♪ >> lawrence: so a fox news alert. today deliberations resume in penny's chokehold case here in manhattan. the jury now considering a lesser charge of criminally negligent homicide after the court dismisses the top charge of second degree manslaughter. after jury deadlocked was twice deadlocked. is the move just a desperate attempt for a guilty plea? here with insight, fox news legal analyst gregg jarrett. so, gregg, i mean, i have set in court a lot of times as a private investigator. i guess i have never seen this done before. once the jury has reached some

sort of verdict. if it's hung or not, then that's pretty much it. the judge issues a ruling. either they retry the case. something was different in new york. why? >> well, it was improper, lawrence, for alvin bragg's prosecutors to suddenly decide to drop the top charge of reckless manslaughter after spending 8 weeks telling the jury that penny was guilty of it and, you know, the judge let them get away with it. he shouldn't have. and, in doing so, the judge contradicted his own ruled that the jury could only consider the lesser count if they found penny not guilty of the top count. well, that didn't happen, did it? so, now, the judge is telling the jury oh, forget about the law. forget about what i told you. his ruling also violates the new york procedure law. that forbids dismissal at this late stage during deliberations unless both sides agree 9

defense didn't agree so, you know, lawrence, i think if there is a conviction, it will get overturned on appeal. >> lawrence: i don't want to hop on you, i don't want to skip past that because i was a little confused there as well. at one point, the judge agrees with the criminal defense and says, listen, legally what they are saying right now is true. which is why i was confused why he allowed them to return to deliberations. >> yeah. it really makes no sense, the law doesn't allow the judge to do anything under these circumstances at this late stage than to declare a mistrial. that's his only choice. and, yet, you know, he decides to do the exact opposite, so, you know. it's bewildering. it's tough to figure out. but, as i say, you know, this will create, upon a conviction, and there shouldn't be in this case, a serious appellate issue.
