>> hello, everyone i'm shannon bream along with katie pavlik, just guitar love, charlie hurts and tyrus. this is the five. ♪ ♪ we begin with a fox news alert, we are awaiting the house to vote on a brand-new spending bill, this one boulevard a government shut down for much more on that, but first of that horrific story out of germany where officials say at least two people are dead, 60 others injured after a car plowed into a crowded christmas market in what authorities believe was an intentional attack. police have arrested a suspect said to be a doctor from saudi arabia. let's go with the correspondent alex hogan for more on this. >> as you mentioned it two people are confirmed dead and one of them is a small child after a car rammed into a crowd at a christmas market in

germany. we know from police as many as 68 people are injured. 15 of them are seriously wounded to. people spending their friday night walking around the festive market for the weekend before christmas. one person is in custody, german officials say the driver is a doctor from saudi arabia. germany's state premier says the perpetrator acted alone. police tonight have cornered off the vehicle over concerns there could be explosives inside that car. the town in question is the city of magdeburg, two hours from berlin. late last month germanys interior minister advised people to be vigilant of these christmas markets because some of the eight years ago exactly, a man drove a truck into a christmas market in berlin killing as many as 12 people and wounding more than 50. another person died from their injuries in that attack five years later. the tunisian driver was shot by italian police days later after a cross-country manhunt. more details emerging tonight as

government to still go out, social security checks still go out, government employees will not get paychecks but they will get back pay eventually when the government does reopen. the sky is falling arguments that come with us hostage taking of the funding they refused to deal with throughout the rest of the year's what the end it's a crisis so they jam all this pork into these big bills that can get through and then all of a sudden because it's christmas end of the government shuts down people will suffer they say, they try to get it over the finish line at the very last minute without actually reading what's in it. you've seen this week elon musk, the vivek ramaswamy, a number of house republicans did read what was in it and they were not happy pushing it through the last second. now we are having this big tomato capitol hill a couple of hours to go. there's been a number of failures as a result of the bill over the past 24 hours. the government shutting down is not the end of the world of things will be okay including norad continuing santas a trip around the world on

christmas eve. >> no one is going to take that away from us. we have covered many of these fiscal cliff potential shutdown, it's a shutdown that's not a shutdown, president-elect trump was pushing for a raise or a lift ability for the debt ceiling which is spending more money. at the same time you've got this argument, doge is about cutting all the government spending and the funding, how do you make both of those arguments at the same time? we need to spend more money because we are going to spend less money. >> it's a groundhog day, we have this argument every time the debt ceiling thing comes up. strategically speaking i understand why trump wanted to do that. in whatever it is, two weeks republicans will have control of two chambers of congress and then in a month, the white house. the only remaining thing become the best weapon democrats have at that point is the debt ceiling. he was trying to get rid of all

the bad things now so they would have a stronger hand then. i understand that. i agree with katie. i'm always in the pro-government shutdown caucus. i'm fully in favor of government shutdowns i think they're fantastic. i think it's a great first step. if her republicans think they are going to get done with the need to get done without some really ugly stuff happening, they are sorely mistaken. you are going to have us either now or at some point in this fight to get done what they need to get done and what photos have asked donald trump to get done, i think it's really funny watching all of this, democrats are great at playing mental games. that's all they do is play mental games. the big difference i think now is -- the media always blames republicans every single time, republicans never pay a price in an election, i think they actually get something done as a

the farm bill for one year and also $110 billion in money for disaster relief. hurricanes in north carolina and florida that's a major part of this package we are told a few minutes ago and the house democratic caucus, that hakeem jeffries the democratic leaders signaled there was enough in this bill to get his vote or get the votes to he thought of some democrats. i'm going to point out something that's good to be very dicey and very important. they are treating this bill is what they a suspension periods you need to go thirds to pass the bill and i keep being asked this afternoon, what's the magic number? it depends how many people vote for the bill and how many total numbers are voting in the chamber, that's how you arrive at the two-thirds threshold. i can't give you a number, they would have 290. there are some absences today, you've had people who have gone home for the holidays.

people who checked out because they are retired or they lost the races, that number is down and 270 even 260 depending on attendance. the other thing that's important in this is whether or not republicans carry most of the freight in this. house speaker mike johnson has been at a serious fire about the handling of this interim spending bill over the past few weeks and if you have more democrats support this bill then republicans, that is part and parcel of what has happened on every single major fiscal vote this congress where democrats have swooped in on other government funding bills, lifting the debt ceiling and they have saved the day even the republicans are in the majority. we also wonder because of the barnacles that have attached themselves to house speaker mike johnson in this process, with that impact him as he goes for speaker on january 3rd?

it's going to be a narrow majority when they come back to session in january. that's going to be a tough vote, he can only lose one vote and retain the speakership, he seemed to give himself a little bit crossways with president-elect trump, certainly with elon musk, that's another issue and we have to watch to see how that emerges over the coming weeks. go to point to the floor right now, look at the clock. you only have less than 100 numbers voting right now. if this were to be the vote, this would pass. that's two-thirds based on how many people are voting but there's a lot more people who will roll in. this came together quickly and just because that time rolls down on the screen, i always say this is like a soccer, the time is kept on the field. we don't know how much injury at broken, extra time they will have. if they started a few minutes ago, they will probably wrap this up maybe a little bit after

6:00, it usually takes 25 to 30 minutes to vote in the house of representatives. we might know before then whether they have the votes to either pass this or defeat this and even if they do pass it, then they still have to get this through the senate and sync up later tonight. >> all of us are going to have questions here but let me ask really quickly reduce the democrats coming in favor of that and we hear there will be more of those. we see were public in votes against, there were some people said no matter what they weren't going to vote for this, they thought even continuing funding of the current level was something they would not sup support. as we get closer to figuring out if this gets to two-thirds it doesn't include the debt ceiling change president trump wanted. you give us a little bit of analysis but what is your best guess on what happens to mike johnson will not vote rolls around january 3rd if this is the package that keeps the government open? >> it's hard to believe he would

not be the speaker of the house because he looked down the roster and say who else? the one thing people were starting to think and this might be the reality is it takes more than one vote for speaker and we had for the first time in a hundred years, more than one vote to go years ago for kevin mccarthy. 15 rounds in five days. a lot of people are starting to think they need more than one roll call vote to get the speaker. there might be a protest or if they get to a stasis which was what happened last time, that could be a problem getting the congress started to because they can't swear in the new members yet, that's an issue as well and it may be delaying the beginning of the trump agenda, you can't start the house. you cannot do anything i will underscore that again -- anything until you get a speaker of the house and that includes if this does take a couple of days certifying the electoral college on january 6th. >> given the absurdity of the

size of the bill originally, i don't see how mike johnson can continue on. it was everything against with the american people voted for, the reason why we had such a huge show up for republicans to see a 1500 page thing with all kinds of woke stuff, do you think mike johnson can walk away from this? i think there's no way he can fix this especially given all the blowback we are seeing, are there optimists on the floor, is a republican party feeling good about this bill? >> they are feeling okay about this bill mainly because they get the disaster aid in the farm aid in there but you are right, there's a damage inflicted with mike johnson, i asked him tuesday, he said he was going to try to get away from the christmas tree omnibus, what they say around capital healed at this time of year as they put together a christmas tree and it has legislative ornaments on it -- guess what, you have a 1500 page bill with 1500 ornaments on it. health care, provisions for the bridge in baltimore.

the land the site in washington, d.c., for rfk stadium, ticket pricing issues -- it went on and on. sometimes you put those things into the bill to make them sweeteners and what those turned out to be was sour. it's not just the size of the bill, mike johnson put up with this svelte bill last night, 116 pages in the bill that was on the floor is 118 pages and that didn't get a simple majority. that only got to 170 votes in the house of representatives. size is not always matter and house of representatives. what does matter, if members are comfortable with voting for something because it has the provisions they want and that's what's so complicated but that rubik's cube. in just the right mixture of provisions in the bill. >> assuming for arguments sake this bill goes and the way it looks like it's going right now and democrats help get this

across the line under suspension of rules, what is your speculation about what happens to it when it goes to the se senate? >> we think it would probably get through the senate although we don't know if it would get done before the midnight deadline, sometimes they take a little more time in the senate. i talked to one senior republican senator earlier this afternoon who thought because of some of the farm provisions you might have some people try to throw up a couple roadblocks to get some floor time to speak out against it. a lot of people don't want to see a government shutdown even if they oppose this bill and the most powerful thing in the u.s. capital and have looked for this for years, somewhere in this building is an air duct and this time of year right before the holidays it cranks out btu after btu of jet fumes because members are trying to get home for the holidays. even if they oppose the bill, some people might say i will both know, i need to get out of here. that happens often.

shutdown tonight to. the question then becomes how quickly can the senate process this? do they need some time, do they have the votes? if they really want to stretch this out and they don't think this is the mood of the senate based on what i said earlier about the jet fumes in the air ducts in the capital, they will probably move some time later tonight. they might even get this in under the wire at midnight. right now we would suspect there would not be a government shutdown because the house has to pass this and is in the process of passing this was such an overwhelming super majority. the threshold of all 435 members if they were passing it it would be to 90, they are right now at 315. that tells you this has a lot more support than was needed to. that was a good play called by both the republicans in the democrats in the way they cobbled together this particular bill. >> chad program, we do expect >> shannon: chad per gram thank you very much. we are getting reaction from the
