donald trump's transition is in full swing and we're watching it play out today. i'm harris faulkner and you are in "the faulkner focus." several of trump's key cabinet choices are on capitol hill meeting with senators who will determine their fates during confirmation hearings. senate majority leader elect john thune said republicans are ready to make sure the incoming president has the cabinet he wants. >> republicans united around making sure that president trump's nominees are put in place and ready to roll up their sleeves and go to work and that we also are prepared to take care of the people's business in this country and move forward with an agenda that will help get the country back on track. >> harris: republicans will be in control of the u.s. senate, as you know. you are voters, i know you are up on it and you were part of it. that will determine when that

process of confirming nominees begins. of course, many positions in the new administration do not need senate approval. senior correspondent on the hill for us chad pergram with more. chad. >> good morning, harris, pete hegseth just walked past us a couple of moments ago meeting down the hall with bill cassidy, republican from louisiana. he is now in this office behind me with susan collins, republican of maine. one of the swing votes on all nominations. he met with another swing vote yesterday, lisa murcowski and this is what hegseth had to say earlier this morning. >> this is how we're feeling today. feeling great. fight for the country, fight for america. >> now collins is one of the most senior members of the senate. she has questions for hegseth about sexual assault in the military and money for ukraine. collins will lead the senate appropriations committee that

doles out the money next year. hegseth talked yesterday with another swing vote lisa murcowski of alaska. >> i had a good exchange and we'll see what the process bears. >> what did you learn? >> well, he has got probably at least half the senate that he is going to visit with. he has a process that is going to involve vetting through the administration and ultimately -- >> it appears the trump transition team has had concerns about hegseth with republicans that happened after hegseth began meeting with gop senators. democrats have other theories. they believe republicans are afraid to cross president-elect trump. >> the pressure is just overwhelming. almost beyond words from a bully, a tyrant, someone who will use every political leverage simply to uphold his

own ego invested in this potential nomination. >> now the nominees are starting to meet with some democrats. you had marco rubio, republican senator from florida up for secretary of state, he talked with chuck schumer, the-out going senate majority leader and kristi noem meets with a democrat. a democrat from michigan. right now he is the chair of the homeland security committee. back to you. >> harris: at this rate, chad, by the beginning of january much of this will be in place and as you've been pointing out that gives donald trump a huge advantage after january 20th to really put some things in gear. appreciate your great reporting always. good to see you. the 26-year-old suspect in the recent execution of united healthcare ceo brian thompson is now fighting extradition back to new york. he faces a murder charge in new

york. and now he is in pennsylvania, a jail there and making news in that area. we'll get to that in a second. back on the extradition. i pointed this out yesterday, it could be as many as 45 days. new york governor kathy hochul has to get involved and file for extradition. luigi mangione made a wild scene as police were leading him into court for a hearing yesterday. >> harris: there are later pictures where you see those police officers having to kind of -- you see a close up of it there. they are wrangling him inside. mangione later smirked at his own attorney during the hearing. the "new york post" cover today

calls him grimace reaper. the suspect's former friends and classmates say the news about him has been shocking to them. >> the luigi i knew was a hard working, driven social kid who had everything going for him. it is like a different person we're seeing in all the headlines and the yelling and the arraignment. he is -- something has happened in the last eight years. he was everything you could want in a high school kid. >> harris: bryan llenas is in altoona, pennsylvania east of pittsburgh. i have so many questions about his family. we have yet to see them. it is an interesting twist in the story. you have more about the suspect. >> yeah, that's right, harris, good morning. we're learning more about what potentially was on luigi

mangione when police arrested him. we learn in addition to the three-page handwritten manifesto according to the "new york post" mangione also had a handwritten spiral notebook. in that notebook it had a to do list of things that he needed to do to carry out the murder of united healthcare ceo brian thompson. a written line said what could be better than, quote, to kill the ceo at his own bean counting conference and wrote a shooting was more targeted noting a bomb could kill inoh center. mangione's mentioned united healthcare and knew brian thompson was attending that investors conference at the hilton hotel in new york. investigators are also focused on a traumatic back injury that mangione suffered back in july of 2023 which resulted in a surgery, apparently pictured here in an x-ray he posted on social media.

>> he was posting an x-ray on his social media showing numerous screws being inserted into his spine. some of the writings that he had he was discussing the difficulty of sustaining that injury. so we're looking into whether or not the insurance industry denied a claim from him or didn't help him out to the fullest extent. >> friends say mangione went radio silent in the months before the shooting. back in june and july of this year. his parents reportedly reported him missing a couple of weeks before the shooting in san francisco. now mangione also seemed to have a respect for the una bomber praising him more of an extreme political revolutionary. what happens next legally mangione is fighting that extradition but authorities are hoping he can be moved to new york to face murder charges in less than 30 days. new york governor kathy hochul

says she will sign that governor's warrant to have that happen. mangione met his defense attorney in court yesterday for the first time and he said they intend to fight tooth and nail. >> this is not just a small thing. the fundamental concept of american justice is the present suss of innocence. i've seen 0 evidence at this point. we've made a strong bond and i look forward to moving forward helping him out. >> the lawyer said he is open to representing mangione in the new york case as well. >> harris: thank you. nichole parker, former f.b.i. special agent and fox news contributor. out of everything that we're learning right now, what are you piecing together as an expert in looking at these investigations? >> each moment that goes by is a treasure trove of information. first of all that outburst that occurred as he was walking into court yesterday just is a demonstration of his defiance

and to me it is a manifestation of the grievance that he had. he really does believe that he is the victim here and that the american people are the victim. and he was the hero. he had to do this. he had to shoot and kill this ceo who was leading this prosperous american company and happened to be a health insurance company as well. so again he sees himself as the victim. he had to step in and save everybody. i think also what's important to note is that they will be looking at the motive and behavioral artifacts. he literally went off the grid. his family members, loved ones and friends couldn't find him especially in the last six months. i find that very interesting as it coincides with the back injury that he had going into a back surgery. think about it. he is a young kid. he had the world at his fingertips and now he thinks his back injury is going to inhibit him from living the life he wanted to life. the moment he was redefining himself and trying to discover

his purpose and maybe his new purpose was i won't have the life i wanted but maybe i will save the world and put corporate america in their place. >> harris: to your point i want to get to this. there are so many questions about how someone like the one you are describing, the suspect could take such a turn. i have know you call him a kid. he is 26 years old. well educated from a good family. two degrees from ivy league u penn in engineering, financially privileged. plenty of friends. yet the alleged -- he allegedly chose to execute someone he had never met in the middle of the busiest city in the world. "wall street journal" editorial board writes this. it appears a back injury just as nichole was saying left him in pain and frustrated. i became isolated from family and friends and trafficked in the theories of exploitation and blame that dominate corners of the internet. upon his arrest, he railed against the healthcare system. perhaps he saw himself as an avenging hero.

this is a common trait of young men who justify violence with the perverse logic of a cause. >> i feel strange because he was a great friend and person i took meals with and person that was part of book club and other activities with. it's like two completely different human beings. he is the kind of guy who was doing his best to take care of himself despite having some severe back pain and a severe issue. i know there are days and perhaps even a week at a time where he was bedridden. so he was doing what he could when he could. >> harris: for a period of time, his family owned lorien health, a nursing home group that they owned. it will be interesting to learn more about what he saw that luigi mangione was volunteering in his teenage years, 15, 16, for his family's health system.

so that also may play a role in whatever he did see or experience and how he feels now your quick thoughts. >> i absolutely agree with that. they'll go back all the way through to his childhood and see what happened even within his family, how they operated in their businesses and is this a statement against that? going back to his isolation. i understand he was a big gamer. was he in isolation not in contact real humans and become desensesy advertised and acted out a heroic effort. i pray justice is served and god bless thompson's family. >> harris: his mother filed a missing persons report in the month of november. we haven't heard from the family at in point. wealthy family. he went for hours without an attorney yesterday. a lot of pieces coming together that will tell us more about

luigi mangione. i do want to get to another name that we have not heard in a while. even though it's an extremely important name. right now in court is ryan ruth, the man accused of attempting to assassinate president-elect donald trump at his home mar-a-lago, the golf course there in mar-a-lago, and west palm beach, florida. that happened back in september. the suspect allegedly waited for more than 12 hours on the perimeters of that west palm beach golf course. a secret service agent saw the man pointing a rifle through a fence and fired at him. ruth fled the scene and was later arrested. he pleaded not guilty to five counts including attempted assassination. meanwhile the house task force investigating both the assassination attempts on trump's life. you have butler, pennsylvania, july 13th, and then you fast forward to a second attempt on his life. they are looking at both of it and just released the final report. the panel found that the events

on both the golf course showed how proper protective measures can stop an attempted assassination. however, it offered a scathing assessment of the actual security at the july trump rally in butler. trump and three others were shot in that. co co corey -- one was killed. butler was preventable and shouldn't have happened. were they even learning from what happened? certainly the second attempt should not have happened. >> i agree with you, harris. again, i hope and pray that president trump gets in there and appoints a powerful, strong secret service director to clean house here. the first one was completely preventable. a series of failures over and over. the lack of communication, lack of leadership. laziness in my opinion. the focus on the wrong things. so focus eats on diversity the same problem happened at the

f.b.i. we have lots of information about diversity. it took away from the mission of solving crimes. the secret service is doing protective detail. one mission when you are in the secret service. primary mission is protective detail. they do criminal investigations. when you are so focused on diversity and other distractions it is dangerous and no place for that in our law enforcement agencies. there were several failures. the reason that president trump is alive honestly is because of the good grace of god. that's what i truly believe. >> harris: nichole parker, great to see you, thank you. new developments in the very controversial election interference case against president trump. you see her there? look, fani willis is back in the news. fulton county, georgia, district attorney fani willis has refused the hand over court records -- records to the court related to her prosecution of donald trump. they are important. and manhattan district attorney alvin bragg is digging in for his case. he is arguing what should happen to the criminal conviction of

>> harris: manhattan district attorney alvin bragg has filed a brief asking the judge in bragg's case against incoming president trump not to drop the case. trump's attorneys as you know just last week exactly one week ago today were arguing that trump has presidential immunity and other constitutional protections. bragg's team wants trump to be sentenced after a jury found him

guilty of falsifying business records. here is a quote. the extreme remedy of dismissing the indictment and vacating the jury verdict is not warranted in light of multiple alternative accommodations that would fully address the concerns raised by presidential immunity. >> it is not a surprise the manhattan d.a.'s office is refusing to dismiss the case. what is a surprise in the filings today in over 80 pages they're telling the judge the preservation of our verdict is important. shows you just how far they've gone in an attempt to preserve this jury verdict that they think is fundamental to the constitutional value of the jury process. >> harris: alina habba is here. is this good news for the former president that this push is coming on? how do you see it? >> i think that alvin bragg is

so self-interested and his team he is failing the american people and what america needs right now is unity. this case should have been dismissed. never should have been brought in the first place. past the statute of limitations, nothing happened. the president did nothing wrong. the evidence presented was clearly outside of the perimeters of anything that should have been considered as he was president of the united states, not even at the trump organization during the time period they were questioning. immunity decisions have come down, have made clear that he has immunity but d.a. bragg, unlike jack smith just won't quit. meanwhile, they haven't extradited the gentleman from altoona who has just shot and killed somebody on the streets of new york yet. this is the hypocrisy that has destroyed america and is the reason 77 million people voted for president trump to be president again. >> harris: the way that i put it like that is because bragg just

came off a pretty bruising loss with daniel penny. in that case that never should have been brought. you had someone a marine vet on the subway, a hero to the people inside that car down beneath and penny rescued them and put down a man who was threatening them inside that car. i would think watching bragg get this thirsty might be good news because he is going to make mistakes. >> you are 100% right. more importantly where is your dignity? this goes for fannie as well? how do you want to be remembered in history and the question i pose to them. we will not allow it to continue. i most certainly will not. it is unacceptable and hurting the american people and constituents in the state of work that have elected him and had him come in an bragg has literally ignored the needs of new yorkers. he is soft on crime for people that are actually committing crime and he has been persecuting and prosecuting

people like penny and donald trump who are here to help america and to help real americans. it is a disgrace. he should be ashamed of something. 80 something pages of taxpayer dollars wasted on the motion and instead of saying we will dismiss. >> harris: he was too busy lose the high-profile and important case that never should have been brought against daniel penny. you also put those two people together. fulton county georgia district attorney fani willis as the same sentence as alvin bragg. they are in a drought for any way to go after trump. willis has refused a judge's order now to hand over any communications that were with special counsel jack smith and house january 6th committee. willis is prosecuting president-elect trump's 2020 election interference case in

georgia. she denies ever talking to jack smith about the case and says there are no records to hand over. willis also claimed there are legal exceptions to justify withholding communications with the january 6th committee. a new piece argues this. willis's refusal to hand over records suggests she is willing to clash with her critics on yet another front. even as she faces the possibility of disqualification from her own case. jonathan turley had something to say about this, trump's team asking a georgia appeals court to throw out the case. let's watch that. >> this entire case is leaking like a sieve and always has. based on a ridiculous rico theory to get to the president. on top of that you have willis's own conduct and whether she should be removed from the case. a big debate what will bring this case down. i can't see if she was able to secure a conviction that she

would be able to sustain it on ap appeal. >> harris: she is stuck in a sticky wicket. if they turns over records they would think there was a conspiracy against her and jack smith against donald trump. >> say it ain't so. you can't imagine that would be happening, could you? listen, the truth is this. we know there was. we've seen white house records that show that a lot of these d.a.s and a.g.s were visiting the white house and coordinating with jack smith and also the white house administration. unacceptable. political motivation and selective constitution. we don't do them in this country. my message is the same for fani, you have embarrassed yourself was a enough. the case is a joke and hoax and need the american people to have what little faith they have restored in our justice system. it starts with all of those hoaxes being dropped and saying we respect the rule of law and understand the presidency and

>> harris: daniel penny is breaking his silence in an exclusive interview with judge jeanine pirro. he was found not guilty in the subway death of jordan neely, a homeless mentally ill drug user violently threatening people and his words were someone is going to die today.

it's daniel penny's first and only interview televised since being acquitted. he is expressing gratitude after more than a year of being vilified by so many people and across the country the story migrated from new york. it was huge news. >> a jury of your peers, danny, felt unanimously beyond a reasonable doubt that you committed no wrongdoing. what would you say to them? >> i would like to give them a hug. i would like to thank them, definitely. it takes a lot of courage especially in this climate in new york city, to stick up for me. so i'm very thankful they were able to do something like that and it is very courageous of

them. >> harris: in "focus" now judge jeanine pirro co-host "the five." you are a tough lawyer, you teared up as you watched that. we both did. what a young man. >> danny penny is, harris, one of the most incredible young men i have ever met and his strength, his determination, his -- people calling him names, prosecutors trying to bring him down violating their own rules. medical examiners contradicting their own testimony in order to get him convicted. nothing changed that face and i was in that courtroom for five weeks. he was stoic, tall and then when i did the interview, i found a man that was so incredibly powerful, kind, courageous.

he was trained as a marine. he is sensitive. but he is also had the courage of a lion. he said he could have turned away but he said when i saw those women and those school children hugging each other on that underground subway car, i couldn't look away. i said to him well, you were freed yourself of him. he said yes, of what? being killed. that was deadly physical force. and he legally had the right to use deadly physical force although if you watch the whole interview. you have to watch it on fox nation. he said i didn't use deadly physical force, he didn't. he died of something else. the medical examiner, new york city, should be embarrassed because they made a decision without the toxicology, without the histology, anthropology, without the hyoid born analysis,

it was unlike -- because there are outbursts on the train all the time. in new york city there are people coming on and saying kind of -- talking crazy. this was unlike anything that i have ever experienced and it was -- it was very serious. i completely believed what he was saying. >> harris: he is emotional there, too. what was your impression of him as someone who now is known by everyone a hero? he not only is a hero, he is more than that. he is to me an icon who at this point in america represents true masculinity. when the last election we tried to talk about what is masculine. that guy is. he wants no attention. he is very uncomfortable in any kind of public setting.

he doesn't like the limelight. doesn't like politics. doesn't want to criticize people. but he was willing to carry the burden, as he said, of a million court appearances because he couldn't live with himself if he didn't interfere because of all of those victims. and they were white and black and hispanic. and the people helping him hold jordan neely were black and hispanic. people on the jury were black, hispanic, asian. so, you know, they weaponized his military experience against him. they tried to make this a racial case. it was not. >> harris: they did. >> kudos to this jury. when he said he wanted to hug him we all teared up. this man is a classically trained musician. he studied classical music since third grade. he is very zen.

that thing, that chinese spy balloon that went across. some of these drones are the size of a bus, a small bus, s.u.v. can you even imagine? new jersey governor murphy was supposed to brief mayors, we were telling you this for a couple of days. he was going to show up today on the drone sightings. we've just found out he was a no show for a scheduled meeting with officials. nate foye is outside the new jersey regional operations intelligence center. our main one question to the state lawmaker who will join you is where is the governor of the state? >> yeah, harris. there were two separate briefings. one with state legislators. another with the mayors. second briefing is happening now. we're working to see if governor murphy is there at that meeting. but emotions are high right now and there are virtually no answers at all levels of government. remember yesterday white house press secretary karine jean-pierre told reporters to ask the f.b.i. or dhs.

during a hearing on capitol hill lawmakers had a chance to ask the f.b.i. what they know and the answer was nothing. listen to this exchange. >> public safety at risk? are we concerned that there are nefarious intentions that could cause either national security or public safety incident that would put americans at risk? >> there is nothing that is known that would lead me to say that. but we just don't know. that's the concerning part of it. >> we are joined by new jersey state assemblyman who left the meeting that governor murphy did not attend. you said a lot of people in there. 50 legislators were there. people were getting angry. what happened? >> we all drove from quite a distance away. i spent an hour inside and drove for two hours. an amateur hour presentation. they told us nothing. when i got here today i wanted

to learn what i could tell my constituents. the state police told us one of his helicopter hover evidence above one of these drones but felt unsafe for the pilot so he let the drone go and come land. the state police, f.b.i., homeland security are not doing what they need to do the figure out the issue. their answer was to us they don't have answers and not sure what's going on. it's not about the tech noll gill or the attitude to put forth everything they need to do to get this done. i came out of that meeting pissed and i am pissed. our residents in this state deserve a government that works for them and what i saw in there was a government full of fricking excuses and it really annoys me. >> you hear the frustration there and it is echoed by the residents of new jersey who spent a lot of money in taxes and feel it is not being spent well because they are still being left in the dark. send it back to you, harris.

>> harris: our governor phil murphy said if taxes aren't your thing don't move to jersey. we know how much we're spending. thank you. this is dangerous for the whole country. think about this. if we have objects in the sky that are the size of an s.u.v. over any city, over any state, it's an invasion of our airspace. in "focus" new republican congressman jeff van drew of new jersey member of the house judiciary committee. how do you address this? >> the real deal. i'm also on the transportation committee and aviation subcommittee and gotten to know people. from very high sources, very qualified sources, very responsible sources, i'm going to tell you the real deal. iran launched a mother ship a month ago that contains these drones. that mother ship is off -- i will tell you the deal. it is off the east coast of the united states of america. they've launched drones.

everything that we can see or hear and again these are from high sources. i don't say this lightly. we know there was a probability it could have been our own government. we know it is not our own government because they would have let us know. it could have been some really glorified hobbyists doing something unbelievable. they don't have the technology. but let's pretend that's possible. the third possibility was somebody, adversarial country doing this. know that iran made a deal with china to purchase drones, mother ships and technology in order to go forward. the sources i have are good. they can't reveal who they are because they are speaking to me in confidentiality. these drones should be shot down whether it was some crazy hobbyist that we can't imagine or whether it is iran. i have think it very possibly could be. they should be shot down. we are not getting the full deal and the military is on alert with this.

>> harris: look, you've given us some pretty dire information just here. i want to make sure our viewers are digesting this. iran has the capability to pull up along our eastern seaboard and launch drones the size of an s.u.v. into the skies of several states, particularly new jersey, where we know the incoming president has a large home. also in the same county or nearby where some of these drones in new jersey have been seen. that capability exists. it is possible some of those drones are here. i have two questions. how are they fueling them? they have to land somewhere, drones don't fly forever. why don't they close down the airspace? yes it's inconvenient and the holidays. shut it down. if you start shooting things and you don't know how they are fueled that will be mass explosions. this isn't like one spy balloon. congressman, this is serious. >> we've got to bring them down and we have to find a way to bring them down. i don't know exactly where they
