelan illegal aliens who were caught and released at the border earlier this year. keeping an eye on that, sandra. send it back to you. >> sandra: we will indeed. thank you. republican congresswoman maria salazar member of the foreign affairs committee joins us now. thank you very much for being here. you think about the optics of this moment where the trump transition team tom homan, governor of texas are down there on the border. they will have this big day of
8:07 am
showing their support for the troops, bringing them a meal two days before thanksgiving, biden is heading out on vacation and kamala harris is returning from one. i mean, right now our borders are still open. these criminals, some of them, are still flowing over that border as we speak. your reaction. >> embarrassing, what a disgrace. but we are extremely grateful to president trump that he has sent mr. homan down there before 50 days before the inauguration. he is sending the message there is a new sheriff in town, specifically to mexico. you know what happened yesterday that the new president of mexico said that she was going to stop the caravans because 24 hours ago president trump said that he was going to increase 25% tariffs for any products coming from mexico. so they got the memo. good. now she is going to be sealing
8:08 am
her southern border with guatemala and you will see how that caravans are going to slow down. good job. that's exactly what we need to do. this is the most important national security threat since 9/11. how could the biden administration be so irresponsible? we have to say something that homan worked under obama and under trump. so it is not that he is biased. he has seen everything. we the miss panic community don't want open borders. we want sealed border and crossings to be made in an orderly way. >> sandra: the unaccompanied minors some as young as two years old. we've seen it happening and heard from them and it is still happening and they are being turned over to unvetted hands in some cases and going unaccounted for. you are talking about many, many young children that are being turned over into potentially very dangerous situations. where is the concern for that?
8:09 am
>> i'm glad you are mentioning that. 85,000 children according to the "new york times" were let into the country and we do not know where they are. without a dna test. we do not know if that person who is next to that 7-year-old girl who is saying that she is -- that he is her uncle, in reality is not her sex trafficker. we have a major problem in this country specifically with children. i'm so happy that you are mentioning it. homan has seen it. the mothers desperate back in guatemala or honduras everything will be good with their kids. no, we have the most horrific things happen at the border. the coyotes have a list and they determine if you come in or not according to how many criminal acts you have committed or sexual favors. i'm not -- most of your viewers
8:10 am
don't understand what really happens. that's what homan is saying. he is not being cruel. he is stopping horrific experiences to those children. >> sandra: no doubt he has great concern for all that is happening at our border and beyond. we should see and hear from him shortly along with the governor of texas. meanwhile, as far as trump's mass deportation efforts and what he pitched to voters that obviously was very popular with the american voter, democrat governors and mayors are vowing to resist those plans. listen. >> would the massachusetts state police assist in mass deportations? >> no, absolutely not. we are not cooperating with those efforts that actually threaten the safety of everyone by causing widespread fear. >> we aren't going to ask our police force to service ice agents. >> i will do everything i can to protect our undocumented immigrants. they are residents of our state. >> i will fight you every step
8:11 am
of the way. >> if it is contrary to values we'll fight until the death. >> sandra: new opinion piece with this headline americans are fleeing progressive governors vowing #resistance to red states. progressive policies have fueled a max exodus of the citizens of california, illinois, new jersey, new york and massachusetts. from 1990 to 2021 net domestic migration has totaled 13 million fleeing their states. red states like florida, texas, north carolina, arizona, tennessee, nevada and south carolina have seen a net gain of 13 million over the same period. going back to president obama's two terms democrats were largely silent when obama, the deporter in chief, showed some 5.3 million illegal immigrants the door. so you have to ask yourself what is different this time around? why are they taking such issue with these plans to deport
8:12 am
illegal migrants from this country? >> because trump is republican, that's why. and obama was a democrat. you said it correctly. within the hispanic community obama is a big traitor. i want to point to you why. and i was there and interviewed him in 2008 when he promised the hispanic community, the largest minority in the country, that within the first 100 days of his presidency he was going to bring to law or bring legislation for complete immigration reform law. he lied. he lied the first two years. he put that political capital in obamacare and the hispanic leaders remember. that's why you have probably what happened now with trump 55% of the hispanic males voted for the president. so obama did it quietly and the news media and governors did not say a word. i want to say once again that the hispanics, the legals and
8:13 am
undocumented don't want criminals in their neighborhood. what the deportation army is going to do and hone in on those criminals, terrorists, spies. i'm not sure if you know that the gotaways pay more to the coyotes to be got aways. we have 35,000 chinese nationals that we do not know why they are here and of military age. so the democrats and those governors do not understand what they are saying. they have not asked our community what is it that we want? we want secure borders and those who have come in years ago, talk to them later about what are we going to do with those contributing to the economy and don't have a criminal record. right now you have to seal the border. number one national security threat since 9/11 produced by the hands of a president. >> sandra: we'll see those efforts underway as we're going
8:14 am
to see tom homan there at the border shortly along with the texas governor. congresswoman, thank you. good to have you in the program. new outrage over protecting women's sports or the lack of doing so. federal judge ruled the san jose state women's volleyball team can play in a conference tournament despite claims one of its players is transgender. but the legal fight for fairness is not over yet. plus the list of companies ditching woke policies and practices just got longer. >> dei may stand for what, diversity, equity and inclusion but the true definition is did didn't, e earn, i, it. didn't earn it, let's face it. >> sandra: now wal-mart one of america's biggest employees is the latest to realize that go woke and go broke is no joke. jason chaffetz in "focus" next. y for your family? newday usa can help.

>> sandra: federal judge ruled yesterday that the san jose state volleyball team can play in this week's playoffs because of allegations that one teammate is a biological man. about a dozen women, some from san jose state, had sued the mountain west conference and its commissioner. they are claiming that player's presence violates title ix regulations and first amendment rights. they have filed an emergency appeal of yesterday's ruling. they want an injunction before the tournament starts tomorrow. five schools forfeited matches to san jose state over the issue. the university suspended its own associate head coach after she spoke out against the alleged transgender player's participation. she says this fight is not over. >> this ruling definitely is a little minor setback, of course,
8:21 am
but we're here to fight the long fight. it is going to be a long haul. allowing trans into our space as women will forever change women's sports. we will not have women's sports as we know it. >> sandra: critics of the ruling blowing up on social media. riley gaines saying it's time to remove activist judges who refuse to uphold the law as intended. another would love to see all teams boycott the tournament. it must end. a third. what a joke. we're living in an upside down clown world. jason chaffetz, former republican congressman of utah joins us now. i feel for these athletes. time is wasting here. they should be out there playing and on the court safely participating and they have had to stand up against this. your thoughts, jason. >> this just seems like common sense if you have a women's volleyball tournament women should be participants.
8:22 am
look, if you are 18 years old and older and you want to pretend you are a woman, have at it. you can do that. but not in the volleyball sport. that is what's so wrong here. sandra, you and i both played college athletics. you were a fabulous runner. i was a placekicker on a football team. same thing. they do all kinds of testing. we had drug testing on a regular basis and yet those same people are just fine with putting a biological male on the court. the reason you have drug testing is to make sure it's an even playing field. that nobody has an undue advantage. those same people can't see the fact that a man playing volleyball has an undue advantage and people might get hurt. people have been hurt in the past. >> sandra: major safety issue, no question. not just in volleyball but so many of these other sports are facing the same challenges. jason, where are we getting with this? we saw it pop up as an issue in
8:23 am
the election more so than we had seen in the past. more and more women are standing up for themselves and teams and daughters in all of this. it feels like the voices are getting louder. where do you see this going? >> look, i think it's an embarrassment these so-called women's groups have not stood up. thank goodness you have leaders like riley gaines in her early 20s to take this oh on. what she went through in the locker room and changing clothes in front of a male who had, you know, not had surgery and just -- it's so gruesome. i don't want to get into the details of it. what 16-year-old should have to go through that? where are the leaders here that say we're not going to put a man in a women's restroom? i don't understand why the common sense isn't actually there. i think it will prevail but you have to have brave people stand up and say enough is enough. >> sandra: you don't want to get in the details of it but some of
8:24 am
these girls are having to live through it. jason, a democrat congressman is scolding his own party over its handling of trans issues but not until after it become a losing issue for democrats in this election. listen. >> he told "the new york times" i have two little girls. i don't want them getting run over on a playing field by a male or formerly male athlete. >> i stand by my position. maybe i didn't get all the words exactly right but the point is that the backlash i perceived proves my point that we can't even have these discussions as a party. we've got to be able to have these debates. >> sandra: now he is talking about it. moulton could be a flip-flopper or a hypocrite. he voted against a bill to protect women and girls in sports and co-sponsored house democrats' transgender bill of rights. where was he then? now is he speaking up only because it's politically popular to do so?
8:25 am
>> i think seth moulton, the congressman, is a bit confused. i think the democratic party is still trying to find their way on this issue. they struggle with it. there is no driving principle for them and they pay the price politically. it is an overwhelming numbers of people, men, women, all across the political spectrum understand that putting a male in women's sports is wrong. and if they are going to try to defend that, offer the bill and stand up. but he has been all over the map. they try to have it both ways. a lot of democrats. >> sandra: some companies are looking to roll back dei policies. wal-mart is the latest big business to ditch the controversial initiatives. joe concha with this on that. >> customers just want a good product. they want to be treated with respect and want the best people running these companies.
8:26 am
dei may stand for diversity, equity and inclusion, the true definition is d didn't, he earn, i it. didn't earn it. corporations are losing money. ask bud lite and target. it is not the way to go. >> sandra: consumer researchers tells fox you had dei coming from the federal government. if you wouldn't go along under the biden administration with dei regime they were threatening to sue you or claim you are violating civil rights or minorities. it was more a combination of the threat of bad press or government action against these corporations. the issue is at the center of a heated exchange in the house last week. lawmakers debating the republican dismantle dei bill in the house. watch. >> there has been no oppression for the white men in this country. >> please keep dr. martin luther's words out of your mouth.
8:27 am
his children have asked you to stop invoking his name and perverting his work when he was a proud and unapologetic black man fighting for equality for black people. >> sandra: how trump can rid washington of wokeness. excerpt from it reads to put a spike through the heart of woke mr. trump and the new congress must reverse these policies. all will help restore sanity. give us a preview of what we might be about to see as we see this transition of power, jason. >> well yeah, look, the power is certainly changing. look, i think it is all about -- let's go back to competency. things shouldn't be based on the color of your skin. affirmative action proved it was wrong. diversity, equity, inclusion has cost a lot of people their jobs
8:28 am
and there are not the justifications in order to do this. so i think congress is going to play this out and how for instance in the military and other places who gets to participate in what. let's just go back to competency. as it relates to the corporations, people just want to go in and buy a good quality product and don't want their kids exposed to perversion at stores. if jaguar wants to go all in on it and we'll go for this product, then consumers can decide whether or not they purchase that product. people don't want to go to wal-mart or target or any of these mass market retailers and have their kids exposed to things that are really surprising and shocking to them and their family values. >> sandra: not to mention the fiduciary duty to shareholders. happy thanksgiving to your family, jason. the menendez brothers convicted of murdering their parents

decades ago won't make it home for the holidays. the latest ruling in their case for resentencing and possible release. israel and hezbollah could be on the verge of a cease-fire deal. will the terrorists make good on any promises? mike pompeo not optimistic. >> i suspect hezbollah will continue to build, continue its commercial criminal enterprises that have funded it for so long and that this cease-fire will prove for naught. i hope i'm wrong. >> sandra: the israeli cabinet are meeting to discuss the proposal. we're in israel on the ground next.

>> sandra: we're now getting word that israeli prime minister netanyahu is expected to speak at 1:00 p.m. eastern time today. you just saw a video of heavy fighting yesterday as israel continues to battle hezbollah terrorists in lebanon. israel's ambassador says the cease-fire could be finalized today. one sticking point israel demands the right to retaliate with hezbollah violates terms of the deal. trump's pick for ambassador to israel mike huckabee says that demand is a no-brainer. >> this would be wonderful if it holds. but the problem is that
8:36 am
hezbollah and its iranian-backed proxies like hamas and houthis have never kept an agreement. so i think the prime minister is doing the right thing but i also think he is very smart to retain the right to restart the fighting if hezbollah breaks the truce. >> sandra: alex hogan is in tel aviv at this hour. hi, alex. >> major international efforts today to secure this cease-fire with expectations it could happen as early as this evening. potentially go into effect by tomorrow morning. the state department saying it is doing everything it can to push this deal across the line. under the cease-fire hezbollah, the iranian-backed group in lebanon would need to move its forces north of the litani river. 20 miles north of the israeli border. the cease-fire would call for the withdrawal of israeli forces from lebanon, lebanese army along with the u.n. would create

a buffer along the border. they hope the deal will be agreed on by tonight. israel's defense minister warned that if the lebanese army and u.n. workers do not enforce the buffer zone along the border israel will protect itself against any threat. former secretary of state mike pompeo highlighting threats will remain. >> iranian sponsors in tehran. they aren't signing onto the deal. goodness knows whether the attacks will continue from syria and gaza. >> a bitter pill for civilians in gaza still hoping for their own cease-fire. today for the first time in five months the jordanian air force brought humanitarian aid practices in the northern part of the strip. initially hezbollah it would not agree to a cease-fire until the war in gaza had endsed. a condition clearly that is no longer one of the

non-negligentibles. prime minister benjamin netanyahue is expected to peek in israel within an hour and a half taking place at 1:00 p.m. eastern time and we'll follow the latest. >> sandra: we'll watch for that on america reports at 1:00 eastern time. the menendez brothers will stay behind bars for now. the judge said he was not prepared to move forward. resentencing hearing is delayed until late january. that gives time for the los angeles district attorney time to review the evidence. lyle and eric menendez attorney had this to say outside the courthouse after the hearing. >> it was a very -- first of all, the first time that lyle and erik have been at least remotely in a courtroom in a number of years, number one. it also was quite a moving experience. >> sandra: chief correspondent jonathan hunt is in los angeles as we continue to watch this play out.
8:39 am
jonathan. >> sandra, erik and lyle menendez and their sporters hoped they might be home for the holidays. that will not be happening after a judge here in l.a. told their legal team he is delaying their resentencing hearing until the end of january because he needs more time to go through all the evidence and documents from the case which stretches, of course, back to 1989 when the brothers, then 18 and 21, murdered their parents kitty and jose menendez. >> by january 30th or 31st we're hoping that by the end of that, or sometime sooner, that we will, in fact, get the brothers released. >> the move to free the brothers is supported by some menendez family members including sisters of both murdered parents. >> i can't stand it. >> 35 years is a long time. >> it's time, yeah.
8:40 am
>> the resentencing recommendation for the brothers now in their 50s is being reconsidered by l.a. county's incoming district attorney nathan hawkman. >> i will be doing that thorough review of the facts and the law as the judge will as well. that involves reviewing thousands of pages of prison records. thousands of pages of trial transcripts from two month's long trials. >> even if the new d.a. decides to support resentencing, sandra, the judge must then agree to it and even then eric and lyle menendez would have to face a parole board before freedom could be granted. they have a few months more behind bars. no guarantees of anything at the end of this process, sandra. >> sandra: we'll be watching it. jonathan hunt on that for us. thank you. you are not alone if you are hitting the road for the holiday. a record number of americans will be traveling. we'll tell you where the sailing might not be so smooth.

plus the democrat depression still looms large as the party is trying to figure out what went wrong in the election. here is one take. >> it is not that you are talking wrong to people. it is that your issues sets, the things you stand for are not considered attractive by more than one half of the american people. >> sandra: you may be old enough to remember the movie "reality bytes." v.p. harris is back in washington set to face her pop donors, ouch.o take a moment to address my fellow veterans, because i know so many of you have served our country honorably. one of the benefits that we as a country give you as a veteran is the eligibility for a va loan, for up to 100 percent of your home's value. if you need cash for your family call newdayusa. with automatic authority from the va we can say yes when banks say no.

8:47 am
>> sandra: optimistic attitude is good. brooke taylor is at the dallas fort worth air for the. >> so far here smooth sailing in dallas. a lot of people saying they got to the airport early but no problems. there is a flight headed to cabo soon and people said they traded in the turkey for some nice weather by the beach and who can blame them? aaa predicting that 80 million people will travel at least 50 miles from home between today and next monday. most of them going the travel by car. here is what some of the travelers we spoke to had to say they are looking forward to most. >> we do the turkey trot and then dinner. being with family. >> we're going to cabo. headed out. the first thanksgiving where we aren't eating turkey and gravy. a little switch up. hopefully enjoying sun for this
