the trump train. they try to curry favor. the polar opposite of what he faced eight years ago. remember that? good morning on tuesday, bill hemmer. here we go live in new york now. >> dana: i'm dana perino and this the "america's newsroom." that was unexpected and we got a lot of news out of it. everyone wants to be a part of his second term and previewed his agenda yesterday during a long press conference. >> we're trying to help strongly in getting the hostages back. if people don't come back work and come back into the office they'll be dismissed. we spent a tremendous amount of money building a wall. the administration is selling it $0.05 on the dollar. i have a warm spot in my heart or tiktok. i won youth by 34 points and there are those that say that tiktok has something to do with that. will i do preemptive strikes on iran? is that a serious question? how could i answer a question like that?

something. it is like a complete opposite. the press has covered that fairly for a change. the first one they were very hostile. and maybe it was my fault. i don't really think so. >> dana: kennedy, it was wide ranging. let me give you a wide open question to answer whatever you would like. >> i think what these people are realizing, the press or politics, whatever state you're talking about, tech, law enforcement, they realize they tried the mean girls pig pile and it didn't work. and so, you have know, the former president, now future president, went through all of this with such incredible confidence because it's not that he wanted to be the most powerful person in the world. he wanted to clear his name and it reminds me of the johnny depp trial. when you know you're right and you go through this process with confidence and you come through on the other side, you almost become a cult hero.

democrats have to be careful about launching this resist at any point. they learned a little lesson. the more slings and arrows you throw at this guy the more popular he gets. it has gotten in their head and they're freaking out and don't now how to respond. >> dana: i said on the five they're in a bumper car game. trump is back without distan and the republican strategist said the difference between a shocking victory in 2016 and commanding victory in 2024. one other thing that is different. when trump won in 2016 obama was president for 45 days after. this time it's biden and he is almost invisible. you actually have president-elect trump the one that people are turning their eyes to as all of these things are happening around the world. sir, will we be okay? they're not asking biden that. >> it is not just in terms of diplomacy and him being the chief diplomat and

representative of the united states. they are looking to him to use relationships and strategy to quell the hot spots in the world. so yes, you know, we are seeing a transformation. the contrast you draw is stark. democrats loved obama. independents loved obama and wish he could have had a third term. joe biden is completely m.i.a. and it's kind of scary. >> bill: the following men also loved barack obama, these are the tech ceos have gone down to mar-a-lago. i don't know what they say to him behind closed doors but i have to imagine that he may have the opportunity to have a few choice words with some of these men about very recent history, charlie. >> you think? i can imagine some of those conversations. of course, you know, trump loves to exercise power especially in personal dynamics. so he is maximizing that to the

full extent. >> dana: are you going to eat that? >> bill: do you think he has enabled to hit the ground running. >> yeah, for him, you know, victory was not just winning re-election, which was an important part of it. he really does view victory as being able to accomplish the things he wants to accomplish. those things, it is not a right wing agenda. a lot of people in the press failed to appreciate. these are broad bipartisan common sense sort of things he is talking about. not straight out of the republican conservative right wing playbook. these are issues. one reason that people are laying down arms now. they realize like john fetterman realizes this guy is talking about issues that matter to the people that elected me and i need to get right on these issues and that puts him in line with donald trump. >> that's what michael moore said in 2016. not excited but warned he is touching on a populism that the

democrats have failed and they continued for eight years to utterly fail their coalition and their most loyal voters. >> bill: tim ryan, a somewhat moderate democrat from ohio says the dnc should move to youngstown. he is probably right about that. an interesting title. charlie and kennedy, you guys come on back. want to get to the battle of the border wall. that continues now. president-elect donald trump saying he may seek a restraining order to stop biden from selling unused border sections. the steel parts are going on the auction block for pennies on the dollar after the biden administration sold them off earlier in the year. william la jeunesse on the story last week. back on it today. what did you find out, william? good morning in l.a. >> we actually have video of where some of that wall actually is. the other question is did the biden administration as president trump alleges sell it for as little as a nickel on the dollar. you are looking at some pictures from arizona where some of the

wall, one of three locations where the wall is being kept right now. thousands of pounds of steel that was being trucked away from the border. this is north of tucson and just weeks before trump takes office. >> the administration is trying to sell it for $0.05 on the dollar knowing we're getting ready to put it up and what they are doing is really an act -- it's almost a criminal act. i'm asking today joe biden to please stop selling the wall. we'll use that to create a strong barrier. >> senator tom cotton demanded yesterday the defense department keep all records related to the sale of up to $350 million worth of unused wall and support materials. trump says he needs that to finish building about another 200 miles of wall. problem is once biden took office and refused to install those wall sections, the defense department sold it. that's what you are looking at

right now. some panels were used by the states like texas. but millions of tons were sold for scrap through a government contracted website. this drew anger on capitol hill yesterday where missouri senator schmidt claimed in one lot the d.o.d. sold 16,000 pounds of fence for $100 recooping less than 2/10 of 1% what taxpayers paid for. >> president trump should be able to use the materials to build a wall. not only an insult to taxpayers but an insult to voters who voted for president trump to come in on very clearly an effort to secure the border. >> bottom line is, bill, taxpayers lost a boat load of money on this for materials paid for but never used like you saw at the top of the shot there. trump is hoping to buy back as much as he can. that stuff that i showed you is

just heard shouting and there was a teacher, she was going to oh, my leg, help, help. >> bill: wow. terrifying scene yesterday. we watched it all afternoon really. two people killed. several injured. shooting at a christian school in madison, wisconsin. police identifying a 15-year-old girl who was also found dead as the shooter. garrett tenney is on scene and has more on the fallout the day after. garrett. good morning. >> police don't have an answer why this 15-year-old girl came to school with a handgun yesterday and decided to shoot her teacher and classmates. but to give you a sense of the makeup of this school, the abundant life christian school is a small private k-12 school around 420 students. some of them as young as 3-year-old kindergartners. police say the shooting happened in a classroom during a study hall just before 11:00 a.m. the 15-year-old girl killed a

teacher, a student, and injured six others before turning the gun on herself. the first 911 call that came in was from a second grade student. here is a mother of one of the students who made it out. >> we always -- but we didn't think one day that can happen to us here at this school. in is not okay. if the >> kids are at school, church or outside. where are they going to be safe? >> two students remain in critical condition. based on what investigators know so far, at this point they don't believe the shooting was targeting anyone specific. today detectives will be going through the security footage inside the school and scouring the shooter's digital footprint to try to piece together a timeline of her last hours

before she went to school. so far the parents are cooperating with the investigation, police searched their home yesterday and today they are hoping to pinpoint how she got the gun and where it came from. >> i do not believe the 15-year-old should have access to weapons that they can bring to school and potentially hurt someone. we also want to look at if the parents may have been negligent. that's a question we'll have to answer with our district attorney's office. at this time it does not appear to be the case. >> we are expecting another update from police later today. hopefully with more information on both the victims as well as the investigation. bill. >> bill: our condolences to everyone in that city and school. >> dana: juan merchan upholding trump's conviction for falsifying business records. he says the supreme court's immunity does not apply in this case. jonathan turley joins us now.

what was the judge's reasoning. what was he saying? >> well, he really iron plated this decision. he said first of all this was not official conduct but even if it was official conduct it wasn't protected and even if it was protected and some evidence came in that shouldn't have come in, it was all harmless error. you can pick any one of those three and he would still be good to go. that is an opinion that is likely to get support from some people on the appellate level. what is interesting about the opinion is it really contradicts what many in the media have said for months, that the supreme court's decision granted sweeping immunity. that it was a death squad ruling. merchan had no difficulty in finding exceptions that might apply to this case. so i think a lot of judges would probably agree with the outcome. not necessarily all the reasoning of judge merchan. but we'll have to see.

there are good faith arguments the trump team made and will make on appeal. >> dana: and the trump spokesperson said the decision is a direct violation of the supreme court's decision on immunity and other longstanding jurisprudence. president trump must be allowed to continue the transition process and execute the vital duties of the presidency. can this spill into the new administration? >> well, that's the real question we're struggling with here. this judge has the longest performance of hamlet in the history of new york and broadway. we're waiting for him to just simply reach these decisions so we can have clarity and more importantly an appeal. so he has got a number of objections to how he handled the trial. some of us believe the trial is riddled with reversible error. he is unlikely to find he committed those errors and then he has to deal with the

sentencing question. you have district attorney bragg saying well maybe we should just leave him in suspended animation for four years. that would leave the leash in the hands of judge merchan, this state trial judge who would just sit there pending a sentence on the president. many democrats would like that, a defendant in waiting for four years. it is a perfectly horrific idea. i hope he doesn't take that. it would be bad for the country and bad for the court. >> dana: jonathan turley, thank you for catching us up on that & answering. they are on my mind. >> bill: 24 past the hour. president-elect trump leaving the door open for a possible pardon to mayor adams. here is his response when asked about it yesterday. >> would you consider pardoning

hate the country that put them where they are. >> dana: a lot of concern about that. in addition a lot of initial response from some people like senator warren, for example said but you can only push people so far as if justifying what he did. >> bill: this mayor and incoming president seem to have a lot in common, don't they? as the days go by, they get more in common. remember two months ago before this election when trump was in new york at that big dinner and he looked over to eric adams and said i told you if you open your mouth on immigration they're coming after you. so they kind of have the same view when it comes to the legal system. we'll see if the pardon is real or necessary. >> dana: fight to cut government waste and spending is picking up steam. on tap today the house doge caucus meeting for the first time. plus a political shake-up north of the border. one of canada's prime minister justin trudeau most trusted

toodaloo. when you're in the military you're really close with your brothers and your sisters that are in the military with you. and when you get out of the military, you kind of lose that until you find a new family. we can talk about our struggles and the things that we did overseas and not everybody can do that. adam! how's it going, brother? we live pretty close to each other. so he's always coming over. when i go to jack's house, we watch a lot of football, hang out. we go outside the friendship has kind of grown into a family i was overseas on a deployment. i got separated from my marines and i got hit in the neck, and it broke my neck and paralyzed me. 14 years ago, i was on a training mission. did a military freefall, and i had some faulty equipment. i hit the ground. going, 30 to 40 knots and was instantly paralyzed.

>> dana: canada prime minister justin trudeau losing a loyal ally as the deputy prime minister announced her resignation from his cabinet. freeland called it quits after sparring with trudeau over how to handle canada's economic tariff situation with the united states. edward lawrence is live from the white house and can explain more what's going on. good morning, edward. >> good morning. the now former deputy prime minister freeland wanted to cash up to deal with a coming trade war that she believes could happen with the united states. she did not want to back down immediately to president-elect donald trump. the president justin trudeau wants to use the extra money in their budget for stimulus checks in this canadian election year. he asked her to take another position in the cabinet and she resigned. interesting because she is the one who negotiated the u.s. mca in the first trump

administration, an agreement that president-elect praised at the time. >> usmca is the largest, fairest, most balanced and modern trade agreement ever achieved. >> now he said her behavior was toxic and not conducive for making deals with the unhappy citizens of canada and won't be missed. she agrees with the president-elect because people are dying from fentanyl on both sides of the border and hopefully tariff war can be avoided. >> we'll know for sure with the details of what the expected billion dollar announcement in border security measures the federal government is announcing. this could be a down payment on us putting in the infrastructure in place to make sure we're doing the proper surveillance of potential border entries and be a good partner in national security as well. >> she has moved resources to

night that caught my ear. last night you said this is lawful, legal commercial hobbyists and law enforcement aircraft activity. some is manned, some unmanned. on the today show you said these are lawful, legal aviation activities. i don't know the manned drone. do those exist? >> i must have misspoken there. a oh drone is unmanned. if i said that's my error on live tv. >> bill: mailitary bases have seen these drones fly over them. if there is justification to shoot one down that would be it. why hasn't it happened? >> first of all, bill, the military commanders at installations have the authorities they need to defend themselves, their people and interests and certainly to

protect our secrets and national security. sometimes the answer is to find a way to down a drone and sometimes the answer is not. a lot depends on the capability the base commander has available to him or her. they have the authorities that they need. the sense that you have to shoot everything down just when you see it, even if you do believe there is a malicious intent doesn't comport with actual reality. it really depends on the situation at hand. rest assured commanders have the authorities they need to take the action they must to protect their facilities. >> bill: what did you think about the incoming president saying the government knows what is happening? >> we do have a good sense of what's happening. i don't disagree with him in that regard. we've been looking at this very hard. as you saw in the joint statement last night from four different federal agencies our assessment to date based on the information that we've seen, the people we've talked to, the tips we've corroborated, this is

lawful, legal aviation activity. manned and unmanned, drones, civil aviation and see nothing that leads us to a different conclusion. there are about 100 leads the f.b.i. is following up on. the ongoing investigation continues. if we learn something different, something that contradicts this assessment or adds to it my goodness we'll come on tv and talk to you about it. >> bill: is it your hunch a lot of people are seeing the same thing? listening to your comments do you think some people are seeing planes and some drones and some stars? >> yes, sir, i think that's part of it. we had 5,000 sightings. maybe 12 people see the same aircraft. that's 12 different sightings that we have to work through. doesn't mean 12 different aircraft. that is happening. people are looking up more now. more of a story and thing and people are paying attention. remember the reason they can see these things is they have their navigation lights on and flying in a legal, lawful way according

to f.a.a. rules. they don't have lights turned off. in some cases after we did the triangulation it's commercial air traffic. a coast guard cutting saw 30 or 40 drones following it. we did forensics. it was air traffic going into jfk international airport and not drones. the initial sightings, you want to take all the facts down. then start working your way through the evidence and seeing if it tracks to something else and it turned out to be the case. >> bill: two very important stories to get to. ukraine admitted it took out, assassinated the russian head of the chemical weapons unit. where does that lead, sir? >> we don't have a lot more information than what we're seeing in press reporting right now. obviously we certainly will be talking to counterparts about that. i can tell you, bill, we do not enable or support those kinds of missions but again i just don't have a lot more information on it today. >> bill: i'm reading netanyahu

looking at this, murcowski and collins are looking at the issue that vaccine confidence is already down because of the pandemic. we're already seeing a decrease in vaccine uptake in our young children and flu vaccine and other vaccines. so transparency is great but he may be still thinking of casting doubt on vaccines. that is number one. that's something that the senators are looking at. he was reassuring, by the way, to senator tim scott yesterday on the issue of abortion. when scott reported on instagram that kennedy was open to this discussion of no federal funding for abortion. that was probably unexpected. i think that's a big headline out of yesterday. >> bill: reading this sentence. kennedy said the covid-19 vaccines were the deadlyist ever made and polio vaccine might have caused more deaths than it averted. if that question comes up in the hearing how will he answer that and will it be satisfactory? >> well, i don't know how he

walks back his comments on the covid vaccine which saved millions of lives and clearly the virus was what was deadly and definitely were vaccine side effects and maybe the administration downplayed those and instituted mandates that was a huge mistake. to deny they saved millions of lives is very problematic. that virus was costing millions of lives. so i don't know how he walks that back. as far as polio i told you before it came around we were seeing 20,000 people a year paralyzed by polio and that was just part of what polio did. one of the greatest public health accomplishments in this country was getting rid of polio. it is not just polio. it is a lot of other childhood illnesses like measles. he has been critical of that. the measles vaccine has done a tremendous amount of good. >> bill: do you believe he will have the opportunity to educate americans on better health and better nutrition? he talks about it all the time. trump seems to think he is on board with that idea.

allowing the direct election of presidents through popular vote alone. joining us now is fox news contributor karl rove. does that mean they want trump to win? >> i'm mystified. since we have had the electoral college since the creation of the constitution that we've been undemocratic since 1787? what kind of lunacy is this? why are we wasting our time on this? you know what chance this has of passing? i want to be on the good list so it is no chance in heck. this would require the approval of the united states congress i think by a 2/3 vote and ratification by 3/four of the states of the union. do you think that idaho and rhode island and north dakota and hawaii and all the states with smaller representation in the electoral college will give up that right? i don't think so. i really don't think so. >> dana: it goes back and forth. some people say we don't need

the electoral college anymore. they don't want the red states to have a say. smaller populations. donald trump won the popular vote and all the different presidents. george w. bush did in 2004. you remember that? it was a good night. barack obama did both in 2008 and 2012. joe biden in 2020. it was a surprise donald trump was able to break that trend. that is happening but this caught my eye, karl. on one of the websites yesterday it said the democrats are freaking out there could be a constitutional convention. which hasn't been held for 200 some years. why would they be worried about that and what are the chances of a constitutional convention happening soon? >> well, again little chance of it. article five of the constitution says 2/3 of the state, 34 states can call for a convention. over the years both red states and blue states for different

reasons have passed and legislatures passed such a call. in california there are seven such calls for a national convention over the constitution that are on the books. but any -- what's happening is states mostly blue states are now withdrawing those so that we won't get to the 34 number. but even if it happened, any recommendation to that convention and they could be -- since there are no rules regarding what can be taken up and considered, there will be all kinds of stuff considered if it happens. 38 -- 3/4 of the states would have to approve any such amendment. for my opinion it is just a -- much to do about nothing. go ahead and withdraw your resolutions if you like but don't scream and shout and dance about that somehow our democracy is on the verge of being taken over by elements of the hard left or the hard right through some kind of convention. the system doesn't work that way. can i say one more thing about

the electoral college before we depart that issue? i think the electoral colleges, it gives us a sense national unity after close elections. donald trump won the popular vote by 1.9% but the electoral college he got 312 votes. you need 270 to win. a mandate to be the president. same thing with john kennedy. won but a handful of votes and what happened? he won by a significantly larger number in the electoral college and gave him advantage going to office. we want to country to be unified after a presidential election to the degree we can be unified and the electoral college plays a vital role in giving that extra push to the winner that gives him a chance to bring us together as a country. >> dana: long live the electoral college. thanks. see you next week. >> this is lawful, legal aviation activity, mannean
