according to friends in hawaii. he wanted to distance himself from this wealthy life. his family on social media said that they were shocked. they were devastated. now, then his school, he went to the gilman school, which is in baltimore. now, that is a very prominent school. it's all boys e was there from sixth grade until graduation. he graduated in 2016. he cost will $40,000 a year to send your children there. and many senators, many governors graduated from the gilman school. his friends called him likeable, athletic, studious, on the quiet side. had an interest in technology and robotics and he was valedictorian of his high school. we will show you a clip of that valedictorian speech in just a second. he thanked his parents and thanked his faculty. then he goes on to have an ivy league education. goes to u. penn with a bachelor's and master's degree. graduated four years ago a compe and mathematics. a member ever the fraternity.

that guy is 26 years old. what happens when you are 26 years old. you were knocked off of your parents' health insurance in many cases. we don't know if he was on his parents' health insurance. can you have your kids on it until 2 #. if he has been impacted on that. and when you apparently according to the cops here in new york. when you read his three-page note that he was found with and handwritten because he didn't want a digital trail, it echos what was found on those three gun casings about deny and all that other stuff. and it looks literally like he was caught red handed. he had the gun. he had the note, he had the fake i.d. and has the face. >> the big thing now since this

there could be another deadlocking but reasonable doubt. the entire jury room everybody had reasonable doubt. we'll don't think he did this on purpose. >> lawrence: bry? >> brian: alvin bragg failed again. epic embarrassment for this country. hopefully the beginning of the end for the woke d.a.s. we deeply respect the jury process and we respect the verdict. desperate attempt to make sure that danny penny went to jail for something. they came and said get rid of the top charge. i beg you, judge, look at negligent homicide. and then the jury to their credit, we're not going to know until they sit down and talk and said almost seems like they resented the fact that they had to go back and we told you we were deadlocked. lesser charge and say not guilty. not deadlocked. going to say not guilty. i talked to missing here?

why would they come back with a lesser charge. jury had an easier time. to do it and have this happen is bizarre. and this reaction is also bizarre. >> lawrence: i never seen anything like it. i was worried because there seemed to be one person or it could have been multiple jurors that did not agree with the others. and so, i thought there was going to be almost this consolation charge and the result of it. they come back other the weekend and within hours, they have come out with a unanimous decision. and i just think it wasn't just a victory for daniel he deserved to go to the bar and a drink. >> ainsley: he deserves more than one dink. >> lawrence: after what they put him through. law and against mob justice. everyone is afraid in this city right now. going on these subways and walking in the street. and everyone wants someone to step in for them. this was a victory for the

fox wildfire alert. mandatory evacuation orders nirkd malibu after a wildfire broke out overnight. the blaze exploding in size to over 1600 acres in a matter of hours. look at that it looks apocalyptic. the flames reaching outskirts of pepperdine university's campus. students and staff are sheltering in place the campus' center and in the main library and classes and finals today are canceled. the fire is being fanned by powerful santa ana winds with more than 12 million people in the region. under a warning. so far no reports of any injuries. the cause of this wildfire inve. stunning doorbell footage out of chicago showing the moment a garbage truck explodes. when we first saw the first images in the video of him shooting the ceo in cold blood, the fact that he recognized him so rapidly on that street says to me that he just wasn't looking at a photo. he either did a deep dive on videos or saw him live before. and where did he get that information that he was going to be there? so were there other people involved? and the fact that he held on to all the ids. he held onto the cash, he had the gun. one of the reasons why the police were going and diving for evidence in that pawn is usually criminals and murderers get rid of the evidence. he held on to it. was he planning more things? that's what they are really going to be doing a deep dive on. >> brian: you said part of a generation that can't deal with stress and strife. >> yeah. that's part of the challenge here is that he is 26 years old. and so hypothesis is he falls off his parents' health insurance plan and he sees himself with this victim mentality as social justice warrior. instead of going from 0 to 5 miles per hour as james clear

turley joins us now to discuss. professor, i was a little taken back because after there was some disagreement on the first count for them to go over the weekend and come back i thought people would say a con labor relation indictment. but it seems like the jury was annoyed. >> well, you know, this was part of the plan for bragg, he was setting up for what is called a compromise verdict. you start out with this more serious offense. very few people thought he could stick that landing. but the idea is that i fracture the jury or they reject that count. and then you get them to compromise on the lesser count. and that seemed to be working when we heard this was a hung jury. then, over the weekend, it didn't work out that way. clearly, you know, a couple jurors how many were holding out. changed their mind.

and fortunately the result is something that everyone can celebrate. but, really, this jury was speaking not just in terms of themselves but i think in terms of the city at large. at the end of this process. this was a very strong voice that in new york you really don't have to walk away. you don't have to just watch. but, the problem here is the mixed message by bragg. he put this person through hell. i mean, he put him through a criminal trial. he will now face a civil trial brought by the family. and the question is what was it that bragg was representation. ultimately the most fundamental values. what else the value here across the city in the other case involving the shooting of this ceo. you had the mayor saying, you know, this shows people need to step forward and act. well, just blocks away. you just tried a guy, at least

bragg did. who did precisely that. and he has spent a year going through hell. >> lawrence: i'm just curious, professor, will this put the end to these, i would say political prosecution because when you look at this d.a., he allows criminals to run the street all the time. but this one was political because of the social justice warriors protesting. is this over now? >> the question is who really is the constituency of alvin bragg? i think you saw many of those voices outside the courthouse that were filled with rage and anger at this verdict. some even threatening penny not to remain in new york city but beyond that mob mob is the rest of new york city. they need to look at this case in a more broad sense. this is what you have come to. you have a prosecutor who takes an individual like this who should be celebrated as a hero.
