with we've had 20 years of the fbi getting bigger and bigger in washington and more and more politicized. all the big stories, where they come out of? to either come out of washington, d.c., or they come out of new york. last time i checked we have millions of people pouring across the border. we have a drug problem in this country. we have countless numbers of crimes, the blue states are increasing in their crime rates. why are we building a new building in washington, d.c., after all this? shouldn't we have fbi agents out in the field? i think that's what they need to do and i think he understands that. >> sean: appreciate it. i don't want to lose you as a colleague, i will put it that way. when we come back, the fate of this brave marine, this veteran, daniel penney, now in the hands of a new york city jury. and a really cool announcement. it has to do with this week.

>> sean: jury deliberations now underway in the case against marine vet daniel penney. he's facing up to 15 years behind bars over a deadly subway incident in new york city last year. he is charged with second-degree manslaughter after stepping in to subdue a crazed homeless man threatened everybody on the subway car, threatening to murder people, passengers on that subway car and even willing to kill himself. new york city prosecutors have been hell-bent on sending this guy to prison. insisting during the closing arguments that he saw jordan nearly as a person that needed to be eliminated. no evidence i saw in this trial points to that fact.

fox news legal analyst greg jarrett, why do i think we're going to get a nonguilty verdict tomorrow? am i overly optimistic greg? >> i think you are absolutely right because this case comes down to one word, justification. if a jury finds that daniel penney acted reasonably and -- in restraining somebody threatened to -- threatening to kill pat... it requires a complete acquittal. these jurors are well aware of how perilous the subway is in new york. they heard from the passengers who were frozen in fear and panic. toward an elite menace them and vowed to kill them. they were grateful that daniel penney protected him and the law says that if you are allowed to use lethal force if you honestly believe that others are in imminent danger of serious bodily injury or death.

even a mistaken belief is justifiable. so the witnesses and penney himself support the defence but there is another reason and that's cause of death. the defence expert said penney didn't cause his death, it was the drugs he took combined with his severe medical condition. that's what killed him. so there are two ways to find him not guilty. this case has reasonable doubt written all over it. >> the villain of this case is the district attorney. he never should have brought this case. the judge should never have allowed it to get to the jury. there is so much reasonable doubt here. i was worried when the jury didn't come back after two hours of deliberation. i suspect there may be one or two people who have some doubts but it would be shocking to me if there were a conviction in this case and if there were a conviction i thank it would be reversed on appeal.

this is a case that never should have been brought. this is a case that would never have been brought had the alleged victim not been black. this is a case which is brought as a result of protests on the street. not a fair application of the law. i believe that ethics committees should be looking into district attorney brag related to his decision to bring this case, his decision to bring the trump case, he has become a danger to the rule of law in america. >> sean: i will tell you this, as a consequence of even this trial, even if he's found not guilty, when is anybody ever going to want to step in and be a good samaritan? i don't know if it will happen again. appreciate both of you. when we come back, i huge, fun announcement, straight ahead.
