>> dana: hello, everyone. i'm dana perino. happens every monday! along with ted jeanine pirro, jessica tarlov, jesse watters, and charlie hurt. it's 5:00 in new york city and this is "the five." >> dr. biden, do you support the pardon of hunter? >> dana: first lady jill biden breaking her silence saying that she supports what some are calling the most sweeping pardon since richard nixon. president biden issuing a blanket pardon for his son hunter covering a decade-long period where hunter had been convicted of tax and gun crimes as well as other offenses that haven't even been adjudicated yet. the president argues that hunter got a raw deal and singled out because he is his son. biden even portrayed it as an act of honesty, saying, "for my entire career i have followed a simple principle: just tell the american people the truth."

but many feel that it smacks in the face of reality, and these repeated denials president biden gave to the media. >> i will not pardon him. >> will you accept the jury's outcome, their verdict, no matter what it is? >> yes. >> have you ruled out a pardon for your son? >> yes. >> dana: now looks like someone's not getting their story straight. the last clip we showed you a president biden was from june, and then this. according to nbc news, june is when joe biden was discussing the hunter pardon with his aides, some of whom decided at the time that he would publicly say he would not pardon his son even though doing so remained on the table. however, just today, karine jean-pierre said that was a recent development. watch. >> he said he came to this decision this weekend, and he said he wrestled with this. because he believes in the justice system, but he also

believes that there were politics infecting the process that led to a miscarriage of justice. >> the justice system is broken? >> he believes in the justice department. >> you just s said it infected with politics. >> i just that i will not interfere. >> how many selective prosecutions are there at the doj? >> what i can speak to is this particular case. >> dana: i'm not going to subject you to this everything, unless we needed, about how karine jean-pierre said a million times from the podium that he would not do the pardon. but that's what happened. we'll take it on the table. judge, let's start with you. the one thing about this pardon is how sweeping it is. like anything he did in that time frame. >> judge jeanine: did you notice that? and some of those years, it encompasses the years that david weiss, is the so-called special counsel, i think he is, allowed the statute of limitations to run in the highest earning years that hunter biden had, and it certainly involved his father

and his business dealings. they have done everything they can to try and cover up what they did. they have denied, they have lied. joe biden started out this presidency by saying, "i know nothing about my son's businesses," and he's ending his presidency by lying again and pardoning his son. the bottom line here is that they're afraid of something. they're afraid of the trump justice department weaponized and going after hunter for things david weiss did not indict him for. and only donald trump can speak to that issue. but let me just say a couple things, and i'll be very quick here. they knew that jail time was coming for hunter biden. he's convicted of two celanese. not one, two. if joe biden says there is no reasonable who would look at these facts and reach the same conclusion, he was singled out because of being his son, he was singled out because he was your son, then why didn't you fire

merrick garland? if the justice department is so selective in their prosecutions, fire the guy that you hired, okay? let's talk about the fact that he's always said no one is above the law. hunter biden is a classic example of someone -- a classic example of someone above the law, because he was never even sentenced. most of the pardons we hear about our pardons or someone has served their time, they paid their debt to society, and they are going to end up getting it removed. it is an impediment going forward. not this case. we won't even know what his sentence would have been. for him to call out the media and selective prosecution is absurd. a jury found him guilty. are you saying you don't believe in a jury system anymore, mr. president? by the way, is your son stupid? he pled guilty to six tax evasion counts. if that is selective prosecution, why didn't he take it to trial and say this is selective prosecution?

it's all about a joe biden lying. he is starting and ending his presidency in the same way. >> dana: and charlamagne tha god said this today, jessica. >> i just want democrats to stop acting like they are on this moral high ground politically, when they have shown us they're not. whether they are skipping the primary process when biden stepped down, things like biden pardoning his son. stop acting like y'all are the pure party and republicans aren't. >> dana: mixed reaction from the left on this. what you say? >> jessica: there is. a lot of people are doing political jockeying. if i'm thinking about running on the future, i want to be on record as saying this is an abuse of power, and maybe we should have a larger conversation about presidential pardons, because it seems perhaps they are too sleeping that on your way out you can just about do anything. i think for a lot of rank-and-file democrats they actually would rather see joe biden do this, because this feels like mitch mcconnell vibes. someone who is like, we are not going to see merrick garland before donald trump comes into office. i'm going to make sure that supreme court seat is open.

then privately having conversations saying of course it's on the table. this is why no one believed them anyway. now all the lies -- i had the four lies, i'm going to add the fish fly. >> jessica: i don't disagree with that. he should have always said, "maybe, i don't know. i have to see where the chips fall on this." but one of the messages that came out of the election was voters don't think donald trump is a threat to democracy, they don't care about norms or any of the things democrats were campaigning on. and i think joe biden just essentially said, on my way out, i don't care anymore and i'm just going to protect my kid. >> dana: i'm not sure i'm buying all of that. >> i would protect my kid if jesse jr. did something bad. >> dana: you probably wouldn't let him be on the board of burisma and send you a check. >> jesse: i would need the money like joe biden's family, who could make an honest buck. >> jessica: you make that much. this is prime time. >> jesse: my mother wouldn't pardon me but i'm sure my father lead. everyone knew he would pardon his son.

no republicans wanted to go on record, because they didn't have it. >> jesse: donald trump got impeached for looking into what joe just pardon his son for. you guys said it's okay for foreign nationals to bribe a first family? as long as it doesn't hit his checking account? and then it hits a checking account and you're like, i don't know. >> dana: charlie, you've been in d.c. for a while, seen a lot of things. on a scale of 1 to 10, ten being the most brazen, how brazen is this? >> charlie: it's pretty brazen, but i agree we all knew this was going happen. it's not surprising that he lied. he's lied throughout his entire career. before barack obama plucked him out of the security, he was known almost exclusively for his failure at campaigns because he lied about absolutely everything. so all of that is not really a surprise. i think it's kind of interesting is the democrat reaction. i think the fact that they are kind of freaking out has a lot to do with the fact that -- it's like joe biden rolled another grenade into the democrat party as he's being forced off the

stage. by confirming basically what donald trump's entire campaign is, which is that the department of justice is filled with corruption, and that there are all these political persecutions going on. and now -- if you read his statement and just take out the sort of absurd things he says about hunter biden being persecuted, it sounds like a statement that donald trump would have made. the truth is hunter biden is the most privileged criminal in washington. he's gotten every advantage. so when he talks about political persecution, it's not in the way we think. the last thing i think is interesting, usually politicians wait until january 20th to drop their controversial pardons. he's doing it now. so my question is, who is he going to pardon on january 20th? is he going to pardon his brother? is he going to pardon himself? this pardon is so extraordinary, because of the length, but also because it was a prospective party. to pardon him all the way to

the damage that the 2024 campaign has done, the damage this decade has done to the democratic brand is almost unfathomable. you can audit the campaign, audit the dnc, so people can know. i'm telling you, without complete transparency, two and a half billion dollars. do you have any idea where that money went? >> judge jeanine: jessica, he says two and a half billion dollars. is james carville right? has kamala done this unfathomable damage in terms of -- is it because of her as a candidate to the democrat party, or is it because of the money that she wasted and is still trying to raise? >> jessica: out to get her to put it on kamala when biden was clearly part of this. the timeline goes back a year

[laughter] i understand what tim ryan is talking about. sherrod brown has been extreme and successful statewide in ohio until this last election. i know that he lost, but these are people who have genuine working class bona fides and ways of talking about it. every demographic group, democrats underperformed with, except people with a college degree and a postgraduate degree. so that's obviously something we need to work on.

we also picked up and held the key senate seats and that shouldn't be ignored. seats like jared golden and pat ryan, very competitive seats. so it wasn't like democrats that rejected across the board. >> judge jeanine: well, the republicans have the house, the senate, and the oval, so the pretty big rejection. let me ask you this, jesse. tim ryan. why did it take a loss for him to come out and say we've got to be more into what the working american is worried about? didn't he realize that he was part of the con himself, with drag queen story hour and men and women sports? all of a sudden now we get it. >> jesse: it's like when someone breaks up with you. you start looking inward. "was it something i did?" every time you lose, whether it's a football team or anybody, you look at the tape and figure out what you did wrong and you try to win next time. but i love how this government burns or trillions of dollars, and kamala burn to disk $2.5 million in everyone's looking for every penny?

working class. and they ignored him. and they paid a price for it. so i don't know who emerges. there is a guy from wisconsin, i can't remember his first name. he's the state party chairman in wisconsin. he's the first person to step up and say, i'll do it. i have an idea, have a message. one of the things are going to have to do is figure out a way to deal with the left-wing dark many groups that were funding all these activities and pushing the party farther and farther to the left. i don't know how they break that, but they have to do that, they have to deal with the fact they lost the working class. how do you get them back? with the agenda? what are you going to do and s say? as you pointed out, the republicans won the white house, the house, or kept the house, barely, admittedly, but they have more people in the senate. and also we have all these court cases coming through with the conservative court.

incumbent. two incumbents with half as much money as the other person. this is an thinkable and politics. he could also undo the other curse, that the party in power in the white house always loses massively in the first midterms. he could undo it if he made good on these agenda items that people like bernie sanders applaud. the problem with the democrat party i think is so much deeper than i think anybody realizes. if you have a dei party, which is what this is, and she was a perfect candidate, a terrible candidate but the best they could come up with, she didn't get 75 million votes. 75 million people voted for her because they didn't like donald trump. she didn't earn a single one of them. the problem for the party goes back many years, and i think barack obama kind of managed to paper over these problems by trying to put this racial

classified. i think it's brilliant. i'm very much behind it. the democrats have weaponized government. they've done it for years, and they did it in the fisa court with an unverified document, money that the steele dossier was paid for by hillary clinton through her law firm, and it goes on and on. there's been no consequence for those people who relying about that unverified one. no consequence, nothing. even court did nothing. i'd be disbarred for it, but you would dare to come to me to spy on an american through the fisa court, through a lie that you know is unverified. but, in the end, i think that is one of the most important things he can do, and we want to know about jfk, we want to know about 9/11. i want to know about crooks. what about this for an encryption act, this app that he has that is encrypted, that nobody can get into? i want to know what that says.
