public office has always pridefully boasted about his word as a biden. we now know his word as a biden is trash. for months he and his white house spokespersons promised the american people they wouldn't pardon hunter biden. not only did he lie to them about that, look at the scope of the pardon. it is far beyond the offenses for which he was convicted. it is any crime he committed whatsoever for 11 years. which raises the question what crimes does joe biden think his son has been committing for the next decade plus and raise the question whether joe biden will pash done his brother as well up to his neck in the biden family influence peddling operation. i would ask joe biden to commit not to pardon his brother but again we now know that his word as a biden especially about pardons is trash. >> dana: do you imagine that the incoming administration or even

the senate will try to continue an investigation into what has been alleged about the bidens? >> well, dana, i think we have to wait and see who else joe biden pardons. if he pardons his brother and maybe a sister, maybe some of hunter biden's corrupt businessmen there may not be anything left to investigate at least for criminal liability. i will say this, though, joe biden may come to regret this decision because having given his son a blanket pardon of 11 years to include time when joe biden was vice president, hunter biden now can't plead the fifth if he appears before congress or appears before a grand jury. he has to testify about exactly what he was up to, for instance, when he was traveling to china on air force two and meeting with chinese communists or why being paid hundreds of thousands of dollars to sit on a ukrainian energy company's board with no

qualifications. that may be one unintended consequence of the pardon that joe biden didn't fully think through. >> bill: a democrat out of arizona was one of the first to chime in on x. he said i respect president biden but i think he got this one wrong. this wasn't politically motivated. biden was convicted by a jury of his peers. kash patel is nominated to be the head of the f.b.i. trey gowdy summation of him as he knows him from last night. >> he would not know the foundation or the funding of the steele dossier. you would not know about fisa abuse, you would not know about fusion gps except for the work of kash patel. he is quite candidly the most unfairly maligned person that i worked with. the entire eight years i was in washington. >> is he the right guy for this job and how well do you know

him? >> well, i don't know kash as well as trey knows him, having sat on the house intelligence committee and worked with kash on that committee. but i do know that trey is right when he talks about all that kash worked as a member of that committee, staff and then at the white house to expose the corruption and wrongdoing at the f.b.i. and the department of justice that unfairly targeted donald trump and those around him in his first campaign. i would also point out he has many years experience as a federal prosecutor and a federal public defender. which means he is experienced not only putting criminals behind bars but also can understand what happens when government overreaches. that used to be something for the last four years that the democrats extoled as they put public defenders on the bench. now they condemn that kind of experience at the same time that joe biden is committing a total perversion of justice by giving his son the most sweeping pardon

in modern american history. a stark contrast for the democrats. >> dana: one of the things from the previous hour, andrew mccabe, the former acting f.b.i. director said that kash patel is profoundly unqualified for this job and it's not even like a matter for debate. there is going to be a debate. do you expect him to get confirmed? >> well, andrew mccabe is scared that someone like kash patel to expose the wrongdoing of partisans who have taken over senior positions. as far as qualifications go whether andrew mccabe or democratic senators, what were pete buttigieg's qualifications to be the secretary of transportation or cam plain when joe biden put a cross dressing luggage thief in charge of nuclear programs. kash patel has a long record in intelligence and law enforcement. the kind of qualifications you would expect for an f.b.i. director. i expect the senate to move

2023 death of jordan neely. cb cotton has more on that now. hello. >> good morning. before jurors begin deliberating the fate of daniel penny both the prosecution and defense will have a final chance to make their case on whether penny should be found guilty of recklessly killing jordan neely. over the course of the trial, prosecutors called a total of 35 witnesses including one of their key witnesses, medical examiner dr. cynthia harris, who testified that penny's choke hold did indeed kill neely. harris told jurors there was quote sufficient and consistent enough pressure during the restraint to kill neely and unanimous consensus on her team. penny's defense team argued their client had no time to de-escalate the situation and acted to protect others. they offeredcould have died usi expert witness and you can see

downtown here in new york. >> dana: paul mauro fox news contributor and former nypd inspector. we have them here for their expertise. you heard the chants of guilty as he is going in. the closing arguments are happening today. to catch people back up i want to play a witness who was there defending penny. >> dana: that's witness testimony video initially and you made a good point in the break. penny was never arrested at this moment after they do the initial investigation. >> police show up. according to their testimony neely's heart is still beating.

they gather all the information. take the witnesses back to the station house, including daniel penny. the video that was shown at the trial and in it while daniel penny doesn't know that jordan neely has expired, he gives his mindset how he was not trying to hurt him. he was just trying to prevent him from hurting others, etc. remember what is going on here. his defense's justification he was justified in doing what he did. he didn't go too far. when you boil it down reasonable person test. would a reasonable person have believed that was what was necessary. you don't have to take in this instance penny's word for it. you have the other witnesses who felt the same way. that's why the police didn't arrest. they threw it over to the d.a. and where it sat for ten days. there was no arrest until the protestors came out. city hall buckled. took him out. never went to the grand jury and had him arrested. >> bill: he did not take the stand. defense rested.

judge said take ten days off and we'll talk about it after thanksgiving. however, there is an interrogation video at the cop shop. call for number three, guys. going back some time. >> this guy was threatening. i was concerned he would actually lash out saying he is willing to go to prison forever and going to kill this, this. i look around there are women and children. >> bill: there is more from that. what do you think? >> as my counterpart mentioned the probable cause was shallow at best. we didn't have an arrest. it was the district attorney that pushed it. bear in mind the district attorney is an elected official. so he is speaking on the part of the people that elected him and that's why i believe the agenda was pushed. when we look how this manifest laid on down the line. the standard of proof is beyond a reasonable doubt in a criminal case. i don't think that the testimony that's been introduced has rose to it being beyond a reasonable doubt. i believe that mr. penny will

get off. it begs the question is this a miscarriage of justice and i highly believe so. put yourself in that position. as a common citizen if you are on that subway and it was your mother that was being a costed by some lunatic what would you do? if it was myself, bill hemmer and you, of course, we would have all triangulated an attack and taken him down and that's when my counterpart would have laid the cuffs on him. that's what happened in this situation in essence. we need to applaud the fact we had a genuine public citizen that stepped in and helped out. >> dana: here is the "new york post" editorial board. house of cards against daniel penny is falling apart. so much evidence that penny was protect being himself and others and other factors likely contributed to neely's death bragg's decision to prosecute looks like politics. other factors likely contributed talk about his drug problems. >> right. he had a drug called k2 in his system. synthetic marijuana. it is not that, it acts in the

testified the choke hold killed neely. pathologist hired by the defense team disputes that. is that what this whole case could come down to? >> that's a germane component. you have defense witnesses present the certain narrative and prosecution witnesses that will present something differently. it's in the hands of the jurors. they will either make or break what happens in the final outcome in this case. i can tell you from being on many in these trials as an expert witness i have seen these verdicts go extreme left to extreme right. we don't know what these jurors are thinking. i generally believe the prosecution has failed to present this beyond a reasonable doubt and we will see an acquittal in this case. >> i will say a hung jury. i think it will go awhile. it is manhattan. as people try to influence the decision and protest ask yourself this now that we have a little feel for what daniel penny is like in the same circumstances, somebody who did that on the subway, screaming

i think what's happened here is this has become sort of the instagram universe where these guys aren't happy enough to win but they want to plant flags on the midfield stripe. baker mayfield years ago, now the quarterback of the tampa bay buccaneers, did this with oklahoma, i believe it was against ohio state. it went mega viral. a lot of these kids have seen those clips circulating and so they hate these rivals. you look at that. michigan and ohio state, nc state, north carolina, florida, florida state. they also had i can't believe i hope you get to see this at some point. arizona state spikeed the fork on the arizona -- they have a fork they run around with that is pretty incredible. that was all going on but man, it was an amazing weekend of football if you were out there with your friends and family able to check it out. >> bill: what does the ncaa do? i was listening to one analyst

saying they should hand on fines worth millions of dollars and there is a incident in the ohio state/michigan game. there was a sheriff's deputy down in the middle of all that when the mace came out. it wasn't abuse of power the way i saw it. >> you could see it there with the mace coming out. it is crazy. was anybody in danger that you needed to pull out the mace can? that guy is a moron. but in general i think it is on the coaches. both sides, right? you have 60 minutes to prove whether you are the better team. deciding that you will plant your flag on the midfield logo of an opposing team is seen in many ways as disrespectful of that team and so the idea that you would do it is taken as a provocation over and above the game itself. i think coaches on both sides have to say we aren't going to do this.
