moments after it first happened and live outside the court room where it is, alexis. >> high john and jacqui, we have been waiting in new york city tn altoona, pennsylvania, supposed to land here facing federal charges according to investigators in new york city. we want to pull up the camera shot. this is one of the helicopters, a large police presence and that is mapped on purpose because they want to show this line up force here to this murder suspect who they were looking for four days. he left new york city and was on the run nearly a week, but they captured him thanks to a tipster in altoona, pennsylvania. me know luigi mangione will head to federal court once he lands from the helicopter john and jacqui in lower manhattan. the 26-year-old is facing a dozen charges in new york city. let's pull out the video and we saw him out in a pennsylvania. he is looking at three murder charges and also one count of

first-degree murder that brands him as a terrorist era to a lot of people talking about that specifically because it is not uncommon in new york city periods jail jumpsuit getting into the courthouse and getting into the car from the courthouse. to this comes grand jury formally indicted mangione in the killing of brian johnson. he was unitedhealthcare ceo and a tad of two. the helicopters command that you have to remember he was only in town for work and business, thompson, i never went on to his family around christmas. he targeted unitedhealthcare even though not insured by the company, all these writings according to federal court documents john and jacqui that talked about how we planned this for months. a journal entry from august talking about how he wanted to go after unitedhealthcare leading up to six months before he talked about the planning into this doing it methodically. he has a new defense attorney new york city, and her name will ring a bell to people at home

because she is married to mark go to a lawyer representing sean did a comb and sex trafficking case. this is high-profile legal couple who has his case. they say he is being overcharged here especially with the four new counts according to the federal charges they are looking at. they believe it is unusual to bring this and talks about the statutory double jeopardy concerns according to a statement this morning. they say we are ready to fight the charges wherever they were brought. as for what is going on in new york city, we will zoom in and we will see the members of the joint terrorism task force. city officials will be here as well. they are standing waiting for him, waiting to see this large show of force as he gets off at the helicopter. it has been a long time coming and took a while to get extradited to. he wanted to fight according to sources in altoona. he was quiet and kept in his cell that had an outburst. we will see what happens in

after we get the state level indictment, we get a federal indictment covering almost the exact same charges. in this case, it is almost certainly going to be the death penalty. the optic we just be so futile if it did not have that escalation. so it will be interesting to see the charges and so on and so forth, but the take away for much of the audience is this will go federal. by statute, this means all certainly that alvin bragg's entree into this case is likely over, despite the fact it will be all the same personnel on the police department side and all the same evidence that is going to end up going into the court case. >> jacqui: pol, what do you make of these charges making him eligible for the death penalty? how rare is that especially at the states where he's being prosecuted? >> it is very rare. as you know, new york state does

not have the death penalty. it was taken off a while ago, even for murder one. as we have talked about on the network, new york a specific charge and only a number of ways to get it in one of those ways is, impact, terrorism trying to influence work orders or intimidate population or government. this does seem to qualify and i have been quite critical at that alvin bragg. but in this instance, i think the terrorism charge was not an overreach. if you read the statute, terrorism would apply. one of the things the federal government, and i have been there, does not like the states dipping into the terrorism world. don't underestimate the impetus of that charge coming in here relative to the feds decision to take things over. >> john: when you take a look at the circumstances and what is alleged to have happen, mangione

was allegedly upset with health care industry, but according to reports that we have seen, neither he nor his mother or clients or subscribers have unitedhealthcare. so, if you are on the streets of new york city with a gun that is partially homemade. and you are lying in wait for a health care executive that you know will be coming by who you really have no personal association that we know of and you had allegedly murdered that person, does that not fit the definition of an act of terrorism? >> i think that is a very good point. that is very perceptive, you're right. it was not a personal grudge. i think one of the other things that nudged this into the terrorism world is the manifesto. a lot of it is bouncing on line assuming it is accurate, and it appears to be a number of ideological statements in there that seem to track to the idea he did what he did for the elite

will make it theological statement for a public opinion and that puts him in the terrorism world. you have the part where he was yelling out that the media as he was brought into the courthouse in altoona. and that seem political overlay but then you are right. when you add the fact he doesn't have seem to have personal contact, even with the company and he seems to have decided to go after the ceo rather than some aspect of the company because he thought it would get him the best headlines and make the biggest statement, all of these things track to a motive that does in my estimation put in an ideological territory that would count as a terrorism charge. >> jacqui: when you talk about the biggest headlines and making a statement, how careful do investigators have to be and the nypd have to be in the way they are transporting him right now in the way they are talking about his case to not sort of generate a cult like following? we wouldn't be talking about a

school shooting in the same way we are talking about this man. obviously, weapon was brazen and on camera. the manifesto with the thinking behind his rationale for this murder has generated a lot of discussion. but therein lies a challenge as well for everybody in talking about what he has done. >> yeah, absolutely. and i think -- >> john: paul, hanging on a second. they are talking. >> terrorism antiviolence that stems from it is something that would not be tolerated in the city. we want to personally be here to show the symbolism of leading from the front. apprehension and some of these detectives will finally sleep tonight after this person has been brought to justice here in new york city. i want to thank our partners and the other jurisdictions that played a vital role in this

apprehension, particularly the mcdonald's employee who saw something and did something. notifying the proper authorities. i will say this over and over again, the radicalization that is taking place across the country, we cannot ignore. when you see an incident that took place on the streets where you witness a shooting that took place on a school campus by now a young girl, it is a continuation of young people are crying out for help. we have an obligation not only to make apprehensions after this magnitude, but to do far more to prevent it. i will take your questions. >> reporter: theme. what does this mean for the investigation?

neck or, that should not be celebrated. what is the challenge investigators going to have been talking about this case when there is so much discussion around it in terms of generating a support system for this guy? he's had a following developed. >> it is ridiculous. one of the things the federal case might do a hotel especially with the death penalty on the table is that, it could be romanticized this entire thing because very clearly it is not leaving any place good don't quite see how this reporting out somehow rather the case will run on parallel tracks. now, the state charges are terrorism related and they fit. further, let's be clear. we don't have the terrorism because federal charges you almost always need a connection to a foreign power and overseas and overseas entity, ices,

al qaeda, et cetera. they were a hole in the system because we don't have a terrorism. it is murder. that goes to your question, jacqui, last romanticized, he killed a father and a husband he is not a hero. he will probably end up on death row federally, and he is looking at a lot of hard roads. the idea this person is innocent until proven guilty of the story is compelling and certainly nobody to celebrate. >> john: paul, why do you think looking at the federal charges, count 1 stocking, traveling interstate commerce, count 2 traveling from georgia obtain new york for the murder is count 3 and use of a firearm, count 4 firearm offense. why do you think the federal government felt a need to supersede the state charges? very good question. you know, this happens in the terrorism world where you have

these battles, but they generally occur behind the scenes before you get to the point of indictment. in this case, you have this indictment and they came in and essentially overrode it. this is an override to. make no mistake, had the feds not done this, he would be walking now into a state arraignment. he said he is going a a federal arraignment. it could happen, and this is unprecedented that the feds will not look to give up this that going to federal lockup. one of the things that deromanticized as this and keep him safe and out of the public eye as he goes end. that is why they brought him and biplane and chopper as opposed to long drive by car from pennsylvania that wade not trailed by the media. this is the way to do it neater and cleaner. pet very clearly, the federal government wanted to say this is their weight.

they want to send a statement to people that think he has a hero. but the fact that they are getting a new u.s. attorney, attorney general at some point after january 20th when pam bondi presumably confirmed. it will be a whole new atmosphere here. i don't think they will be very interested in the treaties have the alvin bragg office because they have this case now and want to drive at all the way through. the trump administration, as you mentioned, far more interesting to bring this to the death penalty. speed to paul, how do you expect prosecutors to change the way they are talking about the individuals involved in this cas underway? it seems like you mentioned the romanticizing, but they unitedhealthcare ceo, brian thompson, make them act his job makes him unsympathetic in luigi mangione's camp that he has a husband and a father.

and luigi mangione, a prominent family and yet, has become this sort of icon of marxism and anticapitalism. do you expect they will be happy emphasis on changing the contours of the discussion with the case gets prosecuted? >> you might very well get those statements embedded in press releases and interviews given by the government that are outward facing. mangione had everything going for him. let's not sugarcoat this. he was from ib leak and apparently multimillion dollar empire and his parents came from nothing and built themselves up. thompson has a similar story. this is one of those situations than narrative in mangione's light does not fit because thompson fought his way up in a far more hard to wade them mangione did. that narrative doesn't really fit. let's remember there is a lot of

gaps in mangione's story. one of the first things he said when he got caught, i did this on my own, i want this to be clear i did this on my own. that strikes me a little bit too forward. he wanted to imprint that. there are number of gaps in his travel log. he was in hawaii and then san francisco where everything goes dark including his family. i think there is a lot of investigation to come on this thing and that is why it is good to have federal reach because they can scrape this stuff all over the country. >> john: all right, paul, stand by as we see the video from not too long ago of luigi mangione, the suspect in the murder of brian thompson, unitedhealthcare ceo and walked flanked by detectives and officers and counterterrorism officers as well on the wall street hello part to the federal courthouse in lower manhattan. this could be the last video that we see of mangione for some

fake i.d.es from other states, cross state lines, that became a federal matter as well as a state matter. by bringing these federal charges, he has subject, ultimately, potential death penalty. payee creates this dual trap which allows the federal prosecutors to take the faster track if that is what they decide to do. you joe to usually these type of dual traps or negotiations between the state and federal prosecutors where they get their best advantage in terms of time and charges. >> john: jonathan hunt paul mauro moments ago was talking about the counterterrorism or potential terrorism aspect of this. the state charge was balked up to murder 1 because of the terrorist statute. we talked with paul mauro about the idea alleged luigi mangione ted was true, he barely had no connection to the unitedhealthcare ceo joe you can make the case he was looking

for a very, very prominent to take out to send a powerful message. but there is nothing in the federal charges about terrorism. basically stalking across state lines and use of a firearm and firearm defense, obviously fling across state lines as well, which you pointed out. if they are not charging on the terrorism aspect, why not leave it to the state? >> there is an advantage, john, having these types of prosecutions. this is not unusual in handing a dual track but a little unusual in terms of timing. one would expect the state charges would play out further before the feds intervene. this does have footprint of state crime first and foremost. also a feeling the state where the crime occurred really could she get the bite of the first apples in terms of prosecution. but the federal government may

believe that this is something they need to be at the table for because as you noted, he wasn't someone who was briefed specifically the company and the industry at large. ofootprint and that he wasm-type trying to send a message by killing this executive. the federal government may want to be here at the beginning because there has already been a great deal of celebration of this murder. even people who said they might want to copy kept this. the federal government, i think coming in is sending a message we are not just on this but we are in the lead. if you try to replicate this person did, we will be on you with state authorities periods beta that was really my next question, jonathan, does the fact he was going after this figure and their r role in health care and i won't mentione

account celebrating this young man, but they are putting out sayings like privatized health care is a crime against humanity. i wonder if the terrorism angle is meant to sort of put a stop to any of that potential for copycats. it sounds like you think the answer is yes. >> i think the answer is yes. keep in mind, we have people in the media and congress who rationalized what has happened by condemning the act itself saying in the words of senator warner, "you can only push people so far." that is occurring in this highly inflammatory environment. so, i think the feds and also the state prosecutors want to send a very strong message that there is this joint effort to deal with this. keep in mind, these prosecutions can hit snags with eight to cotrack system, you can proceed

more quickly towards a trial. and i think the prosecutors are going to argue strenuously and i think they have a good reason to in saying that we should be delayed prosecution hear, hear. but what the feds are saying, we will be there in tandem. if you end up delayed or have problems, we can always turn this into a federal case. now the question will come if there is tension and if this is a race who the win. but the federal system is viewed a little bit more efficient but also coming with greater potential penalties in terms of the sentencing on a case like this. all of that will factor in. >> john: some comparisons drawn between this and the ted kacyznski case. it would appear to some other reporting that luigi mangione was an active ted kacyznski who was charged with federal crimes as well. >> that is right. and i think that was a chilling
