killed ceo brian thompson we're finding what is believed to be the shooter's backpack. charlie: that discovery coming as the fbi joins the nationwide search. will: chanly is here with more. reporter: good morning that's right the manhunt now entering its fourth day expanding nationwide after authorities say this gunman pictured here left new york city immediately after murdering united health care ceo brian thompson wednesday morning. in the photo you can see the suspect wearing gray backpack authorities now say they have that gray backpack after finding it hidden in the brush in central park. new york post sharing this up close photo police say that when the assailant fled from shooting on an e-bike he rode into central park wearing backpack and exited without it as you can see here in this new video obtained by fox, the suspect in black on the bike no longer has the backpack on. that critical piece of evidence, though, now in the hands of all

crime lab for analysis and testing. the nypd police chief of detectives tells us what happened next. watch. >> you see about ten days -- but we have that bus leaving the same morning him going up to the port authority terminal the same approximately an hour after this. >> here's a look an overall look at path the suspect took wednesday morning after the shooting. police believe the suspect likely left on a bus headed towards atlanta. reversing the same rout they think he took on the way to the city. they have video of him entering the bus depot and no video of him exiting an now fbi is assisting the nypd with thisinv0 reward for information leading to an arrest and conviction. the dea also stepping up saying, quote, we have offered all assistance but fbi has federally so we're there for them lean on us for anything and we are being told police -- they're processing that possible dna fingerprint and cell phone

data as they hone in on the identity of this person responsible. guys. >> thank you for that chanly. will: it is a fascinating case the mystery -- the tiktok of what this guy did that day. and maybe where he is now, we did speak to a former threat management team leader from united health group. he was on fox for us to talk about how they prepare normally to protect themselveses from any type of situation that happened here. how they try to protect their ceos. >> threat management treatment is multidisciplinary what we try to do is take threats to the employees, the staff, others, assess those for escalation to violence and ultimately try to intervene in some way that prevents somebody from effect lating to violence. it's possible that this person may have communicated with

others through other methods it is clear at least from my perspective in many ways this is a very -- very strong case of a grievance move to action. so the things like what we've been hearing about the -- items written on the ammunition -- the ability to do a surveillance to be there early all of the things are predator acts leading up to violence. >> we need more information and i guess with time we'll get that nypd is on it supposedly i think fbi also involved see how it turns out. >> they have a lot more information understandably than we know. but it looks like the -- it appears like maybe the walls are closing in a little bit on this guy. they know they're tracking his movements pretty well. >> meanwhile back to politics. one of the lessons i think we've come to understand i hope that everyone is come to understand

there are going to be times potentially when one side tries to stack the deck and lock in a -- a permanent grip on power. either by actively votes or politicizing the armed forces or using the judiciary criminal justice system to go after opponents. will: that my friends is projection. rachel: that is amazing actually so it is intentional this isn't just some tick or something that just popped into his head. because he's bummed out that they lost the election so bad people need to understand barack obama has been a really negative force on this country. and on politics, and creating so much division. that comes from saul, people forget barack obama was teaching rules for radical he was

ran who gave that speech in 2004. even if you didn't grow or agree with his policy prescriptions it is a different guy than when he gave that speech in 2004 or when he won that election in 2008 he's a deeply bitter angry guy. and he's talking about how voters don't care about democracy. will: change turned into dour and bitter and bitter and projectionism. will: projecting he's not just projecting that we know at this point had is department of justice was weaponized under joe biden that was under joe biden what we should point out it all began under barack obama. that is when for example, he spied on a "fox reporter" that is when lois lerner targeted conservatives with irs and this begun and it was just extrapolated under presidency of joe biden. rachel: and then under barack obama and then under joe biden. which you know many people

so-called doge initiative. from our perspective, we want a federal government that is effective and efficient and equitable. and to extent the other side of the aisle shares that objective which is right for the american people and see if there's common ground for the american people. >> there's some of the government spending, the wasteful government spending with 7 billion, empty government buildings this one think about that, 3 million dollars on girl centered climate action in brazil. why wouldn't they want to even just from a pr state even if they didn't want to cut their programs just say we're not for that. >> yeah. exactly doge is exciting we have elon and vivek on the hill a couple of days ago and it was an amazing time. we brought together i brought together the senate and house republican leaders first.

the top charge of second-degree manslaughter as jury became deadlocked twice chanly joins with us more. >> so daniel penny fate still in the hands of a jury, though, he may be resting a bit easier this weekend knowing the judge has thrown out the top count of manslaughter in the second-degree. which carried a sentence of up to 15 years. this all come after four days of deliberations and the jury telling the judge friday they could not reach a verdict on that manslaughter count. the judge then read the charge encourage them to reach a verdict but by the afternoon panel of five men and seven women were still deadlocked. so now on monday they will return to deliberate whether penny is guilty of the lesser charge of neglect criminal one remounting count will be dismissed by the jury on monday. that would finally put the nightmare behind danny and allow

us to focus on the civil lawsuit filed two days ago for the same allegations contained in the criminal indictment. now prosecutors mantessed that 26-year-old went way too far and placed 30-year-old jordan neely in a choke hold on a subway car for nearly six minutes after neely behavior was threatening. and neely family and supporters say this case is really about racism. racism is still alive ad kicking in america. those among you who say that daniel penny is innocent have racism and bias in your heart. >> america hates black people and we see it from the jury pool. on that lesser charge penny could face up to four years behind bars. >> chanly you were inside of the car and thank you for that report you were inside of the courtroom for closing arguments this week. tell us what you saw what you gathered, obviously, his attorney saying we think this lesser charge will be dismissed

were you able to get any ideas, feelings of where the jury was at? >> right i had my eyes on this jury for hours on monday and then again on tuesday as closing arguments concluded from both sides and i was trying to look for any sort of clue as to which way they may or may not be leaning really rachel i did notice a positive energy i guess you could call it or nods for both sides so it really doesn't surprise mw after several days of deliberation this is jury still can't reach a consensus there are five men. seven women, there's two lawyers on the jury panel too and it is interesting to see they've asked for some clarification on the law and jury instructions over last couple of days moving forward including justification self-defense, theory so it will be interesting on monday if they are, in fact, hung up on whether or not this was valid self-defense. that really wouldn't change if the count is lesser with criminal negligence on monday we'll have to wait and see. rachel: you are an attorney as well. what does it tell you the amount

of time -- that they've taken? the kinds of questions they have and clarifications they have for the judge does that bode well or bad for the -- >> that's a great question rachel. >> for the defense? >> you never know that's a great question i've been in a lot of courtrooms over the years and you always think if it is a quick vecialght it will be either a quick acquittal or a guilty not guilty verdict but here it over several days it doesn't really surprise me because it was a 20-plus day trial and it took a while to go through all of the evidence from both sides and sort it out and this jury being there are a couple of lawyers going to be technical they're asking for clarification on the law. they're going over the evidence the video evidence in this case. usually the longer it goes on you usually see what we saw yesterday which was a jury that can't reach a decision that leads to a mistrial or it could eventually after the judge gives them the alan charge they feel a little bit of pressure to reach a decision one way or the other.

rachel: my heart goes out for this young man and his family i'm a mom with boys disclose his age and we tell them to do the right hying to stand up for people who are, you know, victims potential victims and people in trouble. to be helpful -- to be a hero. and boy this mess the message coming out of this entire trial the fact that he was prosecuted at all -- is the opposite. i think this has more than legal implications i think this has very huge cultural implications safety implications for the people of new york. if this man is put in jail chanly i don't think anybody can ever expect a young man like that to stand up and do what's right for the women and children who are in damage. chanly great reporting. thank you. >> you've got it. rachel: trump making history yet again what the first ever crypto and a.i. czar is planning for

president trump appointees he's not select academics or author he's choosing real world people they've done this ever be and rolled they're sleeves they've been in the trenches they are doers so from president trump it is clear he wants to deliver on preelection promises and make ugh the cryptocapitol of the planet when you look at david sachs in particular, he certainly is procrypto he's a capitalist he owns crypto he was one of the early investors in biggest a.i. players out there so it is very crystal clear that president trump mean what is he said and he wants to make us the biggest crypto player in the world. charlie: such a great point and trump you know in every arena, he separates -- surrounds himself by people who are these doers it is such a

terrific point. so what are some of the things that david sachs and donald trump are going to be doing in this area? >> well, look i think one of the biggest issues with crypto is nobody knows how much to regulate it should there be any regulation at all and i think from a -- stand point of having some clarity reducing uncertainty, that will certainly make it much more likely that you have more crypto bowls that bitcoin continues to climb higher. but then further more you look at the rest of the trump appointees and nominees whether it is scott bessent in the treasury and howard and fcc they're trying to make this a legitimate currency and all if at some point you see a company like amazon allowing people to buy goods with bitcoin, or with crypto overall the coin is going to go to the moon. it will go up substantially. so i think you'll see more use cases.

i think they'll have some clarity on regulation and both of those are going to be great for crypto. >> of course donald trump is first president to come along who embraced crypto like this why do most politicians think crypto is such a threat to them? >> well i think probably the biggest issue is i think there's dirty business happening with crypto right. you know whether it's -- drug deals or, you know, ransoms there's a lot of that. so that's i think that's kind of a black mark on crypto. but you know about when you look at the technology, the block chain technology, when you look at the ease of transfer, it is a legitimate currency and i believe that the people who are in place right now are certainly going to further legitimatize that and charlie i have to tell you some of the bullish calls out be bitcoin is a thousand up 50% sense the election. mike of galaxy digital of maybe a month or so ago he said that if trump is able to build a bitcoin reserve which he's

>> i love volunteering it is for the kids project like the cop it is a great event i love having involved great for the holiday season. >> tell me just the idea of what this event is for and the building the relationships with kids in the community. >> it's really good to give back and you know show them that we're here to help and -- you know give back to the community and you know, not only for them but for the hospital and people that can't be here right now. >> you guys are some volunteer kids right you're volunteering. tell me what you like about this event. >> i like it because i get to help people that need help that don't really get a lot of chances to get toys. that need it more than us. reporter: tell me we're going to get gifts and then bring these also to kids in hospitals? >> because they don't really get to go shopping because they're stuck in the hospital because they got injured or something. >> and it is a hard time at christmas we're glad that you're
