and welcome to hannity. >> and tonight, president elect donald trump's nominee for secretary of defense, pete hegseth, continues to meet with senators on capitol hill ahead of his confirmation hearing. pete will join us live in a minute for an exclusive interview. you do not want to miss. also, tensions. they are rising all across the middle east and europe tonight, sparking new fears over a potential world war. biden seems hell bent on escalating tensions, starting world war three on his way out the door. he knows that donald trump wants negotiated settlements. we'll have a lot more on that coming up later. and yesterday, donald trump's first interview after the election aired on meet the press, know tim russert. anyway, we're going to show you the highlights that's coming up. but we start tonight with breaking news tonight. justice was served in the new york city courtroom earlier today after the jury found daniel penny not guilty of criminally negligent homicide in the subway. death of jordan

nealy. now, this comes after the manslaughter charge was dismissed by the judge on friday after the jury failed. they were deadlocked. they failed to come to a unanimous decision. now, the fact that this case was ever brought forward is a complete travesty of justice. this is someone. this is someone you know. how is this person supposed to react when you have a crazed homeless person with a history a mile long in terms of dealing with cops and authorities in a subway car yelling that he's going to kill himself and everybody else in that subway car. well, that would be a clear and present danger, not only to himself, but everyone in the subway and everybody around him. daniel penny, he stepped in as a brave good samaritan to protect everyone else in that car as as one african-american woman testified to is, she said, thank you to mr. penny for what he did. the charges alone

brought by the radical d.a. alvin bragg, represent the blatant weaponization and abuse of our system of justice. then, after the jury deadlocked, the judge went against new york state law that mandates that d.a.s choose the charges before the trial and allowed bragg to eliminate the manslaughter charge without a verdict, which leads to what the law is intended to prevent, which is something called a compromise verdict. now, new york courts and this d.a. are completely out of control. this has to end. now, following the verdict, black lives matter activists, some guy named hawk newsome immediately turned up the rhetoric calling for race based retaliation. take a listen. >> just like everybody else seeks justice on their own, just like everybody else has. vigilantes. we need some black vigilantes. >> that's right. >> people want to jump up and choke us and kill us for being loud. how about we do the same

when they attempt to oppress u? right. >> black vigilantes. let me ask this question. where was black lives matter? you see that police officer right there? a saint louis police officer. his name? david lee. he was killed in the line of duty back in september. a drunk driving incident by a biden-harris illegal. where was the outrage, then? here, with reaction to today's verdict, fox news legal analyst gregg jarrett, harvard law professor alan dershowitz. good to talk to you both. greg, we all we all called this. we all knew what should happen here. this case never should have been brought. but after the jury deadlocked on the manslaughter charges, gregg at that point, my understanding of new york law is that should have been the end of it. the jury is not allowed to go back to the lesser charge unless they come to a unanimous verdict on the more serious

charge, am i correct? am i understanding of new york law? >> oh, you're absolutely right. and the rules of criminal procedure say only if the defense agrees at that late stage to a dismissal, can the judge grant a dismissal. otherwise, he can't do it. he knew it and did it anyway. you know the verdict, i think sean proves this case should never have been brought. it was a gross injustice, contrived by a biased prosecutor who sees everything through the lens of racism and politics. he doesn't give a about innocent victims of crime. alvin bragg pilloried an innocent man, targeted him because he was white, then manipulated evidence to turn a hero into a villain and his lead prosecutor outrageously referred to penny as the white man, the white defendant in the end. this diverse jury refused to buy into the race baiting,

which means that now and again, justice is vindicated. the question is, will bragg now try to recharge penny on the manslaughter count that he dismissed? can't do it. once the jury was sworn in, double jeopardy attaches and forecloses a retrial. so it's over for bragg and hopefully new yorkers will wake up from their slumber and kick him out of office next year so that it's really over for alvin bragg. >> well, why would that happen? i mean, alvin bragg will be rewarded for what he did in this case. he will be rewarded for going after donald trump, even though the statute of limitations had passed. this novel legal theory that we all agreed on, it was a legal nda put together by a lawyer labeled as a legal expense. those 34 stacked charges against donald trump that never should have happened, professor, nor should this case have ever been brought to trial, nor once they deadlocked

on manslaughter. that case should have immediately that that case should have been over. they could have retried the case, but they dismissed it. even without the defense's permission. >> look, in the normal course of events, bragg could have been sued for what he did. he violated the law. he put himself above the law with trump. he put himself above the law with penny. but there is judicial and prosecutorial immunity. they are above the law. they are what they claim. donald trump is above the law and what about failure to prosecute or investigate the black lives matter organizer? the one you showed a minute ago on television? newsom in the courtroom in front of people. he said the following. turning to penny, it's a small world, buddy. and several people in the audience in the courtroom gasped. that was, at the very least, a veiled threat of violence. if i'm penny, i got to get myself protection at

this point, he is threatening to kill and to choke and to strangle penny. why is there no investigation and prosecution of the head of the black lives matter? there are guilty people here. the head of black lives matter is guilty of incitement and of threats, and the district attorney is guilty of unethical, immoral conduct. and there ought to be consequences. it's not enough to get an acquittal here, because nobody is going to come to the rescue of anybody else in the subways in the future, because of the horrible decision that bragg made to prosecute this innocent man and the threats that are being made by these guilty black lives matter leaders who ought to be investigated and prosecuted. >> all right. so what happens from here? this this case is now over, but the subways aren't going to be any safer. and i think you both probably agree with me that new york being as left wing radical left as it is, this guy is going to

get reelected. and this weaponization continues. and then we have judges in new york all over new york. i mean, you still have engoron, you know, swearing that mar-a-lago is worth $18 million when it's worth 1 to $1.5 billion. and he stuck to that and stays stuck on that to this day, which is madness. greg. how do they get away with that? >> well, they they do because this this is a far left liberal state and voters keep putting these people into office. you know, penny won his freedom. but the societal damage that bragg caused, that's long lasting. sean. future good samaritans. well, they're going to be reluctant to come to the aid of people who are threatened and attack. they will fear that they too, will be criminally prosecuted, even though their actions by law may be justified. they'll remember the penny case, a former marine absolved. but he is stained by a da who persecuted an innocent

man and anybody who might have the courage to do the same thing to help other people preyed upon. they're deterred, making the weak and the vulnerable easier targets. you know, by any measure, penny is a hero. alvin bragg is the coward. >> right, professor? what recourse? >> put together a group of people we ought to put together a group of people to put to put a candidate on the democratic primary. he must be defeated. last time he was opposed by a brilliant young woman lawyer, but beaten. this time he's going to lose because he has two major cases. the trump cas, which he's trying to manipulate so that there can't be an appeal because there is an appeal that would be reversed. >> what the penny case new york city professor, that's not the person you want. but let me ask you this. what recourse is available if you have either prosecutorial or judicial misconduct? what recourse is there for citizens that maybe want justice, not a lawsuit?

>> the supreme court protected other judges in a horrible case by saying there's total and absolute judicial and prosecutorial immunity, and they're the same people who complain that that trump is above the law because he has constitutionally protected presidential immunity. we have to have a single standard here and there. there has to be reconsideration of that decision. immunizing prosecutors for putting political considerations over judicial and legal ones. the same thing is true of judges. they should be amenable to legal consequences. they, too, are not above the law. >> yeah. all right, gregg jarrett professor thank you both. we appreciate your time. thank you for being with us. now we turn to other breaking news tonight and earlier today, police arrested 26 year old luigi mangione, the suspect in the assassination of unitedhealthcare ceo brian thompson in new york city. also

last week, the suspect arrested at a mcdonald's in altoona, pennsylvania, after an employee recognized him from pictures circulating around the news and called the police. according to the police, he was found with a fake id, a ghost gun, a note expressing ill will towards corporate america. our very own brian yanis here with the latest tonight, brian. >> sean. good evening. tonight, 26 year old luigi mangione showed up here for his arraignment at the blair county criminal courthouse, where he was arraigned on five criminal charges based on having fake ids and that illegal ghost gun. he was denied bail. our cameras actually captured him going into the courthouse. he will now spend the next couple of weeks in a jail cell. his preliminary hearing is set for december 23rd here in pennsylvania. police say at about 915 this morning, mangione was eating at a table in the back of a local altoona

mcdonald's. he was wearing a blue medical mask and a beanie while working on a laptop. when a mcdonald's customer told him mcdonald's worker to call police because mangione looked like the thompson murder suspect. when a rookie altoona police officer asked mangione if he had been to new york city recently, he got quiet and started to shake, police say the officer asked mangione to take down his mask, and the officer immediately recognized him as the suspect in the universal. in the in the health care ceo assassination of brian thompson. now, police say mangione had multiple fake ids on him, including the same fake new jersey id used by the thompson shooter to check into a hostel in manhattan. he had a loaded 3d printed pistol, a 3d silencer, $10,000 cash and a u.s. passport. he also had a three page handwritten note about the ill will he held toward corporate america. tonight, pennsylvania's governor josh shapiro, is blasting those online praising the murder of the universal

health care ceo brian thompson, in some dark corners. killer is being hailed as a hero. >> the real hero in this story is the person who called 911 at mcdonald's this morning. >> luigi mangione is expected to be extradited to new york city to face charges in the murder of thompson. but that is something, sean, that could take up to 45 days. sean. >> all right. brian, thank you for that report. we appreciate it here. now with reaction. former nypd inspector paul morrow and former fbi special agent nicole parker, both fox news contributors. nicole, we'll start with you. first of all, it took a long time to find him that they had a pretty good idea what he looked like. we had pictures of him, even though he did have his face

covered at different times. the second part that bothers me here is this guy appears to have been very public and outspoken about his radical views, and we're finding more often that people are telegraphing these crimes before they commit them. reaction. >> well, first of all, i mean, of course, in the public we want crimes to be solved immediately. and i understand that. i mean, this is a very dangerous individual, but behind the scenes law enforcement, they are working tirelessly, 24 hours around the clock, trying to locate who he was, where he was. and so i do respect. yeah, we wanted this to be solved sooner. but you know what? i'm just grateful that he is currently in custody. they are poring through thousands of tips, lots of things that they have to look through, processing evidence. and so i do respect law enforcement and what they have done. but i agree, sean, you know, we would like to have had this sooner. but i'm just grateful that he is now in custody. and i do think that this individual, this is not the person that i suspected it

would be. this kid came from a very privileged, wealthy background. i mean, he went to university of pennsylvania. he graduated number one in his private school class, valedictorian in high school, multiple degrees from university of pennsylvania. and this individual killed a ceo of a of an insurance company. what caused him to do that? what was the grievance that he had? clearly, he has a problem with corporate america. he's an anti-capitalist. and this act is a clear demonstration that he is not in agreement with what is going on in corporate america. but i would like to understand, looking at the grievance and looking at the motive, how did he select this particular ceo? why was it brian thompson that he selected? victim selection is going to be very important. and pointing back to motive. but this murder is a clear manifestation of his grievance. >> what do you make paul morrow over the fact that so many on the left, taking now to social media and elsewhere, and actually celebrating the

assassination of a husband, a father, a ceo because of a bad experience, maybe that they had with their their health care provider. i mean, that is getting very loud on the internet. what is your reaction to that? that's pretty sick to me. >> you know, i go back to the statement about democracy, which was, i think margaret thatcher said, which is it's the worst form of government, except for all the others. right? america's health care system is far from perfect, and it's gone through some machinations. but the idea that that's somehow or other justifies killing or countenancing somebody who kills is preposterous. i like to think that that's a representation of a much smaller group of people than it appears. we say in nypd, empty garbage cans make the most noise. realistically. now, none of that should matter unless it rises to a threat. in the same way that we've seen blm rise to threats, in my opinion, relative to daniel pennie, those threats need to be investigated. this case is just starting. they're going to have to do the extradition. they're

going to have to try to get into his devices. they're going to have to see if he was working with anybody. how did he know that the victim would be there? almost an hour and a half earlier than he was scheduled to be? there's a lot of questions here. still, there's a lot of legal machinations. they got to get him back to new york. this is just starting. >> nicole, i'm going to give you the last question. why is it up until recently, i don't know if they ever finally got into the phones of the would be assassins against donald trump, one of the would be assassins had up to 6 or 7 phones. why can't the fbi hack into these phones? it seems like the iranians have no problems doing it, and the chinese have no problems. but the fbi can't open up these phones to get the evidence that they need. >> right. these encryptions are very difficult for them to break into. but you know what i have to say to that, sean? maybe the fbi should start focusing on the technology that they need to get into these types of phones instead of continuing to focus on political things. i kid you not, the capitol violence is still on that front. homepage of the fbi.gov website almost

had a drink or two too much on occasion. pete has been on capitol hill meeting with lawmakers discussing his upcoming confirmation hearings. today, pete had his second meeting with iowa senator joni ernst. after the meeting, senator ernst said she looks forward to supporting pete through this process. pete hegseth joins us now with more. sir. welcome back. great to have you. >> hey, sean. >> thanks for having me. let's talk about let's talk about the meeting with joni ernst today. >> absolutely. sean, it was a great meeting. i mean, people don't really know this. i've known senator ernst for over ten years. i knew her when she was a state senator, running to be the first female combat veteran. and we supported her in that effort and have continued to because you get you get into these meetings and you get you get to listen to senators is an amazing advise and consent process. and you hear how thoughtful, serious, substantive they are on these key issues as they pertain to our defense department. and joni ernst is front and center on that. so able to have phone

calls and meetings time and time again to talk over the issues is really, really important. and the fact that she's willing to support me through this process means a lot. and i also want an opportunity here to clarify comments that have been misconstrued that i somehow don't support women in the military. some of our greatest warriors, our best warriors out there are women who serve, raise their right hand to defend this country and love our nation. want to defend that flag and they do it every single day around the globe. so i'm not presuming anything. but after president trump asked me to be his secretary of defense, should i get the opportunity to do that? i look forward to being a secretary for all our warriors, men and women, for the amazing contributions they make in our military. >> let me ask you this there are more liberal senators like lisa murkowski. i don't know lisa murkowski. i do know susan collins. and i actually got a lot of time to spend with her. and she was beyond reasonable. but she is the only republican from new england. have you had a chance to speak with them up

to this point? >> we will be meeting with senator collins on wednesday and senator murkowski on tuesday. and let me tell you, sean, the founders got this right. this is this is not a trivial process. this is a real thing. advise and consent of a nominee who the president has chosen and i'm so grateful that president trump would have the faith in me to lead the defense department or to choose me to do that. but this advise and consent process, meeting with all the members of the senate armed services committee, and they all have great questions. and my answers are for them. sean, the left is trying to turn this into a trial in the media. a show trial, and we're not going to let that happen. i'm going to walk into the door of every one of these senators with, just as an open book, willing to answer their questions because they deserve answers. and that will be, i've heard great things about all of these senators and the questions they want to ask, and we look forward to earning these votes. that's what it's

about ultimately earning the votes through the committee and through the entire u.s. senate. and hopefully i'll have the honor of being able to stand up for our warfighters. that's what this is all about. it's all about the men and women who put the uniform on for us. they want someone who kicked down doors and had their back in the past in that top spot. >> the media mob doing what they predictably do. you had a consensual relationship. it was investigated. you were fully exonerated. and correct me if i'm wrong here wasn't there video tape evidence that was largely responsible for exonerating you? >> i mean, in addition to personal, personal witnesses and all of that, it was fully investigated at the time, years ago, and i was completely cleared. and that's why, sean, you know what i look forward to? i look forward to the fbi background check. i look forward to the actual under oath conversations with senators as we go through the process, because, again, this is what the left does, sean. it's the anatomy of a smear.

they take something and then they add anonymous sources and contortions and flat out lies, and then they try to try you in the media before you can even get into the doors with senators. and this is where i give so much credit to president trump. he's got a backbone of steel. he never backs down. he called me and said, pete, you keep fighting. and when he picked me, he said, pete, it's because i know you can do this. you're going to have to be tough as hell. stare these folks down and stand up for the change that needs to come to the defense department for our men and women in uniform. so if he can endure what he's done, sean, then i can stick up to this lying press and fight on for the american people and our war fighters. >> okay, so when reagan became president, he talked about what he called a gap of vulnerability militarily. we had planes that couldn't fly, ships that couldn't go out to sea. i want to know about your vision for the department of defense. for example, putin and xi, russia, china, they have hypersonic missile technology. i am of the strong belief that

future wars will be fought from air conditioned offices. the nature of warfare is changing military technology is key. i feel like right now we are behind. i love the president's idea of an iron dome. if we can protect the entire country, i think that would be his greatest legacy in the in the end, if he follows through with that and, you know, and then how do you deal with die in the military, how do you deal with recruitment problems we've had in the military? we have about a minute left. >> well, there's a lot to be done. first of all, you salute the commander in chief who got those 76 million votes and is going to chart the way. and i'll give him advice and counsel along the way. i'll just say what he told me. return the pentagon to the warfighters. pete, get in there and clean out all the social justice, politically correct garbage on top and get back to lethality, warfighting, accountability, meritocracy, and readiness. and guess what? 95% of the people in that

building in the pentagon and that wear the uniform, that's all they want to do anyway. and so when you return to that, it changes the culture of an institution that now stands up straight. you address that recruiting crisis. you addressed the retention crisis. sean, i can't tell you how many families have reached out to me and said my son or daughter wasn't going to join and now they are. after president trump was elected and you were chosen to be secdef same with retention. and then the rest of the world takes notice of that. sean. so i'm not going to get ahead of the president on policy or or what our posture will be. but we will be strong and we will have peace through strength, as donald trump has said. and we will put america first. that's what he's asked me to do at the pentagon. and that's my promise to the american people and our warfighters, led by president donald trump. >> all right, pete, we appreciate you being with us. good luck on the process. democrats are not going to be nice to you. that part, i can promise. we appreciate your time. also tonight, donald trump is going to be inheriting a world in crisis thanks to biden's many foreign policy failures in ukraine, joe has been escalating the conflict

with hundreds of millions of additional dollars while ignoring north carolina and granting ukraine finally permission to fire ballistic missiles into russia. well, that's great, because vladimir putin now responded by changing russia's nuclear policy to allow the use of nukes to respond to any ballistic missile attack inside of russia. he knows that donald trump, meaning joe biden, wants a negotiated settlement. both sides seem to now agree with trump, and biden is also insanely you know, he allowed the taliban in charge of afghanistan. he has left american hostages held by hamas. plus, there is now a power vacuum, as you know, in syria. and what did joe do? he fired missiles into syria as soon as assad was deposed. and right as donald trump was saying, we should not as a country, be involved. it almost seems like joe biden is trying to ignore world war three on his way out the door. well, but
