>> brian: it's 8:00 on the east coast, this is "fox and friends." >> steve: it is, first up president trump's pick for defense secretary will be back on capitol hill today and his mother will join "fox and friends" in 15 minutes to set the record straight amid intense media scrutiny of her son pete hegseth. sgls sglo and the case of daniel pe penny. this is a wake-up call, watch.
5:02 am
>> people will wonder if their local prosecutor will prosecute them for doing the right thing. >> lawrence: battle over tr transgender surgery for minors heading to court and could have implication across the country. we'll preview the case. >> brian: final hour of "fox and friends" starts now, get dressed. fox news alert, today on capitol hill, some of president trump's cabinet nominees will make the round on cabinet side. trump is considering replacing one key pick. >> steve: bill melugin has the latest. bill. >> bill: good morning to you. w "wall street journal" dropped a report claiming trump is considering replacing pete hegseth as defense secretary nominee with florida governor ron desantis. we have not heard tr trump or
5:03 am
governor desantis's office yet. here is part of what street journal is reporting. trump's allies think pete hegseth may not survive further scrutiny, which considers next 48 hours to be crucial to his fate. one republicans he's worried about some of trump's nominees making it through confirmation process. >> two or three nominations, i'm worried. i won't go over the ones, you can usually pick those out. we have to point out strength of these nominations. >> one pick that withdrew himself is trump's choice for dea administration, hillsborough sheriff chad chronister. he arrested a pastor for holding
5:04 am
church services in 2020. he posted last night, as gravity of this important respo responsibility, there is more work to be done for hillsborough county and initiatives i'm committed to fulfilling. trump's transition team is targeting woke agenda in federal government. we're being told trump transition team will act christopher ruffo, to get rid of all dei initiatives across the entire federal government. back to you. >> brian: perfect person to lead the charge. christopher ruffo worked with governor desantis straightening out the education system and exposing things hurting kids in florida and got attention of
5:05 am
president trump. >> steve: talk about what is going on across the country. we've been talking about this for a while. during the biden administration, it does appear to many people southern borders are wide open. come to southern border, get in and go and mill about the country. we have problems in new york city, sanctuary cities and sanctuary state says. one place it hit the fanl fan finally is chicago. you know about this. >> lawrence: i've been talking with residents of chicago for a while. just once my home state of texas, greg abbott decided, i will bus these migrants to your community. it put a damper on the message of we want to be loving of all in our community. one resident is upset and choke out at the meeting the other
5:06 am
day. multiple city council let the mayor have it. watch. >> tax hike, push have notes to house illegal immigrants and you told trump you ain't going to blink, we ain't either. >> you are going down in history as the worst mayor in america. i'm typically here and fussing, i want to say thank you to the city council, our mayor is embarrassing us around the world and you all took power back from him to say the city of chicago is out of tz business of funding illegals. >> brian: they want to get sanctuary cities off the books. they are overwhelming cops who are underof staed. the mayor thinks he is speaking
5:07 am
for the african american community. we are not going to build trust among law enforcement and ice and turn on our people as if enforcing the law is turning on your people. the people show up and said, stop helping me, sanctuary city status, make it yesterday's news. they were saying positive things about trump. i hope trump understand people are open to him, if he goes back and says what blocks the problem, where is the crime and unrest, where are issues? with tom homan, i don't need your vote anymore, i want to help you out. force this mayor to sober up or kick him out. >> chicago is number two in city border, second to this gotham city we are sitting in. number one when residents assume illinois debts.
5:08 am
each resident is responsible for $43,000 of debt. add in liability, that is 12% of their income. what you are canning them to do, they have highest sales tax, too. you are telling residents, your crime is among highest, sales tax and proper tax among highest and you are responsible for highest amount of debt in the ko kourp but let me prioritize illegal immigrants and tell you that you are not black if you do don'ts vote. >> lawrence: you have kids that can't read and write in the community. they shut down the school, we have zero money to fund extra schools and suddenly illegals come in and they open the school back up. they say healthcare is a priority, they shut down the health center. they reopen it for illegals.
5:09 am
you have criminals in the city, shootings, i've done reports and now illegal gangs in chicago are ri rivalling. >> brian: gangs are fighting the american gangs. you did a story, no money to keep boys and girls type place open. next thing you know, it gets open much where did you get the money? for illegal immigrants. what a kick to the groin that is. >> steve: we talked about how you will find on x how the b breakdown of how much illegal migrants cost each and every american. $150 billion when you look at cost and taxes. cost to americans is $150 billion, that breaks down to a little under $10,000 per illegal migrant in the country today.
5:10 am
you were talking to a woman na named peray. >> lawrence: she joined us earlier, watch. >> it affects our bottom line. it is cold in chicago and there are people getting up to go make donuts, we are not paying for illegals. we don't allow people to feast off criminality. our goal is to the go the border closed and get every unnecessary expense off the budget line in chicago. we can't afford it anymore. what i believe my mayor is doing, attempting to use social and political capital of my community to advance immigrant community. we are america first. i am eighth generation american, extremely invested in making this country great. please don't racialize this
5:11 am
deportation fight. every american is in lock step with this, we deserve to spend money in better ways. >> brian: nicely said, don't racialize this. people that get hurt the most have the least, they don't put them in nice areas. >> lawrence: we saw what ha happened in martha's vineyard, they were there 48 hours and they were out of there. we saw last election, coalition of democrats when it came to minorities, it is shattering right now. they are going to trump and republican party and giving it a second shot. can you imagine voters telling you this immigration issue is a reason why and the mayor paying no attention to it? like they want to lose, they don't want to compete for voters anymore.
5:12 am
voters aren't putting up with it. >> steve: in chicago, the mayor is tone deaf to people like peray. tom homan is coming into office noon on january 20. tom homan wants to meet with mayor adams and yesterday after a state of crime, mayor of new york city made it clear, you come into this country illegally, if you are illegal, you do something and break the law, we should send you back. listen to the mayor. >>y woo are willing to take migrants and asylum seekers that are not criminals, we are willing to take them, they have to be able to work. i don't understand why this was not clear to previous administration. those here committing crimes, raping innocent people, have been a harm to our country, i want to sit down and hear the
5:13 am
plan how to address them. those are people i'm talking about and i would love to sit down with the border czar and hear his thoughts how we're going to kr address those harmi our citizens. in the state, era of cancel culture, no one is afraid to be honest about the truth. cancel me, i'm going to protect people of thissy scity. >> brian: his phone gets taken on the street while boarding a plane to go meet with the president. >> lawrence: he was co-chair and they kicked him off being co-chair of the campaign. >> brian: he says, i'm not going to be warring with this administration.
5:14 am
i think his instinct, i have no money to pay for 57,000 people here. we closed five shelters, hundreds of thousands are passing through. buses have stopped, illegal immigrants have not, i disagree on the other thing. he said you can come here, as long as you can work. can't. we can't welcome people here and get them jobs, if you start giving them jobs, they'll keep coming. >> i take issue with that, he stood in front of signs that said lowest subway crime in history except for pandemic years. daniel penny awaits his verdict for stepping in where gap was left by that mayor.
5:15 am
where was he protecting citizens for last four years and more. he says he is waiting for tom homan, i wish my mayor had brought solutions when we were drowning. i sat next to a woman who bore scars of hundreds of stitches from being attacked. that happens in this city and you now want to hear what tom homan has to say? what about laken riley murder and migrant kids that stabbed that man in time square and the police officers that bore brunt of ambushes and crime at laughing illegal immigrants baked into juvenile system, they are called boys. too little, too late for mayor adams for people of new york city. >> brian: you have "outnumbered" to do laters, you better keep some in the quiver. >> more where that came from. >> steve: mayor adams hsz
5:16 am
opportunity to follow in the footsteps of mayor rudy giuliani. when you are walking around on streets of new york city because of migrant crime, which is substantial these days, it impacts everybody and impacts decisions am i going to the doctor's office today by myself? do i feel safe? am i going to go to the grocery store? the lady down the hall got robbed. if mayor adams turns it around, he could be a great mayor. >> brian: talk about a movie clint eastwood did, they used real-life heroes in it, terror attack happened on a train in france. knives everywhere and start the stabbing everyone.
5:17 am
vet veterans got up and took care of it. thises veteran was recognized for hero ic activities. when he saw the danielle penny situation happen, he gets hailed a hero, he is fighting for freedom, he wrote a column and joined us earlier. you convict this guy, it is going to be downward spiral for this country. watch. >> it is going to scare people into action and i don't think that is just in this case, not just in subways, not in dealing with people out of control. this will have further reaching consequences. there is good samaritan laws that protect people and i think a lot of people wonder if their local prosecutor will throw that
5:18 am
aside and prosecute them for doing the right thing. >> steve: see what the jury does in the daniel penny case. yesterday they got instructions and deliberated for one hour and asked for read-back of the judge said regarding justifiable defense. what is justifiable defense to make sure daniel penny followed it or if he exceeded it and we won't know until they say okay, we have a decision. >> lawrence: there is vacuum in the country right now, we have demonized law enforcement. we want bad ones gone. we have demonized cops and they have stepped back. we have liberal d.a.s that let peopl people roam the street and that lawlessness has spread throughout this city and country and because of that vacuum, we need good men to step up when we
5:19 am
see erratic behavior on the subway, on the street, within apartments. i went home the other day in manhattan and all the windows shattered, homeless guy got into it with security at the front desk and started being erratic. took the cops hours to get there, this is normalized behavior. the jury needs to listen to what the judge is telling them as far as instruction and go by the law. if you feel reasonable doubt, there is down ballot there. if we don't do right, no one will step up. >> brian: the mayor did back up daniel penny and said he did right thing. emily is sorry for interrupting you. so rude. >> i'm sorry, i did not mean to. >> brian: i'm kidding. >> you got to say bless you.
5:20 am
>> brian: without missing a beat. >> lawrence: it is texas way. you are a yankee. >> brian: don't stop. i'm continuing. >> lawrence: you would have continued. >> i'm on the couch. >> brian: you're fine. >> steve: she's fine, folks. moving on. pete hegseth at the center of intent media scrutiny after donald trump picked him for next defense secretary. pete's mother, penny, will join us next to set the record straight, stick around.
5:21 am
i try to put my arm around any vet that i can. absolutely. at newday usa, that's what we're doing. we put our arm around the veterans. when i think of the veteran out there that needs to refi his home, he may want to purchase and we can help them and provide that financial solution for them and their families. it's a great, rewarding feeling. everybody in the company, they have that deference and that respect and that love for the veteran that makes this company so unique.

reliable 5g, plus wifi speeds up to a gig where you need it most. xfinity mobile. now xfinity internet customers can buy one line of unlimited and get one free for a year. >> steve: former "fox and friends" weekend cohost pete hegseth has been at the center of intense media scrutiny since he's been named for secretary of defense. there was a leaked e-mail from pete's mom from 2018 published in "new york times," in it she was critical of his paftz relationships with women. pete hegseth's mother joins us to tell us what she wanted to tell us. i called yesterday and said you
5:26 am
wanted to come on. >> i would do anything for my son. >> steve: you never thought you would be doing this. you did not realize this e-mail you wrote in 2018, somebody leaked to "new york times" and they printed it. i will read part of it. you say peteduring the 2018 divorce, i have no respect for any man that belittles, lies, cheats and sleeps around. you are that man and have been for years and as your mother it pains me and embarrasses me to say that, it is a sad, sad truth. we still love you, we are broken by your behavior and your lack of character. when you wrote that, what is the back story? what was going on that made you write that? >> i will tell that story in a moment, let me make two statements first.
5:27 am
one is to president trump. thank you for your belief in my s son. we all believe in him. we really believe that he is not that man he was seven years ago. i'm not that mother and i hope people will hear that story today and truth of that story. so the other thing, i am here to tell the truth. to tell the truth to the american people and tell the truth to senators on the hill, especially female senators. i really hope that you will not listen to the media and you will listen to pete. >> steve: you are here to tell us because you are in the news now. why did you write that e-mail? what was going on? >> go back seven years, if we all went back seven years, we would see maybe we are not the people we are today. they were going through, pete,
5:28 am
and his wife were going through a difficult divorce, a very emotional time and i'm sure many of you across the country understand how difficult divorce is on a family. there is emotion. we say things and i wrote that in haste, with deep emotion, as a parent. about two hours later, my husband tells me i should think through things more. peteand i are both very passionate people. i wrote that out of love, two hours later i retracted it with an apology and nobody has seen that. it was a difficult time. i want to say something about the media. part of today is to discredit media and how they operate. when they contact you, i let a few phone calls go. they call and threaten you,
5:29 am
first thing they do. unless you make a statement, we will publish it as is. that is despicable way to treat anymore, threats are dangerous and they are hard on families. >> steve: to recap, you were angry about what was going on, his behavior during the divorce and you wrote that e-mail. couple hours later, you apologize and you worked it out? >> oh, yeah, pete and i are very close today. our whole family is very ti tight-knit. i think that we as parents always parent. >> steve: i get it. >> that was seven years ago. i want to talk about who pete is today. >> steve: there are, you wanted to talk and you mentioned a
5:30 am
moment ago, media scrutiny, there are allegations of sexual assault, alcohol use, financial mismanagement, as a parent, that is hard to hear. >> right. our job as parents are to correct. they are to speak truth. and i am a passionate person like pete, and sometimes emotional words come the out. i don't believe any of that is true. i wouldn't be sitting in this chair today if i didn't believe that about my son. >> steve: how is the family holding up? >> we're okay. we have a deep, deep faith. not only in each other, in god. our friends have been amazing, support has been amazing. we're trusting in our god and in our faith and in our family. >> steve: uh-huh. what do you say to people who
5:31 am
have read the stuff about pete, or heard, you said he has changed. >> absolutely. >> steve: how do you convince people of that? >> i start with four things. first i have a very intelligence son, i have a leader son, i've known that since he was two. he went to princeton and harvard. he returned harvard diploma, i wouldn't let him return the princeton, i worked too hard. he's written two "new york times" best-sellers, what mother can say that. one is about war and defense. he already has a play book. you talk about experience. he's also put his life on the line twice overseas for our country, one in iraq and one in yafth afghanistan. i'm a proud blue-star mom, there
5:32 am
it is right there. he's still a warrior and he's still fighting, we're all still fighting, we believe in the good. >> steve: with confirmation hearings and process, you just hear from the nominee, they go and visit everybody. you were dragged into this story because "new york times" wrote that, reported on that e-mail you sent back in 2018. for most part and what i heard you say, you wanted to come on, that was not the whole story. >> no, and i want people to look at pete, and understand him for who he is today and disregard media, that was seven years ago, most of it is misinformation. way they threaten you is very hurtful. the person who leaked it, i don't know who that is and i
5:33 am
don't think i will need to. pete is a new person, he is redeemed, forgiven, changed, i think we all are after seven years. i believe he's the man for the job. being a tv news host prepares you for most things in a position like this, good communicator, think on your feet, take charge, everybody should do a year with fox. >> steve: there you go. it has to be tough as his mother to hear drip, drip, drip. everyday more stuff comes out, like you probably hate to turn on your phone. it is my cousin telling me the latest about pete. >> yeah, i know pete, and people who know pete, and trump knows pete, the pete of today, he is a good father, a good husband to jen, he has seven kids, he's a
5:34 am
wonderful son. and wonderful son to his brothers and his friends, he's a changed man and i hope people will get to know who pete is today, especially our dear female senators that you would listen to him. listen with your heart to the truth of pete. >> steve: i heard you say was he's a changed man. the man you wrote to in 2018, who you were really mad at. >> as a mom. >> steve: he is different than that man? >> absolutely. i believe that with all my heart and i wouldn't be sitting here if i didn't believe he is the man for the job. >> steve: as you look at what is going on in washington, d.c., this is the way it works. there are people who want pete to get the job and people who don't want pete to get the job. that has to be tough, they don't
5:35 am
like my son. you add allegations and it becomes more complicated. >> pete and i are both warriors and i've developed a really tough skin over the years, first raising pete, going through war, saying goodbye to a son to war. what mom needs to do that, his accomplishments and qualities as a leader. he is strong and capable. and i think his experience, i think people trump has picked are not ones you would expect and i love that. >> steve: given fact you have suddenly become part of the story because of the 2018 e-mail you sent pete, do you feel guilty, i wish i hadn't written that, i have made a mess. >> don't you think everybody has regrets as a parent, it is not
5:36 am
an easy job, we've all made mistakes. i challenge anyone who thinks they are qualified to throw the first stone. >> steve: does it upset you it brought so much scrutiny to your family? >> well, that is hard. >> steve: there are people looking throughout his entire history and whatever that means. >> yeah, we've been through a lot as a family and our faith has assured us greater is he that is in us than he that is in the world. no matter the result, we know that god is for us, our friends are for us. thank you, friends, you know who you are, "fox and friends," too, our dear fr friends supporting through prayer. >> steve: you thanked donald trump. has pete heard from mr. trump?
5:37 am
>> they talk often. >> steve: what is going on? >> the other night i heard everything was good, i'm not in that world. i think trump is a good man and picked some good nominees and i think senators need to listen. >> steve: do you worry, penny, that donald trump is trying to hit the ground running in less than 50 days and the pete hegseth stuff has become a distraction. >> to a degree. but i think it can be overcome. people need to listen to him, get to know him. not the pete from seven years ago, the pete from today. >> during confirmation hearings coming up, if pete continues with nomination process, you might be called, would you testify in front of congress? >> i don't have an answer to
5:38 am
that right now, steve, i haven't thought about that. >> steve: what about people involved in the other allegations, they will be called to tell their story. i wanted to come on to tell your side of the story, which you have. they will probably get that same opportunity. >> yeah. that is up to them. i only have so much control. i want to make two final statements. i want to thank fox news, all of you at fox from makeup to cameramen to producers, to other hosts, how you have grown him as a leader. i think everybody should do a year on fox, you learn to be a communicator, learn to take charge. >> steve: what is something, he worked here until a week ago. >> i know. >> steve: we all know him.
5:39 am
as his mother, what is one thing about pete people don't realize? >> he's got a big heart. he's very smart. he's the most faithful patriot of this country, he loves his country, loves his country. he's fought and almost died for his country. he's a good dad. he's an amazing son and father and that is the pete, i want people to know. i want to say one more thing, i said i believe he's the man for the job. i believe he's the man for such a time as this. >> steve: at this time, you are on tv explaining your son and his character because somebody gave "new york times" that e-mail. they did. >> how many people got your e-mail, was it just to pete?
5:40 am
>> i have not been able to track that like my blind copy, i don't think that is important. what is important is that truth be told about that e-mail and that we look at pete today, not then and i'm here. >> steve: you say it is important people know the truth, is there some part of that story depicted in the media that is not true? >> of course. >> which part? >> i don't want to use the words, he does not misuse women. no. he has been through some difficult things. i'm not going to list them by name, some of those attachments or descriptions are not true, especially anymore. >> steve: it sounds like you are disillusioned, have you lost trust in how things happen?
5:41 am
>> i came to take on new york city, take on "new york times," to be a mother, a strong mother, fighter. >> steve: what is your message to "new york times"? >> i would say, i don't think the way you operate, it feels almost criminal when reporters call and threaten you. i don't think people know that is how they operate. they are in it for the commission and don't care who they hurt, families, children. i just don't believe that is the right way to do things. >> steve: do you think that is the way they try to get the story? >> of course, it is their job. but i can take opposite view, i can take the high road, the belief in good and good in people. and will we be persecuted and you have isser in life? sure, we will. i know in whom i believe, i believe in god, i believe in
5:42 am
pete, i believe in my family, my husband of 48 years. hi, honey. he is in tennessee, taking care of pete's four children, all 21 chickens, two horses and beavers that seem to be at work at the pond. >> penny hegseth, thank you very much for stopping by to tell us about your son. >> thank you so much, i appreciate it, i appreciate all the fox family, you are amazing people and thanks for the way you have treated our son and thanks to all the people out there. >> steve: taking a break, stepping aside. more in a minute. what can i do to make a better cotton crop? we believe that the best products are made in america and come fresh from the family farm. and produced under the most sustainable farming techniques. from our sheets to our blankets and quilts

>> janice: good morning, my friends from texas. you are from? >> augusta, georgia. >> janice: you are celebrating wedding anniversary? >> 55 years. >> janice: you gave me advice five years ago, what was that? >> one wife, one house. >> janice: what is your claim to great marriage? >> family and faith. >> janice: i love it. you are amazing. amazing in new york, we are going to get chilly weather and

wind and maybe snow depending where you are. it is cold as far south as florida, where we have freeze advisory. heavy rain. lake effect snow in nee next couple of days six to eight inches. it has been cold for much of the country, we will warm up getting into m to later part of decembe. we have had over six inches. where are you from? >> new jersey. >> janice: new jersey! everybody cheer for new jersey. thank you for coming, do you love brian kilmeade? they do. i did not ask them, it is brian and emily. wave to the studio. >> brian: beautiful people, great advice and weather. u.s. supreme court will consider
5:49 am
tennessee law banning certain medical care for trtransgender children for first time today. >> emily: court's decision will affect states with similar bans. joining us can shannon bream. what do you expect to come out of the supreme court case? >> i expect they will go over the hour allotted to them and then wait weeks or months to learn what will happen. this law trans treatment of gender issue for patients under 18 years old for surgery and hormone replacement therapy and hear moan treatment. what -- hormone treatment. the challenge for hormone treatment, plaintiffs are not

5:51 am
who may not understand how permanent the impact can be. >> emily: california, in particular, has taken massively aggressive and some argue irreversible impact stance on this, custody issues, stepping in as a parent. the question, how will this affect, for example, radical state like california that has participated in butchering children and destroying family units? >> everybody is watching closely today, half of the states have a ban on some version of these treatments whether hormonal or surgical, and you have states saying to parents, you are at risk of losing custody of kids if you do not agree with what
5:52 am
they want to do moving forward. depending on the wording, this could be beyond tennessee and treatment, it could factor into sports and other things. >> brian: excuse me for not knowing this, 64 trans gender adults argue they were so glad they had hormonal things done as teens and i imagine people did transition and regret it. will any of these people be before justices or just attorneys? >> just attorneys today. there are all sorts of interested parties who have filed and want the court to read their story and briefs and arguments, that is part of tz story. you won't physically hear from the people.
5:53 am
they are outside telling their s stories. >> brian: see the people there. >> emily: this administration has stepped in on side of this law, january 20, cannot come fast enough. a case like this favors irreversible butchering of children. >> we'll bring the arguments and congrats on the new book. >> thank you. >> brian: we'll get you a copy, i'm friends with her now. now this. >> emily: let's check in with dana perino for what is coming up top of the hour. >> dana: all my friends are there and i'm up here. thank you, emily. they were talking about know t trasgender care, supreme court will weigh the issue and we'll have analysis on this topic. jury in daniel penny manslaughter case back in today. and working with president trump
