including some who trump actually helped to get reelected in november. let me hold your hand and walk you through what happened last night. house speaker mike johnson put up a much slimmer 100 page bill. include farm aid, disaster relief and that debt ceiling attached to it as trump had asked. the bill was so slim even elon musk approved posting this picture on x. it is to the right of the previous bill on the left. president trump also endorsed it reminding republicans that congress must get rid or extend out to perhaps 202 # the ridiculous debt ceiling he wrote. without this we should never make a deal. remember, the pressure is on whoever is president. but the bill, you guys, was brought up for a vote under suspension which means it need add two thirds majority and republicans needed democrats. but yesterday leader hakeem jeffries came out trashing the bill. >> the musk-johnson proposal is not serious.

knew it was dead. >> people knew it wasn't going to pass when leader jeffries came out and said democrats would not be voting for it. we knew there would be people like chip roy, thomas massi and some others that weren't going to vote for it. you know the house republicans have a slim majority. what we did not expect, no one saw coming, i'm not sure if speaker johnson even knew that it was going to be such a high amount of house republicans. once it started shooting up toward the 20 and 30 nos that's when you knew this was not good. >> steve: aishah, the 38 republicans who voted no. they had a good reason. they went to congress to try to control spending. and what they said squishy bill didn't have a lifting of the debt limit they will probably would have voted for it. they do not want to give anybody, including donald trump, a blank check they said. >> aishah: i think it's a fair argument and that is the argument they are making. you heard chip roy what he has

been asking donald trump for. senator mullen also involved in these negotiations trying to help achieve trump's goals put it this way last night. this is all about leverage at this point. it's about getting the debt ceiling pretty much taken care of before trump takes office so chuck schumer doesn't come in and hold this over his head which is he going to. it's all about leverage. democrats will have very little next year so it's about trying to take that away from them now. >> brian: just real quick, what happens if it goes past midnight, do they work next week? do they just keep working or they quit? >> i seriously doubt if they actually stay. it sounds like they want to go home. there has been some backup plan ideas about passing a clean cr for a week i'm not sure that's going to happen. it's really hard to get people to come back after christmas between the new year holiday to do anything. we might see a mini shutdown. come back in the new year.

great guy, ethical guy, great morals. i understand it. if he is going to be this critical, he has got to get into leadership. these people go in there in the room and find out what it's like not just to pontificate but negotiate because you guys can't get everything you want. you don't have -- you bear have the house. you don't have the senate. and you don't have the white house. so there seems to be a reality check needed among some about how much power you actually have. >> yeah. the reality check is that we are still in 118th congress. the democrats still do own the senate. and the democrats still do have the white house. and the fact that democrats are the ones who shut down this bill, democrats want to shut down because they care more about power, you know what? >> brian: 38 of your guys voted against it. >> more than 200 democrats voted against it. you have democrats are saying hell no to giving the american people what they want. you have the democrats continuing to focus on power rather than focusing on the

people. and that is where we need to put our focus is making sure that we come together as republicans and that we unite to put the america first agenda out there. but we also have to put blame where the blame is required. and that is making sure that democrats actually come to the table, negotiate in good faith but democrats aren't interested in compromise. they are interested in capitulation. we have to recognize who we are dealing with. >> steve: congressman, the democrats didn't vote for it because the republicans took all the stuff the democrats wanted out of it how many times members of the freedom caucus voted against it how the president has a mandate. when it comes to his nominees for different things e should get his say. president is saying republicans, it's part of my mandate. i want this debt ceiling lifted. indefinitely. but they said no, you know what? that's the line in the sand. >> you know what? i have three small children. they all still believe in santa

claus. >> steve: they should. >> that's right. that's right. and they should. but, the worst present we can give our children is trillions more dollars in unnecessary debt. what democrats had in this bill are things like a new bridge, a new stadium. things that the american people. particularly folks in michigan have no business paying for. we have to make sure that we're responsible that we are putting america first agenda first we are being more efficient. what we were able to do going a 1500 page bill down to 100 page bill. just shows the americans, republicans' commitment to actually getting more efficient while also taking care of americans stuck by disaster in issues. >> lawrence: i'm curious, this is the one thing i don't get. do you know this is why you have a whip. you have leadership to know the vote count. we continue to see republicans bring bills that they don't have the votes for and then everyone is shocked. so, are you all not having

conversation? are members telling the leadership team that they're going to vote for something and then getting on the floor and not? why are we bringing bills if we don't have the votes? >> well, that's actually what's going on right now is people don't know how they are voting when they actually get to the floor there are some people and if you notice they will get to the floor and wait to the last minute and cast their vote. these are tough issues. and there are people who are still wrestling with this within themselves and within their districts. and it's tough to count. this issues why we have to play as a team. republicans coming together to work for the american people. yes, we do have a mandate. we also have a democrat senate and democrat white house. we have to work within the realm of reality and get something passed so we can take care of the american people. >> brian: you learned to work as a team. you learned that at west point. hopefully other people play team sports even tag in school, something. >> that's right. >> brian: appreciate it, congressman. >> steve: merry christmas. >> merry christmas. >> brian: explosive report from

the "wall street journal." shedding light on how the white house functioned or didn't function with a diminished biden in charge. >> lawrence: incredible. peter doocy joins us from washington. hey, peter. >> peter: when i got to the white house four years ago with president biden, he was walled off because of covid. they didn't want him to get sick. but then he stayed walled off and now the "wall street journal" has this item with the headline how the white house functioned with a diminished biden in charge. and it comes with this quote: if the president was having an off day, meetings could be scrapped all together on one such occasion in the spring of 2021, a national security official explained to another aid why a meeting needed to be rescheduled. quote: he has good days and bad days and today was a bad day, so we're going to address this tomorrow, the former aid recalled the official saying. the president showed natural signs of aging but key allies always stuck their necks out to say no big deal.

times was basically told not to believe what i was seeing or hearing. the president misspoke. the president has a cold. but now the dam appears to be breaking. this "wall street journal" item interviewed 50 people familiar with biden's operation. back to you. >> brian: peter, you had this story in august. the "wall street journal" began to dip their toe in the water on this very topic and they got blasted. you gotten blasted when you questioned the president's acuity. kamala harris offended that people even bring it up. they talk about interaction between biden and many of his cabinet members were infrequent. tightly scripted. one cabinet member stopped requesting calls with the president because it was clear that such request wouldn't be welcome. the cabinet. peter doocy can't get an interview. his own cabinet can't get a meeting. adam smith, who is chairman of armed services tried to tell the president how bad afghanistan could turn out, he couldn't get to him. this is cataclysmic.

>> peter: it raises a lot of questions about who was making key decisions you mentioned the afghanistan withdrawal. if the president was as diminished as this story makes it sound, that would be a huge problem, and it could explain why certain decisions were made that turned out to be catastrophic and why no apologiesy ever paid. to your point, brian, when the cabinet met all nine times, which is the least in the last several decades that a president has had their whole cabinet together in an entire term, there was a different item a few months ago where cabinet secretaries were being asked to submit their questions for the president behind closed doors in advance the way it worked they would ask a question prescreened and the president would have a card with the answer even in a closed setting i hear a lot of

complaints and there was a bite in the open why wasn't there more coverage of the president's age and acuity earlier? >> steve: you kept asking. >> peter: i kept asking the whole time. and a lot of the stories that we would hear that we would try to report out are second hand. but it's a lot of stuff like oh, you would hear from somebody on the staff or somebody that works at the white house it. looks like the president was falling asleep somewhere. okay. hard to confirm that but we have tape of him falling asleep at events as recently as his most recent foreign trip. >> steve: you know, it was off the record last friday there was a holiday party at the white house. you had a brief interaction that has not been reported and it kind of speaks to how his aides rip you out of the room when you two started talking. >> peter: it was actually kind of funny. i took my sister mary as my plus one. and, when we got up there i

said, mr. president, this is my sister mary. the first thing he said to her is you know my sister tries to control me. and the first lady and the press secretary who is standing off to the side were trying to keep the line going. and they did. so it was quick. a lot of that. >> steve: he might have said something i would like to talk to you later and it was come on, peter, there he went with your sister mary who tries to control you too. >> peter: it's true. i made sure that mary did what i always do at these white house parties. they have like napkins with the presidential seal so just make sure that as many as you can grab on the way out. >> steve: that's the lovely parting gift. >> lawrence: this sem bare wassing as a country. everyone is talking about the republican party and who is debating this bill and elon musk. who is running the country right now? and the fact is that the report

said this was months into the presidency. that means it wasn't about covid-19. he was diminished before he was sworn in and only got worse when he was in office. i don't understand how they have any credible anymore. >> ainsley: so serious and such a big deal because if this was going on when he was making decisions about the afghanistan withdrawal, how do you think you would feel if you are the parent that lost a child at the abbey gate. >> steve: who decided? >> brian: how about fought for 20 years in the war fought for the right reason and built a society that had somewhat representation of women and people had opportunity. iny this disqualifies barack obama, hillary clinton, chuck schumer,. >> steve: all of them. >> kjp. they all lied to us. told us he was fine.

>> steve: president-elect donald trump's legal battle is finally over after a georgia appeals court disqualified fulton county d.a. fani willis and her team from the trump election interference case. the appearance of impropriety generally is not enough to support disqualification. this is the rare case in which disqualification is mandated and no other remedy will suffice to restore public confidence in the integrity of these proceedings. attorney ashleigh merchant led the effort to oust fani from the case and joins us now. ashley, good morning to you. >> good morning. >> if you would, start at the begibeginning explain how you hd knowledge that nobody else had that nathan wade was having a relationship with the d.a. fani willis who hired him? it's a unique set of circumstances, really relationships.

i knew nathan wade. i knew nathan wade personally and fani willis and their friends and law partners. in the legal community we were talking about this and they devulgd all of this information to me. i start started tracking it down and closing different loops and investigating and it blossomed into something that i knew i had to do something about and became actionable. >> steve: right. we saw it play out months ago where the judge in the case was trying to figure out, you know, is there a conflict of interest here? it was so obvious it was. the irony the case of the conflict of interest was stronger actually than the case against donald trump. >> i know it. really was. it was something that you couldn't turn your eye away from. i think that's what the court of appeals said. this is just -- it's one of those things that you know it when you see it. it's the appearance of impropriety. it is so great that it had to be enough to kick them off the case. i think it's really clear, i know, how fani willis has dug in

from the beginning. she started this and you know, she could have done the right thing early on whenever we brought this to everyone's attention and said hey, let's have a new central prosecutor handle this case. let's have someone else look at it. i think she was terrified because her case was so weak. she didn't want to have someone else look at it. >> steve: she was saying up in the bitter end she would wait until the end of the trump term to bring this case if necessary. donald trump had a statement to fox news digital, he said there is no way such corrupt people can lead a case and then take over by somebody else. the case is entirely dead. everybody including the wonderful patriots caught up in this four years, the asmart move for georgia would be to end this, drop the case that never should have been brought. technically, they could keep it alive. it's really up to the state, right? >> right, it's up to a group

called prosecuting attorney council pack. they can decide what to do. burt jones who is our lt. governor in georgia. he has taken off the case early. weighs separated out and fani willis was disqualified. they looked at they said we are not going to prosecute. this i have always thought it's a new central prosecutor, someone who didn't have a financial interest in this case and political interest in this case looked at it, that they would see things differently and they would decide that the taxpayers, the courts, the people who are charged in the case, they deserve this case to be dismissed. >> well, congratulations to you, this is what you were after. you really cracked the case, so christmas came early for you. >> it did come early. thank you so much. >> you bet. ashley, thank you very much. all right. ainsley, you have got some headlines? >> thank you, steve. that's exactly right. the "new york post" reporting that ice freed 124 migrants who stormed the border in el paso, texas back in march because officials did not view them as the security threats. the mob was criminally charged

but the cases were dropped due to a technicality. just five 6 those rioters are still in ice custody. a texas national guard source telling the "new york post," quote: we have soldiers who are still recovering from injuries to this day and our officials have shielded their attackers have any consequence. unionized starbucks baristas are hitting the picket line this morning in los angeles, chicago, and seattle, but the union warns it could reach hundreds of stores by christmas eve. the workers are demanding better pay and more staff and starbucks says they are ready to return to the negotiation table amazon workers are entering second day of strikes across the country. union says they don't plan to stop until the demands of better pay and benefit are met. and this just in, the biden administration announces it's canceling the student debt for another 55,000 public service workers that brings the total number of student loan handouts under biden to nearly 5 million

this started out as you saw homeless people on the streets of new york, or whatever cities. and then you took them blankets. >> yeah. >> it's morphed into something else, right? >> i was commuting into my corporate job in new york city. as many new yorkers see there is a lot of people in need simple give out a blanket. videos online and the news picked up our story. my fifth grade teacher saw he us on the news and saying nick i you saw you on the news and 200 students like to help out. light bulb helped out. this could be so much bigger than mike and i making an impact. if we could get the kids involved in this movement of kindness that's powerful. >> ainsley: i distantly thought i need to tell our school so you can go into our schools. what is the reaction when you call the schools and say we would like to come and teach these kids about kindness. >> we have a waitlist of about 30,000 students right now of schools that are dying to

participate in blankets of hope? >> we don't have the funds send in the blanket right now. blankets free of charge. a lot of these schools that want to participate don't have the their own funds to pay for those blankets. we rely on the generosity of the public donors to basically sponsor these students and get them to participate. >> ainsley: we have a lot of viewers this morning. hopefully they will all donate. nick, how does it work. >> a school will go to our website and sign up. once we have the funds we ship the blankets right to the school. students go through a 30 minutes kindness workshop. walk the kids through empathy exercise hand write a letter and attach to their blankets, teachers will collect them and donate them to a local homeless shelter right in their community. doesn't matter if the kid is 5, 7, # 1. every single student makes a direct impact on someone's life in their community. >> ainsley: what do you say to the kids teaching them about kindness.
