sean. >> we start here with a fox news alert. >> president trump leading the way on budget negotiations, endorsing a new, drastically slimmed down bill to keep the government open. but on capitol hill, that measure was just voted down. and the clock is ticking as government funding runs dry at midnight tomorrow. that's about 26 hours from now. now, this comes as we learned shocking new details about how the biden white house cocooned and protected a diminished commander in chief. now, the reporting comes from this exposé in the wall street journal. they reported that, quote, there were limits over who biden spoke with, limits on what they said to him, and limits around the sources of information he consumed. the president of the united states, limited out of necessity by unelected handlers. let that sink in. the report notes that, quote, senior advisers were often put into roles that some

administration officials and lawmakers thought that biden himself should occupy. so who has been running the country over the last four years? that's the question. the president's diminished status was so bad that meetings with democratic lawmakers, powerful secretaries like defense secretary lloyd austin and treasury secretary janet yellen, quote, were infrequent or grew less frequent. in fact, they canceled meetings altogether. if biden was out of it and, quote, some legislative leaders had a hard time getting the president's ear at key moments, including ahead of the us's disastrous pullout from afghanistan. now, as you'll remember, we lost 13 heroic americans at the abbey gate in the ruinous fall of afghanistan, and lawmakers couldn't get a hold of the president. but perhaps the most disturbing detail of all of this is this. listen closely.

quote a sign that the bruising presidential schedule needed to be adjusted for biden's advanced age had risen early on in just the first few months of biden's term, administration officials noticed that the president became tired if meetings went long and would make some mistakes. so aides to the president knew in just the first few months of his term, the incapacity of the leader of the free world, and they did nothing. what a scandal. in fact, listen to this. in the spring of 2021, so just after taking office, biden was having an off day. so they scrapped a national security meeting. now, one national security official involved with that canceled meeting noted to a white house aide, quote, he has good days and bad days, and today was a bad day. so we are going to address this tomorrow. let's hope the matter could wait until then. meanwhile, president elect trump is actively engaged and this is a

month before inauguration day. trump is negotiating government funding deals. he's prodding allies like canada and mexico to fix their porous borders. and he's mapping out an ambitious legislative agenda. but first, congress will need to pass a budget deal. here now with the very latest on that. and there's a lot of breaking details on this from capitol hill is chad pergram, who's with us? chad. >> kelly. good evening. you know, you talk about the president elect's legislative agenda in the new year. that kind of took a blow tonight because they can't even fund the government. republicans are blaming this on democrats. but when i look at the vote matrix here, republicans could not even get a simple majority to pass this bill. there were only 174 yeas on this bill. 38 republicans voted no. and that demonstrates just how tenuous the majority is going to be in the new year. when you have the president elect, along with elon musk and others who blew up the bigger spending bill

yesterday, they come back with a more svelte bill tonight and they blow up on the floor. they couldn't even get it across the table when president elect trump pushed for that. now, of course, republicans are saying, you know, the democrats should have helped out. i will point to every single bill that has dealt with fiscal matters this year and last year as well, this congress. they have had to get democratic votes to move this across the finish line. republicans are in the majority in the house of representatives, but it's democrats who they have leaned on repeatedly. democrats today said we were not part of this negotiation. the bill that we negotiated, you guys threw in the dumpster. so we're not going to help. they whipped against this, and only two democrats voted yes. kelly. >> you know, chad, one question on this. and there have been five continuing resolutions. you make the point that every single one of them, you needed democrats. that is a fact. but when you look at the republican vote count on these five continuing resolutions, the most republicans that have ever

voted for any of these is 132. and tonight you had 170 republicans. so there is that kind of lift that the president elect gave it, even though it did not cross the finish line. is that correct? >> you're right. they definitely showed, you know, some positivity in that sense. but on capitol hill you don't get style points from the east german judge. either you pass a bill or you don't. and when you have the president elect of the united states saying, this is the bill that i want, and we're going to do all these things with tax cuts and budget reconciliation next year, and you can't do this. that's a problem. you know, the president elect, you know, he flexed his muscles yesterday with these 38 republicans, flexed their muscles back at him today. this is demonstrating the deep divide inside the republican conference. there are some republicans who simply aren't going to vote for additional spending. chip roy, the republican from texas. he said, you know, just because this bill is a leaner bill, not as many pages, that does not mean that it doesn't spend. bob good, a republican from

virginia who lost his primary. he's going away in a couple of weeks here. he indicated that, you know, there was there wasn't an offset here for all this disaster aid. that's a problem for many republicans. $110 billion in the disaster aid package. so until republicans can get everybody onto the field at the same time, which is very challenging. and that's why when you go down to one vote, i always say it's about the math. next year it's going to be really hard to get all these things done. and maybe republicans potentially overpromise because the legislative and the mathematical realities do not align. and they didn't align tonight. and the government may shut down here. not quite. this time tomorrow night. they have until 1159 59 tomorrow night. that is the deadline. we could have a weekend shutdown just before christmas. >> well, it comes down to math, chad, and you don't get style points. as you noted. chad, keep us updated. thank you, thank you. here now, with reaction to all of tonight's top stories, arkansas senator tom cotton. you know, senator

cotton, we will get to the breaking news this evening, but i want to start with this explosive wall street journal report, an issue that i feel you'll probably have some thoughts on. and that's afghanistan. i want to pull this up. some of their reporting. this is about adam smith. adam smith is chairman of the armed services committee over in the house. and this happened. adam smith sought to talk to biden directly to share his insights about afghanistan, but couldn't get on the phone with him, smith said. after the disastrous withdrawal, smith made a critical comment to the washington post, triggering an angry phone call from secretary of state antony blinken. shortly after, smith got an apologetic call from biden. it was the only phone call biden made to smith in his four years in office. and smith said this, quote, the biden white house was more insulated than most. i spoke with barack obama on a number of occasions when he was president, and i wasn't even the chairman of a committee. does it outrage you tonight that a democrat that has

knowledge of afghanistan could not get ahold of the commander in chief ahead of that disastrous withdrawal? >> yeah, kayleigh, it's consistent with what we had heard from the earliest days of the biden administration and frankly, what any american could see as well. >> the angry phone calls should have been going from democrats like adam smith to joe biden and those around him for not listening to him and listening to us when we warned of the peril that our troops faced in afghanistan. but again, there was a vow of silence among democrats and liberals in the media for four years. you know, it was just in february of this year that chuck schumer was saying joe biden's mental acuity is great. it hasn't diminished at all over the years. so think about that. in february, four months before joe biden's calamitous debate performance, chuck schumer was lying to the american people, saying he hasn't lost a step in years. they didn't say it after the debate, either, when it was clear to everyone it was only after the election when it could no longer affect their

ability to cling to power, that you start to get some of the real story the american people could see from the beginning. and, kayleigh, i have to remind all of our viewers, joe biden is still president, still president. tonight we've got another month of joe biden. he may be forgotten, but he's not gone. and that's tied in to this debate we see over government funding right now. donald trump is the president elect, but people are still going to him trying to get guidance, trying to put together a compromise bill to fund our government, not to joe biden, the actual president. where's joe biden been all week long trying to get his party, which controls the senate for another two weeks, to pass legislation to fund our government? you've seen this for four years. joe biden has been an absent president, and the american people have suffered for it. >> without a doubt. and, you know, you brought up the spending bill. so i want to pull this up from one of your senate colleagues. this is elizabeth warren, notably a critic of the president. at times, she's on the far left. he's conservative. she tweeted

this. i agree with president elect trump. i couldn't believe she said that, that congress should terminate the debt limit and never again govern by hostage taking. what do you make there of that? >> well, i think one, we should probably bookmark that, kelly, because i'm not sure we're going to hear for another four years that elizabeth warren agrees with donald trump. look, what happened tonight is very simple. the overwhelming majority of republicans voted not just to fund the government at christmas time, but to deliver badly needed aid to hurricane ravaged communities in the southeast and farmers who are struggling. the overwhelming majority of democrats voted to shut down the government and deny that aid. why? because they want to obstruct president trump's ability in the new year to deliver on our campaign promises the american people want, like securing the border, rebuilding our military, reducing the price you pay for electricity and gas, and cutting your taxes. it's just that simple.

>> it is. and i want to end with one final question. back to that wall street journal cover up and the reporting on the mental acuity of joe biden, which began very early on in his presidency. you sent this out that tom cotton, this was our fox news headline. tom cotton demands dodd records on border wall material sales be preserved. so you want documents preserved as it pertains to these border wall sales. and i'm wondering, should documents be preserved in the white house? as we learn more and more about the president's diminished capacity as it relates to afghanistan decision making? >> well, it probably wouldn't hurt kelly because there's still a lot of questions to be answered. and i think you're going to start seeing more of those questions answered. that wall street journal article had 50 or anonymous sources. i mean, you had to line up outside the door and draw a number if you wanted to share your story about joe biden's diminished capacity once he's finally out of office, i think we'll see more of that. i am worried about what's happening as they leave office. things like the department of defense selling border wall materials

for pennies on the dollar again, to thwart president trump from doing very basic things that the american people want, like securing our border. >> senator cotton, thank you. well, joining us now is south carolina senator tim scott. senator tim scott, i want to start by moving this forward from the wall street journal and going to the new york times. we learned a lot. when the president loses an election and aides start talking. and here's what we learned from the new york times. aides say that biden remains plenty sharp in the situation room, calling world leaders to broker a cease fire in lebanon or deal with the chaos of syria's rebellion. but it's hard to imagine that biden seriously thought he could do the world's most stressful job for another four years. so there's the new york times finally admitting that. and here's biden aide still telling us what they told us before he runs circles around us. i mean, do you think he's running circles around the generals in the situation room? >> well, kelly, he's out running circles at all. here's what we know. one of the

from a government shutdown. what do you think happens? yes. >> well, listen, i hope that the house continues to move in the direction of president trump. he's laid out clear markers. what he doesn't want is the democrats to hold him hostage with a debt ceiling. that's why it's such an important part of the conversation. what he wants is to make sure that doge is successful. that means the american people get to keep more of their hard earned dollars. we are going to see president trump take command, cut spending, and get things done. that requires us today and tomorrow to find the deal he supports. he's already acting as if he's the commander in chief, because today we don't have a commander in chief. we have, frankly, staffers who want to be the commander in chief leading this white house. it will not be that case when president trump comes in. >> yes. staffers who want to be

the commander in chief, who for all intents and purposes, according to that wall street journal report, were the president over the last four years. you know, we had some new foxnews.com reporting today, thanks to you, you will be heading up the nrsc. this is the campaign arm of the senate. it's extraordinarily important. if we learned anything today, it's the importance of a robust house majority in a robust senate majority. and we learned tim scott's campaign arm staff revealed ahead of crucial 2026 swing state races. i know most people don't even want to think about politics, but two years from now you have 30. you have 20 republicans up for reelection, 13 democrats, a harder map for republicans. what do you think happens in two years? are you guys ready to try to secure and grow that 53 seat majority you have in the senate? >> well, kelly, the first thing i did was sit down with president trump and make sure that we were on the same page. he said, hire the kind of staff that helps me win in maine with susan collins all the way to

the reddest of the red. and so what we've done is created a kind of staff that president trump will be proud of, because we will not only hold the majority. i believe we have an opportunity to expand the majority. georgia, new hampshire, michigan, three states where we can win today. and if you're watching governor youngkin, we're coming to you next, because virginia is another place we could add to our totals, defend our incumbents and our seats. let's add 2 or 3 or maybe four seats. i'm an optimist. kayleigh, it's going to take a lot of work. but the good news is we have the right president leading the charge. this is his republican party. we're going to add to his majority. the american people deserve four consecutive years of a republican majority in the senate and the house. that leads to a generation of american opportunity. >> so you just mentioned four seats. do you think it is within the realm of possibility? a 53 seat senate majority could become 57?

a world full of hate. be alive. >> welcome back to the special edition of hannity. so on to this. the biden administration's open border crisis continues to wreak havoc across the entire country. but things are about to change. appearing on cnn last night, incoming border czar tom homan said that birthright citizenship might not be enshrined in the constitution. homan also told cnn host kaitlan collins that he wants funding from congress for a mass deportation operation.

watch. >> the president elect said recently that he believes still not a new position for him, but he believes that birthright citizenship must end. >> obviously, that is no easy feat, given that it is enshrined in the constitution. >> i kind of disagree with you. >> i don't think it's enshrined in the constitution at all. not the way i read it. but then again, i'm not a constitutional scholar. we'll let the courts decide that on the birthright citizenship. i'll say this. it's a major driver, a major magnet for illegal immigration. we need congress to give us the money to get this done, because i don't know how many resources i have. i don't know how much money i'm going to have to buy beds. i don't know how much money i'm going to have to buy transportation contracts. that's why it's imperative on congress to, in reconciliation, to give us the money we need to do this. i think the mandate given by the american people from the election is they want this done. >> meanwhile, under biden, border states have been left to fend for themselves. texas governor greg abbott announced his latest effort to curb illegals. a billboard campaign in mexico and central america. this all comes as a new report

states that immigration is driving the largest population growth in the unite states in over 20 years. here, with the latest incoming trump borders are tom homan. tom, last night you were asked about the general framework for immigration. you said it will be ready to go on inauguration day. you're going to hit the ground running. and i thought of this nbc report i read a few weeks ago, i want to pull it up. and it said this much of the first day is likely to focus on stopping illegal immigration. the centerpiece of trump's candidacy. he's expected to sign up to five executive orders aimed at dealing with that issue alone, after he is sworn in on january 20th. that's according to three trump allies, and this is as many orders as he signed on every single issue the first week of his last term. does that ring true in your mind that these executive orders will be coming day one? >> oh, absolutely. >> and more than five. more than three. there's going to be many already working on them.

so look, he's got he's got a mandate for american people. we can't have strong national security if we don't have border security. so there's going to be some executive orders signed on day one. at the same time he signed those executive orders. we got ice. offices across the country are going to start. they're going to be hitting the streets looking for criminal illegal aliens. at the same time, we'll be putting ending catch release. day one had the same day. we're also going to be looking for over 340,000 missing children. we got a lot happening on day one. it starts on day one, but it's going to continue until we finish the job. >> we have more than five executive orders. that's huge. that's sending a clear priority of immigration across the starting line of this administration. i was also really intrigued by the cnn report i read. i don't know if it's true or not true, but i think when people think the trump administration is so radical in what they want to do, the cnn headline reads this some part of trump's deportation plan may be obama esque. and this is a quote. a lot of the same tactics are

being dusted off. what tom is talking about are obama esque things. that's according to john sandweg, who served as acr obama. you worked in the obama administration. you now work for president trump. do you think some of this will be coming from the obama playbook? >> well, first of all, i forgot more about this game than john sedgwick. john sandweg would ever know. but bottom line is obama did concentrate on public safety threats. he did. but, you know, the results were terrible. we look at the this administration, and i looked at the data in this administration right now and there's 74% decrease on the arrest of criminal aliens. then i noticed the day they released the numbers, they're bragging they deported more illegal aliens than president trump. but look, i put that report together. you're not going to fool me. i look in that report. bottom line is, over 80% of those removals were people that were arrested on the border by the border patrol, not ice, arrested and removed right at the border interior arrests

were down 80%. so, you know, they play a numbers game, but president trump's numbers are going to blow all these numbers out of the water because we're going to let ice do their job. we're going to take ice. we're going to take the handcuffs off ice, and we're going to put them on the bad guy. starting day one. >> the numbers games are always interesting when we just have facts that young women, mothers of five like rachel moran have been killed when they go out for jogs by people who shouldn't have even been here. that tells you all you need to know. but as we look at this, not only do you have these tragic stories, you have an election where 77 million people voted for trump. trump always said he believed immigration was the reason he would win. i think there's a lot of truth in that. and is that why you're seeing this is an axios democrats who who say they're wanting to play ball with you guys? here's mark kelly. he's a democrat. if there's willingness to work in a bipartisan way to do some stuff not only on border security but on immigration, i think it would be great. here's ben ray lujan, a democrat. also, we've been clear as

democrats in the senate were willing to work with republicans. richard blumenthal, even there are all kinds of conversations. i hope to be a part of them. aiming at comprehensive immigration reform. could you see a realm of possibility where you get democrat votes on your first legislative priority? >> i'm pessimistic about that. but look, i hope it happens. look, there's two things. number one, these elected officials, their number one responsibility is protecting protecting americans, protecting their communities. president trump and myself have been very clear. we're going to target public safety threats to national security threats. what an elected official does not want public safety threats removed from their communities. that's our number one responsibility. second of all, i think they look they looked at the results of the election. this was the number one issue that president trump ran on, and he won this election overwhelmingly. so i think they realized, look, we missed the boat on immigration. a lot of democrats are speaking up now. they should have did more on immigration, more on the border. and the american people are rightly upset about it, and we're going to fix it for them.

so i hope democrats come to the table. i don't hold out a lot of hope because already i got sanctuary cities saying they're going to try to get in our way. they're trying to sell pieces of the bordel. they' trying to sign legislation in the last minute to try to keep more here under the parole program. they're pushing more through cbp, one app than i've ever seen. and, you know, they're trying to set president trump up for failure. but let me tell you something. president trump, his success on the border is unprecedented. i worked for six presidents. no one did more than president trump. we're going to have success again, except this time we're going to finish the job, and we're going to end up the most secure border in the history of this nation. >> final question i don't have a ton of time here, but i was seeing publications putting out the lie of the year, and it just was crazy to me because to me, the lie of the year is nothing's going wrong. in aurora, colorado, where we saw gang takeovers of apartment buildings, i just want to remind everyone of what the media was saying. abc j.d. vance stands by trump's false

claim about venezuela gangs in aurora, washington post trump campaigns in aurora cite a false claims about gangs. new york times how the false stories about gang takeovers in aurora reached trump. and now we have tom homan, this reporting that 19 individuals we think were part of a venezuelan gang were arrested for torturing two people. what do you think when you see those headlines? >> it's just constant lies by these elected officials. and look, i went to aurora. i went to that apartment complex. i saw that neighborhood. i also drove through neighborhoods in denver. they're in bad shape and criminal gangs are everywhere. and i talked to i talked to some of the people that lived at that apartment complex. i talked to the woman that took those photographs and had to be rescued and moved out of that apartment complex because her life was at danger. i was there, they got a problem. but as far as i was concerned, they're on notice. you got about five more weeks of doing what you're doing. but guess what? day 1st january

and governor youngkin have managed to do. you had a budget surplus last year. when's the last time you heard of a state budget surplus? a budget surplus won $2 billion. you want to use that money to give tax relief on tips, tax relief on cars. and there's a democrat general assembly in the two chambers. they are poised to keep that. do you think democrats play ball with what you and governor youngkin have done? >> well, the reason we have that large surplus and this, by the way, kaylee, is after we have fully funded education, we have really helped on transportation. >> we have done so much to keep everyone safe and then so many more things that we have done. i'm talking about even $400 million for child care, so that those who want to come back to work have the ability to do so. so we're flush with this cash, and what we're trying to do is to put the people's money back into their hands. and you would think that that would be, well,

the wise thing to do, because you give the people the money that they work hard for, they know they are going to buy another refrigerator, they're going to buy another car, whatever it is. and you know, that whole ecosystem eventually produces taxes, which comes back to the government. so we can put it back in their hands. it's as simple as that. and apparently that's controversial. but we're going to put a bill in and we'll let the democrats vote against common sense. >> yeah, against common sense. we'll see if they do that. and you guys would become the first state there in virginia to pass no tax on tips. that would be quite an accomplishment. look, you received the endorsement of governor glenn youngkin. that's a huge deal. and you win this primary, let's say, and you move on to run against whoever the democrat is. we're thinking next november, this is a huge election. all eyes on virginia. abigail spanberger is looking to be the democrat nominee for governor there in virginia. do you think that republicans can hold on to the governor's mansion in the state of virginia? it was hard to do.

youngkin did it. can you do it as well? >> yes. you know, we are a blue state, but you're looking at someone who, 20 some years ago, when i was first elected to the virginia house of delegates, i was elected in a 58% black district, 62% democrat overall. i won as a republican. i won against an 11 year incumbent who had the seat for 20 years. actually, his dad had it for 11 years. i only had three months to run, and i ran as a republican, as i said, and we won. we're going to do that again. i again won after coming back after being gone for 20 years. and here i am, lieutenant governor in the former capital of the confederate states. the people know common sense when they see it, and that's what they want. they're not wanting to play racial games. they want common sense. how much of my money that i work hard for do i get to keep? are we going to be safe or are you going to be talking about defunding the police? are you going to be

millions of americans do not listen to the lies that they have spewed. these women are completely out of touch with reality. and you're right. abc should wake up. they just paid 15 million bucks to president trump's future library. that's a great thing for the american people. >> it is. you know, i wanted to start with that crazy absurdity because during my tenure as white house press secretary, there was a lot of absurdities coming from the press. i remember one briefing where ryan lizza bizarrely asked me if trump was happy that the south lost the civil war to which you could see me. i stopped, i looked at him and said, that is absurd. i mean, you'll deal with these kind of crazy questions from the white house podium. how do you plan to deal with it? >> yes, i absolutely will. i feel prepared to do that. i've been facing the media now, speaking on behalf of president trump on the campaign trail for the past couple of years, and we are expecting the media to

be hostile. however, kayleigh, if you do talk to a lot of these reporters off the record, they will tell you they look forward to more press transparency and access. and while we will expose the fake news when they are fake, we will hold them accountable for their lies and smears of president trump. i can also assure the american people that they are going to be hearing directly from the leader of the free world, and the press likes to hear that, too. that's something that is not happened. over the past four years. we've had an incompetent, senile president, as proven by that scathing wall street journal report that came out today. and you discussed on the show earlier. you have a press secretary who hardly knows what's going on in the building and never gives honest and truthful answers. all of that is going to change on january 20th, as evidenced by president trump's press conference at mar a lago this week, where he took nearly 90 minutes worth of questions from the legacy media. and so nobody cares about access more than president trump. you knew that as his press secretary. that's going to change come january.

but we will continue to hold the fake news accountable. no doubt about it. >> caroline, you know, i read this report from media research center that there's been 96% negative coverage from the broadcast networks of trump's cabinet picks. and yet, polling shows a majority of americans support them. and the reason i wanted to bring this up, and i would never ask you to reveal a conversation you had with a reporter. so i just want to ask for a general characterization. you'd think after trump got more popular raw vote count than any republican in the history of presidential politics, won the popular vote, that there would be some press that's eating crow right now. and any of your conversations, do you get a sense that reporters are stepping back and saying, look, he's doing something right, and maybe we need to reassess how we look at this presidency. >> i do think a lot of members of the legacy media are realizing that. i thought that was evident at the press conference at mar-a-lago this

past week, where the questions truly were focused on the issues of the day, and there are a lot of problems plaguing our country and the american people right now. we are still entangled in a war in ukraine. the middle east is chaotic. we have inflation that's still robbing the american people of their hard earned paychecks. we have a border that continues to be a mess. we have hundreds of thousands of illegal immigrant criminals roaming free in our country. and so i hope that the media will focus on the issues that matter to the american people, the issues that led them to vote in a resounding way for president trump on november the 5th. that's what president trump is focused on. more so than ever, we have an array of executive action that will be rolled out on day one to change the lives of the american people. immediately we have the house, we have the senate. president trump has big plans for capitol hill. and so i hope the legacy media will take a step back and realize that the american people haven't listened to their lies.

my daughter, who's five, and i watched the movie this weekend. we absolutely loved it. my five year old was captivated, i was captivated, and you said that this was a movie you were born to make. you checked in with the person who held the rights for five years. you had a calendar invite where you would pray for this movie in particular. what led you to want to make this movie? why did you have this strong calling towards this film? >> yeah, i wish it was over only five years. >> it was actually almost 20 years ago that i read the book to my kids. and between the laughter and the nostalgia and all of that of the story, i got to the end of it and i was crying so hard i couldn't see the pages. and so my wife, amanda grabs it from me. she starts reading it and she starts crying. we just pass it back and forth to each other. so for almost 20 years, i've been pursuing the rights to this movie, and because of the chosen, i ended up, i end up getting the rights. and now the fact that we're able to talk about this movie in theaters and at home is, is in many ways
