>> penny opened up about his experience in an exclusive interview with our own judge jeanine pirro. >> rachel: the full interview with daniel penny is available on fox nation. >> steve: that's right. so one day after being acquitted, he sat down at a location, looked like an office. one of his attorneys' offices. overlooking lower manhattan yesterday on the program we were talking about how he was exonerated. how he was acquitted. and we wondered, given the fact that he has been to hell and back 10 times, sings he was charged. with the death of jordan neely, would he do it again? if he were riding the subway today, would he do it again? here is the surprising answer. you take the subway again? >> yeah. and i have been. york. >> knowing what you know now,

danny, if you face the same situation again. would you do it again? >> yeah. totally. i would not be able to live with myself if i didn't do anything in that situation if someone got hurt. i would feel guilty for the rest of my life. and i think i'm in a position and all people if they are in a position to help should always help. i think that's the new york thing to do. that's the american thing to do. and yeah, i would. >> that's why he did it in the first place. >> he said that he believes that all people should help. that's how we all feel, especially if you are a man you don't watch women and children, one lady had a baby. being harassed and don't do anything about it. there is such a void right now. the cops can't do their job anymore. the d.a., a lot of criminals

just take each though he got off and jury put a red line in. i think more people are going to be hesitant to get involved now, rachel. >> rachel: that's the problem. we want good samaritans, we want heros to step forward especially strong men like this part of it was when it first happened. people were hailing him as a hero initially. we have to remember what was going on at that time. people were dying on the subway. there were people getting shoved into the tracks. and then this guy comes in and does that right away as soon as he gets the hero adulation the racial justice cottage industry starts doing their thing and trying to turn him into a villain.

this young man actually talked to judge jeanine. this kid has good judgment also picking judge jeanine. she did this interview beautifully. she was the right person to do this. i was getting even better than barbara walter vibes off. this judge jeanine killed this interview. she was amazing. here he is talking to her about what it was like to go from hero to villain because of the racial justice industry. listen. >> you go from a hero to a villain, when they say they are going to indict you. how do you feel about that. >> you know, obviously, it's pretty nerve-racking. it's -- it was, yeah. it was very anxiety-inducing. but throughout this whole process. i would remind myself of the witnesses coming up to thank me and really no matter what outcome the trial had, i only

cared about what the witnesses -- what the witnesses said about the situation. i only cared about their opinions. >> brian: someone, you know, immediately when this happened. i got a text message and said i surfed with this guy. i have been surfing with him for two and a half years. is he one of the greatest guy. is there anything in his background going to come up as we try to make sense of this? he goes zero. then you find out they went all over his background. tried to figure anything he did walked across traffic. anything. and he was actually in the military. okay. was actually in the military for a while. excuse me, he also was in the symphony. so when he had some time he wants to be an architect and he was going to the gym. there was nothing about him that was anything but correct. here's what i worry about. i worry about the civil trial. and with the threshold being so low and they are saying the cause of death and, remember, that this could cost millions of dollars. and i just thank the american people for allowing his legal bills to be paid.

he is not from a family could write a big check. anybody two i worry about the civil trial that will send the wrong message too i'm exonerated but broke. going to bankrupt me. garnish my wages because i lost a civil trial to what i can tell a father who was mia. this kid this 25-year-old jordan neely put up for adoption or foster care where he pretty much was abused. his mom was killed by the boyfriend and she was chopped up and put in a suitcase. so you can imagine the trauma with that where was the dad. the dad has a cash register out going to sue civilly and look to cash in. >> rachel: showing up now for the payout. that's amazing. >> lawrence: just unfortunate. because he had a rough life. h his. >> steve: jordan neely. >> lawrence: with his story. that is not society's fault. and it's not the innocent people that were on the subway's fault.

there was a system for that. that system clearly failed. but you don't get to create some person to be the person that you crucify as a result of that go after the system. you don't get to make this guy who was the hero a villain. this is a story about the elites. i have been watching other networks talk about this. you have the luxury to not have to take public transportation. there's a lot of people that have to take the subway. >> rachel: that's right. >> lawrence: that have to take the bus. we are blessed enough to be paid where if we want to take a black car we can take a black car, okay? average day new yorkers cannot do that they can't afford an uber, especially with all the -- >> rachel: that's why aoc's comments about this i actually found them shocking. she is a populist after trump won she end with on social media

and hey i really want to understand what happened here. some people voted for trump and at the same time voted for me. she seemed curious and wanting to be in touch with everyday people. then these comments have resurfaced of what she said at this time and her instincts were so wrong. she is not with the common people who have to take the subway at all. >> regarding danny penny taking the subway. he said he takes the subway all the time. >> brian: he will again. >> steve: the thing about danny penny he has a distinctive look. you would spot that hair a mile off. i bet he wears -- he probably wear as stocking cap. >> rachel: he does. i saw photos of him out with his girlfriend recently in one of these magazines. is he wearing a the ha. he is trying to just live his life. it's going to be hard. >> steve: think about it. if danny penny sat down next to you on a subway. i would love that hey sit next to me on the subway. a lot of people here in new york he is a bad guy even though he has been fully exonerated by a

space force base as a launch was actually happening. drone over the launch. >> rachel: today new jersey's governor is set to hold meeting about mysterious drones spotted over the garden state. here in new jersey. and this comes as federal officials struggle to provide answers. >> lawrence: lucas tomlinson joins us from the white house. hey, lucas. >> good morning, guys. new jersey officials are huddling for these meetings to figure out what is flying over new jersey. here on capitol hill, in a very candid admission, an fbi agent says he has no idea. >> you are telling me we don't know what the hell these drones are in new jersey are? is that correct? >> that'>> that's crazy. i mean, that's crazy. that's madness that we don't hem chester, new jersey. senators say the nation lacks adequate drone protection capability. the early morning radars date back to the cold war. they are unable to detect small

aircraft inside the u.s. radars can only track commercial aircraft. there have been nearly a dozen' e.en of these mysterious drones sightings new jersey and staten island. and president-elect donald trump's golf club in bedminster, the incident in new jersey began in mid november. new jersey senator cory booker says, quote: the unexplained drone activity in and around new jersey continues, however with reports on december 9th of drone sightings over naval weapon station earl in monmouth county. this week federal prosecutors have charged the chinese citizen living in l.a. for flying a drone over vanderberg space force base last month that's where the u.s. military test fires intercontinental ballistic missiles once a quarter into the marshall islands. he was arrested this week at san francisco international airport prior to boarding a flight to china. he is charged with failure to register an aircraft and violating national airspace. congressman chris snit mentioned other drones spotted by the u.s. coast guard. >> so i was there on the beach

and i talked to several people, including commanders for the coast guard, who told me that the night before i was there last night so two nights ago. one of their 47-foot vessels, boats trailed very closely by more than a dozen of these drones. ist senator tells fox and the chinese aren't directly flying these drones they are most likely getting the video feed. guys? lucas, the new jersey governor phil murphy says it's under investigation. they are coordinating and cooperating with their federal law enforcement partners. and he says they are no threat. so, obviously, he knows something. you are at the pentagon all the time. what's the buzz about these things? the buzz it steve is that while the u.s. military has great radar systems to intra district

intercontinental ballistic missiles looking out over the oceans over the north pole. we have satellites in space to detect launches, infrared satellites. what we don't have in the united states, officials tell me is radar systems that can detect these small drones. some of them have been reported to be the size of a car. but what senators on capitol hill, what officials tell me is that the radar systems are not there to detect these low drones and if they do spot them the ability to down these things either shoot them down or sever the link like a microwave. >> steve: jam them. >> brian: do you know what could help us? ukraine. they have been innovating and they have been defending and they have been victims. they are the cutting edge. i think it could be some reverse help. >> lawrence: i think lucas' jacket is cutting it. that's a nice jacket. >> steve: you look sharp. >> lawrence: you came with it today. >> rachel: looking sharp. >> brian: what a repellant. >> rachel: thank you, lucas.

we spend a lot of money at the defense and at the dod and pentagon. we need a financial audit. the fact that our government, our military says we only look over the ocean. we don't know what's going on on the inside. this is crazy. by the way our congress, today, tonight is looking to vote on a big defense bill. why are we giving more money when we don't know what they are doing right now? like, where is all this money going? i should not -- we should not have the -- absolutely insane. >> lawrence: the fact that they weren't able to detect the spy balloon and they say hey, you would think they would alter their tracking capability after that. i'm still convinced they know exactly who owns these drones as well. which is why the elected officials continue to say, without saying we don't know what it is and then says i don't think it's any risk to us. >> brian: i hope you are right but i don't think you are right. i looked at some of those congressman's faces they looked chagrined, astonished at the lack of answers they are getting.

yesterday, too. the suspect went, steve, from being silent. they said he was cooperating but didn't have much to say to authorities. he had a lot to say yesterday on his way into that courthouse in pennsylvania where he had a meltdown yelling about grievances about the healthcare industry. watch. >> he looked around and saw the cameras. it kind of looks like that's what he has done when he spotted media. he wanted to get this message out. he tried to as quickly as possible. the cameras were rolling as he created that scene on his way into court in pennsylvania to face the judge. the guards were trying to push him along right toward the door. he was held without bail and is fighting extra digitization. he now has an attorney. i'm trying to figure out if he is paying that attorney. if his family is involved. i don't know just yet. mangione is now facing murder charges. on paper it sure looked like he had a bright future. he went to an comprehensive private high school in the baltimore area. he was ivy league grad and good athlete. he played soccer according to

his friends and he was well liked. he was at u. penn, he had two degrees one in engineering and looking now at time behind bars. people who knew the family say they are shocked to say the least. >> this just doesn't seem like anything associated with them. this is a very deeply respected family from baltimore county it. couldn't be more involved in charity and respected in general. so, when i saw the name, i first had to do a double take is this the same people i have known and have been on the station for so long? it really shocked me. >> mangione had a backpack with him at the time of the arrest. he was spotted at that mcdonald's eating a hash brown about five minutes before police came and arrested him. inside of that backpack was a gun that was printed on a 3-d printer. also a handwritten note according to police that they think could have a possible motive. all about the insurance industry saying that the scam that they won't cover anything including,

shocking number of social media users viciously coming out in support of the suspected killer. the hashtag free legiony has picked up steam on various platforms including x, instagram and tiktok. with some hailing the suspect as some sort of hero. >> it's funny how there are people out there that are happy that the guy that shot the healthcare ceo. when that ceo guy probably killed way more people than the guy who shot him. this guy became the modern day martin luther king. >> you all say a murderer i'm saying freedom fighter. y'all don't see something that go on until they do something radical. now shaking the table and murder and assassin. what happened when that ceo was billing people for insurance and then letting them die. >> carley: since his name was named public the killer the social media pages gained thousand of followers before being essentially deactivated. getting to the point that mangione's defense team people are trying to help pain for the

attorney-client privilege. but what -- tell us what you guys were talking about. i mean, is there one thing that he said to you wow that's cool. >> the relief he felt. the partner kin neff. danny for us became more than just the case, right? we are trying to take care of danny and make sure he is treated fairly in a system that was geared to prosecuted him maliciously in a manner not supported by the evidence. and there was other motivations at play here danny the best thing i could ever hear the stress he has been under for the last year and a half has been tremendous. >> lawrence: you are correct. this was a malicious prosecution. i got to ask you about this lawsuit that you all may go against him with because at one point when they tried to get

some consolation charge against daniel, the jury struck it down. but the judge agreed with you that it wasn't really the right process to go by. but, still allowed it to happen. >> yeah. well, he did. he actually made sure it happened. so, for whatever reason, so i can't get into the mind of the judge, right? but what i do know is it was based on the application of the district attorney's office. just like danny said in his interview, it was like they wanted to try and get him on something. they knew they weren't going to be able to get him, so they had to get rid of that top count in order to get to that second count just in the hopes that maybe they could pull out a win here and they were unsuccessful, thank god. >> rachel: i think the difficult thing for me, i think about his family. i'm a mom. i think about his mom, his sisters. so this happens. he is acquitted. he is freed. but now there is other lawsuits. the one from jordan neely's

father who suddenly appeared out of the wood work. but you are now considering or you are contemplating this malicious prosecution how does this work? who exactly -- is this against alvin bragg? who does this actually go against? it goes against al victim bragg for the way he handled this case and the ethical lines. >> rachel: anyone else? mid call examiner's office. chief gram for his involvement in this case the record was made fairly clear as to the extent of his involvement and what occurred here. he was appointed by mayor adams. same political party as alvin bragg. there was collusion there. and i mean the collusion began from the very beginning of this case and all the way through. the district attorney needed the medical examiner and needed the medical examiner to act quickly. and he did just that.

>> brian: so, first off, how concerned were you after donald trump got convicted by this new york jury in a case that no one thought had validity, including democrats. what were you thinking knowing that you had a case coming up right after that? >> yeah, so that's a great point. because, to be honest with you, it was scary, and for us from a defense perspective, we honed in on the most important part of the case was going to be jury selection. because, that was going to be the biggest challenge is to get a fair jury and from everything that we did all the steps we took and advisers we put in place. it worked out it really did it was close and difficult. that's where the key battle was waged. >> lawrence: people look at you as a criminal defense attorney but you were in the prosecutor's office before. >> this that's correct.

>> >> lawrence: how far do you feel about the system the way it is. when you were a prosecutor, this is not the type of stuff you all went after. they are allowing the criminals to roam the streets and civilians that protect the citizens are now the criminals. how do you feel about this system? >> well, that's just it. i mean, and there were some highlights that were put out there. quite extensively in regards to this office's practice and not prosecuting crime. and some very serious cases, too. talking about restorative justice and such. which, by the way in some circumstances that's a great thing and it can be some brutal cases of an individual who attacked an 80-year-old man mugging him and punching him and ultimately killing him and yet you are going to go after full-throated against my client how admit did a lot a laudable thing and is a fine young man? despicable. >> in talking about a couple moments ago talking about how

you may file these lawsuits against alvin bragg, medical examiner, you had said there were motivations involved. what were the motivations that those offices did that would in your estimation break the law? >> well, listen. it's not necessarily even about breaking the law. it's blurring ethical boundaries and failing to act in the manner in which you are expected because of your office. but, the bottom line is a lot of this came out at trial, too. and it was clear that there was a fear that if an arrest wasn't made and made very quickly, that there might be rioting in the streets. and that that may ultimately look very bad for district attorney alvin bragg. and if that, in fact, happened, that could effect his reelections. now, let's keep in mind, we know this is a democrat strong hold, right? don't forget, alvin bragg has the consideration of the primary. if he doesn't keep his base

happy. he could get primaried and that's where he is wrong. >> he should be. real quick danny penny the person you started to represent a year and a half ago and the danny penny now screamed at been called a murderer, you could hear the chants in the courtroom every day. how has he changed? >> >> well, look, he is scared from. this we had a great resolution. as you know already a lawsuit filed against him. the timing of it is somewhat suspect as far as the coordination between the district attorney's office and the family attorneys. so, danny will be forever changed. he will always have that fear because they wanted to instill fear, heightened alertness. danny is a strong guy and is he going to continue with his life. is he going to pursue his degree and he is going to have a great career. but, he will be forever changed unfortunately there is nothing we can do about that other than pursue these causes of action and defend against any slanderous attempts to hurt him
