president of trying to rewrite history. >> lawrence: in light of the pardon, more accusations have surfacing about the first son's very troubled past. >> brian: lucas tomlinson has the assignment. he is at the white house this morning. fill us in. >> the federal judge overseeing hunter biden's tax case took umbrage with president biden's comments saying these charge against hunter were politically motivated. the judge lashing out saying quote the constitution provides the president with broad authority to grant reprieves and pardons for offenses against the united states but nowhere does the constitution give the president the authority to rewrite history. the pardon not only absolves hunter of his tax and gun cases but also for any crimes or potential crimes committed over an 11 year period. the judge also noted this pardon could be seen as, quote: exceeding the scope of the pardon power. it's a good thing you have an attorney on the couch there, guys. biden for months said that he would never pardon his son. that line was repeated at the

podium here at the white house by his press secretary for months. of course they also said for months that biden will not be dropping out of the race. hunter biden's former landlord says the president's son has been slow to the hip for venmo might be more appropriate. stiffing him by more than 300,000 rent after hunter stayed in $4.25 million home in california. sean macguire posting to x, quote: what happens to the 300,000 plus in paid back rent that hunter biden owes my family from 2019 to 2020. is that pardoned now? perhaps that's a good question for the white house press secretary who is traveling with president biden in africa, guys. >> steve: that's right. lucas, i think it was yesterday or the day before kjp said this particular pardon was not vetted through the typical clemson cley process that happens behind you. >> many eyebrows were raised when the pardon covered this

11-year period that's a large time period, of course, this is not just a pardon for a particular crime it's everything over mother than a decade, steve. >> steve: parking tickets? >> maybe even something more serious. >> steve: maybe. >> brian: thanks, lucas, appreciate it. question of character. hunter biden, who was living free from hollywood producer, who he decided to pay his -- decided to pay his overdue taxes and let him live with him for free and i assume pay for his attorney one of the most respected in washington. now we find out when he was living on his own while the president was running for president, knowing his laptop was in the fbi hands is he living in venice beach with secret service protection, rent-free because he decided to not pay rent when people -- people's investments are in rental properties. especially on venice beach. it takes a lot to buy a little. you have that there. and then when you complain, the secret service changed the

locks. and t the landlord locked out. that's the character of the person. if you are joe biden, vice president, and want to be president-elect and you find out your son is not paying rent. remember when a nanny or a landscaper without papers would hurt a candidate. then you have your crack addicted hooker addicted son not paying rent living for free out on the west coast doing your international business deals all of which is on the laptop that you left at a local repair shop. having said all of that, the fallout has to be beyond what he ever dreamed and among the people who are his detractors is gavin newsom. i completely understand the instinct to protect hunter but i think the president at his word. so by definition, i'm disappointed and cannot support the decision. >> lawrence: this federal judge is not even taking a position of supporting agreement. first of all, she said this is a press release this is not a pardon. the second thing they were very

upset the court took issue with them admonishing the court and saying this was some political process. the judge is like pled guilty. what are you talking about? this was the plea that he gave. so why are you saying that there is this mischaracterization of justice when he pled guilty to the charges there? and then you are saying that the court was somehow allow a court case to come before them that is not going to get due process. so, there's multiple factors there. i also think when it comes to the legacy of joe biden, after he signed the crime bill and put so many people behind bars as a result of that, there is no way he escapes the political ramifications without pardoning all these other people that have similar background as well. is he going to do it. i doubt it. that would be a massive release of people. >> steve: message wise, everybody knew he was going to pardon hunter. but democrats, rank and file,

are it at the approach he took. this is exactly what the judge, mark scarsy out in california said i will get rid of it. but hunter was not singled out because he was the president's son, which is what joe biden said. and democrats question why joe biden would criticize his own department of justice rather than just saying, look, i am a father. and my son has had problems. and he is now on the straight and narrow, so i am going to grant him a pardon. democrats would have been okay with that just the fact that he blew up the department of justice his own department of justice and everybody in the department of justice who we have seen so far regarding these judges, they say, mr. president, your wrong on that. >> emily: to your point, people expected a form of clemency if anything in the form of a commutation of sentence. the fact a full blown pardon and 10 year duration smacks of the lack of accountability, responsibility and corruption of

this frankly mafia family that has held the country in its grips in the administration so long. such an affront to the hundreds of thousands of currently incarcerated people who are eligible for release under president trump's first step act that are still rotting in jail. it flies in the face of all of those veterans which are the rising single most rising population in the incarcerated system. what about them? they don't have a famous father that can pardon them. and it flies in the fails of the single mothers who are also a rising representation of the incarcerated system much like the mother of his child that he refuses to acknowledge. everything about this is the elitism, the protection, the joint that this family has that absolves them of any responsibility and every other american has to pay taxes, has to answer to judges, has to answer to parents. >> steve: pay rent. >> emily: yes, has to pay rent. this is just a travesty and speaks to the spinelessness of the commander-in-chief the total

inverted celebrate he is he could have stood up and said i want to protect my son but i want to teach him as father would so i commute his sentence and even that by the way it wouldn't have sat well with me given that everyone else has to enjoy four walls and a cell. now his son will never learn and he will continue taking advantage of the american people. doesn't protect him from future charges keep investigating. >> brian: 10 years. the obama bros on the podcast yesterday, steve, they would have been okay with it. he said i don't know what i'm going to do with my son. i have got see how this process plays out. democrats would have accepted it. the one are for two years lauded him for not doing what donald trump was going to do and holding the integrity of the justice system up in the department of justice. those are the ones who look so stupid right now. biden, he goes they trashed biden yesterday for making defenders of him look stupid with the pardon. typical, lying politician. >> and the defenders are the people who said look, joe biden

prized possession to a grandfather is their grand child. and. >> steve: you are right. >> lawrence: not that family. what made you guys think that somehow he was not going to protect his son? >> brian: the guy that cheated syracuse in the 180s. talk about danny penny and his trial taken place now in deliberations. they are in deliberations to find out if he is innocent or guilty. now we find out a lot of people standing up lining mayor adams came out and said look he did the right thing, i have been on the subway as a cop. wrestled around with different assay atlantas, let's hope they do the right thing, the perfect just joined us last hour. alec skarlatos, in 2015 he was the guy, along with his buddies, national guard vet who saw a terrorist gets up with a machine gun and he had said i'm not going to die this way. tackled him. thankfully the gun jammed. he was a hero. the nation of france lauded him a hero. he looks at the danny penny situation and says new york city, you got to be kidding me.

watch. >> this is going to scare a lot of people into inaction and i don't think that's just in this case. that's not just in subways, that's not just in dealing with people that are out of control. this is going to have farther reaching consequences, you know, there is good samaritan laws that protect people. and i think a lot of people are going to wonder if their local prosecutor, if they are in a deep blue state is going to kind of throw that aside and prosecute them anyway for doing the right thing. >> steve: yesterday, the prosecutors wrapped up the, you know, their final closing argument in front of the jury and then the jury got the case. they dlish celebrated for about an hour. and while the reporting, we don't know what is going on in the jury room, luckily we have got after one hour of getting the case they asked for a second read through of what is considered justifiable defense. so, in other words, they are

either trying to figure out after they listened to the read through and deliberate berated for 90 more minutes. going to be back there this morning. put on your attorney hat. what does that sound like to you? >> emily: first of all, jury instructions are the single most often basis for an appellate overturn. because the relates is that it's difficult, oftentimes, for people to understand the law in those ways. what they were ascertaining is what is the standard of law here. and remember, it's the prosecution's burden to meet that standard. it's the prosecution's burden to prove yard that here his actions were not justifiable. so here's a jury saying okay, explain to us like what is justifiable mean? now, in other trials, remember we have covered here on fox news, for example the ghost ship warehouse that terrible fire in oakland where the landlord there, that was unfit for human habitation warehouse that he, you know, sort of jimmy rigged

to have electricity and have people living there collecting rent via cash. horrible fire. everyone died. criminally, conscious disregard for human life by him doing that that is what the prosecution is trying to portray daniel penny's actions here when we heard from now mayor adams finally on board. we heard from alek skarlatos saying that is not what happened. we hear from subway workers every day a sigh of relief when a threat is contained. and we had expert witnesses testifying on behalf of daniel penny saying his death was not because of a chokehold. it happened subsequently. there is not a causal link between his actions and the death of that person. remains to be seen, however, what the jury decides. >> lawrence: emily, that's great analysis and goes to the heart of the case. the problem with this case is that there are some that have tried to make this a social justin case. and that's dangerous. i mean, i don't care what race

you are, we all know crazy on the train. we know it through the city. and when these people are erratic on the street, they don't care what color you are, they are inflicting harm on a day-to-day basis. and it goes to the question do we want law and order in this city or not? so i hope they take those jury instructions to heart, and they put themselves in the situation, if your mother or sister or daughter is on that train, and they were in that same situation, is the legal standard there to protect them? i want a daniel penny on that train. i don't care. i don't care the color of the person that comes in to save my family member. >> brian: scar lscar lots said e the way they are being treated. pete hegseth look all they did here. trying to find out what he did in war and unit all this personal stuff.

make irreparable changes to a child's body. consult off body parts or prescribing harmful drugs that will potentially inhibit their ability to bear children later in life. let's love them and get them the mental health treatment that they need. don't do something that's irreversible. >> the aclu is representing the families who challenge tennessee's law. core question of this case is whether the state ban unconstitutionally discriminates against people on the basis of sex. supreme court not expected to have a ruling on it until next spring. as we know today's arguments come just before president-elect trump retakes the oval office in the past trump has pledged to stop any federal support of certain gender reassignment surgeries? back over to you. >> brian: all right. impactful from sports on down. thanks so much. meanwhile, turning now to your headlines, the house select committee on the coronavirus pandemic is holding a hearing this morning after releasing final report on monday. the g.o.p. led panel report says it hoped the work would, quote serve as a proud road map

prepare and respond to future pandemics. future democrats on the subcommittee to uncover the origins of covid-19 fueling extreme narratives like it came from a lab. the 520 page report endorses the theory the virus emerged from lab leak in wuhan, china, citing illnesses among chinese researchers at that facility. even jon stewart picked that out. congresswoman a.o.c. alexandria ocasio-cortez is confirming her interest in becoming the top democrat on the house oversight committee in the house congressional session. aoc saying i'm interested in the position. i have been receiving a lot of outreach from colleagues and members and i will be making a decision shortly. the squad member could run for the spot if it's vacated by jamie raskin who is pushing to become the top democrat on the house judiciary committee. people in queens would love to know what she looks like. the fbi is investigating after a large number of large mysterious drones have been seen hovering in formation over parts of northern new jersey. this for the past few days.

>> steve: all right. fox news alert. today on capitol hill, some of president-elect trump's cabinet nominees are going to be making the rounds as mr. trump is reportedly considering replacing one of his key picks. bill melugin is live in west palm beach, florida where bill, it sounds like another floridian is actually part of this story.

>> waiting to hear more on that front, steve. two have withdrawn their names from consideration. and now we have this report coming out from the "wall street journal" you just mentioned that trump is considering replacing pete hegseth as his dod secretary and replacing him about florida governor ron desantis. here is part of what the "wall street journal" is reporting, quote: trump allies increasingly think hegseth may not survive further scrutiny, according to people close to the president-elect's team which considers the next 48 hours to be crucial to his fate. and at least one republican senator is saying he is worried about some of trump's nominees making it through the confirmation process. take a listen. >> i'm worried about two of or three of our nominations well i won't go over the ones, can you usually pick those out. but at the end of the day we have got to do a good job of pointing out the strengths of these nominations.

>> and one pick that withdrew himself was trump's pick for dea administrator hillsborough county sheriff chad chronister he had been taking a lot of heat from conservatives for arresting a pastor for holding church services covid lock down in 2020. he posted on x quote as the gravity of this important responsibility sets in i concluded that i must respectfully withdraw from consideration. there is more work to be done for the citizens of hillsborough county and a lot of initiatives i am committed to fulfilling. and back out here live, chronister is now the second nominee to pull out of the process behind matt gaetz after he withdrew his own name for attorney general pick. as for that the "wall street journal" reporting that trump is looking at ron desantis possibly for dod secretary. we have not heard from the trump transition team yet. we he don't know if that's a position that ron desantis would want or leave his post as the

governor of florida. i have reached out for desantis' orbit. waiting to hear back from desantis on that reporting. emily? >> emily: thanks, bill. democratic senators seemingly accepting their fate in the minority and willing to you can work with republicans. from vermont said trump won. he's the president. we have to accept that he has a right to nominate his cabinet members. our approach will be to give him the benefit of the doubt when you not a blank check. host of here's the deal with kellyanne on fox nation, kellyanne conway joins me now. what do you think about that? >> i think it's excellent and growing trend because senator welch and others have obviously seen emily, president trump move this country into a center right direction. we have gone from the obama coalition in 2012 to trump country 2024. the migration of hispanic americans, black americans, union households, jewish americans, women.

you name it, going from and of course noncollege educated households, going from obama to trump in the span of 12 years has shown these senators, including those who have been there quite a while that this is a mandate from the country to a president-elect who has been very specific and granular about his agenda. what is he going to do in every day affordability, border security, energy independence. these foreign engagements, he has been -- he is on twitter and truth social daily telling us what he is going to do that day. so, i think these senators are actually tired of the infighting in their party in the democratic party and also the lack of direction. i don't think anyone is going to miss out on a kamala harris presidency. they probably weren't looking forward to that and also only two states in the whole country did not go more red, washington state and nebraska. think of that, too. even if you are in a, quote: blue state whatever that means these days. donald trudonald trump halved td

that joe biden had. kamala harris, illinois, she barely won these states by a single digit. so they see the writing on the wall. i think the last thing to know is people like peter welch are hearing from their constituents, give trump some grace and some latitude. we want some real things done for this country. and i want you, the democrat, to start acting in a bipartisan fashion. the polls say 59% of americans support president trump's transition, his cabinet picks and 55% say they are happy and satisfied that he was elected president. he never had numbers like that. >> emily: hopefully the matt welch approach will be represented by the majority of the minority of those house democrats. i want to get your opinion on this. which is the fact that the trump team, his defense team has moved to dismiss the case in part citing the pardon of hunter biden. this isn't fair, but this also set the tone. what say you about the motion to dismiss under color of that blanket pardon that the president said he wasn't going to do but did? >> joe biden is taking so much

heat from democrats today, emily, saying he put family over country. and it's really rich from the always wrong never trumpers and their stupid slogan of country over party and how ridiculous they all look now. fast-forward, president trump and his team have a right to say dismiss this politically motivated case in the southern district here. a case i should tell the viewers i testified in twice to the grand jury. in that stormy daniels nonsense case, why? i had been the campaign manager. they say it's the campaign vials we never pay people. that entire case, everybody watched it and then he was elected president anyway, people saw it and i think they saw donald trump being treated unfairly, emily in many ways this was a fairness election, fairness over wokeness, people say it's not fair. it's actually outrageous to have pursuant blockers, women and pipe pairs doctors and lawyers to have kids in failing schools

overstay their visa. what we did in the trump administration. we increased the penalties for those. but the biden administration unfortunately reversed that really on day one. so, i think what this case really points, to brian, is the need for immigration enforcement, you need to go after those that overstay their visas, you need to go after those that come in the country illegally and i think we need to get serious, i know president trump and his team will, you get serious about actually enforcing emulation law and removing individuals that either overstay their visas or come into the country illegally. >> brian: look at the timeline in 2022 he went to small claims court because he failed to pay back a $10,000 loan. this year, february, he was caught speeding at 70 miles per hour. at which time they always say can i have your license and prejudice station at which time you don't even belong here. we could have stopped him along the way. it's not like this guy was living a hermit-like life.

a monk like life. he was out there. >> that's exactly right. every time he comes into contact with law enforcement, that is an opportunity to, again, remove this individual. he has overstay advice, is a he has violated the terms of his visa. and should be removed. and so weather he is in a sanctuary city, whether he is in a jurisdiction that just simply doesn't quoont ice law enforcement officers who remove those individuals, this is what we need to focus on, and it's whether it's sanctuary cities or just jurisdictions that may not be labeled sanctuary cities but just don't cooperate, we need to get back to that cooperation and, again, start to remove individuals, we are not talking about law abiding citizens here, we are talking about folks that have overstayed their visa, committed another crime, have come up on law enforcement's radar and they need to be removed. >> brian: chad, we have to evaluate the whole chinese student visa program. have their families over there almost forced to become spies. you know that better than i know that now we have people just crossing the border look like
