accountability, meritocracy and readiness. >> brian: the second hour of "fox & friends" starts right now. >> brian: fox news alert. the suspect, the suspect in the killing of united healthcare ceo brian thompson now being charged after being arrested monday at a mcdonald's in altoona, pennsylvania, 260 plus miles from where the incident happened. >> steve: alexis mcadams has been covering the case all weaning and joins us now live from the couch. good morning. >> good morning, yeah, this has been a crazy story. we have been trying to dig in and get as much information as we can when we are find some of those new details out. we were trying to work this case in new york city. we saw they had dive teams yesterday. they were looking for the weapon. then i got a call from nypd source that said you should head to altoona. they found out there was a man there possibly a mcdonald's employee who recognized the suspect. and called it in. so, although they did all this investigation on the ground in new york city. tends up having this case break

out in, you know, altoona, pennsylvania. >> steve: it sounds like it does make sense. if he was at a mcdonald's and apparently he was on his laptop. he probably ordered something to eat. and if you are going to eat, you have to pull down the mask. >> yeah. >> steve: you couldn't really tell who it was exactly with the blue surgical mask on. but if he pulled down, you know, the mask to have a quarter pounder it's like somebody certainly saw him. >> the main thing with this case was we kept looking at all these different photos coming in from different surveillance cameras. and they kept saying people in the public like this guys eyebrows. what are you could see basically was the eyebrows and eyes. this person at mcdonald's was able to look at him he looks like him whether he had the mask on or not. the police asked him take your mask off want to talk to you e got so nervous according to court documents he started shaking and upset in the mcdonald's they said have you been in new york city lately and that's when a this all unraveled inside of his pocket inside the mcdonald's the fake i.d. used to check in to new york city to

a new york city hostel where he stayed for 10 days before the shooting. >> ainsley: almost like he wanted to get caught. evidence had all this time. he could have gone to mexico. he could have gone to another country. but he was found not too far away from new york city where this happened. >> that's right. investigators at this point they take a look at the manifesto, try to see what is going on with that the question was, too. was he going to come back to new york city? only like a four hour drive from altoona, pennsylvania to get back. he had been here a few days, 10 days casing it being,laying out his plan according to investigators. it's possible he could have been trying to come back again. i think the motive here is the thing that a lot of people across the country are interested in, too. did this have to deal with the united healthcare ceo specifically or about the entire healthcare system. he had a bunch of posts on his social media talking about back pain and how his claims weren't covered. so we're going to have to see. >> lawrence: i'm curious you have been covering crime for a

while have you seen such support for a killer before? >> no i have never seen anything like that. in new york city they this a lookalike contest. having people come and dress under lining the gunman. people going wearing defy, defend and depose on t-shirts. whatever somebody's job is or whatever happened you don't have the right to kill somebody and take vigilante justice? your hands. it's disturbing to people across the country antsz they fine in and hear people excited there is joy from. this really concerning. and people also posting different ceos information then on x. i have never seen anything like that covering crime. >> brian: mayor adams very grateful. he picked up the phone. and he talked to the cop who turns out he is a rookie his name is tyler frye. listen. >> unfathomable, knowing the kind person i saw and knew. i remember he said he had a back issue and hoping to get stronger in hawaii. it also weighed on him that he knew there was impending

surgery. >> brian: yeah, that was the wrong one. that's his roommate. >> that's interesting. the mayor did pick up the phone and they posted it to social media. mayor eric adams in new york city and thank that rookie cop. altoona pd they had stuff going on even though it's a rural area. went to mcdonald's and followed up on the tip. if they would have waited that cop, this kid could have been gone. >> brian: we don't know if he had other plans. did he have other plans to kill somebody else? this one seems to have been thought out. scope the place number two they knew he left new york city. did they have a sense of where they went? >> getting tips from people in new york city saying what bus line he might have hopped on, but supposedly a bus line that originally came from a bus line that originated in atlanta. comes here and the same one would have gone back to atlanta

but makes a bunch of stops. they say that bus stopped in altoona, pennsylvania. he got off. i don't know if he had any connections there. what he was doing. he had all that cash with him in his backpack. >> ainsley: did his parents ever call the police and say we recognized him. he has kind of gone off the grid. if you look at his social media brian said someone is writing man, you are supposed toed to be in my wedding you have commitments i vnsd heard from you. >> the nypd sources i was talking to find it very concerning that random guy at mcdonald's guy with the mask on no one from the family. >> as of right now, according to nypd sources they say they did not have any contact with the family. also this suspect has not been talking, so he came, you know, he went into custody with the police without a problem. as soon as he has been in custody he is not saying anything. i know they have brought it down but google owns youtube has a working relationship with police in most cases give them all the search history. are they going to release that

video to the police until they see what is in final video i think yesterday. >> the video specifically of? >> he had one video that he had scheduled to go. >> brian: video manifesto. >> yeah. we will have to see. they have some cybersecurity guys with the nypd that maybe can work and try to get that stuff from google. sometimes they try to get this information and you can't get it. but he wrote it all down in his own handwriting and had did t. with him in business backpack. >> got to do something about the mask law and the mayor talked about that yesterday. go do a crime. you have the mask on worried about my health. do you think they are going to move on that? >> i don't know there is pushback at least in new york city you see people wearing masks inside on or about outside and wearing masks. why is that person's face covered in the first place? we will have to see what the mayor does. it seems like he changed his position recently to try to go back to the middle where people want to think more evenly about crimes. >> in the coming days, we will

maybe today we will learn more about, you know, was it related to a denied claim? was it the fact that he is 26 years old? he was kicked off his parents' insurance, we don't know. but, alexis, this guy left some puzzling clues that people are scratching their heads about. we know that there is a book that was written about how big insurance companies were called denied delayed depose. but then what's the deal with the monopoly money that he left in one of the backpacks? i mean, it seems like he was trying to say something about something. >> yeah. and that's the interesting part when you go back, originally when i got over there to cover the case that day. they thought some of the nypd guys thought this was a paid assassin who didn't make any mistakes. he made a lot of mistakes according to police. >> lawrence: a lot. >> left behind weird clues. stuffing monopoly jacket a backpack. dropping a phone. grabbing a drink at starbucks leave saliva on it. going back to the monopoly

social media she was praying for him. maybe they are shocked. >> ainsley: so cute in the valedictorian video. >> something must have changed in high school to college to now. a sad situation. >> steve: alexis, thank you very much. >> steve: let's talk a little bit about this. daniel penny has been on trial in new york city for a couple of weeks. you no he that last week the more serious charge of manslaughter was dismissed by prosecutors after it was deadlocked. and so what happened yesterday? he was acquitted, cleared of all remaining charges, which was kind of a -- it was a big surprise. because the d.a. had put all of his eggs, essentially that basket. okay. you are not going to find him guilty of this big, more serious charge. what about this essentially and i think you depicted it as a consolation charge which it was. but as it turns out. apparently all the jurors in the jury room had reasonable doubt. as we know, his defense said he

acted in self-defense. and alvin bragg said nope, he used too much. >> lawrence: bry? >> brian: here is his attorneys. afterwards when they got the surprise. here's the thing. the theme over the weekend how dare they come with a lesser charge. they are desperate for a conviction. and the jury come back and said screw you, essentially. it's called not guilty. they want to have a drink. he is a free man. he has a civil trial to deal with. >> lawrence: he deserves a drink. >> brian: trying to get a soundbite. is he going to talk to judge jeanine later here is what the attorney says at the bar. >> dabble can you tell me how you are feeling right now. >> go this way. >> can you tell me how are feeling. >> is he feeling great. it's a great day. it's a great day. >> yeah. we are very happy. >> ainsley: the verdict is an indictment on alvin bragg. this just is -- looking at alvin bragg and saying enough is enough. you're not going to get away with this anymore. have you been so soft on crime. you know, we watcher illegal immigrants. >> lawrence: that's right.

again? first instinct would be look at all the trouble i went through by doing it last time? >> i'm just but is he danny penny and he saw something and he did something. >> lawrence: i'm just curious, ainsley what is the correct response -- what do you do when someone walks into a train and threatens to kill everyone? harasses everyone? and people feel in fear for their life? what is the appropriate action? do you wait until they attack? do you just take it? do you just die? do you just get injured? like what is the correct way? >> ainsley: we will remember daniel penny's lawyers said who would you rather have on the train? >> of course. >> i don't care if i go to jail or everybody dies or would you rather have daniel penny who served our country and also is protecting the women and the babies on that train? i know ohio would want. i would want him on there i would be so grateful and be appalled if someone were attacking me and nobody would defend me. that's what we are going to get in new york. people are going to be could scared to stand up for someone.

this whole notion that we as -- and i said this years ago. there is gonna come a point where the public has to step. in you can't demonize law enforcement and tell them to step back. have liberal d.a.s that allow these people just to run across the street and examine average day citizens to have this textbook way of dealing with these situations. it's just not fair. >> steve: mr. neely was apparently ranked -- who knew the city of new york had rankings for people who are most desperate. he was in the top 50 most desperate homeless people in the city. >> brian: most dangerous. >> steve: the city failed him up and down. and yesterday when the verdict was read in the courtroom. mr. neely's father screamed and brian, to your point, he is suing danny penny in civil court. given that it is a lower standard, who knows what is going to happen. >> lawrence: i wish he would have had the same energy when he was alive and maybe he would

hurt and her son dead on sunday. he is wanted for multiple charges including murder and robbery. police say a group of thieves stole the family's car, which was later found abandoned. officials are offering a $5,000 reward for information leading to an arrest. the "wall street journal" reporting that president-elect trump spoke to florida governor ron desantis about choosing lara trump to fill in the florida senate seat being vacated by marco rubio. trump selected rubio to be his secretary of state. of course, lara trump stepped down as co-chair of the republican national committee last week. and mentioned she would quote seriously consider replacing rubio in the senate. and finally old saint nick catching waves out in hawaii ahead of big night two weeks from now. >> merry christmas! happy new year. effects. the united states will produce oil and natural gas and we can do it cheaper, safer, cleaner, better than anybody else. we will become the world's super power for energy. that means you don't need middle east energy as much. now, what's the knock down effect of that? iran, which stays alive by exporting oil at high prices there, will be sanctions against iran. and prices of even what they can sell will be down. iran won't have the money to support terrorist groups. similarly for russia and ukraine. russia is not going to have the money to support its continued fighting in ukraine. that's the brilliant move is the energy move. because, then you bankrupt the bad guys. >> brian: let's talk about pete hegseth secretary of defense. momentum. wind at his back. one controversy that he has some people aren't comfortable with is his view of women in combat roles in the military. an issue worthy of debate. here's what he said. >> some of our greatest warriors, best warriors out there are woman who serving, raise their right hand to defend this country and love our

nation. want to defend that flag. and they do iter single day around the globe. so, i'm not presuming anything. but after president trump asked me to be his secretary of state, should i get the opportunity to do that, i look forward to being a secretary for all our warriors, men and women for the amazing contributions they make in our military. ultimately president trump's decision about women in combat roles. we know they are in combat rolls with the idf taking the lead off and your thousand. >> i have a daughter didn't commander in the navy reserve. i believe in women in the military; on the other hand, the israelis and the idf they have dealt with women on the front lines and sometimes it's not the best thing maybe it's good and maybe it's not. men will take unnecessary risks and dangerous risks to save a woman in combat that they wouldn't necessarily take to save a man in combat. it's a complicated thing. and i think that president trump will be extremely well equipped to deal with it. he is a man who is very comfortable around strong women. i'm not scared of his

similarly here, you have the person stopping at mcdonald's in altoona to get a big mac and scroll through his phone there for a while and looks up all these things you are seeing on the news. this can't be. is this really? what? he alerts the mcdonald's employee there. what is really important here not only did they recognize the person but they took action and called the police. people i have talked to after these things have wound up and you are saying why did you call? they are like well, i didn't really think that could happen here in altoona. the courage to call really turns the public into some extra eyes and ears for law enforcement, which is really one of the most important things. >> ainsley: don't you agree the cops got a lot of calls. lots of people recognize those bushy eyebrows or recognized his face when he took the mask off. people from penn that he went to school with or went to high school with even family members. >> yes, ma'am. i think. so and that's going to be a hard call if you are looking at the news or information on your phone and you are looking is that really him?
