arguments this morning in the daniel penny criminal trial. the judge will then instruct the jury, they will deliberate whether the marine veteran is guilty of recklessly killing jordan neely on the subway last year. they were in a locked subway car with a crowd of people. now a crowd outside the court this morning is not waiting for the verdict. [crowd chanting guilty] >> harris: more barricades are up around the area. likely in case of protesting after the actual verdict. daniel penny's attorneys argue he was protecting fellow passengers from jordan neely and his threats. listen very carefully to how witnesses who were locked inside underground a subway car describing the terror that they went through.

act. prosecution is saying in some -- penny went too far. jordan neely was a form of a threat but penny went too far. defense is saying no, he met the threat with a commensurate amount of force under the reasonable person test and you don't have to take daniel penny's word for it. you have all those witnesses. that's pretty compelling for a jury. >> harris: paul, talk to me, though, about the moments after the police officers got there. you were an inspector at the nypd. they were going by the book. first of all, daniel penny, they took into custody and took him down for questioning. he was not arrested. jordan neely is on the ground and not dead. >> he still had a faint pulse when they got there. by the time they get penny back to the station house cops are aware of the fact neely expired. penny doesn't know that neely is dead. they give him an open-ended video and let him talk. he does himself a lot of favors

his system. we had dr. boyden saying yeah, it is a problem for the victim to have had that in his system. let's get to this. new york city police arrested a 13-year-old illegal immigrant saying he and three other masked suspects beat and stabbed a man in times square a couple of nights ago on sunday. the reason apparently because that man would not take their picture. well, those three other suspects are still free right now. still trying to find them. we're seeing stories like this day after day after day. still many democrat-led city mayors and democrat lawmakers still say they will resist president-elect trump's deportation plans. even though we know we have this illegal border crossers known to kill in their previous countries and they have killed here, too. new york city mayor eric adams is not among them, though. he says he looks to respect new york's sanctuary policies,

son, hunter biden. >> right. and it seems as if even before the inauguration, the actual president is trying to do something in mar-a-lago. the broader point to this is these words, the "wall street journal" described as bombastic you can use that and they supported what he said. you see other commentators freaking out trump will bomb the middle east. no, this is exactly what trump promised and what the world could expect. peace through strength. this is the strength part. asserting america's right to protect its own people. and in the past when trump has done this look at the famous phrase from his first administration everyone freaked out over. fire and fury towards north korea. what happened after that? you have historic peace talks with north korea. my prediction is exactly the same way. this kind of strength from president trump will lead to peace and the return of the hostage. >> harris: can you imagine if you are leading, far down the

at other times being wrong. this isn't something we can tolerate. >> harris: so republican congressman wenstrup and others finally get it in writing. they put it down what we knew and thought all the things and say these are the facts. now what? >> exactly. so look, harris, it is great to have the information. good to have the vindication to those of us like you and i who said this all along as you just pointed out. the real question is when will we get actual accountability? let's start with the lab leak, which is clearly the origin of covid. people say well, you know, loose terms fauci funded the lab and funded the research. no, much more specific than that. we need to be really clear about it. fauci commissioned this research. he was the leading global champion of gain-of-function research. he wrote back in 2011 that experimenting in the lab in this way was a risk worth taking.
