assassinating the united healthcare ceo brian thompson. that suspect is sitting in a pennsylvania jail right now waiting for his extradition to new york on murder charges. i'm harris faulkner and you are in "the faulkner focus." mangione, luigi mangione is facing several charges in both new york and pennsylvania now. they include second degree murder, possession of a loaded firearm, and forgery. pennsylvania police describe the encounter with the suspect this way, watch. >> the officer quickly recognized the male as the suspect from the shooting. he had asked the suspect if he had been in new york city recently. and that really invoked a physical reaction from the suspect. the suspect didn't have to say a lot after that question to show that he was very nervous at that point. >> harris: police found a three-page manifesto on the suspect when they arrested him.

there were no specific threats but one passage reportedly reads, these parasites had it coming. and i do apologize for any strife and trauma, but it had to be done. his grand parents founded a nursing home and assistant living company where he worked or volunteered while in high school. that's the medical perhaps connection with the man you see on your screen now. we don't know technically how that plays a role but we do know that about him. that maybe 15 years old he was volunteering at a healthcare facility owned by his family and saw a lot behind is scenes. bryan llenas is in altoona, pennsylvania just east of pittsburgh with more. >> harris, good morning. at this hour we're now getting our first look inside of the now

famous altoona, pennsylvania mcdonalds behind me. the first images of luigi mangione on that morning, yesterday, eating a hash brown in the back of the restaurant. you can see him there without his blue mask. we also have a photo in which you can see him with his blue medical mask on. eyewitness named larry was inside that mcdonalds having a coffee with a friend yesterday and when mangione walked in he says his buddy said hey, that looks like the guy from new york. he recognized mangione's jacket and backpack. larry said employees at this mcdonalds thought the same thing. >> i think the one worker that actually thought it was him, she said between his eyes and eyebrows she said when i took his order it was like she had in her mind oh my god, it's the guy from new york. >> police say a customer spotted

mangione, recognized him, alerted an employee who called 911 when rookie altoona police officer, six months on the job named tyler frye, arrived at mcdonalds. when officer frye asked him if he had been in new york recently mangione became quiet and start evidence to shake. >> he was wearing a blue medical mask. as soon as we pulled that down we asked him to pull it down, me and my partner recognized him immediately from what we saw in the media with photos, videos, we just didn't even think twice about it. we knew that was our guy. he was very cooperative with us. >> mangione then gave police this fake i.d. the same new jersey fake i.d. used by brian thompson's shooter. mangione's photo but a different now. mangione told police he lied

about his name and said he clearly shouldn't have. he had a gun, silencer, u.s. passport and a book bag capable of blocking electronic signals and a handwritten document manifesto. he was arraigned in blair county, pennsylvania criminal court on five charges unrelated to thompson's murder in new york. including possession of an unlicensed firearm. last night he told the court he had no idea where the money came from suggesting it could have been planted an the bag was simply waterproof. this is a look at the correctional facility where he is being held and since charged in new york city with brian thompson's murder as well as four other counts and now we wait to see when he will be extradited to new york city to face those charges. that could take up to 45 days if

he decides to contest that. we're told he does not have a lawyer and we're also told by police, harris, not only is officer frye and the police department now receiving threats, but so, too, is this now-famous altoona mcdonalds. >> harris: no attorney. his family is loaded. a lot of questions about what goes on behind the scenes in putting that legal package together. we'll be watching it. thank you, 45 days would be a long time to sit there and not come to justice in new york. kerri urbahn, fox news legal expert and bobby chicone. if he contestesque extradited. he doesn't have an attorney. 45 days before he would see the beginning of a legal process here? >> i don't think there will be an issue ultimately in getting him back to new york. governor hochul will work with

governor shapiro if he thought that. a public defender will be assigned if he continues to languish without an attorney. >> are you surprised by that? >> i am given the fact he comes from a lot of money. i am very surprised about the fact that his family hasn't gotten him a laurwyer yet. if he didn't have one there would be a public defender. i don't think there will be an issue getting him back to new york where he will see justice. >> harris: this man's face was everywhere. he was taking his mask down to flirt with a woman at a cafe or store in new york. he was all over the cameras that are -- not during his getaway in central park. that place is basically dark with cameras, just a few. they have drone coverage. my question for you is why did

we see him everywhere. the whole country was alerted with this. social media is alive with him over the last seven days. >> he was hiding himself acting as a hermit almost. my bigger question why didn't we hear from his family and friends, the people that knew him and saw his face on the news? we're hearing between six months and a year ago he went off the grid. that's more reason if a friend or family member saw him on the news saying that's my cousin or that's my frat brother that went off the grid six months ago. now i know where he is and called the police. why did it take someone at the mcdonalds to notice him? he didn't hide himself. an ivy league frat boys. where were the people in miss life that knew him when his picture was global, why didn't anybody pick up the phone and

call and say i think that's the guy. >> harris: or anybody. he was all over the place. you say he was a hermit. in new york there is a lot of footage of him. he was moving around, leaving evidence and little bullet casings left behind by him with words written on them. little clues. we don't know if it was a game. there was a lot there. i want to move to another huge story that affects millions of people because if someone can't come to your rescue in a desperate situation because others are feeling threatened, if there can't be an american hero to save the day, we're in a world of hurt. now we don't have to worry about that in the case of daniel penny. new york and beyond has been divided after a jury acquitted marine veteran penny in the death of jordan neely. he was that erratic person i was just describing. they were all aboard a subway underground with passengers who were panicking. penny's lawyers right after the verdict.

let's watch. >> daniel, can you tell me how you are feeling about this right now? tell me how you are feeling? >> he is feeling great, guys. a great day. just a great day. >> harris: there have been calls for the manhattan district attorney, alvin bragg, soft on crime and ran on the words i'm going to get trump and so did the state's attorney general. a thirst on that side of the equation in the law and it is very much liberal. here were his words yesterday. calls for him to resign. he lost this case after making a lot of hay about it and bringing it in the first place. quote, as if every case we followed the facts and evidence from beginning to end. the jury has spoken now and we deeply respect the jury process and we respect their verdict. he needed to come out ahead of all the protesting yesterday and say a few words like that and call for them to stay peaceful. he still needs to do that. because not everybody respects the court's decision. the jury's decision.

protestors outside the courthouse yesterday could be heard inside the courthouse and before the decision came down, i was asking how does that affect the case? how long has that been going on? new york's black lives matter leader with a threat. >> stop begging the system to justify lies. stop begging this system for justice. when things happen to you, you step up and defend yourself. just like everybody else seeks justice on their own and everybody else has -- we need some black vigilantes. people want to jump up and choke us and kill us for being loud? how about we do the same when they attempt to oppress us. >> harris: jordan neely was threatening passengers aboard

that subway. his words were someone is going to die today. a very different reaction for many who are angry that the charges were brought in the first place. a lot of columns and opinion pieces being written. here is a small sample. stop electing soft on crime radicals like alvin bragg. another daniel penny's innocence and the shame of alvin bragg. fox news legal analyst gregg jarrett writes bragg has done lasting damage. another here daniel penny may have been acquitted but the bad guys still won. the "new york post" cover, enough is enough. jurors reject bragg's indictment of a man who protected subway riders. kerri, i come to you on the legality of some of what was said yesterday. that was a small little clip from that man calling for black vigilantes. there were also threats from a

blm leader, i guess is what you would call her yesterday. a lot of news conferences to burn stuff down in the city, to burn cars. those are threats. those are promises of violence. alvin bragg should be busy today on that. >> it doesn't come as a surprise that blm said what they said. they are a discredited and disgraced organization that is driven by racism and bullying and, you know, we never see them showing up in chicago with all of the gang warfare going on there when you have all kinds of -- african-american people dying all the time thanks to gang violence and the like. where are they then? not there. harris, if i were advising the department of justice as far as day one actions with respect to these soft on crime prosecutors with alvin bragg being at the top, here is something very specific and practical they can do. they need to take a look at the office of justice programs which is within the department of

justice. o.j. p., the name of the division, they give out over $3 billion a year to cities across america to help with their law enforcement activities. if i were d.o.j. on day one i would get a list of all of the grants that have been given out and match it up against cities that are being run to the ground by these progressive prosecutors and say you know what? you aren't getting the millions of dollars from us because you aren't doing your job. not enforcing the law. downgrading felonies to misdemeanor, alvin bragg has done that over and over again. you prioritize political persecutions and prosecutions over actually keeping people safe and enough. >> harris: bobby, from what you are seeing here from an f.b.i. perspective, i am curious with threats on the ground, is the f.b.i. working some of this now? we hope it goes away. we don't want to make it bigger but we have to cover the fact there are threats out there based on race and coming from a group that calls for black

vigilantes against people who aren't black. >> i would think this is inciting violence and a crime in and of itself. you are right. hopefully, i worked the new york office of the f.b.i. for many years and i hope that they are following this situation because these are people that are out there breaking the law by inciting the violence. it doesn't have to occur thankful lily for that to be a crime and they should be charged. if alvin bragg was a responsible prosecutor he would be charging these people or threatening to charge them. it is time to get rid of the immunity for prosecutors. the left talks about getting rid of qualified immunity to police officer. you want to stop them and make them think about it before they bring a prosecution, you open them up to civil liability. when i was an f.b.i. agent i car eft $2 million worth of liability insurance in case somebody sued me. it is time for prosecutors to face the same types of penalties. the bar association won't do it. it is run by the left and they won't call these people to account. i think a civil liability on the

taliban. that led to al qaeda. so much opportunity for getting it wrong and why president trump is so right to say don't rush in. don't get involved. don't start picking sides. you have to be really careful. israel is doing such a fantastic job defending its interests and in a way acting on our behalf in terms of the global interest in not allowing this region to descend into total chaos with weapons falling around all over the place. a big mistake to say they got rid of assad and they're our friend. that is not right at all. >> harris: i am concerned about the christians on the ground in syria. we are hearing reports that -- there are a muslim group aligned with al qaeda. they'll do what they do. i don't know why they would think they're our friends. we don't vet people at the border so, you know, but this only is an hour show. what i am concerned about is the fact it's 10% christian in syria.

how will those people be treated? and you can't trust everything you see on social media but when people are telling you that christians are in danger and they have the proof of that, i don't think we turn a blind eye to that. i don't know if this particular white house will listen to that. the next one will. >> exactly. that's why in the end the correct strategy is focus on what is in our interest. it is always true that what is in our interest is to be strong and to make sure that everyone understands that you do not mess with america and in respect of the christians there, i totally agree. again look what has happened over the years. the persecution, execution. it has been completely appalling. so the idea we are going to say great, these guys are the good guys because they got rid of a bad guy. you can have bad guys also getting rid of bad guys and it is a mess over there and we need to be incredibly cautious. >> harris: the u.s. house is set

to hold a hearing on security fears over drones that people are seeing over the skies of new jersey. we've been seeing this for really many weeks and when i say we, i mean our state. i haven't personally seen them but i know they are a problem. we have get ready to fly an faa is closing down sections of airspace. you are aware of it if you travel allot. the governor murphy he is talking with the white house and security. he called a meeting with state legislators and security and he had to. a lot of pressure on him. people across the state are seeing the drones for more than three weeks now near a military base and trump national golf course. people in new york city, staten island, reported seeing them now, too. new jersey's governor phil murphy from today. >> these are apparently, as i understand it. very sophisticated. the minute you get eyes on them

>> harris: fox news alert. we're getting new information on the 26-year-old charged with assassinating united healthcare ceo brian thompson. he is from a prominent family in the baltimore area. he was valedictorian of his high school class. he earned a bachelors and masters for engineering at the university of pennsylvania. an ivy league school. his most recent address known to be in hawaii. honolulu. he had writings critical of the healthcare system.

alexis mcadams with more on this. they have a nursing home type of situation like the city md, equivalent to that and volunteered when he was 15. i was reading about that. people who wonder what are his ties to healthcare, maybe it's that. >> you have to look back at his history. you look at his volunteer work at a local nursing home there that his family might have owned in that area in maryland. but also according to different reports he had recently had a surgery and was in severe pain according to the documents he wrote up slamming the healthcare insurance industry. that's what cops are looking at now. luigi mangione is facing murder charges as we are piecing together a timeline. the 26-year-old handcuffed and booked at a pennsylvania police department. this is some of that video. you can wait and see him get out of the car and this is his photo they took right after they got him into the pennsylvania police department. investigators telling me he used a gun made on a 3d printer to

shoot and kill a united healthcare ceo and had weapons on him. one weapon on him at the time he was arrested in pennsylvania. the question is, harris, is it the 3d printed gun used in the murder or another gun? waiting to figure that out. he might have printed multiple according to investigators. mangione had a backpack with him at the time of the arrest at the mcdonalds and a handwritten note that explained possibly a motive talking all about how he had been in that back pain and slamming the insurance industry specifically talking about united healthcare. he said i state plainly i wasn't working with anyone. i do apologize for any strife or traumas but it had to be done. these parasites simply had it coming. investigators talked about that motive. >> i had the opportunity to read the manifesto. it is handwritten. he does make some indication that he is frustrated with the healthcare system in the united states, specifically he states

illegal immigration. a house homeland security subcommittee is looking at the threats to law enforcement stemming from open border policies. the senate judiciary committee is focusing on president-elect donald trump's mass deportation plans. one witness called by republicans patty morin said she is the mom of rachel morin, a mom of five. you remember we covered the case. that mother was raped and murdered last year. an illegal immigrant from el salvador has been charged with her killing. her mom testified at this morning's hearing. >> you should put american citizens first. we are the ones that pay your paycheck. we are the ones that pay taxes. we are the ones that believe that when you went into office you would keep your word and that you were the man or the woman for the job at the time that would uphold our values. >> harris: democratic state lawmakers are mounting a

resistance to trump's proposed policies and today the san diego county board of supervisors will vote on a measure to block police from working with federal immigration enforcement. that means that those people just get to stay here and fan out all across the country, many of them we know have criminal backgrounds. we don't do the vetting, though, we find out after they break laws here. complicated and dangerous for american citizens. resolution says the counties shall not provide assistance or cooperation to ice and its civil immigration enforcement efforts. well, that's a setup as trump is coming in. jim desmond, san diego county supervisor. great to have you today. tell me this. how bad is this to do right now, to block the help of getting people out of the country we know need to leave? >> well, this is just doubling down on the sanctuary city or in

our case sanctuary state issue here. what we're talking about is we're dealing with people that are here illegally and already been convicted of a crime and they are in our jails. what is being blocked or attempted to be blocked is right now for serious crimes, felonies, we are able to get -- contact ice and let them know this person is in our jail. they are about to get out of jail. they can come in and interview and figure out the seriousness of the crime, do a background check on them which should have been done at the border bust that will be hindered. what is being proposed we in san diego county no longer have that direct access between law enforcement and ice to come in for the criminals that are already in our jails. >> harris: is that a danger to the citizens of your county? >> absolutely. by putting in more bureaucracy to between local law enforcement, yes, absolutely. these people may never now be interviewed by ice or deported by ice and they are back in our

neighborhoods. >> harris: so is this all about trump? >> i think so. i think this is a knee jerk reaction to trump. even newsom trying to double down on trying to trump-proof the state. unfortunately my colleagues here in san diego county are trying to do the same thing. i am hoping to stop it. >> harris: what is that conversation like? your colleagues next door, you all get together. i thought it was to protect the people, national security. that's the goal. what is their goal? >> to protect the people, the illegal immigrants that are here. they say it's about breaking up families. if the people hadn't committed the crimes, we wouldn't be in this place. so it is more about criminals and making sure we deport criminals particularly for the heinous crimes. this is for felonies and other violations. use of firearms, and things like that. >> harris: in california you're surrounded by democrats. trump wants to handle this two
