carly:the first time i walked in i thought there was an animal. peter:the snow israel. when i was coming in at 4:forty. there was a big snowball fight happening in times square. carley: really? peter:a real mix of people who were out last night. carley: times square before the morning. was it a fun snowball fight or hostile one? peter:somebody standing on top of an escalade throwing snowballs. that could be -- ways mayor adams? that would be a good photo up. behind the guy coming in. carley: you could see it in the back of us and todd said something i never heard before, i hope it snows on christmas but i don't want a lot of snow. i want mood so nobody ever heard that phrase before? just means a nice snow globe

type snow. griff: i will get to this later but santa decided i was good this year and is putting gifts in the mail. i'm in the spirit. carley: is santa named griff jenkins? griff: i can't give that out but he's going to be good to me. pe peter:it is good santa made it with all the drones in the sky. griff: fox news alert, the senate passing a bill to stop a government shutdown sending it to president biden's desk after missing the midnight deadline by 37 minutes. peter: it includes $100 billion in disaster aid. carley: it passed in the senate 85-11, 10 republican senators and bernie sanders voted against the bill.

griff: 366 legislated voted yes. peter: the bill does not include many policies that were in the original 1500 page proposal including healthcare provisions, restricting investments in china, pay raises for lawmakers and suspending the debt ceiling, the president-elect not happy about the bill especially the fact the spending deal does not include suspending the debt ceiling. mike johnson says he spoke with the president-elect. >> i was in constant contact with donald trump throughout this process. he knew what we were doing and why and this is a good outcome for the country. carley: president biden signaled he will sign the bill into law. it is interesting because if you were following along with this yesterday it passed the house at 5:30 p.m. . then it goes to the senate who have to wrestle with it.

president biden has to stay up late and signs this thing, he has to watch what's going on on the senate floor and the functioning of our government depends on this. until you find out the white house says he will sign it in the morning. he's going to bed. >> i don't think he stayed up much later than he normally would. i remember a couple months ago i asked because i asked at the press conference because there was some story out that you are never going to get him after 8 p.m. doing anything. i remember i asked what happens if there's an incoming nuke? the first lady said there's a process when things come up. i don't know 37 minute government shutdown rises to the level they will wake him up. i think what is fascinating is speaker johnson talking about i was in contact with the president-elect but peter and i

this we covered the mar-a-lago beach and here we were thinking this 1500 plus page cr which is exactly what the country had gotten tired of and reflected in the election results all of a sudden trump weighs in, puts his finger on the scale and all of a sudden is going to be sworn in for a month but he's having the greatest impact shaking washington up. what do we get? we got a skinny build it's barely over 100 pages. carley: let's bring in florida congressman carlos jimenez. good morning to you. the original bill was one thousand 547 pages. the slimmed-down version was 118. that's what the president is expected to sign. how do you feel about what passed through the house and senate yesterday and what did republicans achieve and accomplish in trying to get this into a slimmer version that will go into law later today?

>> we averted a shutdown wastes money. when we shut down the government we waste money because we give federal workers a paid vacation. when they come back they get their pay back and in terms of national security all production stops so our fighter jets, submarines etc. is being produced right now to help keep america safe and secure, that stops and we have to restart those production lines which costs more money so shutting the government down is never a good idea. what we accomplished, we averted the shutdown of the government. griff: speaker johnson did something that doomed kevin mccarthy. he put forward a bill to fund the government that needed a lot of democratic support. in two weeks, when you go to vote on a new speaker is speaker johnson a goner?

>> i don't think so. i will be supporting mike johnson. these are the cards that are dealt. if we had sufficient republicans to pass some bills we would need a -- we need democrats. we can't seem to agree with each other, we had 30 republicans that did not vote for this bill, we only have about 2 or 3 seat majority. when that happens, you have to get something done, you've got to look over, we have to pick up some democrat votes. the final bill isn't what we would like because we have to pick up some democrat votes so it works against us. i don't think so. these are the cards that are dealt. what we've learned from ousting kevin mccarthy was he was playing those cards as well as anybody could and speaker johnson is playing those cards as well as anybody could.

griff: the debt ceiling wasn't on the bingo card, donald trump at that front and center, how do you intend to deal with the debt ceiling and how much of a challenge will that be for you? >> we have to increase the debt ceiling, there's no way around it. we are not going to default on the credit of the united states of america, that would be catastrophic and anybody tells you otherwise is just lying to you and so we have to deal with it and i understand what donald trump is trying to do, you have to do it. why don't you do it now because that gives the democrats leverage and so we made it deal, in principle what we were going to be increasing the debt limit by one. $5 trillion but we are going to end that reconciliation package, put in $2.5 trillion worth of fewer expenses or expense cuts in that reconciliation so we need to

start to reduce the deficit we are accumulating in the united states. can it happen overnight? no, but we need to start it, get to a point where we have a balanced budget and start paying off that $36 trillion debt because we are stealing from our kids and grandchildren. peter: the debt ceiling has been raise 75 different times mostly on republicans watch and if we keep raising the bill we are never going to pay it. >> we have to raise the debt limit right now because of four years of president biden. most of this comes after the fact. you authorize it, appropriate the money and start issuing that money but it comes later so now we face that and i think by june we have to face the debt limit. we can't continue on this track. we did this in principle and we are committed to it, reducing, start to reduce the deficit.

we have 2. it is not going to happen overnight so it takes some time but we need to get to the point we balance the budget and start paying off our debt and at the end of the day the only thing that really is going to allow us to do this, we have to pass a balanced budget amendment in the united states. that will force us to be disciplined not only when republicans are in power but also when democrats are in power and that's the way to bring the debt down and stop stealing from our children and grandchildren. >> congress, slim majority than you have now but you did cross the finish line, thank you for joining us, merry christmas. have a great celebration. one of the things donald trump wants to do when he does enter office in january is get all the illegal immigrants out of our country and that is apparently going to be a tall order. an example of that just took place in new york city where a

group of suspected tren de aragua members were arrested in the bronx. that apartment complex is located right next to a day care centers so this highlights how these gang members are immersing themselves in the general population. if you have a child going to this day care center they are walking down the street right next to a suspected gang member. griff: what is fascinating in the larger picture is donald trump was vilified going years back saying that these countries are sending their worst of the worst from prisons, this started in a prison in venezuela. now you've got such a threat so much so that this is all venezuelan criminal migrants in this gang, so much that democrat mayor eric adams is like a enough.

were killed in a suspected terror attack at a german christmas market yesterday. police say a driver rammed into a crowd, hurting 60 others in what they are calling a deliberate attack. >> reporter: german authorities say the suspect driver is a 50-year-old doctor from saudi arabia. they have yet to release the man's name but he is said to live in germany since 2,006 with permanently at residency permit. the man was arrested at the scene shortly after plowing his car some 1200 feet through the crowded christmas bucket injuring dozens and killing five including a small child. authorities say it was a targeted and deliberate attack, the motive is still unclear but authorities are continuing to investigate saying the man rented the car he used to barrel through the crowds of people. a police operation is underway in the town where the suspect is believed to have lived and worked as a doctor. saudi arabia's foreign ministry condemned the attack on x but

did not mention the suspect's mentioned to the kingdom. the german chancellor and other officials will visit the scene of destruction today ahead of a planned memorial service at local cathedral and now major cities across the world are taking extra precautions securing holiday events including here in new york city with the nypd announcing extra resources to various business markets across the city, the white house also saying it's closely monitoring the situation and offering support and we are learning under the more than 60 injured during the attack, 14 remaining critical condition so authorities are warning the death toll could rise even further. carley: thank you so much. let's bring in the former head of counterterrorism operations for the nypd, retired nypd inspector and fox news contributor. good morning to you. the nypd is boosting security and chicago police boosting security as well as an abundance of caution.

what does that mean? what's going to be happening today in cities across the country as a result of this attack in germany? >> one of the first things, they are going to look hard at this attack and its origins to see if it tracks to something that could be global, chatter being picked up by various agencies online and elsewhere. and any warnings put out by the fbi or federal entities to see if they can target what it is they are trying to prevent in a general sense. stuff that's fairly common sense. big crowds, make sure there are barriers in place, that vehicles can't access that area but there will also be things you don't see, assets deployed, heightened awareness of anything going on online, a lot of muscular prevention going on particularly in new york city where the intelligence bureau,

one of my former units built up a lot of institutional knowledge in this area so nobody should be hesitant about visiting a christmas market or rockefeller christmas tree etc. the nypd is on high alert and putting a lot into this to be sure everyone is as safe as possible. carley: it is so sad. we heard the number of people who died, one was a toddler, just horrific and the number just rose to five dead. the number in critical condition, they are saying the number could increase even further. do you think something like that could happen in germany yesterday could happen here in the united states? >> well, it has. we had halloween attack in 20s 17, a rented vehicle just as this perpetrator did, renting a vehicle, someone who was not on federal radar as a suspect came

up from southern new jersey, decided to target the new york halloween parade. the nypd had taken a number of preventative steps along the parade route and put up all kinds of construction barriers and sanitation trucks making access by the vehicle very very difficult as a result, on the w. side hwy. and attacked, and opportunity that was equally tragic, killed 8 people injured 13. pd has been through this, you do everything you can to prevent it, you will learn, there were warnings a month ago that went out europewide that this could be subject to attack and we had attacks like this in wisconsin, at the christmas parade in 2021 i believe so this stuff happens and it is easy to forget the past and you have to learn from it. it's important to face up to your mistakes.

governor gavin newsom the vending the policy saying clean cars are here to stay, naysayers like trump would prefer to side with the oil industry over consumers and american automakers but california will foster new innovations in the market. the epa chief staff joins us now. what is your reaction to governor newsom's statement blasting donald trump who was about to take office? >> he's living in a fantasy, this is a rejection of what the american people just voted for, they don't want the heavy hand of regulations dictating everything is they do including what cars they can dr. donald trump made clear with his america first division he will do away with unnecessary regulations like what is coming from california the does little for the environment but a lot in terms of making cars more expensive and less accessible for every day american.

gavin newsom is trying to do all he can to set the trump administration up for failure or waste time but they have a lot of tools in the toolbox to reverse course, and affect vehicle regulations on the path they should be where there is one national standard that tangibly reduces pollution that matters and doesn't add unnecessary costs or create unnecessary uncertainty across the board. griff: the current epa chief is cheering california on saying get so far there. from a regulatory standpoint, how more difficult will this be in places like california where owners that have a pickup truck that's gas powered might want to hold onto it? >> that's the point. the majority of americans rejected electric vehicles and for good reason, there's obviously the cost but also the problem in california that the

infrastructure has not materialized as promised. you have more and more people leaving away from electric vehicles or if they do, 78% of electric vehicle owners own a gas powered vehicle. there's a case to be made for traditional pollution. you have to consider what you are talking about. the clean air act which this falls under accounts for that. particle pollution because california and particular areas from a topography perspective a large bowl located next to the ocean the creates unique and compelling reasons but when you are talking about greenhouse gases which is what these climate regulations are about, the same cannot be said and does not impact how california can control the presence of greenhouse gases over the state, doesn't make sense from a regulatory perspective and all it does is allows california to dictate to the

and get that on the floor. >> reporter: tell us about this donation and why you've decided to give free ski tickets away? >> the donation came in covering half of our operating costs. that, we decided to give a christmas gift and a little uplift in the community, and go out there to ski for the season, give us a little more awareness, bring more people in, we are a small nonprofit, we figured it would be a good thing to do. griff: can you ski and snowboard there which i've got to know because i'm coming up there if i can snowboard. >> you can come up and snowboard, yes. peter: what are you seeing with

getting young people to try out who couldn't afford to fly to colorado with plane tickets and hotels and resort fees? >> we started by reaching out to our community, doing our own social media, it is more regional, a lot more publicity with it. we are welcoming it all. peter: ahead of the republican primary could we line up, all the people we think might want to run next time and have a downhill race? gravity helps. can you host that? >> we will try it.
