and many suspects crossing the border illegally and allowed into the country. >> john: baltimore, one mission to track down suspects and arrest them and deport them out of the country. we have republican kathy on deck to react to all of that. >> jacqui: first, david spun with a ride along. >> it was interesting to see and these people working all hours of the night. we are very early. the agents with a list of people and already convicted of crimes in the united states. they have an early start in the exclusive fried suburban maryland outside of the nation's capital. we joined the team to prepare for the dangerous mission i had prayed for her to the arrival. the agents picked up sexual abuse have a minor and exposing himself several times. there were eight targets on the list and they captured all late of them the next 8-10 hours.

all had prior convictions for the targets and four child molesters and one murdering someone but let out and living on a temporary st status. she said call the lawyer immediately to her son. she was having sex underage boy picked up grocery store parking lot going to work. we saw a man on a green card in the united states from the philippines and lived here several years and arrested outside of his own before daybreak previously convicted of molesting a girl and served time on the street given prior crime. i.c.e. arrested him and will present before immigration judge hopefully getting him back to the philippines. speak of the people were out for are the worst of the worst. it is not the average person in the country illegally. if we are targeting yield, there is a reason. >> to be clear, all these people have prior convictions but i.c.e. able to pick them up

because remained illegally but the prior crimes on the record appear to the mixed up in many cases the immigration judge but we reported since 2021. there is a massive shortage of immigration judges in the country and a serious concern. some of the people back across the board wait three, four, five years before they get a hearing. >> jacqui: i wonder if they will get some of the funding as they are upping border agents and i.c.e. ice judges. >> john: let's bring an maryland state governor kathy werth in the baltimore police commissioner richard marley said i'm not cooperating on a city or county level with i.c.e. officers. listen here. >> our position has not changed and the mayors made that clear we will continue as we are now. we will not notify, obviously, there are law enforcement agency. but they work separate from us.

we have not partnered with them too much. information and marching orders are the same from the mayor they have always been here just what you say in response to that? >> i say that i.c.e. is doing an amazing job. they are targeting the worst of the worst. the baltimore i.c.e. has apprehended more sex offenders than any other state in the entire country. and they are tied with l.a. for the number of gang members. so there really are some violent criminals and sex offenders on our streets. i.c.e. is getting them and deporting them. so of course, of course, baltimore city should be cooperating with i.c.e. as every county across maryland should be doing as well. >> john: i want to hear a little bit matt elliston on the right along that went on last night. eight individuals as david pointed out in total and four sex offenders. listen to this.

>> four sex offenders off of the street and sex offenders against children. you can't put a price on the amount of ap. every kid around here is safe because of the work we do. >> john: every kid is safer because of the work we did. why wouldn't the mayor and the police chief want to be a part of that? >> i have heard the mayor brandon scott try to walk that back. hopefully, he is getting ahead of him, the head of the police. matt elliston is exactly right, when the jails released violent criminals, gang members, and sex offenders back into the community, that the minute he is not safe. look, we have a tale of two counties. montgomery county, prince george's county both outside of washington, d.c. montgomery county executive said last year will go you know, i think we should cooperate with i.c.e. the violent crime rates have gone down 50%.

♪ ♪ >> john: a live look at the federal courthouse in lower manhattan as luigi mangione is expected to be arraigned on an initial appearance in federal court at any moment now. it may already be on the way and we have folks inside the courthouse that because federal court, no communications allowed and we don't know what happens in the court until the folks come out. he is being trained arraigned on use of firearm, two counts of stalking across state lines in connection with the murder of unitedhealthcare ceo, brian thompson. so there are two parallel tracks, the federal track and state track as well. it looks like the federal track is likely going to take precedence. we will talk with a couple of folks and then no, lexi rigdon

and darren porch or ahead of. in the meantime, the weather outside is frightful. millions of people across the upper midwest under winter storm warnings as the region braces for the heaviest snow fall that they have seen this season. fox weather brandy campbell lives in sheboygan where it is supposed to snow. what is it looking like where you are? >> i'm a tell you one thing, this is coming just in time for the holidays. like you mentioned before the holidays, bit is starting to look a lot like christmas. snow falling from the northern plains going to the northeast eventually. here in sheboygan a beautiful sight as you see the snow slowly following down under the surface is. winter advisory until 12:00 and potentially 5-8 inches of snow to come for us and only a couple of hours since the snow has started to follow. i can show you how much has

accumulated to. this might be an inch of snow. this is the early stages of there. but around the town, you can see on top of the waterways, a nice layer of snow covering. maybe they have ice covering also starting to happen in this area. they are used to the snow here but below average this season and even last y year so likely will welcome sight but i have spoken to the local officials about the safety aspect of it. public works and the police chief, both of them stressing for people to drive safely in these conditions, john. >> john: brandy campbell pour us in picturesque sheboygan where it is beginning to look a. i can't wait for april. it looks like they will have a white christmas and that is always there to, jacqui. speed to this today confirming first case of bird flu in the usa.

a man from louisiana who is hospitalized in critical condition and over 65 years old and has underlying health conditions. they say he became infected after contact with sick birds and dead birds as well in a backyard flock. let's bring in dr. marc siegel, fox senior medical analyst. dr. siegel, gavin newsom declared a state of emergency because of the bird flu. we have this case involving a man in contact with poultry. in the past go to the bird flu cases in the country involving dairy cows. what is going on here? >> i think two separate issues, jacqui. let me explain. the patient in the louisiana with a severe case and british columbia with a severe case, they had contact with birds. we know they had contact with birds. even if backyard birds for the first time, it is still contacting the cdc told me

yesterday we are monitoring this but we know where it came from here to the gavin newsom issue t because those are the cattle herds where 650 herds are infected in california out of about 870 nationwide. so the predominance in california. that is a new plays this past year and spreading among cattle and getting to the milk. we have seen it in raw milk and to cope cows have died to. the raw milk at least particularly dangerous in california and here is the other point, jacqui, people who have gotten the cattle version of this, which is different, had a mild case. people getting the bird version over the last two decades are more likely to get severe cases and potentially even die. i don't see a huge game change here except for the fact that it is spreading so much. we have had over 60 human cases they share. but we are not seen sustained

and stocking charges. if convicted, luigi mangione could face the death penalty. criminal defense attorney, lexie rigden and attorney, darrin porcher. little bit of color inside of the court room where we have people stationed. presentment and not arraignment or initial appearance. federal court term meeting with pretrial services so things have been a little bit delayed in terms of the timing and we expect it will happen about 20 minutes or so. but let me ask you first of all, lexie, new york upgrade of the charges from second-degree murder to first-degree murder using terrorism upgrade. why do you think the federal government felt the need to jump in with its own charges? >> sometimes the federal government does that joe he did allegedly break federal law so they were his dual sovereignty the state can charge you in the federal government can charge you. i know his attorney said this

may be double jeopardy concerns but obviously we are not there yet. the federal government wanted a piece of the action. this is a political case, popular case both for people sick rooting for him and the federal government wants to send a message to people contemplating something like this, the full weight of the law and the b the book thrown at you if you do something like this especially high profile way like this. >> john: darrin, the charge in the state, again first-degree murder because of terrorism upgrade. i can see they made that decision but i don't know for sure that because luigi mangione apparently had no relation to unitedhealthcare and he was not a subscriber. yet, he allegedly shot and killed the ceo and that message would it be considered terr terrorism? murder 3 use a firearm coach on the use terrorism in there that a federal crime on the use of

firearms in commission of the murder statute. >> that is correct, john coach at there is no mention of that. but i believe the federal government is sending a message. we have to bear in mind high classification such as mr. mangione. they want to do anything and everything in the courthouse to prevent the black guy incurred the suicide death of jeffrey epstein years ago. the feds do a great job coupled with the relationship with the nypd in terms of shepherding defendants of this caliber. because back to january 2017 where we put ella chapel and when he stood trial and convicted for murder. i think the right thing will be dampened at the same time, i understand the feds are driving towards the agenda of having this charge of the possible death penalty on the table, which presents a greater -- i

want to say more significant piece to wear if devalued later on down the line, the ball the bottom will not fall out of the case. >> john: lexie, you mentioned the idea of double jeopardy. that is what mangione's attorney, karen agnifilo said about their spiritual putting the federal charge meant, the decision to pile on top of already overcharged first-degree murder case is highly unusual. it raises serious constitutional and statutory double data jeopardy concerns. we are ready to fight these charges whatever corded is brought. a lot of parallels brought between this and ted kacyznski case. ted kacyznski violated state law by killing people with use of explosive device but he did of across state lines, which then brought in the federal government and other charges as well. he was prosecuted and went to jail on federal charges. how is this any different,

particularly considering mangione from reports suffering from accolades of ted kacyznski? >> right, they are able to do that. the prosecution would not have gotten off of the starting line if they double jeopardy concern at the outset. i'm not sure what she's referring to. i am sure these are creative arguments made. he has high powered attorneys and i would assume mommy and daddy are paying for them. they are going to try to do whatever they can to lessen the potential consequences for him. but he is facing significant consequences. there is significant evidence against him too, a federal charge he was talking this map and plotting out for months if not weeks, months where this person was going to be and how to get to him. he is in a lot of trouble. >> john: that is the one thing, darrin, we don't know at this point and may be former colleagues in the nypd know and that is how did luigi mangione n

thompson, who apparently was completely disconnected from mangione was going to be and how allegedly he could get to him? >> there had to be some level of collusion. when you look at the placement of mr. mangione at the time he executed the ceo of unitedhealthcare, it appears he knew and understood what he was doing. remember, he was here ten days prior. i do believe there was a series of reconnaissance and he may inadvertently enable to grab information that afforded him the location of the ceo of u.s. health care. that remains to be seen. but we really have to drill down on how we can gain a conviction. >> john: we will continue to watch things unfold as we have folks inside the courtroom and we will get reports when this gets underway. appreciated. >> thank you. >> john: check jack keane. tooth president-elect trump

scoring a major legal victory as georgia's court of appeals disqualifies fani willis and her office from the 2020 election interference case. the judge who wrote the majority court's ruling stating, "this is the rare case in which disqualification is mandated no other remedy will suffice to restore public confidence in the integrity of proceedings. "the court declined to indict me in leaving the case in lambeau. shannon bream, "fox news sunday claude to" and i need to break this down, because it seems to e choosing not to toss the indictment really leaves this case in lambeau. we have president-elect sing in a statement, there is no way such corrupt people can have a case and taken over by somebody else. it was a crab cake so how could it be taken over by somebody else? does he have a point because fani willis at the end of the date even though she might be removed from this, she decided

who to prosecute. >> she did what we got was an indictment, jacqui so the latest decision at least a majority of the opinion in the appellate case that there is not enough to get rid of the indictment, but there is this issue of staying in charge of the case. she was from the get-go, the beginning the one having meetings and gathering evidence and deciding and presenting this so it did turn into an indictment. the judge says i don't have to find a conflict here and i don't find that based on the information of the evidence below but what i found is that parents have a problem how people of georgia and how confidence in the system when there is so much appearance of a conflict, that the lower court did not get this right. scott mcafee, we cover this, olympus for days as hearing evidence. what he ultimately said, listen, an issue of appearance issue so either she goes or even wade goes. nathan wei decided to leave and that is the way to resolve this.

but appellate court said leaning up to this she will step down off of the case. >> jacqui: fani willis office a notice of supreme court view of the decision but this is what the judge wrote. well this is the rare case that must speak does qualify we cannot conclude the record supports imposition of dismissal of the indictment under the appropriate standard. where do you think the state supreme court will go with this? >> it will be interesting to see where they come down on this after the different reasoning wake up from trial court and appellate court whether appearance is enough to say she doesn't stay. but the case stays intact because now you have to as you referenced early on, you have to find out if there is another prosecutor in the state of georgia willing to take on this case and take a deep dive into it. whether they examine it as well they think what it has to go the distance.

remember, it is not just president trump that many, many other codefendants in this as well. this is a huge group of people waiting and staying in limbo and unaware what will happen next. is there another prosecutor that wants to step in knowing this appeal will go to the state supreme court? we will have to see. >> jacqui: where does fani willis go after this? >> she gets reelected. >> jacqui: to your point, trump has remaining charges in the case including violation of rico act and impersonating a public officer to conspiracy to commit forgery in the first a great you know, will this be complicated by the fact pretty soon trump will be a sitting president. how does that change things? >> we have clarity over the fact there are guidelines with regard to federal charges that you don't go after a sitting president. but at the state level, there have not been clear guidelines and pronouncements.

you have this pending case with alvin bragg and the georgia case of the real question will be, did they pause? did they wait until president trump is out of office? do they go away? funny case, a new potential prosecutor will be the really big deciding factor because that person may say after reviewing all of the evidence, i don't think it is worth moving forward with the case. alvin bragg into state case in new york seems adamant about moving forward. >> jacqui: wow! certainly legal victory for trump another one after a series of them. shannon bream, thank you so much, appreciate it. >> amazon, we asked amazon to recognize us as teamsters and they have not come into the table. we have given a deadline and they have not respected us at all. this is a result. >> john: thousands halves teamsters with a strike against amazon. what will it mean for tech giant

the sidewalk and also blocking the driveway. their goal was to prevent trucks from leaving. they would let one amazon truck at a time leave every 5 minutes or so. that was really restricting. there was a backup 30, 20 trucks at one time. most peaceful but it did lead to two arrests. they issue one spokesperson in the street on and those two coats charged with disorderly conduct. i was able to talk to one of the men arrested and he return as soon as relates in here is what he had to say. >> was the arrest worth it? they arrest was worth it and i will do it in a heartbeat. i want to get on the picket line. >> so now, we have reached out to amazon as well. what they have been saying to us is the teamsters misrepresenting themselves. they only represent a fraction of the contract workers that drive for amazon. but that is not with the feeling is on the ground nor what the

thank god to bless me. that is basically what i am waiting on. speed to donna, your organization has been doing some incredible work including for this family. but they were still a lot of work ahead. described the head wait to have made, and what else needs to be tackled? >> well, we have a lot -- there is a lot of devastation all over western north carolina and so, it is a community effort. a lot of volunteers. wine to water is an amazing organization that typically goes all over the world bringing clean water to people outside of our community. and you know, you start from the beginning and you learn as you go. there is still a lot more to be done. we have people on the list that still needs repairs and their homes. we have got people working with us and volunteers to help with that along with trying to bring in tiny homes and/or campers

just to get people out of the cold. it is a lot of work. it is a group effort 100%. >> john: ricky, i guess you are a little bit like the shoemaker his children running around their feet because of busy making shoes for everybody else rather than working on your home. do you have been working in the community. what have you been doing the last three months? >> clearing brush and getting wood out of the way for people to get to their houses and help fixing bridges. we just recently got our bridge fixed and why we were able to get in here to assess the situation here. but everybody kind of has teamed up with each other. all of the neighbors and i met neighbors i never knew i had. it has just been all inspiring. i am greatly humbled for this. >> john: good works reap good rewards and i know you will get yours with your tiny home. we appreciate you spending time
