[ ♪♪ ] >> new details coming in about the arrest of multiple suspected gang members, anyone teen, at a notorious colorado apartment complex. notorious because gangs have been going in there terrorizing people. now they've raised the game to torture, potentially it's gang members. police in aurora, colorado, say those nineteen people are in custody for kid napping and torturing two victims at the edge at the lowry apartments. the same complex which has been linked to the vicious prison gang. td a as they're called. police say the heinous crime was without question gang-related and they're not ruling out tda's involvement. you're watching "outnumbered." i'm harris faulkner with my co-host, emily c campagno,

rosanna moscato, host on fox nation, fan girling over here and charlie hurt, washington times opinion editor, contributor. fan girling is for you too. let's go to jeff paul with the details on this story. jeff? >> reporter: the city council member who brought the gang situation involving this very apartment complex to light says she's tired of it being downplayed. she says this is not just another gang in aurora and this latest incident proves something needs to be done. >> i will not be silenced on this issue. i will continue to speak up. i will not stand for this human suffering. i don't care if you are here legally, illegally, documented, undocumented. you have a fundamental right to feel safe in this city. >> reporter: on tuesday, police were called out to a local apartment complex on reports of a home invasion. that's where they were told that a group of people entered the victim's home where they were

then kidnapped and tortured. now, one victim was stabbed. the other had their fingernails ripped out. this went on for four hours until the victims were released after promising not to call the authorities. the police chief says the victims, both venezuelan migrants, bravely called anyway: >> i want to make sure that anybody, whether documented or undocumented, knows that they can call law enforcement and we will respond. there is no place in this country, there is no place in this city, where somebody should be victimized or mistreated based upon their documentation status. >> reporter: federal law enforcement sources tell fox news ice, homeland security and the dea are involved in this latest round of suspect and suspect fourteen are tda gang members. incoming trump border czar tom homan is sending a message to aurora's police chief. >> i just saw your piece on the chief of police talking about this issue.

what's lacking is an ice person standing next to him shoulder to shoulder is. we're certainly going it do that starting january 21st. >> harris: they're talking about dropping people off in the meddle of the night, pulling fingernails, tying their hands behind their backs and beating them. this gang warfare. that's what this is. i don't see how you confuse this with just regular police work. >> if they're going to bump it up a notch, then maybe law enforcement should bump it up a notch with how they charge these criminals. because it sounds like terrorism to me. if you've got torture and you're trying to influence a political outcome, i think you could make

the case for terrorism here and also i don't understand whether their elected officials or law enforcement, i understand, you know, sort of hemming and hawing on immigration in general and i get that that in the idea immigrant communities commit fewer crimes than natural born communities. this is not something where you're on the fence, i don't know, i think we should protect these guys. they're fun, so multi-cultural. they add so much to the community. they are showing you, they are the worst of the worst. they are displaying and advertising everything. these are the kind of people you should want out of the country. they make people scared. they make communities less safe. make an example out of them either by putting them in prison forever under terrorism charges. or getting them out of there. >> harris: that second option only works under trump. it could never work under biden because they would just come right back in. >> president harris is going to give them a really hard time.

instead of your residents getting whether they're legal or not, getting mauled and terrorizing and getting your fingers ripped off. >> how bad do you want it to get? >> exactly! if the argument is, well, the police are making up the stories, then that's your fault too. fix the dang problem and the only way you fix the problem is to enforce the law and if you're in the country illegally, you have to be removed from the country and this is especially true for these criminal gangs. it's almost like this whole woke mind virus where they want to be, you know, act like they're all happy with open borders and sanctuary cities. that's more important to them than the basic safety of their residents. >> harris: i call it economic tyranny because they're spending so much money and these people are not american citizens. what you're saying is true too. these communities that are hit first are migrant communities. >> exactly. >> harris: they're the weakest among them because they're already here, some of them not legally trying to make it, whatever they're going to do. they know that.

these gangs punish those people. >> there was an investigation done into one of the -- i don't think it was this apartment complex but another one. you know what people are paying to rent apartments in these places? up to $2,000 a month. these are people, mostly hispanic, and they have families. they have children. and they're paying -- can you imagine paying $2,000 a month for an apartment and this is going on next door to you! it's lawlessness! >> harris: rosanna, we've seen a lot of the city. i don't live in the city. i cover the news here. where do you think seeing eric adams with martha maccallum on the story today, where do you think this goes politically now? how much pressure does this put on the left? >> i think the mayor is totally into -- he already sat down the with the incoming border czar and some people like the city council, they're criticizing the mayor saying, he's got a lot to worry about. he's got charges against him. he wants to be pardoned so he's

going to go along and do whatever is necessary to be on the right side of donald trump. but i think the mayor also has said from the very beginning, yes, he did welcome the migrants here. >> harris: told them that they could vote if they were here illegally too. >> then he changed his mind and he realized how much it was costing the city in services and money and what we were giving up as tax paying citizens in this country. but it is a problem. when we start thinking that we're worried about protecting the people, who were committing crimes rather than worried about protecting the people who are the victims of crimes, we have the tda here too. there are reports that they have taken over the roosevelt hotel, which is the welcoming center. by the way, there are reports there are so many undocumented children without any parental supervision at the roosevelt hotel. we've heard about reports -- cha charlie, you've heard about these reports where they're

making these kids do criminal activity to pay them off. so that they -- because they have no money. they make them go into times square and rob a few people. whatever. they're putting them to work with the tda. >> harris: you scare the jesus out of people when you hear about the torture. there by the grace of god if i go if you run into these people. >> going back to that councilwoman in denver. i agree with her but argue to take it further. everyone has the right to feel safe. everyone has the right to be safe as american tax paying citizens here and the reality is that gang affiliation is an existing enhancement and the reason that these guys can torture like this, that they are torturing like this, two reasons: number one, that is a playbook fair and square of these trans national cartels, of these absolutely hideous originated gangs from central and south america.

and number two, it's because they can get away with it because they feel emboldened. the reality is that rampant torture, that horrific crimes, the endentured servitude of minors, kidnapping, rape, the brutality mixed with the cavalier nature is all because they knew they could get away thanks to this administration and local city councils and governments like denver. because of those gang enhancements, that was stamped out a long time ago before the world turned woke and before it became a war against ourselves, meaning against i. c. e. and the federal government trying to enforce this. it is abjectly terrifying. like we keep saying, there's a new sheriff in town but the collateral damage are those lives lost, all of those beatings, all of that injury, all of that broken community, all of that fomented horrific climate right now, that's the collateral damage. >> harris: i've had law enforcement sources tell me too

that it is kind of a hang a shingle out for initiation. how much pain, torture you dish out. there are people in this country who will join sadly. >> we had a pattern of that, a history of that here in new york city. remember in chinatown. depending on the decade, there is a history of essentially sort of foreign born trans national cartels or gang affiliation that come over here and essentially try to operate how they did in the old country. we saw it with the sicilians. the whole point is, once the americans came and said, not on our watch, not under our laws, then it stopped. we deterred them. essentially now, here we are again and no one's deterred. >> harris: 33 days until inauguration day. we will see that be one of the first things that trump will address. tune in. i mentioned this. story today with martha maccallum today at 3 p.m. eastern, she will sit down with new york city mayor eric adams. rfk jr. is promising to meet with democrats in his bid to become the head of the hhs.

fetterman writing, "i believe it's appropriate and the responsibility of a u.s. senator to have a conversation with president-elect trump's nominees. my votes will come from an open mind and an informed opinion after having a conversation with them. that's not controversial. it's my job." someone has the right mind-set. earlier this morning, we saw fetterman pop out of his office as kennedy was walking by. you can see here the two exchanging a handshake and a quick few words. it's still unclear if and when they'll hold a formal meeting. charlie, breath of fresh air of fetterman's pov and hopefully everyone on the hill continues to have that open mind. what to you see the challenges are facing kennedy, however, and do you think he'll make the hurdle? >> first of all, it's a reminder, we live in wild times. you have a republican nominating robert f. kennedy jr. to be hhs secretary and then you have somebody like john fetterman who is the wise voice among democrats saying, let's have an open mind.

rfk jr. is a 99.9% dna democrat. he's a democrat. i can see why a lot of republicans might be some reservations about a lot of basic issues. but on the democrat side, and i think it reveals that democrats care more about sort of the government establishment than they do sort of classical liberalism. which is what rfk jr. represents and his skepticism about government agencies getting corrupted by the industries that they regulate should be something i would think all democrats would embrace. but because of the partisanship, it's not going to go like that. >> that's the irony. i'll bet you that's the bigger challenge than being nominated by a republican president-elect. do you see there being support for kennedy? >> i think when people start to do their own little research and find out we have cereals here that europe has banned for years! why are we serving these to our kids? and the vaccines.

now, listen, i took my flu shot. i have no problem with the vaccine. but dr. deborah burcks, she was alon alongside dr. fauci. she recently went on tv and said this, "whether my children went to school, there was maybe one in a thousand kids diagnosed with autism. now it's three per 100." every mom is seeing a classroom of kindergarteners where one in three children has ought i am. she's saying maybe we need to look into this. maybe we don't get kids 17 vaccines at a time. at first when i was listening to kennedy, i was, like, is he a little cocoa coco puffs? i think we need to do our own research. >> when we talk about that, doing our own researchers, incumbent upon fetterman, enter this conversation with an open mind, some argue in a way it's

not kennedy's policies per say, it's his lack of leadership. and that potentially the role of leading the hhs would be drastically risky and that he's more of a counselor, an adviser, in that role. do you think that poses an issue at all? >> i think that's a really good point. you know, when i listen to what he has to say, and this is why he has so many people who are passionate about his message, he feels like a podcaster. he's got so much influence and that's how he thinks. he thinks like someone who does a lot of research and wants to take the world as we know it apart and examine things before we put it back together instead of just assuming that everything the government does for us is beneficial. that might not be the case. you know, we might have some outdated vaccine protocols and food additives that are harming us, and he does bring up some really good points about things like chronic disease. my worry is that his philosophy, in a position of power, could lead to overregulation.

so that's where i will always, as a limited government libertarian, push back against is too much government, too much expansion and too many new rules. if he can figure out a way to get people to think and govern better for themselves, to make us a healthier society, then i think that would be a massive net benefit. >> harris: to your point, when trump addressed this at his more than hour-long news conference earlier this week, he said he's not going to be as radical as some people think. well, he's the check on that. he's the anti-regulation, overregulation guy. there is some check and balance in their own relationship. i think are democrats are worried. i think that there's a new kind of democrat now and he's still a kennedy. and he's in a republican administration potentially. and they're worried because they've got the clint eastwood look, not out of my dead hand will you take my power and relevance. that's how they want to go forward, some. the greatest thing democrats could do is let the youngest among experience some change.

the old guard have proven they are not fungible. they are not nimble. they do not want to let -- ask representative tim ryan who ran against nancy pelosi for speaker of the house. the new and the old guard. she crushed any hope he ever had of even making it a competition. and you saw that again with the primaries with joe biden this year as well. so i do, i think they're worried about what's the new democrat going to look like? >> they'll only get their answer if they meet with them. let's hope many more senators meet with this individual to make that choice for themselves or more appropriately for their constituents. that's why they're there. up next, some democrats can't seem to get over trump's victory. their new push to now, wait for it, abolish the electoral college. stay with us.

>> harris: president-e donald trump is celebrating dominant election win. he posted this picture of his signed pennsylvania electoral college ballot writing, our big pennsylvania win. so nice. trump didn't just win pennsylvania. he won all seven swing states and more than 300 electoral votes leading to a massive victory. and, of course, the popular vote. now, just weeks later, a coalition of democrat senators are looking to change our constitution and abolish the electoral college. their proposed amendment reads in part, "in an election the person who gets the most votes should win. it's that simple. no one's vote should count more based on where they live. the electoral college is outdated and it's undemocratic. it's time to end it.

democratic new york governor is showing her support. >> unfairly, less populated states have outsized influence and, in fact, the votes of their residents count more than the residents of a state like new york. consider that a s elector in wyoming, no offense, represents 200,000 residents and in new york, an elector like you represent 700,000. it's time to amend the constitution and relegate the institution of the electoral college to the history books. >> harris: this is how i know they're sore losers and they're liars. these are the people who gave us the super delegates. >> exact limited -- exactly. >> harris: they wanted delegates to wear capes. >> ring their own primary. twice. and then, of course, threw out the guy that won the primary and replaced it with somebody else

because they thought that maybe she would do better and she didn't. i think the democrats should be very careful about this. i think that this is a short-term partisan attack on the constitution in a way that may backfire in ways that they can't foresee. the founders recognize the importance of giving states the power because -- it's really important. and it was very prescient. if you fast forward to today the reason they wanted the states to have this power is because they were worried that the federal government wouldn't have a check on it. the reason that states -- the reason that states have this power is because they're the only entity in our government that can stand up to the federal government. and, you know, my worry -- the consequences of doing something, i don't think it's doable and i don't think they'll succeed. but the consequences would be disastrous and i think it would also probably hurt them in ways they can't foresee. >> harris: do we want the people who literally could not figure

out not to close down everything and lock us down in covid, to then be able to cut out the rights of voters that were foundationally carved for states? do we want them to do that? >> no, we don't. everyone knows that. that's why it's so difficult. that's why the process was designed to be difficult to amend the constitution. because it had to do something that would have long lasting ramifications that we could agree on as a society and all it would take is for a republican to win the popular vote and a democrat to win the electoral vote and then they would completely switch course, which will probably happen because our politics are only going to get weirder and weirder as the two parties sort of age out their humpty dumpties like mitch mcconnell and pelosi who can't stay upright a new generation will come forward and appeal to voters in different ways so everything will continue to get flipped on its head. the constitution should not be one of those things.

and you're also going to ignore everyone in the middle so that means presidential hopefuls will only be campaigning in new york, california, texas and florida and they're basically saying, suck it, iowa. >> harris: wow. right now aren't all of those sanctuary cities? states, i should say. >> they're spreading like scarlet fever. >> harris: my goodness. all right. in her lovely scarlet fever-like skirt, rosanna scott. >> this is what i have to say, harris. you know, governor hochul has so many problems in new york city and the state. it's interesting she's talking about this. her administration did a redrawing of the congressional maps, okay, which was overturned, okay, and then nancy pelosi basically blamed her for losing congressional seats and messing up everything in d.c. so does governor hochul have any weight when she comes out and talks about electoral votes? i'm not sure. >> harris: that was such a great lead-up. wow.

>> it's are perfect. nothing it more rich than these democratic individuals saying that the current state is undemocratic when they removed the duly elected candidate for their own party for the presidency. and expected everyone to just sit back and swallow it. you're exactly right. what they are indeed telling the other states, as hochul said, no offense, no offense taken. that's exactly what you are projecting is an elite smugness for the volume of your population by the way is fleeing to sunnier, warmer, more business friendly states. the reality is, every single one of their constituents should take note that that is how their representative is spending their time. and i am one of them. governor hochul, to your point, there are a million issues just on this block that she should be addressing and she should stop again getting onto the caboose of what they think will earn them, i think it's strokes in congress, because there is no way that any valid member of a constituency actually wants their representative to be doing this. >> harris: that's an excellent

president-elect and his closest ally, i should say, elon musk, of corruption. in a letter to trump, warren detailed concerns of musk having a conflict of interest leading doge. she questioned elon musk's intentions. >> here is this man, richest man in the world, who has multiple companies, tesla, the electric car maker. he's got "x." he's got neurolink, spacex and a handful of other companies. those companies are directly involved with the united states government. and here he is whispering into the ear of donald trump. so what is he whispering? is he whispering here are ways to help the american people? or is he thinking through ways to make those companies richer? the american public has a right to know who's giving this kind

of advice to donald trump. someone who's helping the american people or just helping himself? >> harris: do you think she rehearsed that? that last part? i think she did. trump's incoming press secretary, caroline levitt, shot back a fiery response in a statement to fox news digital. here it is: "president trump has assembled the most qualified group of entrepreneurs and geniuses to advise our staff and government. pocahontas can play political games and send toothless messages, a standard career to a politician whose societal impact is 1/1024 of elon musk. girl can write and do math. >> that's called a mic drop. yeah, look, caroline levitt, she nailed it. the reality is, i know that elizabeth warren means well or at least i think she does. but this is so misplaced and so misguided and it really falls

flat because to this point, elon musk and ramaswamy have begun to take on a colossal and really crucial role with the federal government which is absolutely trimming the fat. and most of the programs that elizabeth warren has advocated for again in a well meaning fashion, but that are just absolutely ridiculous and bloat and had a complete overreach of government and our tax dollars will be done away with. i think this goes back to our earlier conversation where they are clinging tightly to the way things were. but the reality is, put on your seat belt because it's not going to be the way things were anymore because finally we are going to have some transparency of a government that, under people's watch, like elizabeth warren and like bernie sanders, who are multi-millionaires and yet advocate for complete socialism and communism, we had no idea where our dollars were going. finally we do and we want them backs. >> harris: millionaires know how to count other people's money apparently. >> trump is back. so are the insults. the savage insults. which makes it all more

entertaining. and i think it's actually a genuinely good thing because it gets people more engaged and paying attention when things are hilarious like talking about elizabeth warren that way. you know, she raises fair points. i don't disagree with her that we should be wary of anyone who has any interests who is advising the president. either president. either party. the problem with her is that when it comes to government oversight of presidential administrations, she doesn't have a particularly good record. congress doesn't have a particularly good record. they've completely surrendered and both parties do it. i think democrats do it worse than republicans generally speaking where they just sort of hand over all their oversight responsibilities if their team is in the white house, which is a complete attack on the constitution and a bad way to do government. >> harris: just one example of what i think you're getting at as conflict of interest, why in the world can't we ever get a bill passed that keeps people in those high positions from
