jeanine pirro, kennedy, tyrus and jesse. it's 5:00 in new york city. this is "the five." two major crime stories roiling the biggest city in america. the judge is sending the jury home in the daniel penny man slaughter trial. no verdict yet. they'll be back tomorrow. we're getting reaction from mayor eric adams on the case. let's look at that. >> you have someone on that subway who was responding. doing what we should have done as a city and a state of having a better mental health facility. those passengers were afraid. i've been on the subway system. i know what it is to wrestle or fight with someone. based on all the facts laid out, a jury of his peers will make the right decision. >> dana: and there's another shocking crime story in new york

city. we're getting brand new photos of the cold-blooded killer that cops say fatal religioned down brian thompson. he was the ceo of united healthcare insurance. thompson was a father of two. his wife said that the recipient of threats was her husband in present times. chilling video showing the moment when the gunman shoots brian thompson at close range in the back on the streets of midtown manhattan. his gun appeared to jam at one point. here's what a witness that was present at the scene says he heard. >> i hear shots. i was parking the car. i heard shots. when i looked, man down. yeah. then the guy crossed and run. a white male, all in block. he crossed the street. then i called 911. yeah. maybe someone else already called. a guy, he was here, this corner

the whole night. >> dana: yeah. >> who was on the corner? >> the guy that shot the guy. >> dana: all right. we have the two big stories. let's start with the daniel penny case. judge jeanine, you can tell us your interpretation of what the jury asked today and the decision to send them home once again. >> jeanine: okay. i'm very impressed with this jury starting with the first question that the jury came back with. that was a question as to the criminal charges, how they related to the facts and the defensive justification. so they knew right away what they had to do was create some kind of umbrella. these are the parameters which were working. justification, of course, is a defense but it's not a defense that the defense has to prove. it's a defense that the people have to disprove beyond a reasonable doubt. the next group of questions had to do with issues that i think are extremely telling as to where this jury is going.

and the last group of questions had to do with the medical examiner that i've been very critical of. this level one medical examiner that claims she was a medical 2. they specifically in the question say, we want the cross examination of dr. harris, the cross examination of course by a former prosecutor. n"happennow they want in her se death certificate, she wouldn't have changed her mind even if the tests showed a fentanyl overdose. right away the jury says we want to read this again. then they go on. we would like to hear off the testimony up to and including the part where she admits that she told the grand jury that she didn't know if she observed sufficiently consistent pressure, which is contrary and brought out by the defense to what she was alleging when she

testified on direct examination with the prosecution. this jury has honed right in on the inconsistency, the fact that there was a cause of death before the toxicology, before the histology, because this was a case of high public interest that the chief medical examiner came in, this guy named graham, and he changes the cause of death. the defense did such an excellent job where they said it took ten days after the interview, after the interview of danny penny, after he voluntarily went in to speak with the police. then all of a sudden they have no additional tests. now the cause of death is something where we want to charge him. they asked for danny penny, his testimony. a 30-minute interview. he's so calm. he doesn't know that neeley is dead. danny penny said i did it because that's what i trained as

a marine to do. he said he was going to kill someone. the car froze. everybody froze. we know from all of the prosecution witnesses that the defense has made its case through those witnesses. this is a phenomenal trial. they have gone home for the night. they need more testimony tomorrow that will be read to them, but they are spot on. this isn't going to be -- someone said well, they just want to let him go. no, this is a smart jury. they know exactly what the issues are. the vulnerabilities and where they're headed. >> dana: okay. so let's then take all of that and bring it back again tomorrow. hope we get a verdict tomorrow. >> jeanine: we will. >> dana: we talk about what happened this morning at 6:46 a.m. a few blocks from here with the healthcare ceo being shot in the back by a masked gunman that ran off and is still on the loose. >> looking at that video is the

most disturbing -- again, you don't want to jump to conclusions but feels like it was a planned hit. the one witness said the individual, the suspect had been outside on the corner all night. he knew this individual was coming there. the part that really makes me feel this is not a random hit or robbery, he was catching -- as he shot -- the reason why the shot was delayed, he made sure he caught his bullet. no evidence. took his time. hit him again. admired his work. knew where the cameras were. the only mistake he made is when he crossed the street. something he didn't plan on was coming at him that way. the other thing is strange is his car service. >> dana: the victim's car service. >> yes. you can see the other individual holding -- when he sees it, he takes off running. human reaction, he's in a car. he should get the hell out of there. he should ram the other car off. that car does not move.

that's another question. seems like they were waiting for him to be at that position at that time, and that's the part that is most disturbing to me. so you don't want to say it, but looked like a hit to me in my opinion. >> dana: jesse, either case, we have these two things happening. they're not related per se -- >> jesse: i agree with tyrus. looked like a professional job. the guy was cool, calm, collected. he had a silencer, an escape plan, a disguise. looks like an assassination. this guy makes $10 million a year. the largest healthcare company in the country. i think they have $80 billion in profit last year, this is a behemoth. they deny a lot of claims. that could be motivation. john walsh is on tonight to speculate on motivation also. i don't know. this guy could have a personal life that could have been chaotic. you just don't know about these things. there's an anti trust action at

the department of justice. anything is possible. this guy was obviously targeted. this doesn't happen in america. you don't have a fortune 500 ceo get whacked at 6:30 a.m. that's what's carry. i don't know what else to add. the judge covered it beautifully. you have a mentally ill ex-con threatening people's live in a lock box underground, a former marine tries to protect people, these things happen. it's tragic. these things happen. it's sad. there's no racial animosity here. it's just sad. if you have a guilty verdict here, what that does, men are bred to protect people. it's in our instinct. it's all cultures, all races. if you have a guilty verdict come down, it's an attack on the male instinct to protect vulnerable people. you've been on subways.

there's fight as lot in this town where men come in that don't even know the couple, break it up, take your hands off of her. a crazy guy on the subway. back off, buddy. calm down. those things can happen like that. if a man hesitates because he sees this case come down a bad way, there's going to be a lot of people that will be hurt in this city. >> dana: you don't want a chilling effect on people that are willing to help protect others. >> jesse: right. >> dana: kennedy, final word on anything you want to talk about. >> i hope we live in a society as if i'm a womaning riding the subway by myself or if one of my girls are, i hope there's a guy like daniel penny that stands up and protects them. we want a society where there's people like that protect vulnerable people. that's the way it should be. there's not always a cop there. this is a city where you have two very clear contrasts between good and evil.

daniel penny, he's the good person. he was a stand up guy. doing what he should do. and then you have evil people like that, lying in wait without hesitation take someone's live. we don't know the motivation but we know it exists. maybe someone like that sees the vulnerabilities in the criminal justice system and feels they won't get charged or caught. that's terrifying. so i hope we have more daniel pennies in the world. the more we stand on pins and needles waiting on this verdict, more people -- i think people think he did the right thing. under alvin bragg's watch, they will be punished for the wrong things. >> dana: a jury verdict tomorrow. >> let's hope he's home for christmas. >> dana: ahead, gavin newsome is turning on biden over hunter's pardon. ♪

inflation. maybe the inflation numbers on paper are not as bad. that's what democrats have been doing. spinning all of these numbers and saying we're telling ourselves that these things are great, that bidenomics is working. they're trying to brow beat boaters to knowing what isn't try. if you can't afford to pay the minimum on your credit card, the economy is working against you and you want change. often times black friday and cyber monday, it's an optimism metrics. so it's how people feel about the future. they're feeling way better about their chances in 2025 because they remember what their bank accounts were like before the pandemic and they're very optimistic that their personal finances will return to that state. i hope they're right. i hope for the democrats sake, they do a better job of intraspection and figure out how they failed so many people.
