>> steve: all right. our lead story this morning, the department of justice special counsel david weiss says that the motion to dismiss hunter biden's indictment should be denied by the judges in the case. >> brian: madeleine rivera is in washington. maddy? >> hi, guys, good morning. special counsel david weiss and hunter biden's legal team is how hunter's legal cases go away. arguing that the president's full and unconditional pardon warrants the dismissal dismissal of the indictments. weiss is taking issue with that saying that does not mean the grand jury's decision to charge him based on finding of probable cause should be wiped away as if it never occurred. weiss goes on to say there was not and never has been any evidence of vindictive and selective prosecution. that statement there is particularly striking, given that it contradicts the president's assertion that hunter was targeted for being his son. in response, hunter's laura, abbe lowell says the special counsel acknowledges that the majority of courts, when faced

with such a decision, have chosen to dismiss an indictment, that special counsel's admission that this is a practice of the majority of courts, certainly provides legal support to mr. biden's claim that this dismissal is warranted. local ads a dismissal doesn't wipe away the indictment like it never happened. it just reflects that an indictment has been resolved. >> steve: madison, what this is saying he, the special counsel, hey to the two judges the one in california and the one in delaware, don't dismiss them. and apparently it's up to the judges they can decide whether or not they wants to dismiss the charges? >> yeah. look, the core of the special counsel's argument here is that these indictments were returned by a grand jury independent of the court. and they say that's why these claims -- hunter's claims that he was a victim of selective prosecution, all of those are baseless, yes, you will see what the judges have to say about this in the coming days,

that's his words, is cruel and enough is enough. >> lawrence: she lies. she just makes stuff up. >> brian: she says politics have gotten involved in the justice system which they lauded as believing in the justice system. you can't believe in the justice system and say politics got involved in the justice system. and it's affected this case. that means it effected david weiss who you left on the job. affected the deal that fell apart because unbiased judge looked at it and said i have never seen like that. what is so amazing she has got to be embarrassed. she was assured over and over again this pardon wasn't coming. michael bennet upset by the decision, personal interest ahead of duty, democrat, gary peters, president biden's decision to pardon his son was wrong. senator peter welch, president biden's pardon of his son is the action of a loving father, understandable but the action of our nation's chief executive is unwise. it goes on and on and on. i have just think about all those people who went to bat for the paragon of justice and

trial. right? and his attorney general allowed that to happen. this is the next time when his department of justice said that it was time to bring charges against his son and he is now saying that his department of justice is political. the question is, will we hear from the attorney general on this? where his statement on this. taking on his department. will he defend his men and women? >> we have heard from david weiss, the special counsel, and he says look, it wasn't political. grand jury returned an indictment and that's why we proceeded with this. you know. >> bragged about this in his book. he writes that he did this. >> >> steve: right, right. we all knew that joe biden was going to pardon a full and unconditional pardon for hunter. we knew that we knew that for over a year. but for kjp, kjp looks terrible. here's the thing. she said -- she has been emphatic. she is positive. no pardon, no pardon, no pardon. she has told that lie, maybe she

that is the question taking over this manhattan courtroom today as we go to day two of closing arguments. let's take a look back at yesterday. started off with about two hours of closing arguments and painting very different picture from what we heard from prosecutors. telling the jury that on that day, may 1st, 2023, the eyewitness accounts describing 23-year-old jordan neely someone suffering from schizophrenia, high on drugs, threatening to kill people on that train when daniel penny stepped in saying this, quote. ment daniel acted when others didn't. he put his life on the line. he did that for perfect strangers. who would you want on the train next to you? the guy on the train with the ear buds, minding his own business, who you know will be there for you if something happens or you just hope someone like neely never enters, especially when you are all alone. prosecutors during its initial part of the close, arguments

intentions in the influence peddling scandal sur rounding his family. david weiss objecting to the motion to dismiss hunter's case that gw law professor jonathan turley heard us talking about him and scrambled to the zoom and joins us now. first off on david weiss saying i don't think we should go ahead and follow through on the pardon we should follow through on the case, your thought? >> i think it's just positively nuts. of course he should dismiss the case. i think it's an effort to try to scrub away the stain of this case for weiss. he was at the center of that sweetheart deal. he wanted to give the bidens precisely what the president just gave in this pardon, a sweeping immunity for not just crimes he was accused of but other unnamed crimes. he is not going to scrub that away. and saying that i would like to stay in this fight a little bit longer is unlikely to impress these judges, you know, this is not hear to redeem yourself. the question is is there a case to be tried. and the answer is no.

there's not. >> you also believe that hunter biden might not be out of trouble yet. why? >> well, the president clearly is hoping that he has given him this sweeping protection. and that includes unnamed crimes. quite literally, you know, hunter biden could have, you know, six heads in a duffle bag in his basement and this would cover it as long as he committed those murders during this 10-year period it. would not protect him by the way from state charges. but, it's a sweeping pardon that we haven't seen legal really the likes of since nixon. it's pretty unprecedented in that respect. the problem is that hunter could be called before congress. congress has committees that are still looking into the influence peddling scandal involving millions and millions of dollars. he could be called to testify. last time he did that the house accused him of being misleading. even false in his testimony. if he commits perjury again,

it's a new crime. and this pardon will not have an impact. and he could face additional charges. >> brian: you also write he might not have to pay all his taxes back number two so many questions. what did you do the money in china and what did you do with the money from the moscow mayor and romanian billionaire. what about carlos slim? is he ever have to pay taxes on this or answer the question what did you do to earn that? >> i think he should be called to congress. and called to give a full account. we have a lot of questions. you know, the bidens have been notorious for nepotism and influence peddling. i have been writing about them from before the biden was vice president. they are the goats of this favorite form of corruption. in d.c. which is influence peddling. and this pardon really sealed that status. i mean, we have never seen anything like them. they have done an amazing job in
