presented by the prosecution and the defense. which way do you think this is going to go? >> i feel pretty confident that this jury is going to plan for the defense. not only does all of the evidence lead to pretty reasonable doubt coach about pack november 4th when jerry fox news reported beautifully on what the jury looked like and who they were in eight of the 12, john had a negative experience on the subway and they bring that to deliberations. and i think penny will be found not guilty at least of the manslaughter charge. >> john: here are some of the evidence the jury heard and call on body camera by responding police officers. listen. >> i heard a young man saying, "i am willing to die. able to do anything. i will go to jail, i don't care, i don't care!" he was saying it so loud that everybody turned around.

i do agree with heather. he will likely be exonerated of the manslaughter charge, but there may be a compromise verdict. the criminal negligent homicide, but we will have to see. the longer it takes during deliberation, then it will be sure the defense will start to feel a little concerned about it. >> john: they've only had the case for an hour so give them a little bit more time. so here is what daniel penny told the police immediately after the incident. he actually waived his miranda rights when he said this. listen here in. >> yes, i was not trying to injure him. i'm just trying to keep him from hurting anybody else. he is threatening people. >> john: not trying to hurt him but keep him from hurting other people. there is a lesson here that if you accidentally kill somebody, you sit down to talk to the police, make sure you have an attorney present.

but secondly, penny was let go from the interview seven days went by and protest in front of alvin bragg's office that finally led the d.a. to say, oh, you know what, maybe we better charge this guy. was it a politically charged environment that led to this case, heather? >> they were is always politics, unfortunately involved in these cases. we see this all the time. protest like that can drive but at the same time, john, protest on behalf of penny has had on the court found that they could hear from the courtroom. people have strong opinions both sides of this and it seems like a case questionable whether to be charged at all. >> john: one other aspect of the case that is curious. one of the prosecutor as coach, the district attorney, not too long ago prosecuted that a man somebody any phone both and robert pushed the man down and he was old, you can see them act -- it was atm, sorry, pushed

the man down, hit his head and later died of brain contusion. we should pursue this idea of restorative justice and he didn't mean to kill him. in that case, she wanted leniency for a criminal that accidentally killed someone. but at this case, she wants to throw the book, mercedes, who accidentally killed somebody trying to protect other people. i mean, where is the justice system going here? >> well, john, that is a lot of the frustration of a lot of individuals looking up this case have and feel about this case. because they are so many examples and that is a great example you provided. there are other circumstances where they are not being charged. frankly, i represented the d.a.s for many years and d.a. has discretion to charge and to not go forward with prosecution. they have unfettered, enforce my challenge but discretion to do

do you have any concerns, anthony? >> well, i think you will see more pardons. but they will happen before trump gets in. the only sense i can make, sandra, out of the structure of hunter biden's pardon is that president biden has to pardon other people who are involved in what we would call the biden influence peddling scheme that went on so many years. otherwise, the pardon doesn't make sense to me. i can explain reading it if you like. >> sandra: please do appear to the concern obviously for some,t kind of pardons we would see enr a trump pres presidency but thes still time left in this presidency, a&e. >> usually the scandalous pardon happens when a failed president is on his way out the door.

and these pardons happened early because they didn't want hunter to get sentenced and conviction entered which would start to happen next week. let me just explain, this pardon is extraordinary and that it gives him basically 11 years have a minute tape from everything conceivable i the years the biden justice department overt advance eyes 2014-2016 when joe biden was obama administration vice president and when his influence at its most valuable for people who might be willing to pay hunter and others for it. the reason i have to say there has to be more pardons is, what they are obviously worried about is an investigation by the trump justice department of this scheme. but by giving hunter this pardon, what you have done is immunized him and he has no fifth amendment privilege, which

means if they are really worried about trump justice department investigation, they could bring hunter to the grand jury and make him testify about everybody else in the scheme. if what you are worried about which is what biden appears to be worried about is that kind of investigation, which looks into the things especially 2014-2016 that the biden justice department did not look at, it does not make sense to pardon only hunter. you have to partner the neck pardon everybody. >> sandra: what, andy, what shocks you the most about all of this? there are some obviously reaction to this, not shocking that as the outgoing president would choose to pardon his own son. but what really sort of stands out to you the most as we continue to cover this? >> i think the cynicism of biden is the most shocking thing because he said again and again and again he would not pardoning

hunter. i always said that was laughable, sandra the first time he said it. because if you look at hunter's litigation strategy in these cases, it only makes sense if he knew he would get a pardon. but when i say the cynicism is what backs me up, it goes on to the state. even after that history of life after like, they come out where they began to come out sunday saying that hunter was selectively prosecuted and prosecutorial misconduct in connection with his investigation. all of that prosecution was playacting. they tried to get rid of the hunter case and try to make it disappear. they only prosecuted him because they knew in the and his father would pardon him if all else fails. but the clip from before said he has not fired anyone if he believed prosecutorial indiscretion. speed to such a great point and we heard that earlier on the program.
