has made and they are sticking to it. you can make the case that she sort of made the situation worse in that gaggle. >> a look at those responses from her and i think she should be very angry today. she should go in there and say to president biden and the rest of the leadership, you sent me out there and you made me lie, and that's wrong. she could have been more equivocating and she could've said let's let the system play out and see what happens, he is supposed to be sentenced. just be honest that they were still in the midst of figuring this out. i think that nobody is surprised the president had decided to pardon his son. he's about to be sentenced on the 12th and the 16th of this month. one of the things we are going to talk about, this afternoon on "the story," he posted after he saw it president biden said that it was clear hunter was singled out because he was my son, and they take that very personally,

the whistle-blowers. because they are saying we investigated this case starting in 2018, for several years we were basically cut off at the turn. every time we got close to figuring out who is involved here, and it president biden was cognizant of some of these tax evasion and business dealings. they got cut off at the knees by david weiss, they claim. so they are going to have them on today and get their reaction, because they feel personally maligned by what the president had to say to them. and they put themselves really out on a limb as whistle-blowers. it's not easy, what they did, and there have been ramifications in their lives because of that. >> sandra: that will be a fascinating interview to watch. meanwhile, more from karine jean-pierre responding to questions from reporters including, would this have happened if harris had not lost? here's the exchange. >> do you think this would've happened if harris had not lost the election? >> i'm not going to get into the election. it's a no, i can answer that. and what i can say --

>> this would not have happened? the pardon would not have happened if harris hadn't lost the election? >> to where we are today, i can't speak to hypotheticals. >> sandra: interesting question. >> it's another moment where joe biden looks at the situation, probably, and says if you left me in there things would be different. i figure that harris is going to win, and she didn't, and i have to backpedal on something i didn't want to have to do, but now i have to free hunter before he gets sentenced. >> sandra: apparently the left is not happy about this, either. this is colorado governor saying he understands helping his son by pardoning him but i'm disappointed he put his family ahead of the country. that's a bad precedent that could be abused by later presidents and will sadly tarnish his reputation. and here is the left media

slamming his decision. listen. >> what i think is not disputable is that this is a historic active political nepotism. let's be clear, joe biden lie to us for a long time. >> nobody is above the law. joe biden just made clear his son hunter is above the law. >> the notion that he hadn't committed crimes are that the process was tainted and political i think is deeply unfortunate for president of the united states to say that. at least in this instance, he sounds a good bit like mr. trump. >> sandra: while not shocking, the decision, this is the reaction from the left to it. >> he set up in court and admitted to tax evasion, admitted to these crimes, the gun charge. he has already said that he did these things. i think the more honorable thing to do would be to wait this process out, and for hunter to say let's see what comes my way when i get sentenced. the pardon option was always going to be on the table all the way up to january 20th.

defend people after neely began acting erratically. let's begin mercedes colwin and mark eiglarsh, both criminal defense attorneys. welcome to both of you. >> thank you. >> great to see you today. >> mike: i'd like to start with some of the body cam video of witnesses at the scene to get our audience of seal, and i'll let you guys react. >> i heard the young man on the floor saying, i'm willing to die, i'll do anything. i'm willing to die. i go to jail. i don't care. he was saying it so loud that everyone turned around. >> he scared the living daylights out of everyone. >> mike: closing arguments underway in this marine veteran's case. what is your assessment of the trial so far, mercedes? >> well, mike, they really did a good job. the defense really focused on and made sure the juries put themselves back in that train

car. it is so vastly different than what their experiences are day-to-day in that courtroom. they have to be back in the train car. feel the fear, feel the terror, listen to the individuals in that car that were paralyzed with fear. some of them said they'd never been so afraid in their lives. there was a mother trying to protect a toddler strapped in the sea. it was an unbelievable day and that is certainly what the defense needed to do, really focus their attention on what took place there. they did exactly that. the one issue, i must say -- and i'd love to hear what mark has to say about this -- the one critical issue is that jerry probably wanted to hear from daniel penny. i know it is a huge risk as a defense attorney. it's a question you start asking the moment you are retained as a defense attorney. is this person going to take the stand and should they take the stand? granted, they had lots of video of daniel penny talking to law enforcement authorities, but at the end of the day hopefully

it isn't a big question mark in the jurors' mind. why didn't he take the stand? we heard from everyone else. want to know what his thoughts were at the time he was restraining jordan neely. as a big risk. we will have to see what happens at the end. >> mike: our colleague, judge jeanine pirro, who's been in the courtroom, has talked about the power of the body cam video. let's play her clip. >> we are frozen in time here. everyone is describing the fear and the fact that they were on the brink of collapse. they thought they were going to pass out. and they were white and hispanic and black. to make this about race is totally irrelevant, because everyone on that train was afraid. >> mike: presumably all those jurors have been on a new york city at some point, perhaps fearful at times. your thoughts on that and where we are in this case? >> first, i think this is completely political. if you take politics out of it, you have a guy who is a hero.

they recently feared imminent great bodily harm or even death. he not only had illegal right but an obligation to subdue this violent alleged victim. as to mercedes' point, he already spoke without the benefit of having an attorney. he went in and he wei waved his cherished miranda rights and he laid out why he did what he did. at best, the best the prosecution has expressed negligence. and i say perhaps because he is responsible ultimately because he had a minute choke hold. however, we bring criminal charges against people who commit to criminal negligence, where they get to the point where it is a reckless disregard of human life or property. that is not what we have here. i believe that he already told these cops what he did, what he did it. he doesn't need to take the witness stand. i believe are going to acquit him. they should.

>> mike: mercedes, i.e. supervisor at the stage when you consider a lot of crimes go and prosecuted in these blue cities right now? are you surprised? >> this case has divided the city. we are all new yorkers except for mark is in paradise over in florida. this has divided the city. there are those that believe daniel penny is a murderer and then there are others that are so passionate about the fact that really daniel penny risked his own life in taking on the circumstances on the train and that day, including some of these passengers, individuals that testified for the defense or were adamant that danny penny had to step in and do something because everyone was terrified. so there's definitely a groundswell of support for daniel penny. there are a small number of individuals, i'm sure as was reported earlier, that there were these protesters outside of the courtroom chanting "guilty,

>> mike: going concern surrounding the cost of america's migrant crisis and where exactly that money is going. new york city is facing new scrutiny over its deal to house migrants at the roosevelt hotel, which sent more than $200 million to a company with ties to pakistan. national border patrol counsel president paul perez is here to discuss, the first, fox business' lydia hu is live with more details. where is that many going? >> we are talking about, this hotel is owned by pakistan international airlines. that is a state-controlled

entity. last year new york city entered a 3-year deal for $220 million to use the roosevelt hotel and it's more than 1,000 hotel rooms as a migrant shelter. now that deal is raising concerns about whether u.s. taxpayer money is going to foreign countries over the weekend. vivek ramaswamy posted this on x. "a taxpayer-funded hotel for illegal migrants is owned by the pakistani government, which means new york city taxpayers are effectively paying a foreign government to house illegals in our own country. this is nuts." vivek ramaswamy as you know will lead the department of government efficiency, or d.o.g.e., along with elon musk. they may very well focus on spending on the migrant crisis. as of 2023, illegal immigration cost taxpayers at least $182 billion a year in state and federal taxes. most of these taxes are borne by

illegal aliens that have invaded our country and have no business here. >> sandra: you cannot underestimate how significant this report is by "the new york post," that shows an alarming 59,000 migrants with felony records or facing criminal charges. that is the number of people that are just freely roaming around the city, with 670,000 total across the country. put that in perspective for us. how much risk are americans in considering those numbers? >> there at great risk. the thing about it is those are just the ones we know about. there are many gotaways that we don't know who those people are and we don't know whether criminal records are. even the people we have released, they are unvented because countries like venezuela are not sharing their

information with us. so it's very scary. when you have the lady in aurora saying it's only one or two complexes that have been taken over, those are only the ones we know about, because a lot of these people are afraid to report crimes because these criminals have a stronghold. so it is a very insecure -- we need to come in there, clean these cities up, because of what biden and kamala harris have allowed. it's worse than what people think. >> sandra: this was "the new york post" headline, the front page of the weekend. "gang's all here. got them home to kamil migrants. among those numbers, more than a thousand suspected gang members." consider that and consider a city that is already in such jeopardy dealing with all these migrants that it has taken on, and now knowing the statistics. this is tom homan this morning.

the problems that were created were sanctuary cities don't cooperate with i.c.e. let's watch. >> we're not asking you to be immigration officers, we are asking you to assist us in the jails. we can't arrest a bad guy in the jail, and the safety and security of a jail. that means they release them back in the community. they are screaming and yelling, they don't want i.c.e. officers and their neighborhoods. guess what? if you don't want us in the jail you are forcing us into the neighborhood. more officers in the jail means less in the neighborhood. it is simple math. >> sandra: as somebody already spending a lot of time with this and coming team for president-elect trump, what is the plan? how do you ask these blue cities to step in and help? in that case, with the jails. how do you round up these criminals and gang members? >> tom has made it very clear, the president's agenda is to secure america. he wants to take care of all of americans, provide secure cities, bring back law and order. all they have to do is give us

access to the jails so they can go in there and remove these criminals. they are playing politics. they are putting politics over security. the way it's going to work, we know there are many people walked in jails and prisons that have no legal status. so all we need them to do is turn them over to us. when they completed their sentences. or let us go in there and get them before they completed their sentence because they're going to be released on bond, and we can remove them. it's that simple. there's not a lot they have to do. but like tom homan said, if you don't want to do it, get out of the way and let us do it. they cannot put their citizens at risk over politics. that's all it is, just politics. to protect american citizens. >> sandra: you've seen a lot and you've been raising the flags for a long time. thank you for joining us. >> i appreciate it.

if i was tom homan, i would go into court. if you're going to harbor criminals who should be deported, you should get an injunction release from the city and those officials. the other issue is crime, mike. prop 36, the anti-crime initiative, 60% of california passed for it. george gascon, the district attorney, he lost by 20 points. the point is very simple. citizens of california want law and order, and gavin newsom, george gascon, and the democratic leadership are in denial. >> mike: "the washington post" editorial board had an interesting take on george gascon's failure in los angeles, writing, "how l.a.'s godfather of progressive prosecution failed. why he failed to secure buy-in from career prosecutors. researching sentencing enhancements made it harder to keep the worst offenders off the streets. mr. gascon directed that juveniles cannot be charged as adults no matter how egregious their crimes. not

he overrode his mandate." what is your reaction to that? >> i would say those five reasons are valid, but more importantly, george gascon took his marching orders from george soros. he did not listen to the citizens of los angeles county. we do not want to live or coexist with criminals. george gascon did not want to put anyone in jail, and those five reasons, sentencing enhancements, not taking gang members off the streets, not seeking the death penalty or life without the possibility of parole, it does not make sense. every civilized society believes in line order except george gascon and the progressive d.a. in california. that's why they lost. >> the incoming ta nathan hochman is talking about taking a hard middle approach, saying the hard middle strikes the proper balance of accountability since it enables prosecutors to make decisions on a case-by-case basis, driven first and foremost

>> we really believed to love our neighbors as ourselves, and when we see the town of boone is doing really well, we wanted to reach out in tennessee because they have been devastated worse than we have been. so we wanted to just be with that community and walk with them to this disaster. >> sandra: vanessa, i know this is so important to you. you both organized this beautiful christmas party. we have been showing video of t up on the screen. think leave those kids can enjoy some holiday cheer and open presents. we know how important that is this time of year. what was their reaction? >> oh, they were so excited. each child got a bag personalized for them with their name, and they have been prayed over, so we were just blessed to give them something to lighten their load, to lighten their days, and they have been through a lot. we were excited to be part of

"wine to water," bringing cheer to the family. it's been a blessing to us. >> mike: tina, i'm curious -- s are heading into the christmas season, what kind of satisfaction have you received from helping these folks during this difficult time and they've had their lives tury hurricane helene? >> i can honestly say that my christmas was already made, from being with those families and children, and the hugs. this one little girl ran at me and knocked me over because she is so tough, because these kids' lives way back in the mountains. they aren't privileged with the things we are in the city. we might teach them how to clog. we clogged to end the night with a bang. we did a big hello down and square dance with the children. we had a blast and we are going back. you are not going to forget about them. the family said, don't forget
